5:54meeting of may 4th 2021 a reminder to everyone present please silence your electronic devices and mute your microphones now we will proceed with public hearing agenda starting with item p44 uh madam clerk do we have proof of this item yes mr chair um item p-44 was published in the tampa bay times on april 4 2021. good afternoon commissioners denise hernandez planning and development item p 444 is pd210284 this is the adoption hearing on this item so today we're asking that you accept public comment and adopt the proposed ordinance amendments by roll call vote so this is an ordinance by the pasco county board of county commissioners amending the pasco county land development code chapter 500 zoning section 526 c2 general commercial district subsection 526.3.0 conditional uses multiple family dwellings and other sections as necessary for internal consistency providing for applicability repealer providing for severability inclusion into land development code and an effective date and as you know this went to the local planning agency found consistent with the pasco county comprehensive plan recommended approval to the board of county commissioners on 4-1 of 2021 the first reading with a full presentation was done to the board of county commissioners on 4 20 2021 so today we're asking that you accept public comment and adopt the ordinance amendments by roll call vote okay uh we have anyone sign up on webex one on webex and no one on email for p44 okay is anyone at the kiocs on uh p44 there's no one at the kiosk okay thank you you're moving for approval second what is there hold on is there are are there any emails for this no no no okay no emails nobody on webex and there was no one on the keyboard can we discuss can we discuss this you got emotion you got a motion in a second so discussion okay discussion um i know when i originally put in the motion to remove multi-use out from conditional c2 zoning but it seems like we still have the um we have three exceptions to the rule and i agree the exception to vertical integrated mixed use ground floor office or other non-residential use because that is a true mixed use but i didn't realize well i mentioned his staff i was questioning the affordable housing as defined in section four two zero point zero zero four mr yeah i think that was something that came through the planing commission and that was um an exception that they made
9:07i think they discussed in the last meeting that was an exception made at the planning commission which was added to the ordinance i'm not in disagreement if you want to pull that out i'd be in favor i would like to pull that out because that was not part of the original motion and i did speak to staff prior to this meeting i'm in my motion to to remove the affordable housing portion out of it okay with a second okay uh discussion because what i'm not i'm not in favor of that i think um we need to be able to still find places to put uh workforce housing and um that would be no problem for the county i agree with affordable housing but not in the c2 use and the commercial zone you know i think each site is i think there may be sites that are certainly appropriate like on u.s 19 um so um i think that's i think that's a dangerous road to go down if we take uh that pretty much changed because that wasn't that same motion or wasn't that before us before when we talked about this or is this coming back to us with this no so basically the history of this is it was brought to the planning commission um on in march and the planning commission said that they had concerns with excluding um the uh the uh allowance of uh multiple family dwellings as a conditional use in c2 that there would be unintended consequences some of the things that were talked about at that meeting was affordable housing the west market area and i know the board during their discussion separate from the planning commission obviously the board talked about that vertical integration was very very important to the board having the multiple family and the allowance of the integration of commercial uses or office uses or non-residential uses so um so that was brought back to the planning commission on april 1st and the planning commission felt comfortable that that would satisfy the concerns that they had with the unintended consequences and then that was then brought to the board of county commissioners for the first reading there was some some discussion at the at the board and then you know we're here today for the adoption after chairman um after the april first meeting i did reach out to staff and i was questioning because i know what my original motion was and this wasn't the intent and if they're developers i would like them to come in and look for a multi-family one
11:48two or three not a multi-family one two three or commercial use and that was the whole purpose of the original motion but now we're adding apartments back in the only true apartment in this exception would be the vertical integrated use with the commercial floor and apartments above well i think i think the concern was the reason they added that back in the concern was for affordable housing and workforce housing that you need in some areas they still may fit on that circumstance and we didn't want anything to hold us back from doing that because 40 of the citizens of pasco county need housing and so when you eliminate that across the board you eliminate a lot of workforce housing in some of those areas where you really need it so i'm concerned about change of emotion of that i really was before the motion before it happened i'm very concerned about that added in there take that out so do we do we have a map that shows where the multi-families one two and three are and compared to the commercial i i don't have that map available for for this particular for the following which is the moratorium there's gonna be research and that information will be brought to the board of county commissioners because i'm not saying take away affordable housing on the other aspects of it it's just the commercial or c2 so they're just going to go mf1 but then we wouldn't of course at that point we wouldn't know whether it's affordable how you know that that's not something that they have to disclose so you could just apply for an mf1 mf2 or mf3 zoning um and mr chairman yeah sure so someone could if we approve it just the way it's written right now someone would if they wanted to change and use the conditions they're still going to come before the board for the approval right so we could look at it with still doing what your intent is on ninety percent of it but the other ten percent you give them the flexibility to come in they're still going to come before the board on a public hearing to go forward with it and frankly it may it may work out where we the board at the time where it may be may say you know what much as we didn't want to take away commercial we think it's still going to it's appropriate at the time so i'm going to withdraw my support for the motion the way it was modified so then are we just taking oh they're still going to be multi-family use so we're just taking away basically class a apartments so you're you're based on the motion as
14:26i understood it you're striking out affordable housing as defined in section 420.0004 florida statutes that's that's how i understood the motion see the reason they the reason they put that in put that back in was the fact that it was going for affordable housing or workforce housing that you were going to do it had to come back in instead of trying to be a conditional use now you're telling them they have to re-zone it and it costs more and more expense and doing that reason for affordable housing and i think that was part of the reason that's accurate zoning application is more expensive than a conditional use application yeah that's another that's accurate right yeah mr trump yes no commissioner fishbacher i support your original idea by far i'm i'm with you um i have no like i'm with you about removing the affordable housing portion now but it just sounds to me now that you've got a 3-2 we have a 3-2 where we may may lose that so might have to go ahead and be amenable to make this pass to go back to the original um i thank you every project this world i tell you every project we've seen in the past and i'm sure those in the future we've all been pretty much on the same page we've all uh discussed the items very well and i think we're smart enough to understand if it fits for affordable housing wherever that project might be i think we can make the right decision to put it there right so i don't think we need to leave this out i think we need to make that less cost of a project for for those people we need like to say 40 of our people need the citizens in a pasco county i agree with affordable housing okay and i'm sure you do so i think taking it out of this just really changes it for me yeah i wouldn't want to change and make it more costly so but i have a motion okay so it sounds like what i need to do is go back to amend my motion to my original motion as recommended by staff same page second yeah okay okay so i've got a motion a second by roll call vote district two commission more district three commissioner starkey aye district four commissioner fitzpatrick aye district five commissioner mariano aye district one chairman oakley aye motion pass five zero um question just in case i wanna recall that vote is it possible here to add the landscaping language that is sorely missing from our land development code that they have to have trees in the front no i don't think it's broken here this is only amending the condition that
17:06the conditional use section for multi-family i have somewhere to get that quickly i understand what you're saying i'm sure ms hernandez can put it in a glitch i think we're working on it because i'm on board with you on that yeah uh i've seen some of that without man's skin it does not look good and we don't need it in this county and a queen palm is not landscaping yeah okay and i hate to do this mr chairman not just going on since we're having a little bit of discussion on this and i think it'd be proved the team to maybe bring something back what commissioner um starkey was mentioning a second ago because i didn't bring up today i was gonna wait till the next meeting but i wanted to talk more about that tree mitigation fund because i'm noticing some um some um commercial um this retail establishments that are not following have not followed the code but maybe they don't look like they're doing that good so maybe we can step in and use some of those funds for the tree mitigation if you look on the um wesley chapel boulevard 75 54 exit um long story long story about go make it short we work very closely with fdot to go that landscaping so if you've gone there in the last like two to three weeks it's amazing isn't it it's beautiful but we have a couple of situations that surround that that have nothing so it kind of takes away from it right so if we could bring that back just kind of yeah on that issue yeah well i'll save my comments when we bring it back i like the next uh item we'll move to p45 proof item p 45 was published in the tampa times march 21st 2021 p45 is pd210316 an ordinance by the pasco county board of county commissioners establishing a temporary moratorium 180 days on the submission and acceptance of applications for conditional uses rezonings and comprehensive plan amendments proposing to increase multi-family entitlements within the moratorium area providing foreign authority legislative findings of fact definitions moratorium area temporary moratorium imposed duration of temporary moratorium and severability this item um this is the adoption hearing on this item so we're asking you to accept public comment and adopt the proposed ordinance by roll call vote this went to the local planning agency who found it consistent with a comprehensive plan and recommended approval to the board of county commissioners and a full presentation was done to the board of county commissioners on april 20th 2021 okay uh do we have anyone signed up on
19:37webex yes uh mr chair we have three individuals on webex okay okay we first have john tamsu if you could please state your name and address for the record please john thompson 26738 wing dome drive wesley chapel florida 33544 sir can you please uh repeat um it didn't cut in and okay you didn't come in until um halfway through john thompsou 26738 winged elm drive wesley chapel florida 33544 thank you sir you may proceed good afternoon and thank you for the opportunity to speak i urge you to vote in favor of the moratorium ordinance data-driven decisions are usually the best ones as is common practice in the scientific and business industries taking 180 days to collect the needed data is essential to the board making decisions that have a direct and long lasting impact on our community the members of the seven oaks resident council spread the word via social media and boots on the ground to educate the citizens around the proposed ordinance we gathered 128 signatures in person from residents in seven oaks and while engaging pasco county residents at the wesley chapel walmart and landlakes publix not one person that we spoke to was against the ordinance these letters were submitted to the admin and asked not to be read into record in order to respect your time please recognize the voice of the community we are we were able to capture the topics of population density and observed over saturation of multi-family units is a common theme we encounter when just discussing life in pasco county with our friends families and neighbors as a pasco county resident in the proposed designated moratorium area i have witnessed the increase of traffic and related accidents the continued overcapacity schools like seven oaks elementary and wiregrass ranch high school a perfect example of infrastructure racing to catch up to our residential needs is the diverging diamond interchange road project this frequently delayed project and others like it play a role a large role in the quality of life of pasco residents and it's one of the many variables that must be considered when evaluating rezoning and conditional uses our infrastructure needs to catch up with the current master plans in place before making any further changes in the generally well thought out design of pasco county existing unused parcels already zoned to accommodate multi-family dwellings should be taken into account before rezoning or allowing conditional use i'm also asking the board to do a better
22:07job of understanding the data presented to them when deciding on conditional uses and rezonings sources of data can be biased in the board's recent approval of the conditional use permit allowing multiple family dwellings in a c2 general commercial district north of seven oaks the data was misleading in terms of traffic and school capacity quotes from chris williams director of planning services pasco county schools indicated seven oaks elementary was currently slightly over capacity but the data sheets provided by the developer showed under capacity additionally relocatables also known as portables are a clear illustration that school infrastructure is not on par with the needs of a community the units are disconnected from the main campus provide no cover and rainstorms and kids are moved to the media center or similar areas during thunderstorms as noted by bill cronin president and ceo of pasco economic development council there are still too many people living here and working somewhere else our county is not the overflow housing department for hillsboro and pinellas counties we have our own growth strategies and creating more local jobs for our residents is a priority and it's difficult to do that if we zone c2s into multi-use all the time please vote to approve the moratorium ordinance support data-driven decisions and allow the county enough time to collect the information needed thank you for your time and god bless thank you for comments next so um we did have mark doyle on webex he has dropped off so i'm going to move to the next individual and see if mr doyle will come back on so the next person is eric garduno for the record thank you certainly eric arduino with the bay area apartment association po box 15 1958 tampa florida 33 684 thank you sir you may proceed thank you good afternoon commissioners thank you for this opportunity to speak uh shortly you'll be discussing a moratorium related to apartment development in a portion of the county the underlying question at route of this moratorium is whether or not there is an oversaturation of apartments for the ordinance the blcc will direct county staff to look at some key data points these include the number of multi-family units already there existing entitlements and acreage zoned for multi-family while these questions can help determine how many apartments there are today and potentially the maximum number of apartments that could be built in the future they alone don't speak to oversaturation while these quit um oversaturation can and does occur
24:44it happens when there are more units than there is demand as a result when oversaturation does occur vacancy rates skyrocket units stay empty and developers lose their shirts based on the information we have available to us they'll we we don't see anything like that happening in pascal county that said if the board moves forward with a moratorium we do ask that you consider adding additional demand and supply factors for the county staff to research that are relevant to the question of oversaturation we are grateful that the planning commission already added vacancy rates to the ordinance which is a key indicator of demand our data on this point indicates that vacancy rates in pasco county are at 5.8 and that's near historic lows we're pretty confident that the information gathered on this point will demonstrate strong demand for apartments because there is particular demand or sorry particular interest in recently built apartment communities an important demand indicator is lease ups so every apartment community starts with 100 vacancy and lisa is the period between when leasing starts and the community is full typically this lasts 8 to 12 months after the apartment community is open so another important data point to gather is how long are these ups taking on the supply side is also important to examine what realistically can be built for instance the supply of labor and supply of raw materials are real constraints on building new apartment communities at its peak the most departments that the uh county was able to build in any given year is 50 about 1500 looking at how many were built recently will give us an eye into how many can be built into the future ultimately we're seeing substantial changes in the county recent growth rates for the county are at 30 percent or looking at 30 increase in population in the next 20 years these people are going to need places to live and a lot of them are going to want to live their apartments we hope this supply will be there when they come thank you for your comment thank you mr mr doyle has not rejoined the webex so i have no other individuals on webex for this item we have i guess do we have anybody at the kix yeah is anybody at the kiocks there's no one at the kiosk all right thank you i will go into the emails and i believe you told me you had 51. um yes mr chair total of 63 were submitted um actually 50 emails were asked to be read on record i have one letter from our sheriff asked to also be read in the record as he's not able to
27:48make it today all right um and since there are so many emails to read i asked um donnelly schmidt my operation supervisor to help me with it so um i'll get halfway through and then she'll help me with some of this all right okay all right so i'll start with the letter from uh chris nacho our pasco county sheriff address eight seven zero zero citizens drive newport richie florida three four six five four dear commissioners i'm ready today to express my support for the moratorium imposed by the paso county board of county commissioners 60 days prior regarding family multi-family developments as well as the proposed ordinance related to conditional use on commercially zoned properties as the board of county commissioner knows well the pasco the pasco sheriff's office has long championed a well thought out approach to growth and development in our county while available housing including multi-family developments is a critical component of our county's future of our county's future ensuring that infrastructure and resources keep up with the growing demand development is equally imperative similar to what i hear about your county services the sheriff's office has a difficult job keeping up with the current demand for services that our current citizens ask for and deserve quickly approving multi-family developments only exacerbates the problem additionally if we continue to focus on being a bedroom community focusing on sending workers to businesses to the south we will continue to increase traffic issues at key and limited intersections that will intensify traffic issues that in turn create public safety issues with multi-family homes our population will quickly increase to eventually complete to eventually compete with the overall population of pinellas and inch closer to hillsboro however without the tax base provided by the economic engines of these count of these two counties our collective ability to serve our citizens is hindered to demonstrate as it stands currently the pasco sheriff's office receives barely half of the funding per citizen that our neighbors in hillsborough county receive per citizen served and only 35 percent of the funding per citizen served that our neighbors in pinellas county receive the board of county commissioners has a strong commitment to funding public safety as the sheriff of the as as the sheriff's office receives 50 of new revenue each year and the board's commitment to pay increases which has stems to flow
30:15have just stemmed a flow of members having for for better pay in surrounding counties for which the pasco sheriff is grateful however there is still work to be done as demonstrated by this funding disparity per citizen served there are three graphs one graph is population served by sheriff's office 2019 pasco is 484 249. hillsboro is 988 thousand 250. pinellas is 399. 399 488. next um chart budget of the sheriff's office in 2019 pasco 142 billion one i'm sorry 142 million 169 188 um hillsborough 463 449 um i'm sorry 600 400 and 463 449 660. pinellas county 315 for 458.040 and then cost per citizen served in sheriff's office in 2019 pasco 294 hillsboro 469 and pinellas 790 with these limited resources the pasco sheriff's office is committed to responsibly through innovation addressing the concerns of citizens of pasco county this has included a commitment to going upstream to address issues before they become law enforcement concerns through the creation of our behavioral health intervention team and partnerships throughout our community unfortunately recent research by our behavioral health intervention team found that pasco county desperately needs more mental health resources as well while examining mental health providers per citizen pasco county has one mental health provider for every 1460 citizens while the state average is one mental health provider for every 700 citizens we must allow resources to catch up to the population growth we have already seen it is for this reason as well that the pasco sheriff's office requested and was provided a seat at the table in the pre-application review process we believe the seat at the table will assist the county as these developments continue it is critical for law enforcement to be included as each development brings in additional people and additional traffic concerns that will ultimately become law enforcement issues it is important to remember that each multi-family development is essentially adding a small city and as such we must allow resources to catch up to this potential influx any development multi-family or not is law enforcement intensive this is what allows our neighbors in hillsborough pinellas to have more resources
33:03available as they balance residential growth with commercial and industrial we will we with focus we must focus on job creation and infrastructure with this the pasco sheriff's office would support an extension of the moratorium to allow the sheriff's office to be en engaged moving forward we are now included in the pre-application review process and believe that the moratorium should be continued to allow for our input in these projects as they move forward thank you for your time and attention to this important matter sincerely chris knuckle sheriff all right the um first email to be read in to the record is from antonio ponzi address is four three one four will star circle dear a county dear pasco county planning commission i request the following to be read into the record i would like to voice my support for a moratorium on apartment development for background i live in crosswinds which is a single-family detached home subdivision in seven oaks my wife and i specifically chose to purchase in this in that area in 2016 after we moved from out of africa from out of state because of its level of safety the relative peacefulness in the well-renowned elementary school given where we were ready to and have started a family given that the school is already very close to capacity and the apartment complex north of seven oaks has already uh was already approved adding this many potential students would easily push the school even further over capacity crosswinds has a large number of residents with close to or already or already elementary school-aged children and i plan on notifying them as well regarding this proposal so that they may also address their support for this proposed moratorium besides the school capacity traffic would increase dramatically throughout seven oaks which also has an impact on safety entrances to seven oaks are already heavily congested and i can't imagine how much worse additional apartment complexes would make it especially during rush hour please don't add to the traffic at least until additional infrastructure is in place such as additional schools and road improvements overpass road i-75 ramp diamond at 65 and 75 etc so i ask you to please consider the safety of seven oaks residents and the quality of education for the children of seven oaks when making your final decisions because they are our future i am proud to be a pasco county resident i have told numerous people looking to leave their current towns that this is the county to be in because pasco county seems to really care about its residents please allow me to continue having that pride so i may continue encouraging
