okay i'll now call back to order the pasco county board of county commission meeting of september 6 2022. please silence all electronic devices and mute your microphones we will proceed with public hearings starting with ordinances p 70. item p70 was published in the campaign times on july 6 2052 and the tampa bay times on august good afternoon commissioner sally sherman assistant county administrator development services we bring before you item p70 an ordinance by the pasco county board of county commissioners amending the pasco county land development code section 602 john ben hale village villages of pasadena hills stewardship district revisions to tax table and exhibits tax revisions to section 602.08 m impact fees mobility fees and development fee surcharges and section 602-10 via voph transportation analysis table revisions and exhibit 602 point c transportation development fee schedule revisions to exhibit 602 d property owners credits map and table amendments to exhibit 602 e master roadway plan add new cross section 60 double a and revise illustrations of cross section 70a to include family bypass and amend other sections as necessary for internal consistency provide for applicability repeller severability and inclusion into the land development code and an effective date for pdd 22 0369 commissioner district one no action required please we're asking that you accept public comment no action it is required by the board of county commissioners as this is the first of two hearings and the second hearing final adoption hearing will be heard held on october 25th 2022 at 1 30 p.m in the newport ritchie chamber we'll now hear a presentation yes i'd like to hear a presentation good afternoon um the stewardship orders actually has a companion comprehensive plan amendment as well because there are the master railway plan is part of the stewardship land development code and now the the improvements on that are also reflected in the complement that will come later yeah um next okay um next we've already done this we've already been reading the ordinance next um i actually was asked to present joel to and pat gasway they actually wanted to give the presentation i did the presentation they want to actually go over it in detail so i'm going to turn it over to them and see if there's any questions that they can answer as well you know what my question's going to be i'm looking uh joel two two and associates along with mr gassaway at height design we represent the two stakeholders this is a cooperative effort between two

substantial voph stakeholders and the county this is actually a county application and just by way of background there actually are four companion items that you will have coming through your agendas between now and october 25th the first two items are on your agenda today because they are the two items that require two public hearings including a cpa transmittal so today you're going to see the plan amendment transmetal which is a subsequent item on the agenda that's on consent presently and the land development code amendments the long story short and then i'm going to turn it over to pat to give you any details or answer any questions long story short is that the impetus for this primarily was a financial plan update to serve as the basis for the intermediate road network that we need to construct so it's an update on the financial plan analysis but while we were doing that over the last couple years since the last update there were some master roadway changes that either third parties or the county transportation department wanted that we agreed to add and then all the other provisions really relate to the implementation of the new financial plan update and then so that financial plan update is the third item you'll be seeing it only requires one hearing by the bcc and that's october 25th so on october 25th the plan amendment and the land development code amendments will be back for second and final hearing on the same agenda with the financial plan update and then most importantly the fourth item is an item i've mentioned to you on two or three prior occasions we have a global development agreement where the same two master developers have agreed to pre-fund and construct a large tranche of voph roadways and utilities in the heart of voph to try to kick start the infrastructure there to get several projects uh off the board so with that said we're prepared to give you as much detail or as little detail as you want on first reading because you will see all these again you're not taking any final vote today it's just a first reading but mr gassaway does have a powerpoint presentation if you want to see the whole presentation or if you just have questions then pat will answer your questions i'm quite sure so i'm going to turn it over to pat and just let him know whether you want to see the whole thing we don't want to consume a necessary time or he can answer questions and if you have any for me i'm happy to answer those um i just have some kind of general questions i think do you have any round are you utilizing roundabouts in here or red lights that's for mr gasoline because we can't we can't tell in there

i can't tell if these dots are roundabouts or mr two um has effectively escaped the answering the the question the answer is uh it is up to the developers during the implementation we'll we'll go through the the design process of each of those intersections as they are developed so for example um the the intersections that are in in the examples in the master roadway plan are designed to be able to reflect the rights of way that would be necessary if it were not a roundabout and if we were to consider a roundabout then obviously there would be details associated with with the creation of that intersection for the appropriate transportation movements at that time so it's a little early to tell just i was looking at um some of the designs in another development not yours in the area and it it had these i guess in our bike lane maybe golf cart pass that ended up pushing you into the lane at the intersection it was did you did you design those we did okay we can talk later because i want to try and understand how those function okay um but that's why i was wondering with if you have rounded bounds just and i see here in the trails it says meander it does although the picture doesn't meander yeah the pictures rarely do but uh there's there's actually a uh an incentive for the developers to to meander those because it creates a far better aesthetic and allows us the room to be able to include landscaping partially in partially out of the rights away so it creates a better product for those that that want to to try and use that and are you going to consider this community these communities a golf cart communities yes ma'am so are they going to be in the road or are there separate paths for the golf course both in depending on the type of roadway the two-lane roads will have uh and the alternative transportation lanes within the road bed so two travel lanes for cars two travel lanes for the alternative transportation and then curb lines and then grass areas for trees and landscaping and then the in this recent update uh we're reflecting eight foot sidewalks uh in those two lane roadway sections when we move to the much larger roads when we have four and six lane sections those are the roadways where we do not allow the golf carts within the road beds they are out separately on much wider multi-use trails so they're they're in these typical sections for the master

roadway that you you'll be adopting they include those as the the roadways are are more highly used and have higher travel speeds we take the golf carts out of the roadways that's the one where it says seven foot plus five foot um actually that's a two-lane road that's a very particular two-lane road uh called hidden creek boulevard what i'm talking about is the 142 foot wide and greater typical sections where we have four and six lane facilities okay i and whatever i opened up it's it's not in there good well i like that cool um commissioners any other questions check down there okay so no action is required by the board this is a public hearing would anyone wish to speak to this item okay and i have no one on webex for this item right then uh seeing that one commenting we'll move on to p72 item one oh sorry p71 item p71 was published in tempe times on july 20th 2022 madam chair members of the council my name is ed zodian i'm planner with long range about it before you is an ordinance amending the pasco county comprehensive plan providing for a small scale comprehensive plan amendment to the future land use map 2-15 and sheet 5 from res 1 its residential 1 dwelling unit for gross acre to res 9 residential nine colonials per gross acre on approximately 19.231 acres of real property located on the north side of shady hills road and the south and south of the intersection of crayola drive and providing for additional tax amendments for as necessary for internal consistency providing for repealer severability and effective date i'll be delighted to answer any questions this matter does come to you from the lpa with the unanimous recommendation of approval um i think the applicant is here we'll let her make her presentation unless you have a question for staff no okay barbara will height 6327 grand boulevard newport richie 34652 for the applicant and we'll just let you know that we did reach out to all of our neighbors on a couple occasions trying to solicit their input and we have not received any public comment planning commission has recommended both approval of this complaint amendment they've also heard the rezoning the companion rezoning to mf1 as well and they've recommended approval of that as well i do have my team here if we have any particular questions i know we've met with mr mariano and i can he wants to jump in or i can jump in with some of the things we've discussed um either way we can uh if you bring it better yeah i'm going to go over the items we've discussed sure sure so today is just the complaint amendment

and staff's recommending that you approve the comp plan amendment we have to come back with the rezoning and that rezoning and we're coming back um i have to remember now i talked about like two different projects today so at the beginning of october we're coming back with the rezoning but in connection with the rezoning commissioner mariano asked that we look at a couple different things one is to coordinate further with the school board we did have a beginning conversation with the school board to talk about connectivity kind of a unique unique location here on shady hills road we have an elementary school as our adjacent property to the east mary jayala elementary school so we want to talk about whether there's whether they would prefer to have a direct connection through our project so that's one thing and then we have to our north not adjacent to the north but to the north north of adjacent to corella which will be our access there is a middle school cruise lake middle school so we're going to be talking to them about the connections there now specifically we talked to the commissioner about the fact that there is a sidewalk that within shady hills right of way that comes down to krella from the middle schools all along the middle school and then there's a gap from krella through a piece of property that's a single-family home parcel and then our property and then mary jayela there's a gap between mary jayla along and then their the sidewalk picks up as it goes down shady hills towards the suncoast parkway so we are going to look at trying to fill in that gap our project is required along our frontage by code to put in a five foot sidewalk along our frontage the request is to look and see if we can make that an eight foot path as well as making those two off-site connections beyond our project so that there will be there would be a sidewalk coming from suncoast parkway all along shady hills up to cruise lake and so we're we're starting that process our engineer looked at it there is a pinch point as you just come off of our north property line that right away really the extra right-of-way narrows down so we've got to take a look at that but maybe we'll come up with something where if we have to narrow it i think we use that language on the other project that we did on hicks road not too long ago so we will look at that and then we've also been asked by quite a few of the commissioners to talk to the community development department to see what opportunities there are we are obviously close to the schools great opportunity for teacher housing to

see what different ideas we could have and what programs might be available that the client could research and evaluate so those are their are working items did i catch everything commissioner did great so i think it's very important for infrastructure to be in place as the school comes in i don't expect them to do everything but at least all around their property connecting to these two schools if we're going to move up the density this much i think it's appropriate to ask for it now i'm glad you're bringing up because it's obviously it'll come up later but this gives you time to actually work with the school board work with our staff uncomfortable if staff thinks they can give them uh impact fee credits for build nuts path the extra distance that's fine but i think it's something that's that's going to be critical for that area to have it i don't expect them to all the shoulders on them but at least it's this one phase if we're going to go this way then let's make it as best we can for the kids because right beside of this industrial property to the south that industrial property trucks right around if they have a place to go in the northern part they can connect from one school to the other so whether teachers live there firefighters first responders everybody can walk back and forth to the school get back from there get there safely and if you can work with the school if they need a turn lean in which will make it safer for them to get the traffic in there that's great so i appreciate you covering that stuff and i know we're not going to get the detail with it now but as long as staff hears those things they can prepare for it and and work with them on it commercial marianna i agree when i had my meeting with them i also noted the connection opportunity there to the suncoast trail and i don't know if there's an opening there but certainly we should work to have a pedestrian opening there and as this neighborhood fills in kids could easily ride their bikes to school and employees um it's not their property to the north but i wonder what the school district uses that that that entrance off of crella for did they mention that the planning commission i listened to it but i don't know i don't recall them saying what what that to the elementary school whenever i've gone there i've always come in off a shady house yeah my understanding is everybody comes in off of shady hills yeah traffic um for the school so i'm not sure so maybe there's an opportunity to partner with school district on

getting from that corner up we definitely will meet with them in person yeah okay anybody else have any questions and it's a great location for what you're doing so uh is there anyone in the public here that wishes to speak to this item do we have anyone online we have no one online for this item i'll take a question soon no one more approval second all in favor all right i will call sorry district one commissioner oakley district two commissioner district four commissioner fitzpatrick uh district five commissioner mariano uh district three chairman stern aye okay p72 item p72 was published in the template times on july 20th 2022. good afternoon commissioners item p72 is a zoning amendment we're asking for continuance it's the denton place mpud master plan unit development dca timber llc a rezoning request from an ac agricultural zoning district to an mpud master plan unit development district to allow for development of a maximum of 804 residential unit and associated infrastructure on approximately 306.7 acres this is pdd 22 752 7582 district 5 the continuance we're asking the board to approve a continuance request to the september 20th 2022 bcc hearing at 1 30 in newport richie okay this is uh on continuance can i get a motion to continue i'm going to move to continue and i want to check with the county attorney if i can have a discussion on it quickly a second sure you can discuss it under discussion all right i would like you to work very closely with developer we talked about sidewalks in the area we also talked about hicks road before as i look at the maps seeing for the first time of this agenda item they go right to hicks road and hicks road's a property that we want to eventually connect north-south and that's right alongside where the industrial park is going to go with new york avenue you're going to get traffic it's either got to go out by they're going to have to come down denton avenue go out to a little road head south come back in on new york swing back and around it's going to make sure for some major traffic maneuvers i would like us to work with them use an impact freak first if need be as it's off site to make sure that road gets built with a trail going alongside it the traffic down from going to the hudson high school not only did i go to kitten trail where this will connect to but also to the south the traffic is extremely uh

busy down there half hour delays just to get into school school but it's only got so much flexibility so if we're going to look at the development coming in with this much density i want to make sure that we can put some infrastructure things and and these impact fees are designed to you know indicate the impacts that are coming in for new growth i think it's an opportune time to actually take a close look at this so if you work with them on that in the school system i appreciate that yes herself noted okay all right so this is a motion and a second to continue all in favor aye aye okay p73 and now we need to have the instructions yeah there are two rezoning agendas regular and consent staff will present each application to the board of county commissioners if staff for planning commission has recommended approval and there is no opposition the application will be considered by the board without further presentation if staff or planning commission is recommended denial or if there is opposition to the application the applicant will be given five minutes for presentation the opposition will be given three minutes for each individual or five minutes for a group representative and the application applicant will be and the applicant will be given three minutes for rebuttal any individual disagreeing with staff for planning commission recommendation or anyone wishing to object to any condition of the rezoning may at this time request the position be pulled from the consent agenda in which case that application will be heard under the regular agenda later on during meeting otherwise all rezoning applications on the consent agenda will be approved by a single motion and vote if you wish to speak to any petition please give your name and address and whether or not you've been sworn for the record these are quasi-judicial public hearings the law in florida is that mere public support or opposition of an application is insufficient for this board to take action please limit your comments to those criteria found within the board's land development code madam clerk would you like to swear the public in that'd be great if you are here to speak on the remaining items please stand and raise your right hands do you swear or affirm the testimony you're about to give is the truth so help you god thank you okay okay a ginger item p73 zoning amendment it is a consented item it's consent item 54 crossings mpud master plan unit development callswell avenue properties llc a substantial mpud modification request to add an additional allowed
