good afternoon and welcome to the afternoon session of the february 22nd florida county commission meeting a reminder for everyone to please silence your phones and we are going to go to sixty item p sixty was published in the tampa bay times on january nineteenth twenty twenty-two okay um we have a go ahead it is a continuance requested but good afternoon uh victorious peaceos planning development department item 360. is an ordinance by the pasco county board of county commissioners establishing a temporary moratorium 180 days on the submission and acceptance of applications for building permanent site plans special exception uses conditional uses rezonings and comprehensive plan amendments proposing to increase entitlements within them within the moratorium areas providing for authority legislative findings effect definitions moratorium areas temporary moratorium imposed duration of temporary moratorium moratorium and severability this is being requested for a continuance of the march 22nd 2022 bcc meeting in newport richie this is the airport zoning temporary moratorium chair was this advertising continues i believe it was all right move to continue second all in favor aye opposed okay then we are on 61. item p61 what um could you publicate okay item p61 was published in tampa times on january 19th 2022. and i'll read the introduction p-61 is an ordinance by the pascua county board of county commissioners establishing a temporary moratorium 180 days on on the establishment or opening of any new or used car truck or van sales business within the unincorporated area of pasco county providing for authority legislative findings effect moratorium area temporary moratorium imposed duration of temporary moratorium and severability no action is required today's is the first uh yeah so we will uh see if anyone has signed up to speak to this item no one has signed up on the sign up sheet i don't know if anyone is in person who did not get to sign up ask a thrift sign okay and no one's uh online so um and board members just so you know we are working on a stakeholder meeting as we work on the ordinance on this ordinance and we will include both used car dealer representation and new car dealer representation we've had quite a few joint phone calls and uh everyone is on board with uh moving forward
3:08commissioner mariano yeah i did no you want me do it again no i want you to do it the first time i did did any is there anyone here that wants to speak to this ordinance i'm sure i said that didn't i okay yeah i did we're good now i didn't i'm sorry i didn't hear it i'm gonna look at the team okay commission mariano thank you madam chair and i know how this all started was the used car dealerships up and down especially on 19 that have just abused our codes and doing what they want out there that that looked terrible and it's been an ongoing problem and i think we should focus to fix that however this moratorium discussion right now you've got one dealer in particular has got a 50 million dollar investment scheduled to open to possibly shut him down or delay him yeah it's not affecting him hang on let me just let me just carry on through what i want to say um if there's any possibility it slows that down or the perception that others will have that it's not a good place to come to pasco county because we're working on these things could be devastating just as image this uh resolution the way is written there's even a clause in there where they first of all they don't spell the word manner correctly they spell it m-o-m-a-n-o-r instead of m-a-n-n-e-r but it talks about having too many in too many vehicles in inventory causing a problem in the county completely a false statement because most dealers don't have any cars in the lot that are new anyway so i don't think we should be looping and used and new together with this ordinance because you're you're going to affect a business that brings tremendous tax base it's bringing jobs for investment the demographics for the people in the industry are making a lot of money right now across the board both ways i really i've heard from people in the business that own dealerships etc building going to build thinking about building and everyone i'm talking to is afraid of what we're doing here now i know you're going to call for another meeting and and do a stakeholder meeting but i'm i'm just saying the image that's out here is putting us in a dangerous position where i don't think we have a big problem just because the used car dealers are are behaving badly we need to go after them strong i mean we need to go put the mention to every one of those used car dealers that's not following the code et cetera that you're going to get fined and unlike the construction board which will take away fines when people come into compliance
5:42we need to go put deadlines to these things to go put the hammer down to enforce our rules our codes on them not affecting the new car business all right i'm going to let elizabeth blair speak to the issues that you brought up because we've had we've brought everyone on board so go ahead and elizabeth elizabeth pascal county attorney's office um well first off there is an exception to the moratorium in here and i'll read it to you it's in section four it says the only exception to this moratorium are vehicle sales businesses that have an approved site plan and are operating in accordance with the approved site plan and any county approved amendments to that approved site plan this was purposely crafted this way to allow anyone who's active in good uh following our code to be able to go forward this does not stop any good actor from operating their business from opening the business as long as they get an approved site plan which is part of the process so folks that are these large new car dealerships they're going through the process correctly they won't be stopped whatsoever by this ordinance for those that are not good actors and need to come into compliance it allows them to come into compliance it's not a prohibition on them submitting site plans or building permits or whatever they are missing that's getting them caught up in code compliance so it was crafted in a way where only the bad actors are being stopped from going down the street and opening up a business that they shouldn't be opening and as for new and used inventory there really cannot be a legal distinction that i can make because a car is a car the impact of the dealerships can be the same regardless of the status of the vehicle and oftentimes new car dealerships also sell used cars and it's often questionable whether a car is truly new if it's been used by one of the employees or so forth so it's kind of a hard line to make so yeah and we have had multiple um phone calls with mr fink um talked with the attorney representing furman's we talked to the architect um an engineer who's designing most of these new dealerships we've talked with really all all the guys and there is no dealership that is in the pipeline about to open about to submit that will be affected by this and we think it's such a a pretty simple uh rewrite that we think is that they'll have a vision to the existing regulations that we have and the meeting that the commissioner was referring to is actually a meeting not to discuss the moratorium ordinance but to actually work on the ordinance that we need to draft and i consider it to be a very small fix and in fact the reason we're working with the stakeholders is
8:22because they have the industry knowledge as to what's the appropriate park or park product to be on they have obligations under their franchisees agreements and so forth where they only could have a certain amount of inventory anyhow so we're going to take the rules the industry uses and put them in our code so wise to everyone yes and once we've been able to explain this um which i get is a little complicated they're all on board because it's not fair to them um with their investments that they've made that the other ones get to do what they're doing so um we you know after discussions there they are on board so well i'm going to say it's actually already in place if i could mention i mean i've had the discussions in the last two days with them and the people that are either kind of building or in the process of building even the people just have established don't like it if we have the problem with the used cars and we do think this is an easy fix why do i need to go do a moratorium if i need to go fix this it's gonna be that simple i shouldn't be bringing the word moratorium out there let's just go go do the fix and bring it back why do i need to go put this moratorium in place because it protects us when we if you uh were you were around when we had the billboard moratorium and what happened when we were am i getting ourselves in trouble when we wanted to stop something instead we got flooded with billboard permits so we just want to for the next few months while we've announced that we're putting some rules in place we just want to stop that that from happening i'm i listen i a lot of these are in my district and we are not affecting anybody's new dealership and it will take just a couple months so and madam chair this moratorium will only last the length of it as it takes to update the code ordinance correct form the moratorium would would be repealed when you adopt the regulations that it's injured and again we're not stopping anyone anybody whether it's a used car dealer or a new car dealer from going through the application process for new dealerships and the approval and opening of those businesses yes yeah so if you're in conformance with a site plan and you're following the rules you're not affected yeah anything okay and there's no action today all right okay um in case terry didn't get to it though um because you stopped him oh sorry um no action is required at this time it's the first of two public hearings the
11:08second hearing will be held on march 8th 2020 at 1 30 p.m in dade city okay and um does anyone want to speak to this ordinance well no we already did that we already did that yeah p62 yeah you're on p-62 it's just that the next hearing was not announced okay item p-62 was published in the tampa times on february 6 2022. thank you patrick moore with the pasco county attorney's office p-62 this is a public hearing it's a first and only public hearing on this matter i'm going to read into the record the title it's an ordinance by the board of county commissioner of pasco county florida repealing pasco county code of ordinances section 82-1 roadway solicitation and commercial use of public rights of away prohibited and replacing the section with regulations relating to dangerous use of public rights of way providing for the prohibition of stopping or standing by pedestrians and a median providing for the prohibition of physical interaction between a pedestrian and an occupant of a motor vehicle that is not legally parked providing for the prohibition excuse me the prohibition of commercial use of public rights of way and providing enforcement penalties and remedies for violation providing for applicability providing for repealer providing for several ability providing for inclusion into the code providing an effective date i'll open this up for public comment if there are any madam chair um yes i i'm just glad we're doing this yeah we need it done i know when i first came on the commission it was mostly it talks about the west side right it just was well guess what it's it's moved on over it's we have we're seeing quite a bit of that in um in my district as well even along the uh you know 56 corridor um so it's not um only again in the west side of the county it's it's spread out i think we're getting a lot of people from uh hillsboro that are moving kind of cross the county line and uh coming into the and to the wesley chapel and lana lakes and lutz areas as well so i mean kudos to you thanks for working on this i know it's going to obviously assist and help the sheriff's office as well because their hands have been tied so i'm sure they're very appreciative as well as we are and i see some citizens nodding their heads going we like this so commissioner mariano and then commissioner fitzpatrick yeah thank you you know i'm so appreciative lee county actually brought this thing forward to actually make it work and patrick thanks for working with uh our staff jeff thanks for helping move this thing along because this is a very very important ordinance it affects a lot of different
13:58things safety is number one i think you had the video i sent over to you that shows a guy walking in the middle of cars on us19 um all the way through looking for it there there are street corners everywhere you hear some of them talking about making 600 a day doing it uh one guy watched some guy finish with a day got through doing his panhandling got into a new cadillac and went away but here's a guy just just the other day right down on us19 you put can play play it was so fast you couldn't catch them on camera technical difficulties all right so while while she tries to get that up um who can enforce this patrick and by the way thank you so much for bringing this forward certainly absolutely um yeah so so according code enforcement could potentially enforce it but the main enforcing tool would would likely need to be the sheriff's office um but just due to the safety concerns of enforcing it along the roadway the potential that it could be enforced upon interactions with the drivers and pedestrians um you know obviously that's that's a question for the sheriff's office and and the sheriff as far as what they intend to do and the way it's being enforced and what resources that they'll spend towards um enforcing it so i think the sheriff's office um does have the ability to enforce that okay i mean i plan to draft a letter from in my district for all the people at either have reached out to me or the civic associations out there let them know this is now in place uh i would like to see my code enforcement office in my district focus on this for like the next 90 days i mean anytime they see something anytime they get a call on it they go out there they let people know what's going on just to like nip this early and i think it'll solve it quick if we just kind of like let it linger it may not be so good so if our code people can go out assist with the sheriff's office so be it i think it's something that if that when the people know they can't do business in the middle of the right-of-way i think they stop i think that's that that will solve the problem when the when the source goes away with the of the money i think this this problem will get eliminated a lot quicker and what this ordinance does is it it it makes it regardless of the reason why someone's in the road right regardless of the reason why they're in the median um or interacting with vehicles it it's dangerous so regardless of the reasoning for for that occurring it makes it prohibited so yeah and i talked to pat
16:39phillips i think sally you had a meeting with him a little bit ago about this type of thing and i think if we can alert the people who may not be aware this ordinance is going to take effect and the fact that they cannot do business some type of warning thing they can hand to someone that does it we don't want to give them a ticket we just want to give them a warning this is now illegal not to do it i think that'll help get the word out spread the word and hopefully this thing solves this issue commissioner fitzpatrick i'm letting them know that it's illegal for both parties um i think it's really important to focus on this also comes back with vision zero because when we ran the numbers for the top 10 intersections for fatalities and serious injuries for pedestrians and bicyclists so specifically to pedestrians we had 106 sets last year with auto accidents and pedestrians but 6 out of 10 of those top intersections are on 19. so really trying to focus on safety as well as stop the interaction between the vehicles thank you commissioner oakley yes i appreciate you bringing this forward it is something that needs to be done for a while on the east side i don't see it as much i do see it every now and then but it's not as bad as it is on the west side of our county but it's something needs to be done so i appreciate it and with that you know i'm looking for approval you haven't taken public comment yet okay excuse me once so last night last night the night before driving home up 19 to gulf harbors in the dark there was an elderly woman walking the median um and not you know dressed in dark colors and it was hard even hard hard to see her and then again just like you i had someone walking down in the middle of the road and uh you know us 19 has been labeled one of the most dangerous roads in tampa bay if not the the state not the country and um and i it is going to come your way so i'm hoping that i'm hoping that this ordinance can can help stop um the tragic um things that are happening out on our roadways but do we have anyone in the public that wishes to comment on this ordinance no one had signed up for this um in person and we have no one on webex okay commercial oakley your motion move approval second all in favor aye aye roll call vote district one commissioner oakley just waiting weren't you [Laughter] i need to get my script back district two commissioner moore district four commissioner fitzpatrick aye district five commissioner mariano district 3 chairwoman starkey aye okay
19:27p 63. item p-63 was published in the tampa times on february 2nd 2022. hi good morning i'm nancy fredricks libraries administrator um this is just to amend chapter 58 in the ordinances um that pertains to the library system uh all is we worked with attorney blair and just updated the terminology and we've referred to some current policies and it does have a creation of an article one which is similar to the parks and rec additional ordinance recently that you approved to establish stipulations for serving alcohol at after hours events at the libraries uh is there anyone in the public that would like to speak to this ordinance no one had signed up in person and no one is on webex second all in favor aye aye call vote oh district one commissioner oakley aye district two commissioner moore all right district four commissioner fitzpatrick aye district five commissioner mariano all right district three chairwoman starkey aye okay 64 will be roll call as well 64 will yeah okay i'll try and remember business hours we'll help you i was gonna bring a bottle of champagne item p-64 was published in the tampa times on february 6 2022. madam chair members of the board good afternoon keith wiley director of parks recreation natural resources back in 2016 the bcc approved the purchase of a 50-acre piece of property in gulf harbors to make it a neighborhood park in addition to that there was an msbu that was approved by the board 16-25 with the intent to fund that operation in front of you today at the recommendation of the county attorney's office is an ordinance that would be repealing 16-25 and just some highlights on the changes effectively the new ordinance states clearly that the msbu shall share the purchase price is limited to 600 000 interest will accrued a rate of 3.25 percent with the first assessment residents may choose to pay the capital costs upfront to avoid any interest and reduce their annual assessment this is important to note that the approval of this msbu is not subject to a vote by residents and it also clearly states that the msb will not be charged for the cost of managing nor maintaining the e-lamp conservation area i'm here with county attorney nicky spiritos if you have any questions [Applause] okay um wow i'm almost speechless here vicky do you want to come speak
22:34and then we'll open it up to the public good afternoon nicky spiritos county attorney's office we recommend approval all right thank you very much thank you for all your hard work but we'll we'll talk about that after it passes um would anyone hear do we have people signed up to speak to this we have three people who have signed up and i'll um call them in order of what of how they signed up we have skip geiger we have arthur haydike hey dicky pettigis is he here and then we have um diane kobernick hidden behind the chair so those are the ones that had signed up okay name and address commissioners my name is skip geiger and i live at 5017 dory drive gulf harbors florida and i'm here today to speak about p 64 on the agenda last month i stood before you commissioners and asked you to support with a five-nothing vote the takeover of the lindwick water and sewer from fugue this was an important project to our beloved community and i thank you for that vote last month today i stand before you again and ask you to allow our community to have the same thing that every new pasco county community gets which is required now from the start a private community park where residents can walk talk play in a safe environment and not have to be on the streets a group of residents that started down this road more than seven years ago trying to bring this to fruition with a derelict golf course this has been quite an ordeal we have been held hostage four years by a lawsuit while working out details that would protect our community from liability and supporting the county's wishes recently a gulf harbors focus group met with county staff members and of course our county attorneys to create this new msbu document that accomplishes that goal and that residents and county staff could get behind and support i ask you today for that same 5-0 vote for this to approve the msb ordinance and then also to vote to stand up the resident advisory committee after that vote so that we will be able to oversee the creation operation and maintenance of this important community park thank you i think that's mr hayde key next right yes that is correct okay couldn't see you behind the chair yeah let me get this down to my height here skip and i are you know like mutton jeff anyway uh my name is arthur haydeyke uh i'm a 14-year resident of gulf harbors uh live at 4417 florimar terrace and i was past president of the gulf harbor civic association it uh as skip had pointed out about seven
25:46years ago a small group of us began efforts to create a park from the defunct gulf harbors golf course that was in 2015 and a vast majority of the gulf harbors residents have agreed with the park concept our problem uh almost from the get-go was how do we pay for it it uh fortunately for golf harbors uh the county and this is the county commission had the foresight and and saved this project by purchasing the property uh from the owners using e-lamp funds it your actions gave us the gulf harbors residents time to formalize agreeable plans for funding one-half for the purchase price and provide an ongoing funding for maintenance and park improvements well gulf harbor's residents seem to have finally come to a consensus on a format for an msbu to fund these park operations and uh this msbu hopefully is a an item that can work for everybody uh it's been a long haul for this project and it's really time for us to make it happen we respectfully ask the commissioners to vote yes for finalizing our park efforts this is in fact the final development piece for pasco's premier waterfront community and will provide a tremendous asset for gulf harbors we thank you for all your past efforts on this proper project and uh we sure hope for a positive vote thank you thank you and now i think we have uh diane coburn diane covernick well okay okay all right [Laughter] oh before you okay yes now for her before before i heard i heard four [Laughter] barbara will heights at my personal address of 50 20 oyster cove and gulf harbors i'm proud to live there i'm proud to be part of this community we stand before you the county has taken the big step to purchase the golf course property and is now owned by the county and we thank you for doing that for our community we had no ability to do that on our own we only have a voluntary community association we don't have a homeowner's association we have no way to to get together and purchase this property and take it away from private ownership and the potential for development which is what i do so thank you for that we stand before you now with the assessment to bring forward the vision for a park and bring it forward but as we do that looking forward i think it is important to look back and a lot of the delay in getting to this point was the necessary cleanup of the golf course which the sellers paid for and i want to point out that it was miss kubernetes that pointed these things out on behalf of our community that to protect our community so when somebody stands up and says we were held hostage i don't agree with that i think the
28:38process moved forward i think we are where we are today and what i was able to do with the community and i was part of that focus group was to listen to the valid concerns that ms kobernick had brought up years and years of research factual items and i was able to say let's address these things in the documents that come before you today so we've worked for months as a group in combing through the msbu ordinance and the advisory committee resolution to bring forward changes that would protect our community and i did that side by side with ms kobernek and our community and we're proud to be here today we're proud that you're going to help us move this property forward that's a gem that is a gem our community is a gem and we thank you for your leadership and your support and we can't see what the future brings can't wait to see what the future brings for our community thank you wait barbara you just can't leave without me thanking you uh so barbara gave up many wednesday nights and this group came together and met repeatedly and i just can't thank you enough how you moved this this process forward we had many many phone calls between barbara and me and keith and nikki um working through all the issues that were brought forward from barbara through her and her group and um i think you know you just did your community proud and just i just can't thank you enough for what you did so thank you oh my goodness i would like to present these before we should receive a file all in favor aye thank you once you lower that mic that'll be better for you yeah okay so my name is diane kobernick i live at 5001 south shore um commissioners this msbu being proposed is a big improvement from the original msbu that was passed in 2016 which was challenged in court my objection to the original msbu were the costume what kind of control we would have over it it appeared to me to be giving the county an open checkbook there were 711 tons of contaminated soil to remove to bring the level down to the fdep defined as used for a passive park we are pleased that this new msbu will not be charging us for the costs that would have been included in the original one the new provision for an advisory committee drawn only from gulf harbors is a good step to allowing the community to have more control over what we are paying for although much improved there are still a couple of open items we are paying for half the purchase price and being granted some control over half the property
32:02we will also be charged for the maintenance for that half but which half there have been several boundaries seven different boundaries drawn in the past that history is included in your binders but as of today there is still no official survey showing which half will be able to use or even if we are truly getting half we don't know what we can do with our portion until we know exactly what we're getting and finally this msbu has no value if it is not enforceable the language of the msbu itself allows it to be modified and if the county can cancel the original msbu to pass this one what is it preventing the future board from just canceling this one too the county now owns it and will continue to own the entire property and can decide on how to use it this msbu do not change that fact hypothetically some future board may decide to develop and sell to the developer then all this work spent trying to safeguard the future would have been done for nothing it would even though the msb msbu calls for a restrictive covenant to be recorded this is being done unilaterally by the county and in my opinion what the county giveth the county can take it away however there is a solution to this which is to enshrine this msbu as part of a settlement in this current lawsuit which will then bind the county the county to honor these provisions in the future and take away the temptation for future boards to change them so i urge the board to table this for now and let's plug these holes so the community can get what it's paying for thank you very much for your attention thank you uh is there anyone else here who wish to speak to the msbu once you go ahead and line up if you want to come up up after this gentleman hi i'm ken dabbs my address is 4617 floor mark terrace and golf harbors i've been there 20 years i'm a little concerned with the legal notice for this this matter legal notice in the tampa bay times dated february 6th for for the intent to create this msbu states the information concerning this matter is on file at www.pascocountyfl.net so i went there it was not there now we've had this discussion with me several times about when i get a hold of different people in the county nobody ever responds so i thought i'd do it the easy way and just put in a public request so i put in a public request on february 11th giving them time to maybe they didn't get it in by the six i don't so i filed a public request on february 11th i received the following response from desiree wagner the proposed msbu will be ready and
35:26available next week so you said in your legal notice it was already there and gee you know what i finally got it on february 17th at 2 46 p.m if we're gonna put legal notices out there i just one thing i wish this commissioner this board would do is mean what you say and then do what you say because now i've had two business days to go through all the paperwork involved in this msbu and try to determine whether i'm for it or against it that's just not right just do what you say thank you does anyone else wish to speak yeah i wasn't originally planning on speaking but i think i just kind of like do a quick summary uh mitchell kobernik 5001 south shore um i kind of agree with that everybody had to say i agree with the people that were that were uh saying this is going to be a great project for the community i think it is too i think it's it's it's about time that we develop that golf course put something on it that the community can use and i'm very much in favor of that but i also agree with what diane kobernick said it needs to be done right it needs to be done properly a lot of time has gone by trying to develop this msbu so that it will protect the community give the community a buy-in to what can be done on that on that park and and what the cost will be and give the community some control over the future of it i think that's necessary um the way this current msbu is drafted as most msbus are they could be changed they could be repealed by a future board and if if that should happen two five years down the road what have we accomplished uh we are not safeguarding the future of this of the of this gem for the community as someone else said if in the future some other boards with a different makeup may decide that that's not the best thing for the community there's nothing here that will prevent that from happening short of having this done as part of the settlement of the current lawsuit or then it'll be in the court system it will be a settlement that the county will be bound to and future boards not yourselves but future boards that may have a different idea of what to do with this will not be allowed to just run rampant and do whatever they want with the park they will have to be bound by the provisions that we've all talked about today which is i think what we all want so i would also recommend tabling this for for now for a month whatever it takes to go ahead and get this msbu drafted properly and and enacted properly through through a court settlement so that it will bind future

53:07and there will be there would be a subsequent mpd associated with that so so to continue my questioning um i watched the planning commission meeting when this item came out you're watching tv um and mr goldstein you know he's not here now but he requested an economic analysis on this item is that what you guys are moving forward with what we're getting are you referring it to dave ingles yeah we're we're working on gathering the information that was requested at the local planning agency in time for the march 3 planning committee for lpa local planning agency because i was listening to some of the comments and one of the comments referenced that a apartment complex has generated the same possibly generates the same amount of employment as a assistant living facility which is night and day with the discussion was was no i would it is because i watched it and i heard that question answered and you answered it and he said yes the discussion there was the employment generation potential of the alf as compared to the project and the project itself i only got halfway through the analysis my take on the project where i did compare the employment generation of the apartment uses with the administrative and nursing staff of the alf then the discussion moved at that point but the applicant was able to clarify and fill up that with 45 000 square feet of additional office space being generated on that site you had a potential for a similar employment generation amount occurring on the site as if it as if you compared it against a potential alf facility so that that was the totality of the employment generation so you're following up in taking mr goldstein's request forward and moving that to david eagles group to get to the actual analysis we've worked with oeg throughout on that project and we're going to work on refining the information for the local planning agency with oeg uh and then also with the applicant as well and getting the economic analysis done by correct okay yeah thank you sorry madam chair i just i missed that because i didn't say the yeah i looked it looked a little different than the other engine items okay so um i'll take a motion does anyone want to speak to 67 p67 no one has signed up in person and no one on webex and it's a continuous movement second all in favor of the continuance aye opposed

58:42residing on our near buena vista including miss alexandria pappas gold who could not attend today due to illness ms pappas gold has lived in the area her entire life and she has been actively working to get this road repaved on almost for almost three years now as a newer resident to this area i couldn't imagine having to drive this road as long as some of the other residents have been driving it your fellow commission members have stated that this is one of the worst roads in the county if not the worst road um and there should be absolutely no question about the approval of this repaving residents should not have to endure the wear and tear on their vehicles that causes this causes them on a regular basis they should not have to endure the increase in gas costs to drive blocks past their home to avoid going down the road that they physically live on most residents drive past their homes on buena vista to bonita and back down adjoining roads to avoid the awful landmines of potholes and layers of unevenly poured asphalt not only is this an inconvenience but it's also an increase in safety concerns as this pushes additional traffic on bonita increasing risk to the excessive pedestrians that walk on bonita on a daily basis this including children who walk to their bus stop down these narrow roads every day this repaving will not only reduce the risk in two pedestrians on a nearby bonita but it will also eliminate the safety issues and increase of accidents on u.s 19. the drainage issues currently force motorists to stop in the middle of u.s 19 due to excessive water backup and create a bottleneck in the southbound lane leading to potential and unnecessary accidents and injury the residents of this area have voted majority yes for this repaving there are even residents in the audience who wanted to vote yes but didn't get the chance to because the postal service would not forward their mail we urge you to please vote yes in approving this project the residents in this area deserve to see their tax dollars finally put to use on something that's blatantly an issue in our area this area has become rough enough for us to live in with the increase in the homeless the increase in drug addicts somebody on the street and the increase in overall code violations and trash that's been brought into this area including the burnt down trailer we've been waiting for a year to be demolished the least you can do is give us a smooth ride home we appreciate all that you've started to do in our area to make buena vista and its surrounding roads a welcoming and safe place again this repaving will be a huge step in the right direction for making positive improvements in our area and the residents of this area welcome support and will partner with you and any efforts you bring forth to continue making this area we call home better
1:01:09thank you does anyone else want to speak to this so um board members anyone online no one's on webex um i attended the uh meeting the other night on on this paving assessment and um alex pappas who got this really rolling um she was there and i'm sorry i know she wanted to be here today so i'm sorry she's not feeling well it's an interesting road because at the at the front you have commercial um you have some restaurants and bars and you know commercial buildings and right at the intersection of buena vista and 19 you have this dip and so when they re redid us19 they they um pork the asphalt or do they use asphalt on 19. yeah so uh the the way it ended up there's there's a a dip and it is full of these potholes i've fallen into it in my car it can be terrifying if it's uh very wet and and so what she's referring to is you don't want to stop in that dit that wet ditch uh when it's really wet so people pull out further into 19. very dangerous situation so um the first thing that our staff is going to do is fix that drainage issue at the very beginning of buena vista and to the gentleman who spoke about this and also just to make sure everyone knows we don't collect any tax money with your ad valorem taxes to pay for this kind of road maintenance uh we do collect our second five cent sales tax which goes towards pothole fixes but that's just kind of money out the window down the drain down the street because the minute it rains it pops right out so we do have a program ainsley if you could speak to it real quickly for people of certain incomes and could you because this gentleman wasn't at the meeting could you just quickly and anyone else who may be listening i'd talk about that and then we'll call for the vote in each letter we include information about the ship ship program the state housing initiative program and that was included in the packet if you didn't get that information i can give you a copy okay ainsley it looks like to answer the gentleman's question it it looks like kibler lane takes access from buena vista in at least two spots and um it's a twenty-five percent assessment is that that's correct am i reading your map yes okay and and if he has some questions he's got a few more p basses but he can meet you after if you have more questions madam chair yeah for rangeley leaves i mean just for those people that are low income there's a certain level

1:07:18street but mr caldwell assured me that they're going to patch the hole in front of my yard and not with just gravel which they've done when they've patched the road other times they are going to patch it with asphalt and then put the two inches which i hope that works but i would like the commissioners to consider doing what they've done on other streets on roxbury street and on fairmont they have raised the sidewalks by the sewers so it gives a good five inches to six inches of water space so the water can go down into the sewer but hopefully yeah you have another minute and i see these writing that down so well they've already come out and looked at like in front of my house and throughout the whole street but the grass goes all the way down the street on both sides and the people that own the property in that we usually go out and scrape this off each year but when lawns are mowed it just goes straight down the street i have most of the grass in front of my house because it's just dirt in front of my house there's no sidewalks i do know the sidewalks are supposed to be four inches high it's probably just two inches the sidewalks yeah so but i would like them to consider at least raising the sewer system like they've done on the other streets in holiday lakes what they've done is they just bring it up like this and then it's flat on the top so it's just like a little raised bridge and that i'm sure they'll look at that thank you so much is there anyone else to speak to this there's no one on webex thank you uh no she said no all in favor aye i didn't hear the second who who said this okay thank you okay next item p70 was published in tampa times on january 19 2022. uh pw220046 c4 drive fifa's number three four six one one street is counter maintained its um estimated cost is about eighty five thousand dollars maximum cost per eru is three thousand eighteen dollars and twenty nine cents the discounted amount is thirteen thousand six hundred and twenty eight dollars and twenty four cents and the maximum cost per eru after the discount is 2513 and 71 cents there were 30 possible votes we received 12 responding to the petition that's about 40 percent some were in favor 58 or 5 were against 42 percent repayment is over 10-year period and the maximum sorry on the interest rate is 3.25 uh percent uh location map and a footer of the road condition these are all kind of in the same general neighborhood this isn't yeah madam chair yeah so if you're looking at the right side of the road it looks like it is raised about four inches or a few inches but on the left side of the road some of it's not
1:10:30raised so when they repave the road how are the sides going to go are they going to have that lip on the side no what happens is that when you repave you should be just slightly above the existing edge of the gutter so that the water goes into the gutter on the right hand side this is below so it tends to follow you know the road instead of going into the gutter so when we're done it should be just slightly above when the water runs off into the gutter oh i see on the left side there's a gutter but on the right side there's not a gutter it's just a raised no there's a brother but it's a little bit lower and if you have grass growing is there a pointer on this there's no gutter yeah there's a gutter yeah i see the gutter on the left there you go there it is okay there's the go there oh i thought that was a sidewalk no no no no no no no and this is the grass okay i see the sidewalk up there and okay i see okay is there anyone um here that wants to speak to this yes i do have someone signed up okay we have dan spice come on up good afternoon i'm dan spice i live at 6141 seaford drive i'm here to speak against the assessment for paving but particularly about the system involved in this uh commissioner starkey thank you very much for your fast response to me i appreciate that i've lived in saint pete and also in numerous other states i've never been directly assessed for roads before it's always been included as a part of the property tax in every locale in which i've lived paving costs spread over the entire tax base it's more equitable paving schedule i think or a more sensible way to deal with this this arcane formula with its erus pays no attention to the amount of road frontage which directly affects the actual costs of paving so a smaller property then subsidizes a larger one on the road frontage doesn't really seem fair in addition to that garbage trucks amazon delivery vehicles county school buses are they paying for the denigration of the pavement which occurs with the heavy vehicles at a much higher rate no it's part of the taxes they pay elsewhere just like property taxes should be the way to pay for paving projects you own the streets you've already accepted them as county property they're there for the entire county benefit in the case of seaford drive mooc road east of madison and tuckahoe with its seaford butts to at one end are in a similar state of repair so we still get to navigate the same road conditions to get to see for drive doesn't seem tremendously practical now last year's fuhrer over cranes roost drive and the paving project there was a signal that the system puts hardship on many residents but especially those on fixed incomes it's dollars they won't be spending elsewhere in your districts
1:13:26including with merchants and county sales taxes i'd like for you to delay the project and consider changing the system and find a more sensible and less onerous way to approach the paving thank you so um just so you know we are we are an unusual county that does it this way in our ad valorem line items we could charge a fee an advert fee for road and bridge but we do not and most of our money goes into silos so in the silo of road and bridge we collect nothing we are looking at changing that plan and it's going to be coming back to this board they tell me sometime in the next few months i think we're getting ready to sit down with each of you individually kind of walk through it before we bring it back and it's my hope we do uh change it but for the meantime this is the way we do fix our roads and um and so it's kind of uh the county pays 25 above a certain amount and then we uh charge the residents for the remainder um and then there is a special claw special help for those on a certain kind of income level um but we did get a favorable vote and we kind of go by the vote of your neighborhood and so your vote was positive to fix your road moog road is a collector arterial one of those two and the county does maintain those roads that's a little explanation part of the problem with moog is on once you get past madison toward the new copper springs development it's in such a bad state of repair at this point that people go down seaford because it's the next road over i just i just showed that to them last week and they're going to go down there and we'll be we'll be fixing them thank you very much it's in really bad shape at the end yeah thank you thank you uh commission mariano yeah just to make a comment um you know looking at and it looks deceiving as far as a picture as whether it's sidewalk or gutter but knowing that the road is that much lower i think you're going to find these roads will last a while once the pavement gets up there the water can then get to it just like beer creek so that should be a good thing yeah i'll move approval thank you all in favor aye opposed okay one last p-71 thank you p71 was published in tampa times on december 22 2021. good afternoon liam divine planning and development item p71 pdd 22-75 in the name of a.g.j.m pasco llc it is a zoning amendment from ac agricultural district to c2 general commercial commercial district um the subject site is located in the northeast

1:22:02nothing on it that's environmentally sensitive still it will create more runoff into the river ecosystem and it will adversely affect the ecosystems so i'm speaking against it will adversely affect commuters and residents in that area purina is already a dangerous road it'll increase frustrations and perhaps even increase accidents on so i would like to request a continuance and for there to be more of a traffic study before that i know the land's been cleared and everything there but i think it should be studied more um more in depth thank you thank you there were i thought i saw more people signed up um well i think that gentleman is the applicant oh okay and then that's um he's with the applicant okay yes is there anybody else who wishes to speak to this item seeing no one is there anyone online that wants this there's no one on webex okay so this is barbara will height again um they've the rezoning is the c2 it's not a specific use and with regard to traffic as any other rezoning we went through a full timing and phasing review sub-standard road review as well as access management which will be done with the site plan and all of those things met your your required criteria if you want to hear more about the traffic study our traffic engineer is here but we did go through all of the process and it's been carefully reviewed by your staff approval second all in favor aye aye okay all right um so we can't we can't uh approve based on what might come we only can improve on if the zoning changes kosher or not so sorry okay um commissioner oakley first time a little bit i have a couple of things number one is yesterday the pasco county fair opened in dade city and went well they actually had the rodeo placed on the weekend prior which started was on friday and saturday of last weekend they were not sure how much money the rodeo was bringing but i heard they did very well and [Music] had up to 1500 people so the second night but first night i think they said it was over 25 or 30 000 they brought in so they're getting proof that the rodeo does bring money into the fair so
1:24:51that was something they were looking forward to to see how that work and i think it's been working very well if you can and get a chance go out and see all the kids there the citizens of pasco county's children that are out there in 4-h with chickens rabbits all in all i have a grandson that's nine years old and he's participating he won reserve grand champion for a large foul which is a rhode island red rooster which i don't think likes me because he seems to attack me every time i see him so but uh he had he won smart rooster a lot of yeah that's right he had a lot of ribbons and all for for his work in that part and he's also showing a pig on this next saturday's for and it'll be that's where all the little kids cry when they sell the animal they've spent so much close time with so but if you get a chance to go out it's it's a great venue good you will enjoy yourself while you're there and this week supposed to be chamber commerce week i think because the temperature is going to be in the 80s yeah so that's kind of unusual but it should have a lot of people out this round next thing i was very honored to be selected the chairman of tampa bay water yesterday and uh really have uh looked forward to got the chair tampa bay water and the chair of tampa bay regional planning council well house chair now i passed here i don't want to be cheering but it's all good but it's uh i've that's been on my bucket list for about 15 years when i started with the swift mud and i wasn't even thinking about running for a county commissioner at the time i was thinking i wanted to be the chairman of that board so but it's been a lot go by since since that time i learned a lot when i was at swift mud and the resources they have and and to know the knowledge of of the 16 counties that we have in swift mud and tampa water protects our water resource that goes to all of our citizens and future water that we're we all gonna need so there's a lot of questions coming up about projects for the future and what they'll be so we gotta guide that to the right direction and one member for all and uh all for one so we all share in that we all want good things to happen for our water uh and i'll leave you with a thought about 15 years ago i told danny burgess and when we were up at tallahassee visiting

1:30:32bringing up the statues and uh how important it is to look at obviously after our taxpayer dollars across the county but i do want to acknowledge port richie because um they're really trying after the audit and after the last meeting they did vote to start the process to remove another area outside their cra which is very good news um again myself and i know others have obviously harped on that issue throughout the years debating what the definition of slum and blight is when it comes to a crna so again you know i will say kudos to the city for moving forward their new um leadership there as well on their city manager as well as the mayor so i want to thank them for moving ahead um they're definitely making process of progress i should say and one last thing i'll move on um and i won't uh get into the weeds too much on this but last meeting we had some public comment when it came to the moratorium on the multi-family um one of the speakers was from the north tampa bay chamber and i did ask was um speaking ask that person they were speaking on behalf of the chamber and that i would reach out to their chairperson um there was a letter and i can afford as well from the chair of the north tampa bay chamber of commerce that did basically state that um the chamber itself has taken no position concerning the multi-family moratorium that's why i asked those questions i did seek out the answer and that's the answer i was given so thank you commissioner fitzpatrick um well i was excited to attend the groundbreaking for the 54 crossings we'll be having two new office buildings being built on state road 54 and at that location they will be having you to utica collette nursing college from new york and i also had a meeting with the shareholders and the stakeholders for the homeless so we're looking at different ways that we can house the homeless and prevent blight and kathy i would like to thank your team for helping assist in that process we are working way on our lake leaks of fundraising i know we have about 5 000 10 and it's getting it's moving pretty quickly on the fundraising process so i'd like to say thank you and also the city of newport richie has announced they have their dark dart trolley and so now you can ride their trolley around downtown new port richie so that's pretty exciting as well so thank you are you gonna mention mariano the seafood okay oh okay and this weekend um they are having this hudson seafood festival at sunwest mines so i'm very excited and i
1:33:31will be there on friday saturday i'll be at the edc and at smart start and sunday i will be back at the seafood festival so thank you mr mariana thank you madam chair um just to give you some updates on the regional planning council and i'm gonna i'll send this information if you'd like it um there's a global and regional sea level rise scenarios for the united states it's pretty comprehensive there's a lot of acronyms more than you've probably ever seen before so you have to tie in back and forth but i think it's a good read if you want to highlight on just some areas just take a look at what's happened the past hundred years what's projected and watch out for the extrapolations that go up that kind of accelerate but it's think it's it's a good read to to know what's out there there's another one that's coming up there's going to be a topic coming up we had a presentation on the overview of shoreline setbacks and strolling construction could be could be helpful to you uh we do have the tampa bay regional planning uh leadership summit for uh the tampa bay regional resiliency coalition that'll be on april 5th and 6th at the carillon parkway uh hilton and then on may 6 will be a reach uh conference coming up dealing with the resiliency as far as affordable housing and other other benefits um the tempe estuary is also taking a look at whether to expand the current area currently the estuary is all about what's inside of the tampa bay it doesn't deal with the outside of pasco the only part of pasco that really is affected by it is uh i think the hillsborough river going to wesley chapel that touches into it the way the boundaries are listed right now i will tell you that i found that we had the presentation on baffle boxes they've actually had them in tampa tampa bay's got a the city of tampa's got a couple uh oldsmore's got a few saint petersburg has got a few and those baffle boxes do such a great job cleaning set up properly in the experience of the past 30 years have been out there have been working very very well in a lot of areas uh there was a conversation at the estuary to talk about to expand the area to expand it's going to be a unanimous consent at a feel-out conversation there were two no's i i plan to get more information in working with our staff maybe get more information for the meeting in june that's coming up we may go for a formal vote to go forward but i do think that from what i saw with presentations from the bp restaurant committee when you look at the water from the damage done from the bp oil spill the water runs at the top of the gulf of mexico running all the way down all the way down to key west that means our water goes by tampa bay
1:36:21which affects what's going to be down there to some degree so i think there's a case to say that we should look at something to improve the bay and if it means just even the water that hits all of let's say coastal pinellas and coastal pasco going down through that we should take a look at these baffle boxes because the purer that water is the better off it's going to be so i'm going to be pushing that way if you guys keep an eye on it you'll kind of see that's coming up it is going to be something going to be actively working through for us second thing you know we saw a good presentation on the budget today uh all the new construction all the new homes all the new people coming in and as you heard the guy the one guy from uh the paving assessment said look at my actually two guys said it they're not used to paying taxes the way they pay taxes in pasco county what we're going to find and i i've seen it for a couple of things already one one for a redevelopment project where a gentleman came in it's been two and a half years trying to go through the process not staff's fault but just through the process between architects between contractors trying to get something done uh has been a major project he started accruing fines tried to go around trying to cr you know create something to happen it didn't work out so well just went from a construction board and heard i want to say three people before him with massive amounts of fines like 200 000 300 000 those things got waived providing they would pay whatever fees and fines were in there uh i'm glad to see that we work with those people who are new coming in but what i'm what i'm seeing and i think the rest of you probably seen it as well when someone comes in and buys a house and there's been something done to it before these people didn't know about and from what i understand our permit records are only go back 10 years we get a new person coming in that just bought a house that wants to build an alf or just redo a house and all of a sudden we find there's a violation and we're going to whack these people with like double permit fees and and hold them fully accountable for everything now the permits from what i understand is basically we're trying to protect the people and protect construction so we get someone coming in from the outside that just bought a piece of property that doesn't know their full history and it doesn't show up on records we hit them with double permit fees i think we need to go take a closer look at that policy because the last thing i want to do is slow people from wanting to come to the area and secondly for the
1:38:44ones who try to improve a property proper way to hit him with these double fees now i think we all know we're collecting more fee money than we actually need but i wanted to have this conversation with the board i haven't talked to sally or dan or any else about it but just as i look at these things over and over again and and you know you may know that i've got sonia walling my assistant continually working on perming stuff and trying to help people get through the process i think this might be something to have us re-look at as far as the policy bring it back for discussion or just let me get let me get everybody's feedback on what they think about that yeah i'm sure our response yeah no and i appreciate it so i i'll give an example i had somebody and again no it's by no means is it the current team's fault or anything like that um but i had a gentleman reach out um that stated he moved into his home they put a screening enclosure in come to find out when he was out there getting what was he getting permitted i forgot exactly what he was getting permit but he was getting something else permitted they noticed he hadn't had a permit for whatever this enclosure was so he got he got tagged again not his fault how would he know i don't know how you would find out that's a good question how would you find out when you actually and this may even be a question for the clerk because i don't know if that's even shows up on the records but if you're going if you're buying a home for example oh yeah yeah and you and there's a screen enclosure a pool or whatever it may be a pool is obviously easy but a screen enclosure around the pool how would they even know the tax collectors on the assessor's website when they when they add something it's there with the and they give it a value and assess their value because i i go through those well i'm not i'm talking about i'm talking about screening closure not a pool itself yeah anyway anyway so for this example was it would have been if they pull the permit yeah i think this one was like six it would have been 16 years ago or 17 years ago um because they had bought yeah they bought the house 15 or 16 years ago just and just doing an improvement now i forgot exactly what it was but i'm so i'm with you on that what can we do maybe to help some people through that process they would have no clue especially in something that's so small as a screen enclosure well i i sent one that um i think i sent it to commissioner fitzpatrick someone who emailed me in your district um she's in um the one that where we fix the water uh off of 52 summer tree summer country and she said she that she went to sell her i think it's a
1:41:17duplex and um they found something i don't remember what it was that didn't have a permit and she was the fifth owner uh of title since the the stuff happened and so now she can't sell it but we have a we have ways to fix that but i forward that to you christine i don't want to i will say i mean the team was help helping this person and it's there's no even getting again weeds on this one but i i'm with you what can we do what policy does this board need to put in place to maybe assist the team to get through this or not you know how do we not possibly if we tag how do we not find possibly for a situation is that kind of what you're thinking yeah i mean first of all like so the question we need to i'm trying to formulate this in a question for the team to go research is for a property owner who that comes in to get a permit and we realize there's unpermitted work that existed prior to when they owned it correct what can we do to help solve that situation whether it's the double permit fees or whatnot right that's kind of the question i i'll leave it to the commissioner that asks yeah but i'm just trying to raise it so we know what to go research because this is you know it's so i think that's what i'm doing all right so so let me go a little further then just to try to clarify so number one starting number one the double permit fees i just don't like it and especially if there's a permanent pull before it just wasn't closed that you're trying to close it okay so i mean now we're going to penalize the person who's trying to do the right thing whether selling a property trying to do a quick close on it and get it done and move on or the other way we're just we're going to have him do improvements and then all of a sudden oh yeah by the way there's this this and this and whack him with the double fees i think just take away the double fees from the get go i mean especially if they're coming to us about trying to fix something especially if they're just new to the area or whatever the case may be you know when i buy a property i'll take a look at it but you're not going to know every single item that's on there what's going to be on there you could miss something so any lay person if the title insurance that you get from house you're buying you think you're pretty well covered that's what you think you you miss some of this other stuff if the title company doesn't pick up it doesn't show on records from past 10 years you're not going to see it and it could be two three four five different owners between it and all of a sudden you're the unlucky one that's getting whacked yeah better check that's a good point when it comes to closings on some of
1:43:43these because the title company may pick up an open permit and they won't let you close we've run into that and sally and her team have actually have been very helpful with a with a family that had that issue and helped them get it done so they could actually close on the property but you're right that so the title company is not going to pick up everything so probably sally it's more to what can we do because obviously you guys are slammed more permits than ever higher numbers than ever what can we do to change so as far as you're following the rules you have to follow but what things can we change to make it easier less financially burdensome on these people and i'm not looking for an answer today i just want the discussion today what we want to do is as mr bowell said please sally sherman assistant county administrator development services please allow us to look into the different circumstances so that when we answer your question we'll come back with an answer on specifically how to move forward with it in um in some instances it may not even require any action by the board so allow us the time to look into it okay and i want to say i wanted to talk to the board first before i even brought it to staff just to see if we all have the same type of feelings what we're dealing with yeah i just want to answer that we have a policy already there that says get a permit for things that you do on the home remodeling or whatever that's already set in policy what you're talking about somebody's got a friend that does something and they wouldn't put up a screen enclosure on the back porch or something which they should have got a permit yeah they didn't get one and then they sell the home later that person has no knowledge of it all so i understand making that clearer and uh less burdensome for the family that's buying the new home or that home thank you that's all i have madam chair county administrator yeah just a couple things just um if you recall back a few weeks ago we did the media availability out on ridge road i think three or three all were there for that um just a couple facts about that there was about 17 million views of that from various sources what did you say 17 17 million yeah in the publicity value that's a little over a million a million dollars of publicity from that so thank you for being out there and helping with that and thanks to the communications team sam and everybody that worked on that that's uh that was a pretty big deal second thing is um we are migrating over to to office 365 that's on the cloud so email and the office suite will be on the cloud so you will start seeing that in
1:46:23in march and april that does affect you because it doesn't affect your county email so just heads up that's coming that's should make things more efficient our end easier to share files and some other things at least internally to the work we do so just want to give you a heads up on that and that's all i have okay who's next that would be better county oh mr mariano just a question i thought maybe we get an update on the waste energy plant bill that was going today i think it passed committee 22 to 1 21 is that our local bill yeah no that's a that's a global one right that was a global one yeah yeah representative mariano was working on it so i know mike carbella is up there today yeah we gotta wonder we got a wonderful scream grab of mike presenting today we will be using it for many memes for many years you have to share yeah okay i i don't know what's going on with that what's going on with that i don't remember the the waste energy bill that was i'll try to summarize it mike's not here he's i think he's probably on his way back from tallahassee but that was the the the bill that the senate president put together that would create a funding pool for the waste energy plants when the power current power agreements run out to help supplement the the drop in in revenue that those waste the intent there is burning trash is good a policy that the state of florida wants to encourage as opposed to putting in the ground and so that's that's the intent behind that thank you does that have to do with using the waste to base as well when we were no ma'am this is strictly a funding source a financial piece to help offset the power the loss of revenue when the power contracts run out in a couple of years all right uh county attorney uh madam chairman members of the board um we were served with a 70-51 petition by stock development on parcel s19 that is the environmental dispute resolution act um i think i think most well maybe not it's been a while since we we've had one um it it is a it's a process that the that someone who believes that they are inordinately burdened by the action of the board of county commissioners in land development can take there's a special magistrate that is agreed to by the parties in this case we have we proposed a list and we've agreed on an attorney out of tampa by the name of david mechanic
1:49:19he is aicp and a supreme court certified mediator um and that process will go through the process and you know there there it's a statutory process that um we have to go through um and then there is a public participation for lack of a better term mediation so the public is in unlike a court mediation the public is invited to attend especially those who are affected the negotiation if any between the applicant and the county to see if some resolution of the of the decision can be made if such a resolution were to occur not saying that it would then that would come forward to the board in another public hearing to devote on whatever the the settlement would be so um does that take place here that public thing or in tampa or where it would take place some on one of your facilities here either either the i think a lot of times depending on the amount of public um we've either used the board chambers i think when a won concrete because there wasn't a lot of uh there wasn't a lot of public that's the last one that was done in your in your conference room because there wasn't a lot of public um so we find some place that that would work for for the amount of people that are going to attend um and so why is it called the environmental that's what the statute's name is so i assume that it was called environmental land use dispute resolution is because it could also be used for environmental permit denials by ddp swift that sort of thing they all they would also um be under that um statute uh the other thing i wanted to chair yeah before the next one so which item is that specifically s19 was the seven oaks multi-taunt family i don't the public picked up on it but i want to make sure we know um going rolling back to this morning's discussion by mr shumate um because i picked up some discussion amongst the board about um [Music] you went with staff's recommendation but you also said you wish to evaluate taking further steps and i just want to remind the board that if senate bill 2 620 and house bill 516 pass which are the ones
1:52:32that say that if you impact the business by more than 15 percent you may not be able to to revisit that issue after july first your policy decision not trying to influence the policy decision but i do want to make you aware that that policy decision may be taken away from you after july 1st so if the board wishes to ban the retail sale of rabbits it probably should be done before july 1st not pushing you in that direction but i don't want it to be the fall and the board says we want to do this and i have to come back and say well legislature says you can't now so that that should be something you weigh in your discussions about bring when this ordinance comes forward if because there was different opinions that i heard in on the board and i'm not sure where the majority was and that's all i have for today thank you oh do we need to discuss that do we need to discuss the bunnies the i believe what mike was recommending was still a change of the current ordinance so i mean that would come back and you would have time to make adjustments then if you wanted to right so i mean there is a chance right your his recommendation which you approved was to make changes to the current ordinance it was just not going all the way right it was we went all the way we wouldn't we'd have to pay that my only if it was after july 1st so my recommendation would be that when mr shumate brings that back as introduction with the ordinance put together if that's the time the board needs to say no we want to go forward advertise it for the full ban or we're comfortable with going this far right now and go well i would just be on the record that if you heard them say 80 percent of these pets don't make it a year i'm okay with the band and that way if you're really serious about wanting a rabbit for a pet you can get it from a breeder and and spend a little more time i would just request is tony mentioned we can have this discussion at the introduction when mike is here i mean he's our expert let's have this discussion introduction with him here yeah i just want one of the boards think about that as it goes forward good idea okay that would be a publicly noticed item on the agenda so okay let's have the chance to have a discussion then okay um clark yes oh yes um thank you madam chair i wanted to tell some good news my office submitted the annual comprehensive financial report for the
1:55:21year that ended 2021 with the governor the government finance officers association of the united states and canada and pasco county has won the certificate of achievement for excellence in financial reporting and this marks the 38th year consecutive year of getting that award so congratulations the first award was 1983. so that's good the other thing i wanted to say was um a couple of months ago brian corley our supervisor of elections sent out a challenge to the county and the constitutional officers oh and it was a kickball challenge and that happened on sunday and i just want to show you what you missed out on because we weren't invited you were you were invited you just didn't answer it i don't think well that's what brian brian says yeah i'm gonna look probably public information request one the trophy it is an awesome trophy and it's um made to be like the stanley cup so we get to keep it for a year and then we bring it back next year so i hope you guys are there so we can really win that some of those teams had ringers on their team someone had a pe coach or what what else who who had who put some ringers on their team was that you guys no no no no uh i i don't want to even get into that conversation it is dave but no no ringers on our team well congratulations thank you okay um i am going to bring back to you a discussion about chain link fences on me on main corridors because i don't have any photos today but i want to show you what's popping up more and more on state road 54 and i don't think we should be allowing it i don't think that's what a premier corridor looks like so uh do you remember that site that i showed you the photos of behind the walgreens on 19. it was on marianne drive behind the bank of america so interestingly uh i noticed going through my emails that i had one from mike carbala that was forwarded to me from fgua so it turns out there's a well right there next to that little strip of property and they tested their water was full of e coli so you know something that you don't think about when these homeless people or these people are living in property like that what what uh is happening to the water system around it and they had to go uh they had to shut off the well and go around to all the neighborhoods and say don't drink your water so
1:58:05um we do have a penny for pasco workshop settled um do you want to give out that date mr biles march 29 29 sorry i haven't thought into march yet yeah march 29th will be including the uh school district and the sheriff or i don't i know the school district it's mainly between you and the school district to to talk about what you're going to do with your piece of the pie you're 45 yeah all right um the uh a number of us attended the ribbon cutting for the starkey cultural center that some people call the starkey tlc i want to thank those of you who attended it's really uh an awesome venue that's the nation's only p4 two two public entities and a private entity coming together to um co-locate the cultural center with the library and the theater and the school district with the starkey k-8 and the park and the developers so yeah it's really really uh awesome um facility and i hope we have the opportunity to replicate that more around the county um congratulations commissioner oakley on your appointment to tampa bay waters chairmanship i was glad to make that motion uh and just to follow up again on what's going on over there it's pretty important stuff that we're working on we're down you know it's it's our charge to make sure we have new water supply sources that are coming online it takes 20 years or so to bring them up we had four we knocked out one actually i think tampa just withdrew it so we're down to three and one of them is pretty contentious i just wanted to let you all know that it's it um has to do with our um being fairly compensated for reuse water and so we will be uh our utility directors in tampa bay water and hillsborough there there will be some very big conversations coming up in the next few weeks i've notified mike on that too yeah they were watching yeah yeah um madam chair yeah on that topic can i bring up an idea um you know reclaimed water is all of a sudden it's a good marketable thing people would like to have it as opposed to using their own potable water on the flip side of that i will tell you talk to several golf courses where they would rather have be able to use some of the well water pump because when they use the reclaimed water they have to use other chemicals on top of that that have to be doesn't have to
2:00:43neutralize it so i think probably every golf course would rather see let me go use some of the old well water i used to use in the area and use a little bit less reclaimed water now if that frees us up to go put the reclaimed water on the on the regular retail market and make more and help the golf courses use less chemicals anyway there may be a win-win that's a carbolic question that that um as you bring it up i think it's a good idea to look at it yeah i mean we don't permit wells i think a swiftman question is why they're not that i'm going to permit those again but again it's i think it's a conversation to have the same amount of reclaimed water is going to get used same amount of potable is going to get used is it a better way in a better use yeah again i think that's a question for swiftman well that well the consumptive use permits for these golf courses that are on reclaimed water has been taken away by swift mud that all they have now is a reserve quantity um where if our system failed for some reason they could go back to potable water um but that that's a state law question you're right yeah that that's not that's something that we can hear from mike or someone about but i'm not sure that's something yeah you i mean you've your reclaimed water system you effectively created a water supply of 25 million gallons a day that didn't exist yeah because that's how much reclaim we're pumping into our system right now that would otherwise be used we'd be using potable and that's a massive water supply yeah and and the challenge is is that you know there's a new state law that hillsboro soon will not be able to dump their their treated water from the howard curran into the bay when i was on the swift mudboard in the early 2000s we were trying to figure out what to do with that water they were gonna actually we had put money aside they were going to pipe it up to pasco and rehydrate the wetlands back in the early 2000s and then then that got pulled because then they were going to sell it to polk county and it's still being dumped in the bay and so their hands are a little bit tight yeah that the kind of the issue is they don't have a wholesale user and they want to kind of want to charge tampa bay water retail prices so yeah let's talk about uh part and swift partnered with uh tico on some private public partnership to cool down their towers and all for to make electricity you know and so that reclaimed water came out of tampa and went out to a teco plant and it was used to cool down those towers they're dumping 60 mgd into the and they're yeah they put in 60 million pineapples puts a certain amount in in the
2:03:21bay also we do exactly what how much that is but it's a lot so um so uh this week i came out of my house in gulf harbors to four giant trucks on my street and i couldn't figure out what they were doing then i saw the word like lining or something and they're lining all my sewer pipes in gulf harbor so that that was cool um tubarda uh you might have seen the article in the paper on t barta and um and uh i'm not gonna stir the harness and that's too much i'm just going to say there's i i find it frustrating that one commissioner is stalling a regional solution and hopefully there's workarounds that's all i can say and there's discussions on that lastly you guys have the new the new um flyers thank you very much and i've already handed out three of these so i'm not sure you can hand these out when they're soliciting you in the middle of the road you might get in trouble with our new ordinance but um i just realized that because i gave this one to that lady in the middle of the street yesterday just give it with a with some educational piece on the new ordinance and you're good okay maybe i need to put a little sticker um but i i can't they really do work and when uh the lady said do well do you have showers can you really help me um she was just so excited and she you know called i'm sure but she was just so happy to maybe even just get a shower so okay i think that's it all right we're adjourned thank you all right thanks so kevin um [Music] you
