The board approved a five-year, $76 million road paving contract capacity cap split between two vendors and confirmed Nick Erin as Engineering Services Director, a Florida-registered PE recruited from Palm Beach County. Commissioners also adopted Planning Policy Memo 16 requiring build-to-rent single-family developments to be platted as conventional subdivisions with HOA and architectural controls, and voted to send a letter opposing state preemption bills that could strip those architectural requirements. Commissioner Weightman abstained from a solid waste contract addendum vote on advice of counsel.

thank you [Music] foreign [Music] no yeah okay all right good morning I would like to call to order the Pasco County Board of County Commission 10 o'clock meeting of April 18 2023 at this time sounds all electronic devices in mutual phones please rise for the invocation and Pledge of Allegiance oh merciful Creator your hand is open wide to satisfy the needs of every living creature make us thankful for your loving Providence and Grant that we remembering the account that we must one day give may be faithful stewards of your good gifts amen amen to The Republic ANS Nation indivisible Madam clerk please call us the roll district one commissioner Oakley here District Two commissioner Weightman District three commissioner Starkey here District Four commissioner Bradford excused District 5 chairman Mariano here now is the time for public comment citizens are given an opportunity to comment on any current or future agenda item coming before the board and another business on the board's purview today's public comment will be handled as follows first we will take public comment from those who are here in person then we'll take public comment from those who have pre-registered for a WebEx link and are currently on Queue we request that when you address the board comments are not directed personally against a commissioner or team member but rather directed at the issues this provides mutual respect between the board members and the public after stating your name and address for the clerk a three-minute timer will be activated after two minutes a single beep will indicate you have one minute left when your time is up two beeps will sound and you should close your comments WebEx participants will be disconnected automatically when the time is up I know we have a list of people signed up I'd like to call Deb Eubanks first you knew it was going to happen this way late last night yeah um good morning my name is Deborah Eubanks I'm with Homeless Solutions of West Pasco 85 34 Lacy Drive Hudson Florida that we had a great meeting last night commissioner Mariano commissioner Starkey appreciate for being here and having that meeting for us and thank you to everyone who came and made it possible and worked helped work through all of this um there were a lot of great suggestions and many good points made but one problem I don't think we really went over is there are property owners that are not responding to the requests to get Tas to remove the homeless off their properties um without the Tas we all know we can't remove homeless of the camps off the properties

they're unsightly and unsanitary there are properties that camps have been cleared out of but the garbage the debris the clothing and all the remains from their housing still remain there are camps with Tas that are still active I'd given a list to the code and Sheriff's Office to have them removed and also to the coalition to see if they can go out and offer help to them I did that over a month ago but nothing seems to be happening I think maybe I saw one Camp cleared out um the property at the post office had the camps cleared out months ago but the garbage has never been cleaned up it just remains there the old structures are still left behind their um inviting the homeless to take up residence there again I think the solutions to these problems could be to write the citations for all the code violations to the landowners this will get their attention and maybe they will sign the Tas then they will allow for the property proper agencies to get the trespassers removed and the land cleaned up and if they don't respond then put the liens against their property and whatever punishment the law allows if they can't maintain their properties maybe they shouldn't have them thank you very much and I'll finish your minute off for you if you're online but you did a great job getting everybody together we had this room was packed with people last night and it was a animated dialogue across the way but I think we got to a lot of good points that could be done if you would email that to myself and the board we'll then go look at those that issue specifically a little bit further great thank you thank you very much you did a great job thank you um move to receive and filed the document that she had given second all in favor say aye aye actually I can't make the motion yeah I made a motion thank you very much but yes yes um I have Jim Jim followed by Leonard I think it's land Lord thank you I see it and thank you Troy Peterson and then someone didn't put their name down but I'll I'll say what you wrote in just a moment but go ahead come on up Mr Hammond thank you stay here it's coming up Jack or whose responses are these in red um okay good hi my name is Jim Hammond 23 742 Plantation Palms Boulevard Atlanta Lakes uh good morning good morning I've been president of Plantation Palms HOA gated Golf Course Community for the last eight years during that time we did The Impossible we brought back a golf course been sheltered for two years we then partnered with Pasco County on a very complex repair to our North Canal costing millions of dollars um we were ready for a new challenge like many HOAs we'd seen the growth of rentals and we decided we needed limits

we believed our homeowners wanted an owner-occupied environment corporate rentals consumed a disproportionate amount of resources accounted for more than their share of violations fines and collection issues Reynolds did not benefit the community only the investor if we didn't take action now it might be too late later on in order to do this we need to amend our governing documents which had never been done in our 20-year history Florida 720 required two-thirds of all homeowners to approve such a change it's a real difficult thing to do by providing strong leadership community volunteers clear messaging and a very ingenious process we were able to get 88 approval and complete the task not only did we limit future rental growth but we ban sex offenders Airbnb and VRBO type rentals and even their advertising Action News and Spectrum news did interviews and ran stories about our bold move a simple Post in next door generated over 7 000 views in just a few days I was contacted by over 50 HOA leaders representing 14 communities I've already reached out and spoken to many of them and the rest of them have sent packages of exactly what we did and how when we might be able to help them that's all been within six weeks so what can the the Commissioners do if you have HOAs in your community that are also maybe you know having the same issues we'd be happy to share information with them we've set up a new group of HOA leaders we've met twice already in both cases we had 14 or 15 communities represented and the list continues to grow maybe you'll recognize some of the communities that we've already been in touch with contacted me and I've spoken to Arbors at Wiregrass Asheville Creek Belle Chase Collier Place Connerton Connerton Villages deer park preserve Dupree Lake Fawn Ridge Foxwood hammocks uh Hidden River Huntington by The Village Indian Lakes Ivy Lake Estates Lake Forest Lake pageant Lake pageant East Lakes of Sable Ridge Meadow Point CDD Oak Ridge Oakstead Oakstead Townhomes Oxford Place Sable Ridge Silver Lakes South Bay Lakes Stonegate Suncoast Meadows Terra Bella the bay at Cypress Creek The Enclave the Lakes at Heron Cove The Preserve at Lake Thomas The Ridge of Wiregrass Valencia Gardens Village at Wesley Chapel Westbrook Estates Wilderness Lake Preserve Woodbridge and just yesterday Grand Oaks so thank you very much thank you if you would um maybe we could help you make contact with Kona the Civic associations for this side and let me get that get the word out to them I'm sure they'd love to hear what you've done okay thank you very much congratulations all right um Leonard Lord followed by Troy Peterson Leonard Lord I live at 9525 Sunbeam Drive Newport Richie for 45 years first

of all I just want to say I'm honored and blessed to be able to stand here and speak I know that you have a lot to do I represent somebody cures Pasco which means we're trying our best to cure with the gifting of the Lord and and work with you all and by the way with the homeless we are available to to clean up properties we've done that on quite a few occasions that the sheriff's department has got us and we have cleaned them up so we'd be willing to be a part of helping that Commissioners we do meet every Tuesday Morning particularly pray for y'all we call you by name and I want to thank you for taking the responsibility to make decisions for this County just encouraging me and you it says the government is upon his shoulders Jesus walked through this world with all of the things coming against him and showed the love and peace of the father and establish What's called the kingdom of God and we know what that is it's simply doing it God's way doing it in peace and doing it in Joy it's simply being empowered by God's presence in our life so I want to thank you all that we're able to serve but remember there's one common denominator that makes us one that's when we realize we've all messed up and there's one man the man Christ Jesus that fixed us up so we believe that through Pasco County and honoring the wisdom of the scripture and honoring Jesus Christ as Lord that we could be the greatest county around so thank you all very much and we appreciate that being able to serve you so let us help where we can thank you God bless you Troy Peterson excuse me bless you good morning I do have a National Day of Prayer flyer if Mr Stephen file second all in favor say aye aye aye good Troy Peterson 8114 Leo Kidd Road Port Richey Florida that slide of the world Tabernacle where I serve as the evangelists there with Pastor Leonard Lord uh I do come representing somebody cares Pasco as well and when I heard the first lady speak I was reminded of one of the great ladies friends of mine Marcy eastberg sitting in the room and she had reached out to somebody cares and asked the church somebody cares to get together to help clean up the camps behind McDonald's there at the end of 52. so that is exactly why we are here to honor our governing authorities to be ready for every good work and and to unite the body of Christ with the body of government that's you guys this morning I was praying and Pastor Leonard reminded me of a scripture when the Lord had washed away the filth of the daughters of Zion now listen we all have filth all have sinned and fallen short of the glory of God there's not one righteous not one not one but the man Jesus Christ and see but when he washes us clean he sanctifies us he justifies Us by our Lord and Savior Jesus Christ as Pastors in this community It's Our obligation to be

willing to serve but also bring the word of the Lord and this is the word of the Lord see the glory of the latter house shall be greater so it's our job to unite together to bring the glory of God to make wise decisions see that's why I've been presenting to you guys for a couple of years now to allow somebody cares Pasco not me not just Pastor Leonard Lord but the whole network of pastors to come and acknowledge the King of Kings the Lord of lords and our commissioner meetings that way we can be praying specific wisdom and counsel of God to deal with the things that we're dealing with with our County but more importantly because God wants to bless Paschal County he wants to bless it and in this scripture it talks about being a shade from the the heat to be a a resting place God wants Pasco County to be a resting place for that to happen we need to acknowledge the king in our invocation thank you for your time thank you next um the individual did not write their name but the topic said obstructed sidewalls code okay please step step forward thank you for go show 3735 Waterbury Drive in Newport Richie having an issue with the sidewalks people are parking uh Mockingbird is a very busy street and if you have to step out into the street you're taking your life in your hands there's a sign that says no parking any streets and 10 cars at any given day on both sides of the road I kept pulling the sheriff's office until they finally cleaned the one road up we have sidewalks that have boats on them we have sidewalks that have enclosed trailers there's a sidewalk here if you had an umbrella you would think you were at Clearwater Beach I fell on it three years ago and hurt my knee I'll be looking at a knee replacement in November and the homeowner has no insurance called code enforcement code enforcement directs me toward Road and Bridge Road and Bridge takes me to code enforcement they tell me it's a civil matter so I should need to take somebody to court to clean the sidewalks I mean what is code enforcement for I've called numerous times somebody's going to get hurt and it's right at the end of Mockingbird people come around the corner on two wheels so if you step out into the street you're going to get hit what happened to the American with disability acts I mean who do you call I don't understand I just wish somebody could direct me or help me get this problem taken care of I should be able to walk through my community that I pay taxes on I mean we have County police cars parking on the sidewalks County trucks parking and we're responsible for fixing the sidewalks so I just don't know who to go to or where to go to I just know I shouldn't have to spend my money to take somebody to court so I don't know if anybody's interested

Florida declaring the month of May is building safety month in Pasco County whereas Paso county is committed to recognizing that our growth and strength depends on the safety and essential role our homes buildings and infrastructure play both in everyday life and when disaster strike and res our confidence in the resilience of these buildings that make up our community is achieved through the devotion of vigilant Guardians the safety and Fire Prevention officials Architects Engineers Builders trades trades people design professionals laborers plumbers and many others in the construction industry who work year round to ensure the safe construction of buildings and whereas these Guardians are dedicated members of the International Code Council a not-for-profit that brings together local state territorial tribal and federal officials who are experts in the built environment to create and implement the high quality codes to protect us in the buildings where we live learn work and play and whereas these modern building codes include safeguards to protect the public from hazards such as hurricane storm Waters tornadoes what Wildland fires floods and earthquakes and Raz Building Safety month is sponsored by the International Code Council to remind the public about the critical role our communities largely unknown Protectors of Public Safety are local code enforcement officials each I'm sorry who ensure our safety sustainability and affordable buildings that are essential to our prosperity and whereas it starts with you the theme for building safety month 2023 encourage us all to raise awareness about building safety on a personal local and global scale and res each year the observance of building safety month people all over the world are asked to consider the commitment to improve Building Safety resilience and economic investment at home and in the community and to acknowledge the essential service provided to all of us by our local State Building departments fire prevention bureaus and federal agencies in protecting lives and property now therefore be it resolved by the board of County commissioners of Pasco County Florida that said board hereby proclaims the month of May 2023 is building safety month accordingly we encourage Pasco County Citizens to join us as we participate in building safety month activities done and resolved in regular session with a corn present and voting this 18th day of April 2023. well approval second thank you thank you chairman you know the job that you all do is Monumental especially with the volume of growth that we've had in Pasco over the last three years and uh you know I think it's important that we recognize you that you're also a consumer Advocate you're making sure that the home in the buildings that our businesses and our residents move into are safe for them and the customers and the folks that utilize the buildings so

it's an honor for me to to give you this resolution today and and recognize you all on your team for the volume of work that you handle for us we know you take some uh some lumps from time to time like we all do in the customer service business but thank you and uh welcome to have each one of your team say a few words or or uh you know share some of the highlights of of you of your uh your day uh well special thank you commissioner Weightman for sponsoring this Proclamation for us and thank you Mr chair Commissioners Madam clerk for the wonderful reading and Mrs karbala and Goldstein I imagine if we pulled the commission as to what their daily number one priority is it sounds a lot like the Safety and Security of our residents at Priority One and for the month of May we'll be bringing awareness to the role that Pasco County plays in ensuring the places where we live learn work worship and play are safe Building Safety month is a time when we focus on the importance of safe and resilient buildings and the critical role that building codes inspectors and a team of building safety professionals play in keeping Pasco residents safe it takes a great team of professionals to carry out this Mission and Building Safety months is about building safety awareness so we want to take this time to recognize the diligent efforts of men and women serving and building construction services and fire prevention who alone last year oversaw over 65 000 permits and nearly 300 000 inspections for our building officials fire prevention officers and licensed professionals and plan review inspections and contractor licensing Building Safety is a mission of passion and life safety is Paramount and sometimes it's even personal many of us can remember at least one time in our lives and we needed to feel that certainty of the structure around us was safe and secure and since we're all Floridians we probably have a lot more than that just one time we can think of for me I remember being 10 years old watching the roof of our Miami home collapse after the eye of Hurricane Andrew passed overhead that storm changed many things notably it's the reason Florida now leads the nation in hurricane-related building code and enforcement it's also what I'm reminded of when I think of how important it is to uphold these building codes every day and what we do here at Pasco County and hurricanes are just one risk category consider all of the other perils that face our buildings and structures fire flood devastating leaks structural collapse these are just some of the things that the men and women of BCS and Fire Prevention concerns himself with every day but they can't just be the only ones worrying about safety this year's campaign it starts with you raises awareness about the role we all play in ensuring safety each week of May will

feature a different sub theme like building starts at home prepare your community or my favorite Building Safety Professionals in you where you get to get a glimpse of what it is that we do as professionals and this is also my opportunity to shamelessly plug that becs is always hiring and we have many different roles across the department um we're hiring for those newer positions and we're delighted to discuss a future with BCS where we serve our community to create no strike build a better future that's our modification of it um it takes more than plan reviewers inspectors to ensure that 4.6 billion dollars annually worth of in construction gets built safely and we aim to work closely with home builders contractors plumbers roofers and other trades to enhance Public Safety in addition to the awareness campaigns like this one we regularly meet with industry stakeholders and are proud to have a great partnership with the Tampa Bay Builders Association and are constantly working to find solutions to improve services to provide building community and residents of Pasco County we take pleasure in serving the citizens and our gratefulness for this opportunity and we thank you for your support well I want to anyone else want to speak no okay I'd like to say I'd like to thank all the great work you guys do with the third fastest growing County in Florida the work load that you guys is huge I know all of us I know Sonia were sitting right over there makes many calls to you guys and we send emails out and we're just trying to help as commissioner Whiteman says it's a customer customer driven thing as far as we don't call you unless they call us but I want to say that the Ingenuity that you guys can show has is great as to the one we just worked on where we had the gentleman over on the on the canal we got through that process and we set a good template because we solved another situation with another person down the road so you know nothing's you're working on pieces of paper you're working on codes that are there and interpreting sometimes can be a little bit tricky as far as what you can do what you can't do safety is absolutely the priority so uh we'll never want to overstep that but if we can find ways to keep things moving we do want to keep moving and I want to thank you for the huge workload you guys pushed through that uh we stand with you just trying to help you go through the process as we help our people too so I thought well thank you all I think we've got so many people there commissioner Weightman if you want to go down we can all stand behind Maybe and I think Mike and Sally should come on up [Laughter] sure this camera works please everybody and then look at me thank you [Applause] so tall from now we're gonna have to move a little bit more to the right

Mr chair if I may I'd like to add on to that just a little bit um you know since assuming the role of County Administrator have actually been able to to engage a lot with with with these fine folks and I can tell you it is a it is a difficult job to be uh in in the customer service business when you're when you're a regulator it would be like me thanking the IRS for taking a check I'm going to write them today but but these folks do a fantastic job in everything that they do and I know that they're hard working and they're very dedicated oftentimes working weekends and evenings to make sure that we get CEOs and tcos out to people so business can get started up so um uh anyways my my personal thanks to them as well for everything that they have done Mike and I want to thank you for the great in intent and the in the purposefulness you're showing to like help these processes go through um you know tremendous expertise you have in the industry as well that we've seen coming up is transcending I think in permitting so it is getting better and better uh you and Sally both were great in coming out and listening to the people talk and then taking that information working from or so I know we're heading the right direction uh JJ great speech by the way uh Ms Murphy um but I mean with all that said I think we're heading the right way to get the things done I know the intents there and again you got to have the safety in place first but you're doing a fantastic job as everybody is we're getting better and better so thank you all right okay rs2 new one is here for National Community Development week please come to the podium all right all right I'll go ahead and read the resolution resolution number 23-099 a resolution by the board of County commissioners of Pasco County Florida declaring the week of April 10th through the 15th 2023 as National Community Development week whereas Pasco County's communities are the foundation for providing a high quality of life for its residents and Pasco County's Community Development Department has demonstrated a dedication to the revitalization of neighborhoods and production of affordable housing and whereas the week of April 10th through the 15th 2023 has been designated as National Community Development week by the National Association of counties and the national Community Development Association to celebrate the Community Development block grant cdbg program and the home investment partnership home program Andres cdbg program and the home program provide annual funding and flexibility to local communities to provide decent safe and affordable housing and a suitable living environment for economic opportunities to low and moderate income low and moderate income citizens and Raz over the past 10 10 years our community has received a total of 27 million eight hundred twenty thousand seven hundred

and five dollars in cdbg funding and ten thousand seven hundred fifty one thousand four hundred and seventy two million dollars in home funding and 8 million three hundred forty eight thousand seven hundred and thirty one dollars in coronavirus relief funds from Housing and Urban Development and whereas a grant of over 1.2 million utilizing Community Development block grant funding was used in partnership with the Coalition for the homeless of Pasco County to renovate the former boys and girls club bringing building sorry boys and clubs building for a family service center managed by Catholic Charities and whereas this past January the family shelter received the 2023 Audrey Nelson Achievement Award for Community Development from the national Community Development Association as an exemplary and Innovative Community Development block grant project and rise in addition to this award the Family Services Center served 34 families for the first year with 62 percent moving to permanent housing opportunities of their choice andras cdbg home and coronavirus relief funds have been helped have helped support 277 households for rental assistance and renovated 77 multi-family units in rehabilitated rehabilitated 35 owner occupied units with 100 percent of the fund's expended benefiting low to moderate income households now therefore be it resolved by the board of County commissioners of Pasco County Florida that said board hereby declares the week of April 10th through the 15th 2023 as National Community Development week done and resolved in regular session with a quorum present and voting this 18th day of April 2023. move to approve second all in favor say aye aye commissioner Starkey well I'm really honored that you asked me to sponsor this and you know when I joined Naco and and joined the community Economic Development Workforce board I really knew very little about the community and um Community part of it and it's and I still I still don't know a lot but I'm on this Learning Journey with these Commissioners and but I do know one thing that we have one of the top Community Development offices I think in the state if not the country so Marcy what you've done since you've come here I'm just so glad that you worked with us and for us for the citizens of Pasco you know last night we had a a great meeting Jack and um there's a lot of concern and passion in our community for helping those less fortunate so I'm really grateful for all you do for us and that um and that you won that award that's not the first time right no so I actually was thinking while they were reading this that we should be putting that in for one of the Naco achievement awards but I'm just uh uh grateful for all you do for us so congratulations thank you commissioner Starkey Marcy s Burke director of Pasco County Community Development and thank you for sponsoring

today's resolution I'd also like to thank all of the Commissioners for their support and for their commitment to the projects and the programs that we run through our office with the Community Development block grant the home funds as well as the emergency Solutions Grant These funds are specifically used to help our low and moderate income residents and as the commissioner said you know there's a lot of talk a lot of discussion last night about helping our homeless and that is part of our core Mission and we do use a lot of our funding for homeless initiatives in addition to thanking all of you I'd like to thank the team that is standing behind me while we don't do a lot of direct service we do some direct service and so that means that when we're helping people stay in their homes or helping them fix their homes up we're working with people that are very vulnerable that are at a time in their life where where their experiencing difficulties so this team behind me they come to work with a smile on their face every day and a passion in their heart to really make a difference and that's what drives them and that's what keeps them going even through the difficult times so I especially want to thank them and lastly I want to uh thank our partner agencies so we just released thanks to Media Communications a beautiful video yesterday about the core part of our mission which is to work with partner agencies and we do that because our team here and really County government is not responsible to do everything for all the things that are needed in our County so we really depend on our partner agencies to work with us especially to serve those people that are most vulnerable and as we mentioned we were in Washington DC in January to pick up this award this Audrey Nelson Community Development Achievement Award in recognition of exemplary and Innovative use of the Community Development block grant and Community Development block grant coronavirus funds to address the needs of low and moderate income families homes and neighborhoods and I am really pleased today that I get a chance to along with thanking all of you to bring Maggie Rogers up for Catholic Charities so that she can share in this award and share in the work and the congratulations because if it wasn't for her and her organization doing the work that they're doing at the Family Services Center we wouldn't have so many people going from homelessness to housing so thank you Maggie hi Maggie Rogers executive director for Catholic Charities again thank you all because of your support of awarding us this funding we are able to continue to serve the families in in Pasco County and expanding our services with affordable housing and another shelter and we're just really looking forward to continuing to serve the Pasco County community and again thank you so much the the folks standing here beside me today have just been wonderful to work with and and they really have a passion for serving the community as well and so

four buildings and over 30 ambulances today that's a big change when we've gone from a very minimal number of employees we're now up to over 220 since so it's been a jump since the resolution was was written but those are very positive pieces for us we're in the county hospitals every day providing not only normal transports but also life-threatening transports and that will get our life saving and we'll get the the patients from a facility to a higher level of care it is one thing that the employees if they were here today they would tell you they love going out and taking care of people our motto is people care right that's what we do we take care of people and that starts with our folks inside of the company as well as those that we go out and we provide services for um we could not do this without the support of the county the support of the fire department I will say that life has changed for everyone since the pandemic and where we thought that this whole side of the business may slow down it's done just the opposite last year alone we were over nine and a half percent above the prior year and this year we're sitting almost 19 percent ahead of last year and talking to the hospital CEOs just this past two days they're like when does it stop and I said I'm I'm not sure that it does anymore you know we used to have a lot of seasonality in our in our volume the seasons have kind of gone away it's just busy hospitals and stays are longer by probably twofold when they need our patient their patients moved out they call us because otherwise what happens is the fire departments transport into these facilities and now they're stuck they're waiting for beds to be available so while we're not necessarily running a lot of 9-1-1 calls the work that we do puts these 911 ambulances right back in service as fast as we can possibly get them there so from all the folks at medfleet I want to thank you we are celebrating officially the week of the 22nd of this year it's National EMS week Emergency Medical Services week we'll be having an open house on the 23rd I know that's a board day but if there's anyone that can come by we would absolutely welcome it our employees will be there obviously it will be there but this is just a really special time of year for the industry as a whole with Emergency Medical Services week but especially from medfleet with our 30th anniversary to add to the community and some of you are aware already we've also opened up a new division called Patient Care Community Health it's truly to reach out to those people that don't necessarily need to go to the doctor's office or to the hospital but we go to their homes and we evaluate them and treat them in their homes so it's a new area that we've we've recognized is kind of the way of the future and we're trying to grow that and build that to go take care of people where it's most appropriate and give them the care that they need on behalf of athlete thank you so much for this resolution we will proudly display

contracts one to two different vendors to increase the flexibility of the operational needs of Public Works to tell you that both of them are doing a great job for us so we're press elections I got a motion to approve second all in favor say aye aye aye okay thank you and AC 89 Mr Whiteman thank you Mr chair uh this item after speaking with County attorney Goldstein just in abundance of caution I'm going to abstain from voting on this item there's a solid waste contract that's associated with this so we'll step out so just want to put that on the record okay very good any other discussion approval you have a motion second all in favor say aye aye and commissioner Weightman as abstains no go regular items and we have a presentation on platted Bill to rent developments that's Adam Thomas leaving I want to say Adam that's our team that was just out with us at seven o'clock this morning uh turn the west side of the county gentlemen thank you and hope you can help us out with Source development thank you good morning Commissioners Sally Sherman Deputy County Administrator assistant County Administrator for development services I'm here this morning to present to you planning and development item PDD 230307 um as you recall back in January uh this year the board provided direction to staff to bring back a policy to develop some guidelines as it relates to certain projects what they deemed as built to rent multi-family development this is a new form of development that is happening with multi-family developments all across the State of Florida and in my research is happening all across the United States housing types for these Bill to rent developments include your destructed multi-family horizontal Apartments Cottages townhouses duplex and even some single family detached and unplanned detached single-family units before I go any further I want to thank a number of people Victorious pitos our planning Direct after a group of stakeholders that met with us on a regular basis to discuss this matter as well as meeting with each of you this has been a journey of learning about this new type of product that is coming online and so it's with that feedback that this memo has then it's being brought forward um I want to also say that this memo represents just one portion or one step in addressing on this matter knowing that there's more to come the more that we looked into it the more we learned and understood especially with working with those stakeholders that are involved so I'm going to touch on that a little bit later letting you know other things that will be coming down the pike So based on this wonderful Journey that we've taken Mr pito's developed a planning policy memos 16 that's going to address the bill to rent housing utilizing your typical single family

neighborhood design it's going to also look at the architecturals and monotony controls the same that we put in our planning memo number 10 that was approved back in March of 2022 and also it's going to look at the intent for connectivity which is very important to the commission and to our community the first part of the planet Bill to rent is we're looking at those housing that is your typical single family residential development and both those neighborhoods that are designed with driveways and um attach and detach garages that will be um then they look like the single family residential developments and that the conclusion of weeks and weeks of discussion those projects will be required to be plotted as single-family residential conventional developments and I think that's key for everyone to understand they will be plotted then we're going to be looking at the architectural controls associated with um and monotony associated with those developments like I said we're going to continue the architectural standards that we had in that March of 22 agenda and also that's going to be placed looking at the placement of where the structures are going and variations in the arc textual features at least three for each of the structures also an important part of this is going to be looking at the conditions of approvals and deed restrictions and for home owners associations and maintenance agreements during the construction of these projects the they will be required to provide us with quarterly reports showing how they're meeting our architectural obligations and design standards associated with these developments and since these Bill to rent products most of them will be under one single ownership and they may transition at some point to being able to be sold off as individual products so one of the important parts of this process is to include Provisions where they're going to be required to provide ongoing enforcement through a homeowners association or through a property maintenance growth group and again that's going to ensure the long-term maintenance of those developments another important part that our commission continues to remind us and and look out and help us look out for it is connectivity and that's going to allow the interconnection between the surrounding areas and other neighborhoods Trails Etc making sure that that is in place and we're also going to be looking at applicability where this applies to your mpuds your uh a euclidean rezonings and your conditional uses now I want to make sure you understand because this is one of the little things that we're running into as you continue to give us Direction and we're trying to implement that direction we've got projects coming through that have been in the pike for a long time so we wanted to make sure that the board considers that this memo applies to all

those only applications that have not been heard by the Planning Commission or the oph in the policy Planning Commission so we'll note that so if there's some concerns that can be brought up or if you like to address it at this time if you have any concerns or if you'd like me to continue chair sorry yeah I lived in one of these developments while I was waiting on my house being built um they they really are not run very well they have no parking no extra parking they're parking on streets no available availability of of going in and out without everybody using the center of the road because they allow parking on both sides they have no HOA whatsoever they have no manager on site so there's no real controls other than the fact that it seems like the managing company that manages on phone all they can tell you is it's not me you need to call another number and that's all you usually get and you the assign a managers to it but you can never get that person on the phone so these are not operated very well and personally I would never go in one or want anybody actually live in one of these again the way that one was treated that's the one there on 14 the state's 14 and it's just not run very well that's pretty pretty bad and I understand it's all in one lot so I don't know what's going to happen in the say 20 years when you got them on one lot how do you separate them to sell out individual Lots without plating them so if you don't plat them up front then you've got an issue down the road of how do you take care of these products sell them out to individuals that will take care of them and things of that nature so it there's a lot of things that are hidden that you don't you don't see and there's no HOA so thank you there's no one to to cover the on the street parking and things of that nature there's no rules so and keep in mind this is saying they will have to be planted before they can develop okay that's a must I just want to follow up on something yeah well I had wanted to ask the commissioner a question on what he just said all right so same thing so um so do you you live in a bill to rent Community I did yes okay you did so I think you bring up a really interesting point that you know we say these are like deconstructed Apartments but Apartments have a leasing office and are you know they have they have a leasing office and there's no one on site and I'm wondering if we should require a leasing office on site because then you have no one to go to if it's a rental Community yeah and that's a very good not a good situation because you need to have someone yeah I I think and we approved this one we at the board to approve this particular project in the county and now it belongs to the city of Dade City but they they're taking on those issues and

I I don't think I didn't look at that as like I'm looking at it today but I never lived in one so uh I was there for a little over a year and it it's just so confusing especially without a manager on site or one that you can get hold of just ask a simpler question yeah about something it's a good point I'm glad you picked up on that yeah Mr William thank you Sal are you I think we have is this conclude your presentation I was gonna say let's let's roll through obviously this is something we brought forth and we have a whole bunch of commentary around this so I don't want side to be derailed from the direction we're going um so I'll wait until she's done very good okay okay um with that said uh the next portion of is uh we're gonna do a six-month evaluation that's what we've been doing on these um memos so that we take we learn if there's something we need to go in and make some minor adjustments that we don't feel deviate substantially from what the board Direction has been we will make those but if we find that they are substantive changes that we need to bring back to the board we will bring it back um next is really getting to the conclusion and really again the key on this is that these are single family detached built to rent products and not multi-family products they will be required to plot as single-family developments when you have a large development that is just single family they will be required to plot um then there they fall and these are appropriate in your MPD mpud development districts and your single family zoning districts and not in your multi-family zoning districts importantly again it will be required to be plotted some of the future policies that will be we'll be looking at I'll just is that we're going to be you look at it we'll be looking at the um 40 foot and 50 foot lot width and I can tell you that one is currently on the way we've already started work on that and the bill to rent that is for your horizontal Apartments um we're also that's additional one that is going to be tackled um I also it would be remiss if I didn't point out something and thank you David for your email that when we were in tune to what you had shared with us on our presentation that worked with Ralph Lair and thank him for his recent information we have Senate Bill 1604 and house bill 439. one of the things that you need to know is everything that we're doing with regard to certain design standards maybe um preempted by those two bills and um so I just wanted to make you aware of that David did you have any other comments on that no just a clarification

point on the slide you have up so the memo that's before the board today is only dealing with build the rent that has individual driveways is that correct individual driveways and detach or attached garages that are okay so you're not today we're not dealing with the horizontal apartments that have Common parking areas is that correct no sir that's um the horizontal Apartments is a future memo that we'll be working on okay but I think the point Still Remains someone needs to be some some manager needs to be living there so but I wanted to follow up on the legislative point by classifying this product as single family there is now that risk that you're going to be preempted from regulating architectural features of that legislation passes because there's currently an exception in the legislation for mpds and planning unit developments the legislature is now proposing to remove that exception which basically would preempt your ability to regulate architecture on any single family dwelling it is not preempt you from regulating on multi-family though that's why this is a timely discussion but we have another issue a multi-family as commissioner Whiteman knows which is as you've classified as multifamily that means under a different bill you have to now allow it in your commercial and Industrial zoning districts properties to be used for so damned if you do damned if you don't okay it's crazy sorry I'm going to text Brad right now that was and finally we're here for recommendation from our the board on policy memo 16 confirming the proposed language of the attached policy memorandum directed director Planning Development Department to begin implementation of the policy guidance and a memorandum through revised mpud conditions of approval which shall apply to new mpuds that have yet been heard by the Planning and Zoning commission or the vo pH and the planning committee also we are open to an alternative motion to implement the policy guidance and the memorandum with revisions as may be directed by the board commission women thank you we all right it's a big apple to take a bite out of obviously and with what's going on up north Florida um it's given us a lot to talk about but Sally I don't think you I don't see Terry here but but thank you all for addressing this issue this this issue has become kind of our we're really number one policy focus in in my office and Andy knows it and thank you to Andy and Terry uh in our office and in helping us understand what all of this means right

um and it really started off as a quality control mechanism for what was being built here good quality product so appreciate the memo and what this memo does it's a great start I'm very happy that we've got it here timely but by no means this is a Victory lap this is just step one in the process of figuring out how to manage this type of product as it comes into comes into the market and obviously I think there's going to be a broader discussion especially with some of the rules that may be may be coming down if a business promotes them if these this product comes comes to town and they promote themselves as their single family they need to meet the single family standards that this board set in place they need to follow the architectural design standards that the previous board set in place and it and it goes to show that this is true because the Tampa Bay Business Journal wrote a very timely article which solidified our point to bring this topic up and it says the the Builder that's quoted in in the article and the best part of it was the future the future res they offer future residents The Best of Both Worlds an upscale single-family rental living experience promoting themselves is a single family home product and if we tie this in to our true single family home product where there's an actual homeowner and skin in the game of owning a product versus a hedge fund or somewhere somebody else out of state owning these these things you know these folks they meet with all of us they say oh we're never going to sell our product where business is going to last forever I respectfully don't necessarily believe it they're they're working their bottom line and they come in here they build a product and then they bolt whether it's 5 10 15 years it's going to happen it's business and I can appreciate that but if we're going to allow a product like this to be built here in our County I want to ensure the quality and value is there in that the there's not an erosion down the line of this product that's going to have an impact on neighboring single-family product because people come in they see these things oh it's a single family they may not realize it what's next to them is rental if you get a bad actor in there and they're not maintaining gutters they're not maintaining the different pieces of the single family rental living experience depending on who owns it it's just it's just going to potentially lead because of the connectivity piece that we're very sensitive to because commissioner starkey's led the way it's it kind of should it should fit in into

the model somehow but we cannot let this product erode away the quality product wrote away over time and have a negative impact on the true single-family home buyer and the residents in the in in the property owners in our County so I very much appreciate what you guys have done and worked into this I know been a lot of hours I appreciate the stakeholders uh in the building community that have led that lend their time to help understand this and and and and added their input it's always it's always very important and I think they understand the value in having this conversation in as we continue to build in Pasco we're building we're building product that's going to create value and and take our County into a good place to be for for housing um I think with the architectural design standards piece I think that's a different conversation related to this but with with is related to this memo uh I'm very grateful that you all did this timely I hope we worked expeditiously to fill the hole in the donut um uh that way we can ensure that quality control standards are there and there can't be any gaming in our policy to kind of any workarounds that uh allow bad product to come in so thank you Mr Oakley how do we correct the ones that are there how do we get them to be plotted lots and so we don't have an issue in our future that's that's way down the for us back we've left that gate and we're on past that commissioner I'd have to work with uh attorney's office I'm not sure in my experience if there's a way or an opening for us to go back and rectify something that was approved a number of years ago and to bring into some standards I know that maybe the rental registry that we have could help us by connecting us with whoever the management company is and try and put a little a little bit more teeth behind enforcement but I'm not quite sure how we can retroactively address it yeah Mr Charles if the project was not developed in accordance with single family standards it doesn't meet typical setback standards for single-family Lots it's going to be very difficult for you to retroactively require them to plot yeah without a lot of variances and alternative because it wasn't designed to meet single family standards that's the importance of this memo is that staff is basically saying on a going forward basis if they have the driveways and individual garages they are going to have to meet single-family standards and plot but it's very difficult to retroactively plan a project that wasn't developed to those standards well the problem is we have them now and how did we actually get them built I mean I wasn't aware they were not plotted Lots because that's what it looked like that's what it felt like I think it stopped was

preventing them as a multi-family the same way they would an apartment complex yeah yeah I don't think that was very clear when we when we saw that at the beginning because I remember voting on the project commissioner Stuckey yeah I think we're learning a lot as we we go through this but I I you know I do feel that there is a place for these because um some people don't want to live in an apartment complex you know they'd like to have a rental that yeah that um feels more like a house especially if you have a dog I think that would really be a Advantage for someone but um but there's real there's really a lot to think about here because usually if you're in an apartment you have a clubhouse with a meeting space and a pool you definitely have a leasing office um don't have that with this yeah and I mean we need to be thinking about those things the other thing is I don't remember when it was um going back to the platted versus unplatted I do remember when there was a time when Apartments flipped to become condos when was that it was around the 90s you start seeing them start in that direction especially for those con the apartments that were starting to become older they started flipping I know some portions of it and some all the way and they started selling them off as condo units yeah so um I mean I would think there is that possibility that some of these Bill to rents could become condoed and I think we talked about that yesterday so there there may be a mechanism but I agree we have to make sure we are not building future slum areas in the county we have to have some protections what's the problem problem I see they're not affordable because 1200 square foot three bedroom two bath 22 2400 there's there's not many people can afford to do that that's a rental but it's a house but I wouldn't consider those affordable housing sure commission William thank you going I know we're talking about retroactively I know there was uh there was at least one project that came in my time in commissioner Bradford's time here how many I'd like to understand how many of these this type of product and project that we'll have coming forward that will not have to follow these new design standards if they haven't broke ground and started building it if there's another Vote or another conversation I'd really would like to be able to try to bring those those products projects now that we kind of understand we understand what they are up to these up to these standards already approved so concession

is be built but need to be built with the quality control standards and mechanisms that are in place it may take a little bit more time on County attorneys behalf now because and I think it's worth it to have spend a little more time if there is the ability to make a a change for the better and they're going to be built regardless because 10 15 years down the road we don't know what what these things may turn into so it's worth a little bit more time now I think to investigate and talk to the stakeholder to say hey let's let's try to evolve the project a little bit that's just a thought I have because I know would you say Sal anything moving forward that has not been to the Planning Commission so there's got to be some that have already been to the planet's Mission through this board that haven't come to fruition yet if they haven't come to fruition and not broken ground right and there's a legal mechanism kind of attorney to have a a conversation so I think it's worth trying well obviously you can try to get them to voluntarily comply but if you want to make them comply you would have to do some amendment to your Land Development code right what Sally's talking about as he changed to the mpds that are kind of going through the zoning process the only way that you're going to be able to catch somebody that's already gone through the zoning process is actually to amend your Land Development code to impose these standards but even then you're probably not going to be able to catch somebody who already gotten a site plan approval because at that point it's pretty much too late but it's worth to ask them in a good faith effort if they continue to want to build their product in our market and our home just maybe they'll reconsider and make some changes they want to be building this project this type of product into the future and want to have support for it I'd like to think that there could be a good faith conversation moving before before it's done I'm at least willing to try to say try we we have to try I like to approach Mr Oakley all right I remember a couple that I've seen besides the one that I lived in which was already built these others were coming to be built but I don't remember them being like these these had uh services and all that pools they had a Rec Center those type things that I saw with them even though they were rental houses there are some I think on County Road 52 now um that's coming to be but they haven't started building them yet but I think those are a better product than what I was living in so well I say I I'd like to know what mechanism we can use our Land Development code for a single family home doesn't allow with 50 or 40 or 50 foot lot anyway right yeah now we're saying these things could be

first one had is and I'd say I'm glad you brought up the points you brought as far as not having the leasing office there when you talk about not having a clubhouse there either yeah both should be there otherwise as you say you know they don't have any Clubhouse I mean we look at I think the parks and crime we put in place we need to just hold strong on that I mean there's no Clubhouse no additional parking for people and have guests and I mean they're all front loaded and they're very small I mean there's small properties and I think you guys remember the time I was talking with my daughters were up in Orlando they had a town home project loaded parking you could be parking way down the street whatever titles can be and they counted a single car garage was a parking spot I think we count that as a three bedroom spot too and again when you go to three bedroom place right and you've got parking garage number one parking spot number two and the other one's going to find a spot yeah makes no sense of doing for failure and it was I mean it was fill the need for a short period of time but I'll tell you if we had a better place we could we could have gone and made a move so I don't want to build like as you say a slum for the future so I wanted to let you know that I know some invo pH have added parking space on on the interior roads they've added parking spaces in different locations close to the homes so I know that for a fact they've they've put those there on purpose just because they know they need the extra parking space but but that's not that can look kind of that may not be optimal either because then you've taken away the Green Space around building so and you know we talked about this before and maybe in our planning workshop we can have more discussions but if if you drive around Longleaf I think it's a great example where you can see where the roads are narrow and there is on street parking but it's all on one side and and so they're they're still that green space in the front of buildings that are you know rear rear loaded granted but David there's is on street parking where there's driveways on the front as well so I live in the area of the neighborhood where there is no front loaded Lots so but there's on street parking even on the streets that don't have cutouts and it's only on one side as you said yeah so if it's on one side it is I mean they do that in South Tampa and Old Northeast and you know all the classic neighborhoods so I I don't know that we want to be building parking lots all over neighborhoods either but we just there's way I think there's ways to accommodate more parking and we need to require that some of that like I just told you is mvoph yeah I saw the design it's all on the end caps yeah and um right but the bottom the bottom line we've got to really look at these 40s and 50 because they're the ones causing

all the trouble yeah I mean when you look at values of homes it's said between probably all the inflation rates with everything else going up that you know it takes a four hundred thousand dollar house five hundred thousand dollars to pay its own way in taxes I don't know if that's an accurate number how close it is but it just tells you that the smaller the house the smaller the value the worse it is when you get values of places that are down because they don't have enough Park and they don't have a clubhouse they don't have a place for customer service for for that it's it's it's not going to be a boost to the to the tax base I got a more of a burden from people I got an answer we'll just uh not have any more 40 to their 50s and you won't have that issue and and doing unless they're reloaded with the rear loaded so yeah I mean because that's what they're doing I'm on 40 and Pitchford Lots I mean we don't want I don't believe we want the rest of our County to look like 40 and 50 foot Lots all over the place no I don't mind them if they're rear loaded yeah but they're not doing that because it takes more land to do that and they catch their numbers well maybe we'll find out only because the numbers so maybe it's the condition we need to look at putting into place because I will say the ones at Starkey that they built in there they look good there's enough parking if we can work with them in the fire lane issue that they had and some other things it could be something that's good looking product that could last and hold value as opposed to some of the other things we've seen where you get parking on the street parking here parking there that that don't work commission women thank you changing I was trying to get some clarity on this about potentially moving approval with this memo but a change to was it the Planning Commission in the vo pH P so I was looking for Clarity on on that he would just mean he would make the cut off border County Commissioner approval instead of Planning Commission and view a pH policy and planning committee approval but I want to be clear that's for this memo but you can make easily make that change for this memo but this memo is not addressing 40 and 50 foot Lots it's not addressing horizontal Apartments and the problem staff's going to have is there are no standing they haven't created any standards they haven't worked with the development Community to create these additional standards for horizontal apartments and 40 and 50 foot Lots that's why this is step one right so you can make the cut off for step one board approval but I don't want the board to think that's going to affect horizontal apartments and 40 and 50 foot Lots because there is you don't have a memo before you today addressing those issues

going belly up there was no ability to sell each individual rental house off as a single family it had to be sold as a whole you have to conduct so it's a fire sale for cheap price then what's going to happen are they going to come back in whoever owns it wherever they live or what hedge firm hedge fund firm has it to reinvest in it maybe maybe not how do we use code enforcement standards I mean it was it fell under our multi-family code jurisdiction but if if there's an exit strategy in with this product as it gives the owner of the entire place an option if things are tough to sell them off as single family because as our design standards it meets the code it is platted or they could sell them as a whole it creates an equal playing field and then you're selling something that's going to compete with the neighboring connected single-family home product if you want to you know it's it was it that's that's the the premise behind this so I just wanted to share that you know it's it's difficult when you have a let's say you've got a building that's coming in the development's coming in and the people that sit in the CDD are all the developers people at the start hits a certain point then it becomes it flips over where now the majority comes to the owners and they get control I'd be interested to see how the HOAs that can be implemented if it does go to the plat if it does go for sale how are you going to implement all the rules in place are those rules going to be set up ahead of time um I think it's going to something you really got to dive into a look at and I'll go a step further take a look at uh the heart of Ridge Road all the apartments that are in there right not high-end where's Harper Bridge Road Ridge Road apartments up on the side it's the some that are not good right and if you could set up where with Apartments even that you went through when you maybe platted those as condo units so that when they went if it does go where they got to go try to sell it and are we gonna we're gonna sell it to you get some other one that picks up and they're either they're a discount buyer that they're not going to maintain the property either and you got to go deal with those situations maybe that someone should look at where the apartments do to put it put something in there commissioner Oakley yeah I'm just I'm just wondering if if we require them to have an HOA or a CDD how do you have those when you only have one ownership because the people that are actually renting the houses aren't the owners of the house so how do you have HOAs or things you know my first my first thought so no one was coming up I was thinking what are you going to do about you know what's

the one that we approved near Suncoast and I've driven through that one that that actually is the only one I've ever driven through does would that would this apply to that one or no because there's no driveways I think those are horizontal Apartments okay that would not those those would not be affected by this memo because you know I I like the product I don't like the layout um uh so I guess we we still have more work to do but I need to go see one of these I need to go see what what you lived in but I have heard you talk about the horrors of it so so how many have we approved that are like this it's very many um when you say it like this you know there's like some experts like the subject of this memo or build event in general like like the subject of this memo I don't think this is a very small subset yeah there's not many build to rent that are built with individual driveways and garages we did approve one that is from like homes for America or Americans for rent or something like that yeah that was but they are planning it was planned what happened was you didn't have the other controls in in place for that one yeah because staff was considering it to be multi-family so they were not imposing single-family standards on that product type but this memo would make it clear that they would be subject to single-family standards But to answer your question in general this this is just the tip of the iceberg it's it's not covering the majority of build Durant that comes into Pasco County need to you know we need to get an education and if there's others out there um I know that we learned a lot from working with the stakeholders if there's others out there that want to be involved in that you know we would ask that they get in in touch with us because right now we've started on the 40 to 50 foot lot and then the next is going to be the horizontal that we really you know we're open we want to make sure we understand it before bringing it to to you the first one I remember was over in Land O'Lakes that came in there was one I think off of Lake patience Road right what's that one similar to that I don't recall the exact name of it just drove on Lake patients yes was it Lake patients or Bell Lake I know there's one on like patients okay yeah all right bill I think the one I think it was built like I was just and just mentally nothing was on the other side of the road um and I'm sure there's uh other others out there too but I don't know maybe maybe Sally can get us a list of list of these and give us an option to go drive around yeah I think we can do that and I just like to thank Sally and her team it's it's been a collaborative approach both with industry and and and with with the challenges that that we're seeing but I

think you know to the commissioner waitman's point it it does good to preserve options for the future um it also kind of helps integrate into our into our current Community with respect to things that have already passed through the first Wicket I.E board approval I have no issue sitting down with Folks at site plan and and seeing what can be done I'm sure there will be schedule implications that will be of of interest to Industry when it comes to planning but again we we maintain a collaborative relationship with the development community and I'm sure there's there's there's room to talk and please know that as these are coming through even if we don't have something in place we're trying to encourage people to think in this direction because this is the direction we we know the board wants to go and for some say for example that I've gone through planning board and now they're getting ready to come to the commission and we start talking about them they are explaining to us they've expended hundreds of thousands of dollars at this point and you know feel that we're pushing um requirements on them that have not been approved so but know that you know they're open some of them are trying to shift as we talk about this and some of them have you know made a large investment and feel that you know to have go back to the drawing board in its entirety could be very cost prohibitive for them in their um the developers and we've not just sat back and not had those conversations I want you to know that no and we just approved a couple at the last meeting that had been so far down the line we've gone we we had to let them go anyway so and then the boph so I think the discussion is good um I'm sure that each one of us will get several phone calls coming up so we'll probably do some follow-up meetings for the business Community there's no doubt in my mind but you know it's it's so difficult as as Commissioners we can't talk to each other the only time we can have these conversations and throw ideas out is when we're in front of this board so it may be a little disruptive in conversation for the industry but it's the only way we can decide about and talk about our experiences I mean literally I did not know they wouldn't have a person on premises I think it's a great idea to look to have someone with make sure they have a clubhouse too yeah and and and I'll tell you from the Linda lakes one that I remember I remember that being a single drive with every single house in there and I I don't remember anything different so others that have maybe changed and morphed to kind of like get what they wanted and build the product I wanted it's kind of like it's a it's an awareness thing for us right now it's a new thing and we need to go look at what the ramifications are because a long way down the road we want to see what this kind of is going to be for down the road

can but you can direct staff to look into that issue for the horizontal Department yeah for future because they're going to be working on standards for that product right okay that would be an example of a standard for that product type all right so I'm ready for a motion great thank you thank you chairman thank you board I know we kind of went it was good all over the place fantastic discussion I thank you all for entertaining this when we brought it up a couple of months back appreciate Terry and Sally and your team for for going through this exercise and the stakeholders some of them are here in the crowd they have not been neglected from from this process there's been a lot of of time and conversation around it so this this is just step one for a very small portion of of this type of product to start you know adding quality control standards and value again I can't stress that enough if a product comes in and they come and talk to my office I ask the question of quality and value and I believe this is a step in ensuring that the product that's being built like this will hopefully with the added with the applicability being board accounting commissioner approval instead of Planning Commission adding what attorney County County attorney Goldstein has said into that into the motion so thank you thank you okay any further discussion all in favor say aye aye aye any opposed okay and one item got Mr chair can I say one more Point sure I do urge you though to contact your legislators about this bill that is pending in the legislature because a lot of what you're talking about is quality is architectural control and the legislature is very close to taking away your ability to impose architectural controls on single family and again that Senate Bill 1604 and House Bill 439 House Bill 4th okay social Whitman so thank you chair so with that with all the work that the previous board did and commissioner Starkey and Architectural design standards and uh with you saying with with you saying that in this bill no work around to create quality value and Beauty in our in our single family home ownership product you're saying that it's going to be vanilla I'm saying nothing trying to preempt your Authority on that now I can't tell you until the holiday all over the count until until the final legislation is approved I can't tell you if there's a workaround or not now typically there's nothing preventing the developer from imposing their own architectural HOAs and developers do it all the time the question will be for the board do you want to continue to improve 45th to 40 and 50 foot Lots if there are no architectural controls and there may be some developers that voluntarily agree to architectural controls to get 40 and 50 foot Lots but
