The board unanimously approved ordinances repealing an antiquated Health Department fee ordinance, redesignating parcels on Gull Boulevard (3 acres) and Bailey's Bluff Road (2.57 acres) from residential to Planned Development, and expanding the Chapel Creek Community Development District boundary; a rezoning request by Rhema Investments LLC on 8.39 acres along Catfish Lake Road was continued to February 7. Commissioners also received word that a federal judge granted summary judgment in favor of Pasco County in the Sierra Club's challenge to the Ridge Road Extension permit.

17:00what that means so large looming projects out there and uh Cherokee does a great job at the helm so it's exciting that we have a Pasco Pasco chairman uh be remiss if didn't mention Moffitt it's pretty neat pretty neat day for our County a long time coming and I think commissioner Bradford is going to have quite a bit of fun over there a new star of the show coming in uh next I'd like to thank the board and and staff for their Indulgence while I was online out sick on the on the The Bill Durant come the bill to rent um dialogue and appreciate what we see with that you know big fan of quality and consistency and reliability in protecting the values that our people make within our community whether it's single home or business investment like we talked earlier about fish Oakley and chairman you brought this up about what what are we going to look at next for our County and so we all have folks that come to us and Pitch the projects and what's the latest and greatest and the need amenity that comes in and so it's dangerous when start thinking uh so really the word of the week in in our office and what brought up was this was entertainment in downtowns what is a downtown we have in this this is just merely a subject matter to start getting this board thinking when these projects come in what's the destination you know what's a downtown we have so many people there's so many customer base There's an opportunity for an entrepreneur if they can have the space to create their American Dream right here in Pasco if we just provide the opportunity and so I I'd like this board to start coming up with a with a framework of when we have these big projects come in what is a downtown what's the entertainment connectivity walking golf carts to get there um you know entertainment spaces folks are are you know finding the amenity within the community that they live and they're not necessarily traversing on our roadways and you know people have accidents so that overwhelms our police Fire EMS so when we look at downtowns I like to start coming up with a concept you know what do we what do we look at do we look at how Newport you know City of Newport Richie city of Zephyrhills city of Dade City they're they're these downtowns are revitalizing and I think it's important that we have this conversation because I think it's the next step of what makes Pasco County vibrant it's in our slogan so I bring up downtowns and and planning and the size and the scope and and kind of what we want to see I know it's may change the game a little bit of of the future of projects in this County
20:12but I think it's important that we have this big picture policy discussion and uh open it up for ideas I'm assuming it's going to go 50 different directions but it's a start and this can be something fun that we can work on together to to create you know some something neat so with that I worked up open it up if anybody has any any comments Mr Starkey so um I love your direction and I was talking with um some people the other day about um a previous attempt if you remember Joanne Hurley lived in Orlando Lakes along with my brother-in-law there was a an attempt to start talking about where is Downtown Land of Lakes and they came they started coming up with some planning ideas and you know sadly the whole idea got squashed and now you just have commercial sprawl hell up and down that road um but I love what you're thinking and and I will tell you that when when I have the opportunity where's therapy Terry and I um we we really try with developments that come into our community into my district and anyone's as much as I can but especially mine to say okay are you bringing are you making a place where someone wants to go to on a Saturday night with their friends with their family we don't need more strive through fast food buildings on 54 surrounded by parking lots where you don't you don't you want you don't want to spend five minutes and if if we let ourselves get stripped out like that what have we built we've built nothing with a heart there's no heart there's no soul so um if you saw the renderings of what's coming and I'll put it up if you haven't seen it was coming on the property we're doing Mitchell's uh house used to be um you'll see how we worked with Barbara wilhite's client to to try and shape into more of a Main Street downtown feel and um as much as we could with the constraints that we have because you know we can't there's only so much we as Commissioners can control um can you Mike do you have that picture that are just if you don't have it my I'd like someone to put it up here um but agreed and whenever we can we should try and help um have built encourage our development Partners to to build something with a heart and a soul and I think when we have our form-based code guy come um and and as we're going through the comp plan these are discussions that we can have I don't know what the law you know lets us do there's only so much that we can do right with development rights um there's only so much you can do
23:25without an ordinance but okay but let's talk but I mean you've got and there are putting aside the the design criteria for um in straight zoning categories that you you can incentivize and regulate to get to a sense of place if that's the board's desire absolutely as a matter of fact I had a conversation with the County Administrator yesterday there's some property that's being uh used illegally and we're not going to get into that one today we're getting some other ones that are being used illegally that's why Denise is sitting back there but you know sometimes we may have to just buy the land Zone it the way we want it to achieve what we want and then put it out on the market and I can tell you there's a lot of places that operate like that City Pittsburgh that's how they Revitalize their their city if you if you've ever heard the former mayor of Pittsburgh speak he's a fellow of the Uli now I encourage all of you to go to Urban Land Institute meetings this is what they talk about and uh and I'm wondering if this opportunity comes up if we can't do that here in Trinity because okay where's downtown Trinity um but I like where you're going yeah it's thank you I'm sorry Mr chairman the the my goal here in the attention intent here is quality of life yeah a quality product you know we don't have to sell ourselves anymore in this County people people are finding us and I think it's important as new generations are coming here and families are coming here folks are making their choice to retire or come here here for work you know I don't want them leaving and going down South to Tampa there's no reason why each of our communities which are unique in and of itself has a quote unquote a downtown business district that has the internet either entertainment spaces which I learned that's a word I learned this week maybe behind eight ball but they I think this concept will win here in Pasco County and I think people will appreciate it I think people who have an entrepreneurial Spirit they have the right kind of square footage will take advantage and try to live out their little piece of American Dream because there's a customer base here that we've never had before so it excites me to have this dialogue and to learn more and understand it and I just I hope that you all will join me in this in this thought process I like to say I love that you're bringing it up I think it's great to talk about um because I think we want to make sure we're looking we're approving this now what's it going
26:23to be like in 20 30 40 years what are we going to end up with um and sometimes we're going to get hit with projects that sound real good but if you really dive into it what have you really got um I think we've got a proliferation I think it slowed down a bit is between storage units uh car washes seems still soon be strong a couple years ago we're dealing like Dollar Generals coming in everywhere and storage units yeah so I I think you know looking and I and I encourage you all to look as far as Redevelopment goes as well though because up and down the coast that should be that should be prime prime real estate um the experience I saw down at Fort Myers with all that sand come across a street took down every house that was on the ground any building was on the ground anything Elevate was in good shape if that storm ever hit here it would be just devastating up and down and I think you know we've done some things we need still didn't do more to help that Redevelopment coming in um it was kind of very disappointing at the tourist development meeting last week when we showed the area the four areas of the county the full quadrants and it showed Hudson as having like no hotels two motels in a hotel now right down the street in Port Richey as I said they're there but we've got to try to stimulate some things out there so people have heard me talk about sun west for years we've done a great job since we took it over I mean it was like really going down as far as not being maintained the staff out there is doing great we've got some projects coming up a building I think we just approved the engineering for our last meeting so some things are going to come there but we need to make sure we're focusing not only just with brand new stuff coming in but on Redevelopment stuff coming in and I will say we had a meeting it took about five months to finally get to resolution but for a guy who had a house built up and had a bathroom down below where we finally found a solution where you could actually keep his bathroom there he couldn't get FEMA insurance but he could sign a disclosure from it to go now for a guy who would have to have a bucket Down Below in case you couldn't make it upstairs to go to the bathroom yeah it's a good quality of life thing it made sense literally when this guy was sitting down with us face to face didn't he make an impression Sally we could get to feel for how do we how do we solve this and I think you know the team did a phenomenal job coming up with a solution to make it happen and I think that's the type of thing we need to keep on doing to to keep a look but everything we're doing is not just the new stuff but it's also the older stuff too that we've got to kind of work with and like I said I'm delighted to bring in the dialogue up because it's it does need to be talked about is that is the picture you want to talk about this is the Mitchell and I I feel it's okay to post it
29:00because it was in ABC Action News because they did a whole piece on Trinity development and this was there in the news so this is um Eminem um if you remember when Dewey's was originally developing all that property it was going to be a mall um and with the class A office and a a multi-story parking deck and they were given a pads and pours um Dave is not here is he angry okay so um they were given a uh Economic Development incentive I think that was before David Engel was here so this is kind of and then they it ended up the mall went away because malls are darning in America and they developed that corner as a regular old you know development um and these guys have they've worked really we've worked with them really hard to get something different that has a Main Street feel I I it's going to be uh people are going to gasp when they drive by and see six story apartment buildings that I think there's 800 units in here um but that's already that was already approved a long time ago but I can tell you to have something like this which is their the offices are above the shops and restaurants you have to have density to make them work and I I there is a project coming in on 54 and black Lake Road uh I think it's Clark's customer I can't remember um that we worked with again help them design it so that there was a place where people would want to hang out and we got a letter today from a gentleman who's hoping to put a restaurant in there and the corporate office turned him down not enough density so this is what I keep telling people I'm trying hard to get some restaurants over here and use the view that have been up here for a long time you know I whenever we approve one on the west side I said East Side you got to come over to this area but over and over again we're here in not enough density so um I'm hoping we're sending it we're sending them some numbers of all the units that are coming in a radius around there so they they can change their minds and allow this really well-known restaurant to come in but anyway this is this is going to be kind of a cool place for the for the hood to to walk um eat dinner and hang out shop I hope it takes a while to get to something like this you don't build it like this overnight but well anyway eight eight hundred 800 units 986 square feet of commercial commercial in office with a parking deck am I saying that right Barbara so you know with with that sorry Mister so like when when you describe a project like that coming in my immediate thought
32:03is what are these people going to do for work for business and what are they going to do for fun that's you know the the thought process now that we have so many folks coming to Pasco and we have such a unique County with from Coastline to the hills to you know pop stroke and Tiger Woods coming into Wesley Chapel and scalloping we have a real opportunity here uh and um it's it's exciting to have this conversation with you all and hopefully we can come up with with something I'm not sure what that is or how we do it but even on even on the east side we're we're growing and and need more restaurants but I mean we have the population but we don't have a knowledge Garden we don't have some of the other restaurants that y'all have on this side or in the middle like Wesley Chapel have many restaurants over there but we need some of those on the east side too so people don't have to go as far to to get you know dine and and be out so we have in Dade City we have a great a great Community a great downtown so you know it's good Zephyrhills has has that and they're trying they're trying the same thing to get more restaurants and things in their downtown area so this is all good conversation to have and I'd say Dean City's got some great restaurants down there and a lot of not they're not the regular chain they're just great restaurants great place to go yeah commission Bradford thank you Mr chair what an exciting time to be in District Four with Moffett Cancer Center now the Lord has been blessing me with that uh I uh a little story to tell you about Lee Moffett many many years ago I had a different job he had a different job and he had a flat tire on I-275 heading up our 75 heavy heading up to Tallahassee to become a Speaker of the House I pulled over and I helped the guy change his tire probably the wise thing I ever did and now look at us so I thought about that the other day and uh Moffett is going to transform Pasco just think of the excitement if we find a cure or when we find a cure for cancer right here in Pasco County that will change lives that will extend far beyond us up here you down there our kids our grandkids and we all should be very proud of that and I know I am very excited about that that's the first thing second thing small businesses is definitely where it's at through the economic engine of this County all the numbers provided uh indicate that we do need to revitalize the areas that have been neglected and we're doing that I'm excited about in my area Newport Richie they're doing some great things over there County needs to be a partner
35:28with our city Partners not a hindrance we all should be on the team together because together we win and divided we fail so we have to we have to make sure that our vision that we're talking to all the stakeholders in the game and we come up with a comprehensive plan the other thing is I got to tell you I'm I'm pretty tired of fast food restaurants and State Road 54. thank you very much I don't know how to say it anymore eloquently than that but I hear about that every night from my wife thank you uh so we have a lot to do we really have a lot to do so I couldn't be more grateful to be up here I want to thank the chair for the committee assignments that he gave me um some of them I'm uh well I should say some all of them I'm very excited to get involved with and I appreciate your support and I appreciate your confidence in me thank you my pleasure commissioner Starkey well were you done I'll be done I've got a lot but we have a lot of time until my hair appointments we don't have any time um so first of all uh I'm very excited about Moffett too fortunately my responsibility at T Barta caused me to miss the Moffett I really seriously thought of canceling going to tea Barta but I would have been the cause for no Quorum and then they couldn't take the vote to ask themselves so I had to be there before we could finish doing all the action items that we had to do commissioner Kent walked out so there you go so we didn't get to finish our business but um so T Barta will be around uh for another year year to year and a half um while we wind things down to our federal contracts and some other programs that we have to learn deal with and move on one of them being the vanpool program but as we all mentioned at the meeting just because T Barta is disbanding doesn't mean we don't have a responsibility to come up with a Transit solution for one of the largest metropolitan service areas in the country the largest one without a Transit solution so um we plan to continue uh working as a group to to find a way forward I did have a meeting with Tampa Bay partnership yesterday who's going to help bring this move this conversation forward and um a small group of us will be meeting to discuss some first steps and then it'll start to be shared with the all the counties and City officials and you know
38:33municipalities involved but we have an environmental um we have a good route I think a good start from Wesley Chapel a route that goes from Wesley Chapel to um Saint Pete and um District Seven is doing what they can to um build that within the perimeters that they have parameters that they have right now they're a little hindered by some things in Hillsborough County but that environmental permit which you know the state gave us the money um to go act upon will be good for three years and we don't want to have to spend that money all over again so it's not we just can't sit back and find another generation to solve this we we have to take some action so hopefully we'll be having more of this dialogue in the near future and certainly I'm certain it'll be coming up to TMA meetings and it's just we just got to see where where um the responsibility what responsible group is going to take the reins since it was not tea party so that's my tea party message um I wanted to um go over this issue that was passed out to you guys um Jack is probably familiar with this from our time at fact Melissa McKinley was really working on this when no Jack that oh yeah oh pass those out there's I'm not I'm sorry I don't have one for the clerk but I had to accept I have a set for the Commissioners and one for um the County Attorney so this has been something that we've been talking about at fact for a while in in Naco and it's really surprising but when when someone is arrested and um they go to jail they lose their Federal benefits they if they're a veteran they lose their veterans um Health Care if you're on Medicare or Medicaid you lose your health all your health benefits and so does your family so um guess who takes that up the county gets to take on that bill and they may be found not guilty they may they may spend I don't know you know six months in jail waiting for their trial or whatever and we're covering everything and this is a federal issue not a state issue but we are um we are just trying to raise our voice louder this year on working with our federal partners to try and not have people's benefits taken away from them while they're awaiting trial so uh I am the chair of the fact Federal committee this year and last year and this is one of the items we're going to be working on when we're in Washington
41:34and um are you going Jack yeah so I don't know if anyone else is going you are all welcome but I wanted you to be aware of this um this inmate health care cost issue and uh you know the more Advocates we have to change this the better I'm trying to get in with Senator Rubio to discuss this and um and I met with Mr Murphy uh yesterday to discuss this and he's made a few calls and I don't want to speak for you you made a few calls to your peers and in Michigan and and hello we'll let him speak he never gets to speak they're digging in to your request so I'm trying to get specific answers uh from our meeting 24 hours ago yeah but but they issue when they they lose the health care benefits and the county has to pick it up and then it takes a while for that family for everything to get reinstated when they come out it doesn't just happen the day they get out they have to go through this process to get have it reinstated so it doesn't seem like a good plan and so let's hope that we can get that fixed if I could tag on that a little bit Yeah Okay so Mr Murphy I wish I had I had you in the meeting we had this morning we had the opioid task force there Kathy was there Eric was there Stacy Jenkins there um Paula was there baccarello um and we talked about the jail diversion programs about trying to avoid them losing their benefits and trying to look at what we had done for structure and we had designed the jail from the get-go we looked at Charlotte County staff had gone down there four years ago they were down there recently six months ago so they get pretty in tune to what's there um we all agree that we'd like to still try to do something better so if I can get you into the next meeting let's go take a look at it because we need to try to keep every inmate that is going through let's say if they're mental health issues let's get them into mental health before bring them into the jail if they have opioid addictions let's get them treated before they go in for these treatments um whatever we can do to divert that the better off it's going to be and I think people maybe a lot more receptive instead of going to jail to go into treatment if there's going to be a path to go forward and I think with Kathy work with Catholic Charities and what may what they may transpire with them it could even give another place where they can go to to help with the recovery but whatever we can do to try to make this happen because it is a huge burden for us and and maybe Mike if we could or Mr Murphy we could get the data to how much we're paying every year for this inmate health care costs might be the talking point we need and that could help as well help us as we financially figure out what's the
44:31investment we should make to try to divert and and keep this problem from stacking up over and over again and now that we have the jail it's under our control directly those conversations should be a lot easier to have yes sir we'll get that data for you thank you all right carry on all right uh yeah I got more um can you put up well I don't know if I have your pictures up did Denise leave seriously huh oh okay I'll try and do this until Denise comes in so we pass the sign ordinance I don't see if I have the date on here I don't know um and um one of the rules in our new sign ordinance is that and I'm going to read it to you right here I don't know how to read legalese here let me see uh 406.1.5 subsection non-commercial speech for commercial speech that might be it um number three uh one temporary sign of any type Banner or feather Banner that is not prohibited by this code for each residential lot non-residential establishment having a certificate of occupancy or vacant lot so this is something that um sadly I have to we have to have our code department and force uh your you know when you drive by and I have it all over my district and Jackie you want to start cleaning up Hudson so this might help you see five feather banners in front of a business and a temporary sign no you only allowed one you can have one feather Banner or one other kind of sign but you can't have 18 signs on your oh she's back um on your property right Denise yeah we're not we I don't think we've begun enforcing this at all and I know our our code guys are are slammed but I don't even think this was on their radar so yes so I and I apologize I was having a cough attack Denise man is planning and development so yes that's accurate you can have one feather Banner Banner on your on your property per each location having a certificate of occupancy so in other words so if you have a multi-occupancy parcel and there's a massage establishment here and a nail establishment there and there it's not the same place that does massage and Nails each location can have a feather Banner but not Seven Ten not more than one okay so I just wanted to wait don't leave yet uh and I know that's more work for code enforcement which is why I'm advocating for more code enforcement officers okay uh we passed the used car lot and uh the new car sales and used car sales ordinance that requires some work by code right they only can have so many cars in your parking lot based on what your site of plan approvals were when you're when your business started and we have many in my district and it's common on 41
47:47where they put in 50 million cars in five parking spaces and that is not legal same with boats same with I got it going down here on on Massachusetts where we have a boat repair place and they have way too many boats for what's allowed in that parking lot wait to me right here down the street in our old fire fire department um half the time they're parked out on the street and in the right-of-way but that is going to be a responsibility of code and they are very busy so another again uh plea that I think we need more code officers all right now we're going to go on to zoning and code um can we put some pictures up um let's see start with Jumanji jangali and um this this this issue has been going on for a while um this this is at parine Ranch Road and Rowan and frankly I saw it starting to happen and I I didn't know what was going on that these guys did I believe start with a silt fence I never saw a permit box but they at least did put a silk fence up are there any other pictures of that so it's the entrance of Nature's Hideaway over there and and um I don't know if this is elfers or what what you call this area keep going um so and that's purine Ranch and uh Seven Springs I don't keep going I have so it turns out that this company came in and um by the way that chain link fence is is this is before that chain link fence was there so this company came in we thought it was Duke there at first but it's not it's a subcontractor of Duke they they clear cut and filled this whole piece of land without any permission no site plan frankly it's not even allowed in this in this little neighborhood commercial area and we didn't catch it and they were operating for over a year and we didn't catch it so I started asking questions and um Mr administrator do you remember where we are with with jingali and and Denise you looked up the zoning and all that right or am I put you on the spot on that one no you have just um you can answer questions and I can look up the zoning because I didn't know we were going to talk about this one I thought we were going to talk about the other parcel we're going to start with this one move on to the next good yeah actually I'm I'm in discussions with Duke actually there's Landscaping on order and there's some other things going on with jingali but yeah we're familiar in trying to work with with them to make this a better use and not to repeat what we've seen out here and and this is an example of what I was talking about
50:49where we're allowing chain chain link fence and Bob wire in front of a neighborhood I mean arterial I mean that that is would you want that in front I mean in front of Bexley no and I don't it's are there any more pictures of that well I would rather see the pictures on of the inside of what that looks like and they had construction debris alongside the road of the keep going I'm hoping that you see it well you're not getting okay that's the entrance look at that and that got much higher than that um and that what you're seeing behind that fence that's the entrance into Nature's Hideaway um okay so um can you go to the one on Trouble Creek oh that they've been cleaning that up that's better than what it used to be so uh on Trouble Creek and I'm sad that I didn't jump on it when I first saw it being cleared and someone told me that the the giveaway is when you don't see a silt fence this is some beautiful property on Trouble Creek West of 19. and as you can see this was this yesterday yes yesterday so we got we got a call in from someone who's in the development industry said what is going on on Trouble Creek Road substandard Road um we're actually just met with I just met with councilman Peters we're trying to put a Greenway Trail thing in here and buy some property in City of Newport Richie has some property in here we're trying to combine it and make a trail out to 19. keep going this guy just clearing away no permit and um Denise can you give us the history of what's happened so far in this property from your World absolutely I'm not sure how far back you want to go but just suffice it to say this parcel is owned mf1 there's two of them two parts side by side yeah there's a western parcel in the Eastern parcel Zone mf1 it was Zone mf1 in 1985. uh just you see the how I'm sorry do you see the rooftop there it's right next to houses okay just recently in 2022 in December um they submitted for a timing and phasing and a substandard road review application because it appears that they want to apply for a special exception application for a temporary um yard to store um they're saying that they're emergency let me see what their application says their vehicles related to utility a utility company temporary development of vacant land to serve as a staging area for emergency use electrical utility service trucks that's what they're going to be applying for or they have submitted actually a special exception just very recently and it's under review because the substandard road and the timing and phasing applications still haven't come back they have to get a an answer from
53:49that in order to move forward with the special exception application filled in wetlands took down oak trees all I mean the trees this was so you can can you tell from the area around it how beautifully wooded this it was this was there is no way we would give a special exception on Trouble Creek for um trucks like this because it is a it is a very narrow road with a very dangerous ditch on the side and and there's houses all there's this borders houses so I'm just beside myself that we didn't catch this yeah but we did Issue a stop work order yesterday on it and so we're we're sorting through but this was going on for two weeks and we missed it okay across the street with the um can we hang on the side for a second so we've got a tree mitigation ordinance right how many trees do they take down by avoiding to avoid all that this would be part of the investigatory process that we'll have to go through as we figure it out but like I said the stop work order has been issued and we'll we'll sort through things okay so you paid something else you know it'd be very interesting to see what our penalty twenty thousand dollars twenty five thousand dollars clear I think it's like five acres or six acres when you add the two as far if you're and supposedly this is a temporary use for this user coming in did they say for one year they're going to be there they stated for one year okay so and this is kind of goes to David um we I think we fixed we fixed it where landowner clears their land and then comes in for rezoning to something and um this well this wouldn't apply anyway well this is not this is this is multi-family the issue that David fixed was AG land it's AC right now does that count let's just said it's MF the one where they went out is multi-family it was rezoned to mf1 in 1985. okay I saw something that said I see that's the one I showed you that said AC all right so then I think we need to fix that because I know but a 25 000 tree mitigation hit is nothing is not going to stop this kind of action you just made that number up I did [Music] yeah four zeros after that we're doing two and a half million dollars yeah and what it is will be what it is well I think it'll be eye-opening for us let's see what the what the slap is for that then you've got The Fill ordinance huh in the fill ordinance yeah and filling in the Wetland and lots of things are different class two according to the and they had they didn't have Swift Mud permits either right we didn't we didn't I didn't check I particularly specifically didn't check that yes but I would imagine that's part of the investigation okay okay across the street the boat and
56:56tire whatever or truck or okay so I think what you may want me to talk about that is that um several years ago they requested a non-conforming use determination from a former zoning administrator uh Mr Lowndes who some of us know um more than a few years ago it was a ten thousand okay 22 years ago or 23 years ago so um and they were issued a non-conforming use determination basically stating that they can have the use as a contractor's office and storage of his vehicles and equipment and RVs and boats however that doesn't mean that you don't have to meet all the other parts of the Land Development code plus it also doesn't mean that if there's new activity so if there's movement of dirt and there's new things that are happening on the property they would still be subject to a site development permit so um that's what I wanted to comment on that one so because we sent code out to that to this business that's across the street from this and they said oh it's already uh do you remember what a non-conforming use yeah yeah the zoning you know but just because they have a non had a non-conforming use doesn't mean that they don't have to come in and get a site plan to start a new business or to to fill in they have clear-cuts activity happening on this property as well they have clear-cut and filled it in this this place on Trouble Creek across the street from here so somewhere we have a disconnect between you know in what our laws are and I just think as we look at code there needs to be a zoning person or someone with the knowledge more knowledge than what we have now over there helping because mistakes are being made all over and and it's not their fault it's just they don't have that knowledge um so and now I have all these cleared areas in my district that you know don't have permission we've caught another big one on 54 we're going to bring that to you next time um that's been operating for a couple years okay uh was there any other ones that we wanted to go over no I think that that one that on fact before that's still okay I got one more thing uh fire pit and I think we have some fire people here so um I have a had a constituent that um lives in Foxwoods or some one of those nice neighborhoods in in Trinity yeah Champions Club she lives in Champions club and um her neighbor built this very nice fire pit I built one something like that for Trey for his birthday um the problem is this lady lives this is very close to the lady on the left with the screen in pool see they moved it away from their screen
59:52and they put it close to her screen and she has asthma and so when they light the fire she can't go outside to sit on her porch where they have they like to sit over there on that corner that's one issue but the other one is is that um you know a fire that fire next to a pool screen that that isn't always a good idea you can you can burn that full screen and they and they don't like they don't like the smoke they have to close their doors um so it's it's an interesting issue our ordinance says um yeah can you go over what our our rules are and apparently um different Counties have different rules and just wanted to see if you guys wanted to look at this hey thank you ma'am good afternoon commission uh Mr chairman Justin from Fire Marshal of Pasco County and the section that we adopt locally in our ordinance is under 45 uh section 74 and there's two areas that fall in when we respond to these types of Investigations there's open burning allowed which adopts for administrative code and state statute and then there's recreational burning this will be deemed and fall under the purview under recreational burning and if I can recite that I believe it was subsection 10. um where nothing in this chapter shall be contributed prohibit the open burning of vegetative debris or untreated wood and a campfire in a ceremonial bonfire outdoor fireplace or other contained outdoor heating or cooking device or on cold days for the purposes of warming outdoor workers when our crews respond to these incidents um they determine whether it's open burning to clear vegetative debris that was generated on that property if it exceeds the required amounts under statute for administrative code and local ordinance they can't petition Department of Forestry for a permanent issuance anything less than that they have to conform to setback requirements where I believe with your Aid commissioner Starkey they were questioning the 25 feet of a structure so it's 25 feet of a structure heavily wooded area and that's all under the open burning requirements this was deemed and interpreted by our field Crews as a recreational it's attended they're out there doing Fellowship visiting with family neighbors um so under that there there is no regulation which speaks to setback requirements and the recreational aspect so so next question Yep this is uh this is in propane this is a natural gas no it's wood burning wood burning it is yes sir and so would you tell me if I may so what'd you tell me there's no setbacks for this required no sir that's correct no
1:02:52required setbacks by the law as it's deemed in ours in ours recreational open burning and ours locally as well as State Statute and floor Administrative Code this would conform to what's deemed and identified as recreational okay commission waven thank you I appreciate thank you commissioner Target for everything you've brought up I would caution this is my point of view this is a nice fire pit they're using looks like one of these new smokeless wood burning fire pits is placed in the middle no no there's smoke it well there's gonna where there's smoke there's fire I to start regulating in in micromanaging and I think it's a slippery slope I don't I don't want to impede on people's you know have a have a nice fire pit in their backyard I don't know what the answer is I just be cautioned with more regulation more red tape more things to for our folks to police and the same thing goes with listening through all the the the code enforcement aspects that we've discussed today I you know these businesses either they blatantly broke the rules or some of our rules could be so bureaucratic and difficult that they're just going to do what they need to do to get open so I think whatever that the balance is of if we're going to be looking at ordinances and regulation that we don't overburden a homeowner overburden a business we kind of you know I want these freedoms to have a fire in my back yard within well I agree reason like I feel like it should be a neighboring neighborhood why should they be able to put it near the other neighbor why don't they have to put it's on their property so any because it's on their their their their property uh you know one neighbor telling another neighborhood I just bring up these concerns I'm not making an opinion just just things again for us to to think about you know somebody tell me what I can and can't do with with my property I kind of get a little ruffled up there like anybody should you work hard for your property and they spent money that's a nice this is nice they have a pool pump right here so if they're releasing water from their pool that may have come into a factor of well I don't want to wash out my fire pit if they have to release water potentially like it's I don't know if it's necessarily to a certain extent the uh the County's place so to speak so anyway that's just um for me if we're making any decisions I I will be very conservative and cautious in making these types of decisions I think these are great things to think about yeah but because thank you you don't you don't think about that but some in our research we found that some counties restrict how close you can put a fire pit next to your neighbor's screened-in pulled porch
1:06:10I think it's 25 feet and maybe that's the distance a number will go out before it gets there I don't know if you don't have 25 feet Well yeah if I may commissioner as as far as fire Brands it depends on the type of material that's generating those as far as when they would completely extinguish self-extinguish with respect to other ordinances I the only thing that we were able to find in our due diligence was a position on nope and burning allowed such as the city of Dade City they have look ordinance where there's no tolerance for any opening burning no no backyard fire pits in Dade City that's correct um the the other within the city limits that we've had to defend and and offer a lot of educational opportunity to is the fact that I believe it was around the late 2008 when there was a revision Amendment to the Florida Administrative Code pertaining to this where they took nuisance smoke out of the defined for complaint so prior to that if somebody deemed it nuisance and they called and complained because they have asthma they're closing windows they can't step outside that made it in fact unlawful they have since changed that language to where they speak to the moisture content but again this is only in the open burning not recreational yeah um so that's been a position where we had to go out in the fan where just because it's a nuisance we cannot enforce any action as far as extinguishment or ordinance violation I you know it's a it's a Tuffy in my opinion because a lot of people want to add these in your backyard I think the more neighborly thing for these people that now they're like better enemies these two it's that they could have placed it closer to their own property and not put it on the as close as they could to the neighbor's property but um I'll tell you in Europe you can't have fugitive smoke you we went to some a friend of my friend Gunther's uh to their house and they had a Pizza Oven outside they have to pipe it up like so that it can't go into the neighbor's property yeah that's the rules over there so we are nowhere near that and I'm not suggesting that and I but I wanted to see what your pleasure was um I told this homeowner I would bring it up um you know I we're probably gonna have to move yeah I can I can understand what you're getting at but somewhere some of these rules that we have got to stop let people live their life so yeah these things are very common in a lot of places and uh uh of course I've never lived next to someone that had asthma or something like that I I can be understanding of that and if they know this neighbor very well they can work that out where that neighbor knows they're going to do that a certain night and and work it out together so I think those are the right ways to do things like this rather than putting some ordinance or something that says no I guess that's why you get tired
1:09:21of being told no to everything I guess if the Embers burn the neighbor's fire their screen which I have done to my own but that's on me I also burnt our trampoline um uh that's a civil action between the two yes ma'am and there is State statue that speaks to any damages occurred of somebody willfully and intentionally setting fire to anything that they are responsible for that yeah okay I'll give you a little idea Beacon Woods civic association actually had a rule in place that actually didn't allow those so that's how that Community dealt with it this one here I guess didn't think about it so and we we do have Mr chairman we do have locally several HOAs that have taken that position and invoked their right to Institute that throughout their their organization local organization which again we we don't have a position to enforce right so that would be I don't know if they could even change at this point but something they can talk about locally with them anything else nope nope okay well I look forward to seeing you in Washington and maybe we had a sunshine thing we can talk about we'll work on this visits and is Ralph going no you can set appointments up for us yeah and our federal lobbyist is working on something that's very good Mr Bradford I just like to uh you know I'm still the new commissioner on the Block but you know I've been listening and we have a uh a shortage of Code Enforcement Officers and now no matter how you cut it we have rules in place and we're not enforcing them it really just doesn't matter they're just words on a piece of paper on a computer screen I'm not an expert in the budget process right now I know that uh sooner is better than later I don't know if there's a way that we could start looking at adding additional Code Enforcement Officers now but I think if any area of the County government needs help it's code enforcement I did not pay him to say that well you didn't but you know I got two ears and I'm listening and and you just can't go to somebody who comes to work and say Here's 10 things to do today and by the way tomorrow here's 15 and then 20. there's a point where the balls will get dropped not not by the not by our co-enforcement officers by just by the volume and more responsibilities we need to do something about that sooner rather than later so however we do that in the process uh let me know count me in on that because that's what exactly what we need to do uh second thing is um I'm going to leave that alone so let's just go ahead let's just go ahead and highly code enforcement officers and get
1:12:37it done and uh and we'll worry about fire pits somewhere down the road thank you uh metal Clerk Mr administrator that's right County Administrator thank you Mr chair just uh one one brief item I wanted to commend our community development team right now Marcy is up in Washington DC to receive the 2023 Audrey Nelson Community Development Achievement Award for our collaboration on the Family Services Center so if you're unfamiliar with that the Family Services Center has a shelter and a Housing Resource Center and we've helped more than 30 families since 2021 both with getting Services meals Etc it really plays an integral role in the lives of people during difficult times and allows folks to like I said get meals go through case management and keep their children in school all in the same time this is not the first time Community developments won this award this is actually a trifecta for them so we're very proud of this accomplishment and just wanted to recognize that here so thank you she is a treasure how do you turn Mr chairman members of the board I had sent you all an email but I thought I'd bring it up at today's meeting um we were pleased to inform you that on January 20th um the federal district court Middle District of Florida issued a positive order in Sierra Club and rametta versus the Army Corps of Engineers and Pasco County those of us just refer to it as the Ridge Road Extension case so the permit challenge that was followed filed by Sierra Club when we issued our notice to proceed to our contractor to construct Ridge Road about two years ago they challenged in federal court the issuance of the Army Corps permit the federal judge hearing the case um granted the Army Corps and Pasco County's motion for summary judgment there is still the potential for an appeal but the uh judge honeywell's order is well written and it should be difficult for them to challenge the other issue is if um you would like me to set up a litigation assessment meeting with outside counsel for your February 7th meeting with regard to the declaratory judgment action filed by the clerk I'll be happy to do that he is available okay and Madam Clark okay um I have two things that I handed out earlier this morning they should be on your days I also handed them out to the county attorney County Administrator and the assistant County administrators one of them is a noted item n68 and it is the annual audit plan that my inspector General's office will be moving forward
1:16:03on with this calendar year I included the cover letter that she said to me because it explains to you how the plan was developed with the various sources and then the plan itself is categorized by that source of of how they put together their plan the next item is n69 and it is the report from the jail transfer so you might remember a few months ago when um we we had heard that the gel was going to be transferred to the county I came before you and asked for an a quasi audit to be conducted it's really about an accounting to make sure that we know what we are getting when the jail transfers transferred from the sheriff to the county you had allowed me the opportunity to partner with a a an audit company we chose Cherry beckert they came became they came well in under the budget that the county set forwards under they ended up under fifty thousand dollars for the report they were that did all the legwork for my office because at that time we were at 50 percent vacancy in my Inspector General office and this report basically provides the background scope methodology and the results of that I'm going to call it an accounting it's called an agreed upon procedures it's because it's not an actual audit and in that they went through the financials the assets and the liabilities that transferred from the Sheriff's Office to the counties and there were no significant variances noted at all in any of the areas so I just want to let you know it was it was a great result that came out of it and it was a big haul besides the things that the county was doing on the operational end which was outside of this scope which again was a lot of work as well I wanted to um say my my thanks and my appreciation to your staff and my staff and the Paschal sheriff's office staff members so I'd like to just call out by name Chantel syncard she was an amazing Workhorse on this for the county she's your internal program administrator Kathy Donahue with the Pasco Sheriff's Office she's their Finance director there's a lot of work that had to be done by the Sheriff's Office and she really pulled most of that weight if not all of that weight and then we have Captain Kimberly Riggins who is now the County's Captain support services and also your Chief corrections officer Stacy Jenkins amazing amount of work that everyone had to put in and to make this happen and I wanted to say thank you to them there was also Jessica blesser your Finance director and Tiffany polloff with your I.T as well as Manny in my office Manny long and Matt Lazar the finance director and assistant director and then of course my Inspector General team putting this report together Patrice Monica McBride Christine caliano Erica Hendricks and Andrew Henson I just wanted to say thank you this was a great project to show multiple local agencies coming together with a fantastic result this could have gone wrong but it didn't
1:19:28it went beautiful it went right and we all worked very well together on that so if you don't mind just sharing those things with me Mr karbala I'd appreciate it with your with your team and finally um this morning Mr mallow spoke and I was contemplating around lunchtime you know should I say something should I not say something so I appreciate Mr seinsteiner making his comments at the end there and I do appreciate Mr mallow's statements that he made I do want to say Mr steinsteiner here he is correct about the lawsuit it's a declaratory action we're seeking an interpretation of a specific statute that interpretation will set precedence for the entire State and the reason for that is there is no case law that exists interpreting the statute so once the court concludes it'll be in a trial court it's not going to end there because this is the first time it's in court it's going to continue on to appeal I don't know if it would ever get to the Supreme Court of Florida but we're in for a very long haul in the court system so regardless on how the court rules you know if they're going to rule in the interpretation in the favor of me and my interpretation or on the County's interpretation of the statute I do believe that Mr mallow is correct and that it doesn't have to go that far that our case doesn't have to set precedent in the entire State and that we can work out our differences together and and settle the case so I just want to let you know that I am open and I'm happy to sit down and meet with all of you to discuss a resolution without having to go through the court system and having a judge decide our issue so thank you a lot I appreciate the opportunity to speak on it all right so I'd like a recommendation that you sit down with Mr Stein Schneider if you feel comfortable doing that at this point we have hired outside Council I would have I would have and Mr Alfonso and Mr caldevia have indicated they want to mediate the case if that's what the board wants to do that would be the appropriate venue um either way you know it's gonna be a long process you don't want us to be the ones to set the precedent for it anyway yeah so it would entail for the clerk to drop the suit and then have a conversation well no no I mean at this point you're going to have it looks like you're going to have a preliminary indication from the court in the second week in February um uh it's a trial court it's trial court and I I agree with the clerk that it's not going to end there on either side um so regardless of what that whether the court grants summary judgment or whether the court doesn't Grant summary judgment and sets it for trial There's an opportunity at that point for parties to get together and mediate them okay so let's face so let's wait till that point then so the the question I have for you all
1:22:32is do you want a briefing on the case at on the February 7th agenda yes okay um can I ask a question on some of that though so I'm sorry um because I think there were two issues and one is not in the court case I don't think and that is the I.T response they're both in the course oh they both are both in the courtroom I was going to try a separated like a second all right they're separated and I just wanted to say um oppose your your contract counsel opposing counsel um they have declined to do mediation that was brought up in the um at the hearing last I don't know 17th they've declined to have the court not rule and do mediation yes I don't know what that means we can still mediate Africa let them clarify please the my the what I have heard from outside council is that during the hearing Clerk's Council asked for mediation to stay the judge from making a decision they declined to do that yes and I would have done the same thing so uh Mr chair thank you so there's nothing to prohibit us uh from making a decision and settling this right there's nothing we have the power to do that we can settle this case by saying we're not going to move forward fundamentally I would rather give you that answer in in a litigation assessment meeting because it it's it's theory of case got it but I'm happy to answer that question in the Privacy uh of a litigation assessment meeting I got it okay thank you for verifying that okay so February 7th we'll have a briefing on it you can have your conversations ahead of time with the accounting attorney if you choose nothing wrong with that either okay yeah be happy to talk to any of you at any time check I left one thing off yeah anything else that's it thank you okay commissioner Starkey um so I was contacted by residents of Gulf Harbors and I've emailed all of you the copy of the state statute I they feel that the interpretation and maybe that this is New State Statute law about golf carts crossing the highway if you look at in the Senate to David Senator karbala and I sent it to Stein Center um that on two let's see okay to a a golf cart may be operated on a part of the state highway system only under the following conditions a to cross a portion of the state highway system which intersects a County Road or Municipal street that has been designated for use by golf carts at the Department of Transportation has reviewed and approved the location and design of the crossing and any traffic controlled devices needed for safety purposes so uh the golf cart users in Gulf Harbors apparently have been Crossing 19 to get to Newport Richie um or and recently no golf cart crossing signs
1:25:57have gone up now that's the City of Newport Richie um saying they're not allowed to they asked me to bring this up to you and wondered is this new language did you know because you know I've been bringing this up to secretary Gwen all the time at the TMA and so is this new language and can we petition the DOT to allow for Crossings if it is under certain conditions it is not new language it was I think originally adopted in 2000 and 2000 or 2005 the legislative history shows it was amended in 2000 2005 2008 2010 2015 that particular section was added at the request of Colony Cove in Manatee County for them to cross U.S 301 well can it be used across the U.S because it was prohibited completely before that before this amendment to the statute well do you do you see anything in there that would um allow since their golf carts are allowed on one side and golf carts are allowed on the other in a city um and this highway is going through the city do you see anything there that would allow us to ask dot to see if they can cross at the intersection it's d.o.t's call oh I know right but we have to ask them to look at it that's that's what they say they're interpreting the language that section in between is that County property it's not within the city limits it's it's Newport Richie on one side and Newport Richie on the other and D.O.T in the middle you know USA so my guests if there's a trail on one side on the other if I was the D.O.T secretary I'd say the request would have to come from the city if the city if the city is on is is at the point in which they're going to try and cross but I mean the County Commission could ask you already have the ability it's either going to be us they don't think there's a in the city limits probably would be better if it came from both the county and the City from Dot's perspective I'll talk with their city manager and um so Jack yeah it's interesting language there it is yeah let me let me let me bring up another thought um because we have we have timing of lights up and down US 19 plus some of the crossroads where Pasco County's got a one timing setup City's got other timing setup and Port Richey as well I believe in Dot doesn't control them in the cities the cities do at this point and Mr Stein Center maybe you know is there a way we can then petition to actually take control of the highway in the intersections I'm I'm pretty certain that we we control the majority of the signalization along 19 in our Traffic Control Center I can talk with our traffic operations team and find out what the division of responsibility and labor is but I've been in the traffic operations center and we they do a pretty good job during peak hours of moving those vehicles and
1:29:12timing I'm not sure where you're going with that but it can get you an answer sometimes they're really good and sometimes they're different sometimes the County's real good and sometimes the city is not a lot of it depends on time of day and and direction of flow and that it's really meant to move U.S 19 at the appropriate time so you could get stuck at a crossroad for a very long time while southbound traffic is is moving I mean but I can have our traffic operations give us some more detailed briefing on on the on the uh the approach some of the thoughts literally sometimes like I drive down to New Port Richey Saturday Sunday mornings continually and during the day a lot of the other times when you get to sometimes we'll hit our lights and I'll just hit one after the other sometimes green sometimes red I mean it's it's pretty consistent one way or the other you get to the cities and it's a different flow you usually going through so I can start slow or start fast I slow down the other way so I think there's a there's a break and I think and I've talked to the secretary about it because frankly I don't like the red light cameras in the city's only one have it and it's just the cities in the west side and then that costs our citizens a lots of money of insurance yeah I don't think it saves anything as far as there's no strong data so those things work a few years ago the city said they were going to get rid of them and then when it all died down they haven't done anything so if we could take the intersections over I'd be fine with that anyway commissioner do you have soccer in your items uh I do know okay okay uh is everyone getting hammered by soccer people can I speak to this commission our our office is yes There's issues and field issues It's been a uh quick study and we have a lot of hours Andy and I we have we have a lot of hours in this so before before any anything is made and we're working with parks uh I've got to meet with you know I want to meet with all the stakeholders and understand the whole picture and um based on that conversation and talking with Parks team and ask for some time before we discuss it up up here so let me and I'll agree with that sentiment as well I will say to everyone that I've actually met with the Wesley Chapel Athletic Association I've met with Florida Premier in the Tampa United was in the Wesley Chapel Athletic Association uh that Wesley Chapel Chapel Athletic Association does a phenomenal job coordinated things all the way through newer information is coming up from one of the board members from that they didn't know that could change the dynamic of the whole conversation coming up so I think if we waited till
1:32:11the following meeting until the next meeting coming up it might be a good time to talk a lot of things may evolve conversations may happen that may they may help resolve themselves coming up I think it's it's really important um you know I was dealing with Wesley with Wesley Chapel Athletic Association was that when I was on the school board because even you know way way back then they didn't have the fields that they needed for their Association um I think it's really important uh that we have like all the players in the room at the same time because I can tell you there's a lot of he said she said and the facts aren't facts that are being said out there and as I said I think I'll have a meeting next week to have all the players I mean at the in two weeks within two weeks like next week so before an explode again I've already had like two meetings with separate I have two and I'm trying to bring them both I've had Tampa Bay United I've had Florida Premiere and now I'm going to have Wesley Chapel Athletics I don't meet with the team until tomorrow to get an overview of that so which one a little time this is our internal team I'd appreciate it but I've been through that uh commissioner please when it comes to this issue at least from the due diligence and conversation and big picture that our office has discovered I I think our conversation I think will be broader so uh I'm not sure when we meet I haven't met with WCA yet but I'm excited to meet with them and meet those folks and from their uh it could be a good good conversation to have yeah I'm meeting with I'm meeting with them also Chapel group and I think it's a phenomenal way to go I mean the Wesley Chapel group The Athletic Association has been a phenomenal contributor volunteer to the park volun volunteers all parents passion just like when you were dealing with the school board he had all the parents this is the same type of thing and oh yeah Keith what he deals with with everything as well the great thing is I think everybody wants to take care of the kids and help promote the county the best way again so I think everybody's got the right intentions it's just a matter of how do we find to get there so I'm glad we're all having the meetings I think it's critical that we do and then not get too excited right now just let's see how it plays out in a couple weeks and maybe we'll get everything resolved and in a better situation you know and that's a big issue in our area also saddlebrook's a big issue I'm meeting with residents in Saddlebrook also to uh get the full story on everybody's part so there's got to be a meeting of mines and somewhere in the middle we've got to come to rest and we all be happy with what we got so in all my years I try to get information whatever Source I
1:34:56can get it at take it all in so when we're sitting up here making a decision you can make a good decision what you feel good about and I I always want to say that I made the best decision I have with the information information I had available but again I stress on getting as much information I can before we get to those points at the end of the day we have a good problem because we have a lot of Youth that want to play sports yeah and that is much better than not having any youth who wants the place right and play sports in Pasco yeah right yeah that's right so it's good for the families good for all of us so all right appreciate that um I have a few items um and one of commissioner Stark you brought up as far as like Transit um the partnership years ago with the TMA with all of us I think and I even put a letter supporting the gold standard brt running from Wesley Chapel all the way down to St Pete we as a TMA also approved I think the bridge coming across to make sure it accommodated rails so if the conversation with CSX ever came together we can then combine it where we could really make a difference for transit in the whole area and provide those opportunities uh I will say I met a new rep from CSX at the PE DC uh economic report a great guy had a conversation about some other things but this will be a conversation we bring it up at the Moffett groundbreaking I will say you know Mr Moffett just what what an awesome man what an awesome family he's got right it's a passion of what he's done to bring all this together I met him only a couple of years ago up in Tallahassee a few years ago actually and he was talking about the project he was talking about CSX with me and he really wants to see it happen so he's encouraged us to reach out to our state delegation a federal delegation and let's go get these conversation Google at CSX because I think everybody that I've talked to agrees if you get a rail line around the middle of a community a region that doesn't have Transit that sits idle for 20 out of 24 hours a day and they could provide an opportunity for better transportation and some we should be doing so they think we should need everybody in the room to go talk this through so as we go forward I'm hopeful with this new gentleman that I met that he might even be able to help to drive it back to the table because the TMA and had it will be headed Bob O'Malley from CSX presented here's what we can make available to you you know they pulled it back I know that's what I'm saying so so we need to take a different approach and now I think we need to get the legislators state and federal to put some pressure to put some conversation about how important this is and how we want to get this together one way or the other and hopefully they'll just come Cooperative cooperating better than they have in the past year or two and that's really why uh commission Weightman and commissioner Bradford I wanted you to
1:37:41sit on that TMA sppta just to drive this point through because it's right in the middle of both your districts are both the key points of all of it so if we're all pulling together and you guys are from the from the home District Commissioners I think it's going to be get a better opportunity um commissioner if you may if if there's someone around who's uh a nice person to talk to at CSX we have a a little problem with them as we're working on the extension of rangeland Slash Tower so we need to uh definitely get him in the loop of the discussion of uh what they think their little sliver of property is worth I will share the converse the person with you I'll share the contract okay um tourist Development Council had our my first meeting with them it was a great meeting I'm very very pleased with the people they're they're energized about getting things done bringing hits and beds and and working to improve the whole County so that was an awesome meeting on pedc the Pasco Economic Development Council and the TV Tampa Bay Builders Association both had economic report meetings and thank you commissioner Stark for bringing the Builders Association to my attention because that was great hearing one was phenomenal and hearing two even better than that the information that came out I thought was very informational it's not Doom and Gloom it's this opportunity still and Pasco still has great opportunity our County Administrator was there as well you probably yes he was I saw him there he text me some on your right on your left so with those meetings there's one thing that came out that it was a significant change from what I heard probably eight to ten years ago and you might have heard the same thing it was years ago that the Millennials did not want to own their own home and at the tbba they clearly showed 95 of our Millennials coming up the largest population segment coming wants to own their own home so just keep that in mind as you're looking at everything but you can't afford it well and but and I say that just to to think about between Apartments between those two groups don't fit that segment's population and that was what a lot of things were talked about years ago and I think that's where we were driving now that we're seeing this different it's time for us to rethink and again with with the great ideas everybody's bringing up here it's now time to rethink what's going on a townhouse if you get in the townhouse and you own the townhouse guess what you get a chance to build for inflation are the costs that you can go from the tonnos to a bigger house so I think with all that we've seen and all we're seeing right now this is a good time to build let's go take a close look at what we want to do and how we want to thank for
1:40:24the future so I'll appreciate all the new energy I guess I'm a Millennials so you're lucky you have a millennial on the board there we go Maybe [Laughter] a date range I question it but you're right there and you're right in the middle and you're right in the middle with your family you're doing awesome so it's good all right um I want to talk about the homeless population I will say Catholic Catholic Charities got a great idea we had code enforcement people out there um Community Development Services out there all looking at trying to make make some things happen and I'm encouraging we've got some opportunities that could be coming up to take a look at but I do want to say when you talk about Code Enforcement Officers I need them working very closely with the Sheriff's Office I had one right now from a from a property that I know has had people in the back I've got a development with Alf coming in in the back when the ALF was doing surveying work they had homeless people there with machetes threatening the survey as they left we went back out there with code cleaned them out but I'm here to tell you from the email I got just today and I put you on it Sally uh put Mike on it put the sheriff on it uh code enforcement team Sheriff's officers so I got everybody in the loop and Kathy's going to be included from here through it's like we need to go get those guys to work to get those people out that are dangerous Jack I had a meeting yesterday with the sheriff and his team and um matched to him that our Code Enforcement Officers will not be enforcing or going into homeless camps anymore without deputies present some of them have guns yeah it's it's like we don't want to put our people in danger I mean they feel they feel scared enough frankly at dusk working with the panhandlers when some guy maybe as one of the code guy says he could be high on drugs he's fired up yeah I don't want my people in danger from that and I don't want to put our people in danger either but the reason I'm bringing it out to everybody here is it's tough for me to like share it without commenting on it as I go forward now if I just touched it and sent it to you I may start doing some of that I may send you a whole list of the emails I've got over the time but it's a problem that can get fixed there's going to be some solutions out there but we just can't have people destroying business owners business by coming out front one guy did the bathroom right in his driveway not long ago they don't they don't be scared about their business well get the business hurt because people don't want to go by just like we've dealt with down at the Cracker Barrel in Leisure Lane so that has a comment and then I want to do it after okay so we need to we need to work on a close but good commission thank you chairman
1:43:09we brought this I don't know how long it's been brought up to I forgot who who we brought it up to but I think it's time you know pasco's changed unfortunately and our code enforcement folks need to have the ability to protect themselves and I think they need to carry the tools that's needed necessary to protect themselves or protect what they're out there making a service call potentially protect other folks that they're interacting with what level of protection they need to have or warranted to have I think that County staff needs to determine that but no option for me is is off the table to keep coating our code enforcement folks safe that keep them they go to work and they can go home to their families and uh I think it's necessary a set of directors from this board to to tell staff next you know whatever trainings need to happen that they have the tools they need to protect themselves while out on a call at any given time uh from whether it's other laws to Narcan so Hernando County as a rule ordinance I'm not sure it is it's an example is out there Hernando County allows their County staff to carry on the job so I don't know and I'm not saying the use of of firearms I'm saying what whatever whatever tools pepper spray you name it whatever's appropriate for this job for for our code enforcement to protect themselves to do the duties they need to I'm open to any and all options to hear and would like to see something in action sooner than later because this is something I've brought up the staff obviously it doesn't sound like anything has transpired from that conversation uh and I think we need to have a sense of urgency on on this matter so the if I can weigh in here for a second I I believe there are statutory limitations on what our code officers are and aren't allowed they're not Law Enforcement Officers first of all um secondly in terms of doing something yes extracting them from the situation right now is the right thing to do they are not Law Enforcement Officers period And so you know they're there to enforce the ordinances that the board has that the board has passed so believe me we take safety of our employees very very seriously which is why you know after last week's incidents I told them we're not going in we're done and you know until until there's until there's something better uh in in terms of how they can protect themselves I mean we we follow State Statute and and that's that's what we do so you know if there are other Alternatives we'll we'll certainly look into them but I think in terms of of allowing code officers to carry things directly we may have our hands tied in that regard but but again you know we extract them from the situation there's there's really nothing
1:46:07worth sending their lives into on on any of that so I do appreciate the boards uh support and confidence now that we take their safety very seriously as well and so we'll we'll continue to do that I don't know if Sally if you have anything you want to add to that Sally uh thank you um Commissioners and Mike Mr kobala for your Insight we had several incidents within the past week that really elevated the concerns we had already commissioner Weightman looked into what can the code officers do to protect themselves in these situations um you know even the individuals that they're working with advise them just the other day be careful there's weapons back there so when they contacted me of course I kept Mr Kavala in form it is incumbent upon us to make sure that they're protected and based on the information and the feedback that we've gotten from law enforcement officers and and some others is that by law they are not because of not being Law Enforcement Officers they cannot carry anything that can be perceived as protective weapons or anything we have gotten them some Narcan um coming in because we've got them going into situations where uh they're dealing with fentanyl have been located in certain locations so we are able to do that but right now we don't have anything by way of giving them to protect themselves so in our discussions with Mr cabal in my discussions with the team we're going to pull back them for their safety and we have now scheduled meetings with law enforcement to talk about a safe process moving forward with moot caring for the boards directed with regard to how do we handle encampments so as I said when I this this latest one that was up on Hudson on 19 no very very familiar with the area and again I think code and the sheriff's office cleaned it out I'll say three months ago that situation having them come back again just blatantly coming in um Emilio I think it was sent an email back saying don't go out there until you get the sheriff's office now I'm glad when I send my email out I put everybody on that list so that everybody knows we've got to work together to solve this so it's going to take the sheriff's office with us to make this happen we can't have our guys in danger and commissioner Whiteman I appreciate what you want to do to protect these guys but maybe it is going to be the the sheriff's office with the training they've got experience they've got et cetera they're they're up to it and we'd have to worry about that but they can be there to to work together it's going to take working together to to get these people where they shouldn't get out of the areas they shouldn't be in Mr Starkey um yeah 100 don't want our code guys going in there without the sheriffs but I but 100 don't want to stop dealing
1:49:26with the situation because we let we let it be known okay we're not going back there you're on your own that's just going to grow and fester so it's it's just that the way we're going to deal with it we're I mean we're gonna have to find a way but we can't let that situation keep occurring but I I want to um I ask you because I have I have it going on in my district they're back again on 19 and Moog and the owner of that property right on 19 lives in Thailand um the agent so I looked him up on how they're paying their taxes um with the code guys we were all trying to figure out how to deal with getting these people off the road because they have not signed the no trespass sign I mean get out of the property I mean they have a whole village there um um yeah it's unbelievable and so I literally called the I guess the guy's niece who's in LA and said we want to send you this no trespass form and we need you guys to sign it so we can kick these people off the property well every time we send it they send it back um like it wasn't delivered so I said we either I think we need to hire someone in Thailand to go knock on the freaking door and and have the and give give it to the guy I'm sure there's servers that we someone said I'll use my contacts at the state department but what is our recourse I know that we had um another incidence if you remember behind the Walgreens in 19 and Trouble Creek where they were living in that little sliver of land and they had to close down the well because they contaminated with fecal matter they had to shut down my our drinking well for the area and we were able to get the guys attention by citing him for operating a campground without a permit so I would ask um our attorneys if this owner is out of the country and he won't sign this trespass agreement can we start citing him for operating the campground what are the rules as far as sighting our County attorney provided us six months ago with a whole list of things or violation you can't go the bathroom you've got to have facilities you can't be living there so maybe we before before Christy left she gave the board an entire list of things that code could cite property owners for whether or not even if you can't find them well you're going to have to get service on them at some point I mean that's the problem why can't we just bill them start citing him if he's not here because you don't get then you have no due process how are you gonna you're gonna go into a into a court hearing and say yeah we didn't tell them but we want you to start living fines okay so you know the Scientology thing I don't want them spying on me now but you know how
1:52:25they're trying to serve David miscavige I think that's his name and he's avoiding his um his avoiding uh accepting his serving how many times do we have to try to notify this guy who is still paying his taxes we know where he is we know his family and they avoid it um before we can start citing him or is it just never there are there are ways to get service on people any place in the world I know our code people want to go to Thailand the question is whether or not you want to if it's important enough to the board it's a financial commitment but it can be done right we can can we hire we can hire someone over there to go hand it to them is that the best yeah you can I mean it it's you should see the Village Drive down 19 look at the right just before you get to move I've watched them riding their bikes out of it yesterday the the property is not is owned not in the corporate name it's not owned by an individual yeah pretty sure it's an individual he wants to sell it we could buy it well there you go it's one of those deals where we can buy it and then determine it's done Mr chair commissioner Bradford Jeff could you uh do me a favor and provide that list sure yeah I'd like it again too yeah commissioner wait a minute send it to everybody but if you can't serve them then basically you can't do anything so the list is moved but let's let's let's let's take that road commissioner I think we need to change the state statute that's not a state statute question that's a constitutional due process [Laughter] there's a way to change that but I'm not sure that I'm not sure okay I'm gonna look all right so can we take a look at what it takes to serve people even in Thailand it's the limit yes maybe we can bring something back to us about doing that because we have a whole bunch of trouble properties like this that if we did this once and for all it may may give us a solution we need and they won't so can we serve them in L.A mm-hmm we can serve them in L.A because it's a limited it's an altitude if it's if it's a partnership you can serve the registered agent with process in absence of of the owner we like to you know we generally advise code to to serve a real person but in the instance of instance of Corporations or Partnerships that's why the Secretary of State's office lists a registered agent okay very good done with that subject um I want to talk about uh I'm seeing a lot more I think others have mentioned this but I've seen a lot more trash on
