20:43good afternoon, everyone. I would like to go back to order the Pasco County Board of County Commission a grant to You're one should sign. So I kind of Isis and. My home. Now it's time for public hearing. Starting with item number. You 44 ordinances meadow Park. The improve. Yes, Mister chair item. P point-four was published in the Tampa Bay times on April 0, 2021.
21:30Commissioners, Denise Hernandez planning and development item. P 44 speedy 21 0, 2, 8, 3, read the ordinance title. But today you're just accepting public comment. No action is required by the board today. This is first of 2 public and the second hearing will be May 4th 2021 at one 30 in Dade city. So this is an ordinance by the Pasco County Board of County commissioners amending the Pasco County land development code chapter 500 zoning section 5.26 see 2 general commercial district subsection 5 26.3 conditional uses multiple family dwellings and other sections as necessary for internal consistency providing for applicability repeal are providing for severability inclusion into land development code and of and an effective date. We can get the power point up. So as we go through this on Feb 9th 2021 the Board of County commissioners directed the planning and development Department to bring forth a stand-alone modification to land development code to remove multiple family dwelling units is conditional uses in the C 2. Of concern to the during the discussion was that the stand-alone nature of conditional use applications for multiple family dwellings and C, 2 without any vertical integration of commercial uses. The LDC currently allows multiple family dwelling units in the N F one 2 and a 3 district. Additionally multiple family dwelling units may also be allowed through an amputee. At the March for 2021 local planning agency meeting. There were concerns expressed by the local planning agency that removing multiple family dwellings as a conditional use out right in the sea to district would cause unintended consequences. During that meeting. There was commentary regarding how this would potentially affect proposed affordable housing applications specifically in the West market area next slide, please. Thank you. To address these concerns of following his proposed by the planning and development Department section 5 2062 general commercial district subsection 5.26 conditional multiple family dwellings and the underline and bold information is new information where the project complies with one or more of the following criteria. One affordable housing is defined in section 4
23:5020.0, 0, 0, 4 Florida statutes or vertically integrated mixed use ground floor. Commercial officer other non residential use or located in the West market area as defined in the comprehensive plan and has depicted and not 2 dash 17 market area. One West market area of the comprehensive plan future land use element. Yeah, of course and making them as as you as you wish you Mister chair point is that I think you write it down and they haven't calm. And then we'll discuss.
24:27So for reference. I just want provide that subsection 1, 2, 5, 0, 1, 0, 5, 5, Florida statutes provides and this is verbatim from the statute, not which withstanding any other law or ordinance to the contrary, the Board of County commissioners may approve the development of housing that is affordable as defined in section 4, 20.0, 0, 0, 4, on any parcels zoned for residential commercial or industrial use. So basically this is something that the board can do already. So keeping at it the multiple family dwellings as the conditional use allows for conditions to mitigate any negative Also, conditional uses can be revoked. pursuant to subsection for a 2.4 point J examples of content of conditions of approvals that we presented to the board in the past as compliance with 5.22 point for development standard site design compliance with the land development code section 11. '03, hurricane hazards implementation of a public information program and cite specific attack evacuation plan. Then one other example is a buffering and landscaping condition that we had in conditional use 1838 there was some with the folks that resided to the west of the proposed multifamily project. This is in the West market area and the one of the conditions that we places applicants to provide a minimum 6 foot opaque wall along the North and West sides of the property located within the landscape buffer. So those are conditions that and have been placed on conditional uses in the past. OK. Perfect. Thank you. Also just wanted let the board know as as you may imagine, most see to general commercial district parcels are located commercial future land use and retail office residential future land use the comprehensive plan provides the following range of uses related to this item in the calm commercial land use residential uses are only permitted when constructed in combination with commercial uses within single building or of 2 or more stories where in the first floor uses or commercial office and other non residential uses. There's also been prior Board of County commissioners direction to encourage the focus of multiple family development to be part of a mixed use project. Incorporating the vertical integration of multiple family dwellings and commercial
26:49officer. Other residential uses is consistent with the comprehensive plan. Going on to the West market area. Many existing see to general commercial district parcels are located in the West market area consistent with prior BCC direction to encourage development. An infill in the West market area. The proposed changes are and they're also consistent with the harbors redevelopment plan recommendations to focus development efforts in the West market area. Some examples are or ordinance 1848 mobility, fee updates and the addition at 13. '02, point to point C the harbors West market area incentives own also ordinance 20 deaths, 17 mobility fee updates which updates the mobility fee tables to encourage vacant parcel redevelopment in the West market area. When we a review of prior requests going back to 2015 the majority of the requests were it for conditional uses in C 2 for multiple family dwelling units the majority of the requests were in the West market area. So of 13 applications that we received between 2000, 15 2021. 8 were in the West market for were in the South market area and one was in the North market area. And the next thing is a map showing where those were. So 61.5% in the West market area. 30.8 in the South market area and 7.7% in the North market area. I did put in an Asterix next to the ones that are in the south of market area. A couple of them because. At least 2 of those were multiple family dwellings. But for and attach product that was going to be fee simple. So they were not apartments. So that's why put that asterisk there. So I just wanted to only comment that have come in. Conditional uses for multiple family dwelling units in the sea to districts. Yes, there have been a total of 13 since 2000, 15.
28:50Or 8 of those room, the West Mercury 8 of those were in the West market area. One of them was done. I just wanted to put that out there for disclosure. One of them was denied. The one that was denied. I have the list. It wasn't. It was off a 52. That's correct. I was that for the affordable housing you know, that's what it was. 5 deer Creek or something like that. That's that's correct. Yeah. I speak.
29:19That's correct. Yes. So if you recall that one. Yeah, so basically if we can get the next slides. I just want to show, of course, the West market area.
29:29today we're just here to take public comment all answer any questions you may have. and then adoption hearing will be on May 4th.
29:39Signed up to speak to the sound from the public.
29:43So there is just double check real quick.
29:52I did want to mention I apologize. I should have said this before the local planning on April first found the proposed ordinance consistent with the Pasco County comprehensive plan and recommended approval to the
30:05can you put that map back up absolutely. Was there anyone is there any but we're waiting on that. Let's get one thing that bothers got that one does not the next. Okay. That one. While you wait for public comment. I would like to look at that. we've got a way so that you knew that individual that was signed up on what it says is now at the kiosk pay for this item so, you know, by saying that for women now, no one else but the individual that's now at the kiosk OK, we p 44. Okay. Thank you. So let's go to the key acts and it public comment. Is the one at that he acts. Not I mean, it's not only my address is 2, 3, 3, 0, 4,
30:58Charleston place behind lakes. what I want to stay on this item number is quite because it's an amendment to the land development code. I believe it also mentions zoning. And today I'm going to be commenting on a few other different issue that are in regard to is put a few wins on the agenda. Days P 48 P 52 P 50. And keep in mind.
31:28Big yes, we'll OK. My my point is
31:32my comment is sorry. That threw me a little bit. A little nervous. It's my first time doing this number yesterday. Instead of but I would just I feel like that citizens need more information on what's going into changes and development code changes in regard the way the county's doing their planning and also they're rezoning process. And so that's all for this item.
32:01I get to thank you. Thank you for comment.
32:06But Mister chairman. Ask. I couldn't see No, I was just going to ask that. I think that was a student again, like we had last time. Possibly yeah. Like we understand that's required to make public up for class right. I could be wrong but I think it is what the come back and say, yes, remember. That's okay.
32:39Or is anyone else at the yards to speak to this item.
32:53There is nobody in the kiosk for that item. Okay. Thank you.
32:58We're back to the Commissioner.
33:01Yeah. I think this map is fascinating. And I wonder if not what people looking at, though start on the West market area which. What is that the county line. You know, this. It's not really caught. You don't have be. I see 1, 2, 3, 4, 5, different color. So. How do I how do you know where the lines are. So the kind of like the. The best way to describe maybe as the yellowish area is the West market area. The left, yes.
33:38Okay. Yeah. Russia stars are yes.
33:42And then the South market area is the one goes up along Suncoast and 75. Yes. If you see like on 41 at Suncoast and5, just as you stated. Yes. A then the Nort markets that dark grn th grn. Yeah. And we don'have a na for the I gue that's East market. That'she bght berries do all the y to the to they Ry side. We n'have anyone any. And jt wa to be clear, doesn'teathat we rezone parcels tanF one, an EF or a 3.
34:13I'm jt mparing the conditiol uses for multie family dlling units and 2. And I know the applitions wee received sin 2015. I think this sr we hear.
34:26Is is the adult rental community behind the public's ire impossible. I I have them all called out. Yeah. So I don't think I don't feel the need for you to call now. But so doctor Gill says property in Manor, former Rancho del Rio and little road. Yes, and that was that was an approved in 2000, from the conditional use 15 dash 18. So rather than 350 feet east of little Yeah. That's a very successful gated. Don't rental community and its. That's a really great place. If you don't want to buy something and you want to. You may feel the need to be very secure. I think those people are and that that's a home run for So. I like the idea that we're going to be making multifamily integrated. You know, I've heard the comment that we require we we have a mixed use projects, but to me a mixed use product project doesn't mean you have multiple kinds of uses. But that the uses are integrated together and you're making a nice walk. A ball. It's a sense of place that the uses work well, with each other. It's not an apartment complex backing up to the back of a strip mall they even sometimes have to drive to because there's a wall and they can't get to it. So we're going to require.
36:03A greater kept conductivity between the uses, right. Anna.
36:09Well, the way that this is written. It's it's basically for consistency with the comprehensive plans. You have to have the uses vertically integrated into the project. So.
36:17It can't just be a.
36:19Aside from the affordable housing aside from the West market area that would be another option. So if you are in another market area that it would be an integrated Have yeah. Like downtown long we or has the market and have the retail uses underneath and the resident on the on the parcel, correct. And you see that in lot cities, you don't see that the whole lot of suburbs.
36:42But I think it's. I mean, I personally like it. But so that is the only way you can come in see the few. Those 3 different ways. So you have 3 different ways. Can you go back to and those other districts not in the West district. So that would be. And that's if you want a conditional use, if you want a conditional, use them. You can always go on apply for an M F 3, for example, which does have the opportunity of having.
37:14Some commercial uses consistent with the C one district that are to in the in the N F 3 districted specifically says it's to serve the the folks who live in the apartment building. So.
37:29So you can you repeat those 3? Sure. We don't thing can go back to the slide shows. And so that way we can. Look at it together. So this is the so they would be affordable housing as defined in section 4, 20.0, 0, 0, 4 Florida statutes.
37:52Or vertically integrated mixed use where the ground for commercial officer, other non residential use or located within the West market area as defined in the comprehensive plan. So the 3. Carve outs.
38:08Though, removing this. The multi families with from the conditional use you can still have multi-family. But but for but for these types of projects you know, it's still need a heat still need a conditional use for these types of projects. Everything else is excluded.
38:28So whether they exclude. What did you exclude Class A apartment. So if you're in the East market area, for example, and you're not going to integrate.
38:37Commercial with residential, with multifamily, then you can't do a cat. A conditional use for multifamily. For instance. Same thing in the North market area. So there's commercial. It doesn't mean you can't rezoned to an F woman enough 3 could still do that in those market areas. But you can't requests a conditional use for multiple family dwellings because you don't meet any of criteria.
39:07Can you put that map back up I my goal from shoe with. For that. Was or if there's a developer that wants to build multifamily that they come in and they look from multifamily and that of 2 or nf 3 zones not coming in and looking for multifamily. 1, 2, 3, or C 2.
39:29Yes, I understand they can still come in and still look for a And as long as long as they meet any of these criteria right.
39:43So interesting. I have not been contacted by one person on this. No one from the building community. No, we have folks show up at the local planning agency. We had the apartment.
39:54I don't have my notes of who was But there were folks that are the Tampa Bay apartment area builders 2 for 2 folks from that community and you may have some folks a webex right now, but I'm not I jewel to was on at the local planning for both meetings for the March 4th and also for March 20. Whatever it is. I'm sorry, Lee struck a date at this point knowing only the person who spoke signed up for this one. OK. So we've I had the one 1st. and the other commissioners that mean.
40:38We all I think no work districts better. Then, you know, I don't know or the intricacies of commissioner Morris district that well, frankly, I was blown away when I drove around and where grass in Union Park and all those I had been out there and it was
40:57I know in in.
41:00My our challenges is my district in 19 is over. Commercial. And in need of. Some other things coming And so that is why I'm not. Want to see that area come in because I feel it very much needs redevelopment. So as an example, one of the folks who came in as a for a conditional use and it's on the list in the urban service area.
41:26And in the West market area is the what with the redevelopment of the gulf. The square mall. Yeah. So that was one of conditional uses and C 2 and we were able to condition. And as a matter of fact, that particular is in the in evacuate hurricane evacuation zone. So we were able to put lots of great conditions that are permanent to, you know, the coastal high hazard area, whereas the street, you clearly in district F one enough of 3 cannot be condition. But. The applicant voluntarily agree, a green to a deed restriction or a development agreement or something that is that that would go together with with the rezoning. And
42:15the only so is the only place that doesn't have to do what you require the West market. if it could meet one on one or more of the following criteria so affordable housing.
42:30Doesn't have to be vertically integrate because that's one of the criteria. But it could be burger and triggered doesn't mean it doesn't have to be fine. So vertically integrated stand-alone separate criteria located in the West market area separate a criteria doesn't have to meet me 2 or more. It's one or more so. So commissioner Oakley, I guess I would ask you.
42:47And again and I don't know if that's more says, Rick to your b*** and I don't know all the intricacies of 3 oh, one and 98. Do you feel that. This is OK for that area or do you want to consider. For now, not having that area in this.
43:13We're saying 3 oh, one anywhere you actually talking about I'm talking about the Vietnam wall and commercial stuff that might be on the East Side that.
43:19You know you and maybe there's not that much C 2 is not a problem. I've got tons of C 2, 1, 19. We have we have some we probably need more in a certain area but that we're addressing them in the future. So. At the corner 3, one. I'm okay. We have totally different circumstances yeah, as you. You're bringing this bill that we're referring and bringing all and still very rule. Yeah. That's why one thing is he doing that. So I'm wondering if this is too restrictive for a new chairman ugly. And I don't feel like it because Northeast through is pretty restrictive in itself.
44:05That takes out a block of land in an area that you know, Christine, it.
44:11Companies and businesses are still in developers are still able to come and. Asked where land-use change during his own in change. Absolutely not. That still do so later on. But the main purpose is when they originally come in. They're only looking for where they're supposed to be building not looking for commercial building. Is it supposed to be commercial, try to keep the commercial. Then if you have to expand, look for additional areas and look for additional areas where if you want to build commercial a multi families and that's a different perspective. But if someone is coming in to only build. An apartment or multifamily than they should be looking for that zoning to begin with. You know, and an example of why we don't want this. And some of our 19 is, for example, say the Rasmussen college that just came in.
45:02Well, wouldn't it be great to have a complex right there with that could help students that live there. And that would be in a commercial zone. That's in the city. New port Richey, not us. But that's an example of a in a area that have commercial that. Could be re imagined. But no one saying that they can. You know, they're not. And I'm just saying that's an example.
45:31Remember rezoning doesn't it does not have typically conditions attached to it. So for example. I'm nothing we couldn't we could through a deed restriction. We could through a development agreement. But that's having another process and more. Application money. It will cost more money for example, to do that more staff work in staff time and stuff like that. So at least the conditional use allows conditions can also be revoked. Can't revoke a zoning conditional use can be revoked. So if they don't meet the yeah. The conditions of approval or whatever it can be revoked could be taken away. That's why like keeping it. West market.
46:15Okay. You know, the work with common Mister on.
46:20Thank you. Real quick. I just think it's important maybe there needs to tell the rest of the commission because I watched. When the commission meeting. when this was regulates captain not include affordable housing portion of this. This was something that the planning Commission asked for prior to approving and they continue that. If you want to tell folks that was not in the initial recommendation. That is that is correct. It was. You're Commissioner It was it was brought to the planning Commission as the board has had requested.
46:57Just. Just doing a strike through of multiple family dwellings as a potential conditional use in the sea to district the planning Commission said, oh, we have some some might. We think that there there are unintended consequences that are going to occur as a result of this. We did as I stated the folks from the Bay Area apartments and things like God. We also did have someone from community Also speak on affordable housing in the West market area and stuff like that. So we tried to address the concerns of the planning Commission of the local planning agency with potential unintended consequences by carving these things out. And these. 3 things are consistent with the boards direction the past redevelopment in the West market area. Consistent with a comprehensive plan that commercial it in the com, for example. And even in the R o r that there should be a vertical excuse that these were the carve outs. And you know, again. It's it's to the board as the board. Has a different direction. I just wanted to present what the staff presented to the local planning agency and local planning agency. Actually, you know. a commentary that big that this satisfied, their concerns. I know it was there.
48:21Take a look where the trail. So yeah, I on to what the quite honestly, I I like the initial proposal House proposed by commissioner. That's Patrick originally. It reached out to me that the planning Commission meetings.
48:44You know, I want to see this big Board. So, you know, reluctantly, I said, hey, I I I do it to be with that addition. You know, I will be. But I do. I preferred the late Mister Fitzpatrick originally proposed this. But again, you know, this is going to get through. I supported move forward better. Mister chairman.
49:09In the past. You've broken down. Someone has broken down about. There's about 19,000 apartments on the West side of the county. 12 8 on the North and the South. And then there's a 1000 on the East. Are these. Is there a breakdown?
49:28Class A or will this breakdown is only I'm sorry, conditional uses for multiple family dwellings that I I can read the some of the well, in what I'm looking at is we have 19,000 partners on the West Side.
49:43You said and I know we've talked about the mall area in revitalizing everything. How are we revitalize singer, how can we continue to move forward to improve some of these apartment complexes that have gone backwards.
49:59Well, I I can only speak of the multiple family dwellings in C 2, we can put conditions. We can condition them and state what you want to see. You want to see additional buffering. You want to see more there. There's conditions that we can we can place on on these things being that it's a conditional use. I don't know about the I believe that perhaps the following. Moratorium in the geographical area that might some information on numbers or theirs future that will provide information on numbers. I just went through the condition of that. As you can see, they're not that many of them in the last 5 And I can break down that, you know, some of them were for you know, affordable housing for seniors, for there's a couple that were like that for double housing. 83 units. The one at to get Gables at gulfview. I'm not sure what's is that like market rate. Market rate apartments, 410 departments. Again, some of them haven't been built there. They just have an approval. For example, the one that's in the South market area Bruce B downs and Wesley Chapel That one has not yet been built. It just has the approval. According to the timing and facing its a 100 units and it's supposed to be for senior housing as well. So I do have some of the breakdowns of these that have been approved. But I don't have the that number that you're stating. But I think conditions can if we can place conditions on these. So at least there some control. And again, conditional uses can be re vote. Whereas a rezoning cannot be rebuilt. I would question the number of 19,000 apartments units West.
51:54County, multi-family apartments. Like to see those numbers about Terri B have amber. They were in one of the presentations. We're in the day for the side. But it was so there was 40,000 rentals rentals but not as high as 40,000 apartments. And when they and said there was 60,000 rentals in Pasco County. Says about 2 thirds of rentals or apartment.
52:25No, I I well, I I don't believe that's you. Mister chairman Mister just this remote as an adopt them.
52:39But others today.
52:43Now we're now down to the Pentagon interaction is your first public hearing.
52:48So the first hearing I'm sorry. Yes, here it is. No, there's no action taken a lie today and some of the the adoption will be May 4th. At one 30 if their particular numbers and things that they reach up. I think we could have this bath. You know, commissioner very different questions. We've got a staff and get the exact the right numbers. We take note the Senate debating it today. What's right around?
53:09Yeah, they can get the correct numbers. Thank you. Thank you.
53:21That includes virtual rainbow, hearing of the Fenton is normally does this. But the bit to this is this concludes your first public hearing. Second public hearing will be held on May 4th 2021 at one 30 years and they're after is a may be heard in Dade city.
53:36Thank you. Okay. Thank you. Move on to P 45.
53:44Item. P point-five was published in the Tampa Bay times on March 21st 2021. Mister chairman.
53:56Item. P 45 is pretty 21 0, 3, 1, 6, It is the the first. Public hearing for an ordinance by the best kind of Board of County commissioners establishing a temporary moratorium on any days on the submission and acceptance of applications for conditional uses rezonings and conference of plan amendments proposing to increase multi-family entitlements within the moratorium area providing for authority. Legislative findings of fact that the missions moratorium area temporary moratorium imposed duration of temporary moratorium and severability. And of course, there's no action required today. So in short, the Board of County commissioners on February 9th, 2021 directed the planning development Department to draft a temporary moratorium on the submission except so that put patients for conditional use permits rezonings a conference of plan amendments that are proposing to increase multi-family entitlements within the moratorium area which also a in a few minutes in order to determine whether additional regulations are necessary and this is so that more time is affected so that the bill that we can accurately calculate and determine the true potential for the number of multifamily dwelling units within the moratorium area. Looking at that particular area and then also looking Tony white as well. So during the time of the temporary moratorium. It will be searched. The current climate in multi-family, dwelling units and entitlements. The current. It could land zoned for multi-family dwelling unit uses including that includes having the potential for multi-family dwelling units. Upon approval of a conditional use. As well as the potential number of multifamily 20 units available through existing land use equivalency, major U.S. cities which are the we've talked about mechanisms within mpd that unable to land trades between uses. So we'll be taking a look at that during the moratorium area on April. First 2021 the board of the local planning agency. Found the proposed ordinance consistent with the company's plan recommended approval to the Board of County commissioners. However, they an additional request that we
56:13look into the vacancy rate. To the scope of the study during the moratorium. So the sus the vacancy rate within are you doing work around it yet in the moratorium. Mary.
56:27Looks like. Just went through that. So here's and this is the map of the proposed moratorium area. Roughly speaking its 5th. There were 52 on the North us 41 on the West still 54 on the South. And over to Bruce B downs in the East where you go. North cross over that overpass road to uphold Pasco Road and then the this exact right there at the northeast corner area. Let's call it. Is the district boundary between Commission district. One commission district, 2. Where is that down? It would be at the North East and of the moratorium area. Kind words exact. That a plane or make it was a strict new country.
57:19Where we discussed earlier. You can write right. Excludes district one. Yes. Okay.
57:32So no action is required at this time from the board of County this item will be before the Board of County commissioners for adoption at the May 4, 2021, public hearing we're at if it were to be the moratorium would be retroactive and take effect. Beginning April, first 2021. Okay.
57:55And 6 months or 6 months from April. First for my property. OK. You're they prefer this am I did it. Who is a public hearing first public is anyone to keep when the have anyone with things just because I do have one person webex, but you were not able to promote him to speak.
58:22Issues with how he joined the on webex is not allowing us to promote him to speak.
58:30You have we connect possibly come back I think the guys. I don't believe he's been advised that maybe someone can chat to him. And I was in his hearing can you turn it on well, someone needs to call the law firm and.
58:51Tell him how he can get on it. You know, this is our problem. Not. Spot is so I would go ahead and take the kiosk at that point. And and OK, is any one of the key arts. Here's speak to the 45. Are they connected. And one of the key ox.
59:26There's nobody the key up for this item. Okay. Thank you.
59:33So maybe freeing conduct this Jones speak. What I would suggest is if you that this is the first public hearings. So if you temporarily pass this.
59:50Move on to your next items. And then we can come back to it. If we can get the speaker. And ability to talk.
1:00:04Move on be 46. We'll come back to the 45.
1:00:10P 46 was published in the Tampa Bay times on December 16th 2020.
1:00:16Good afternoon. Denise Hernandez planning and development P sixes PD 21 0, 0, 9, 7, It's an ordinance amending the Pasco County comprehensive plan providing for a comprehensive plan plan. Text amendment to sub-area policy. Flew 1007.11 to rivers map amendment to the highway vision plan 7 dash 36 providing for repeal or severability and an effective date. Today we're asking you to adopt the proposed comprehensive plan amendment to rivers by roll call I do want to bring to your attention on page 9 after the word and Pugh D open per ends as close per ends. That should be a comma instead of a We're going to get the correct information over to the clerk's office. Just wanted to note the record on that.
1:01:06In one sign up for people to 6.
1:01:13No one on the Web banks you know, e-mails for peace between us and one of the chaos for before to 6. There is no, but okay after this. all right. Thank you.
1:01:35And just I'm sorry to correct on whether it's friend. P 0.6 is the applicant just not any public you want to. Item P 46 the applicant is on webex not public comment. We didn't. No problems be no comment. No public comments on people to 6. But the applicant in on that happiness with a happy note. Like to speak.
1:02:10But let's go through this and it may or may not just a second.
1:02:15In a motion. And second, I roll call vote. All those in favor district 2 commissioner more motion.
1:02:27Room district 3 commissioner starting. I'm district. 4 commissioner Fitzpatrick. I district 5 commissioner district. One chairman Oakley.
1:02:34Motion passes unanimously. Thank you. And we've got the connection yet for the 45. Okay. Sir. Move on to be 47.
1:02:57Item. P 47 was published in the Tampa Bay times on January 27th 2021.
1:03:25Good afternoon. Commissioners. Amy hiler with long-range planning item item. 47 is going to PD. 21 dash 0, 2, 2, 5, This is the adoption hearing for a small scale. Comprehensive plan amendment in the name of see past 20. '02, Meadow Brook. And I'll read the ordinance into record. So an ordinance amending the Pasco County comprehensive plan providing for a small scale. Comprehensive plan amendment to the future land use map. This map 2 dash 15 and she 20 changing from rez 3 residential 3 dwelling units per gross acre to calm commercial on approximately 1.6, 7 acres of real property located on the southwest corner of state Road 54 and Meadow Brook drive in providing for repeal or severability and an effective date. So this item was previously heard at the March 23rd in continued this public hearing. So go through the park point again as previously done so the proposal is to amend the future land use map has previously on maps 2 dash 15 and she 24 as 3 to calm it is located at the southwest corner of state Road 54 and Meadow Brook drive maps 2 dash 1520 or the maps that are going to be amended. There is a companion rezoning petition to see 2 commercial as well. So to go into detail, the proposed amendment is consistent with the severe or with the following policies in our comprehensive plan. As you see up there, it's location for commercial development. Transitional land use and residential govern. So. Just to give you an understanding what the comprehensive plan is saying. So policy flu 6001.2 location of commercial development states that any plan amendment to calm future land. Use designation shall only be a allowed under the following conditions. There are 3 conditions that allow an amendment to calm commercial in this the 3 conditions are as propose the possible locations for calm future land shall be limited to areas adjacent to existing collector. An arterial roadway intersections. So this subject property is located at the intersection of Meadow Brook drive, which is a county collector or portions of it is a county collector as well as state Road 54, which is an F dot arterial roadway. An intersection. You know, we ended reviewing it with F dot getting definitions. We
1:06:00understood intersection and there are 3 intersections that at and at grade connection or crossing of a local road or he's or state highway. A conventional at great intersection, including 3 legs or an area that includes not only physical area where the roadways cross each other. But also an area upstream or downstream of physical intersection. So in this case it does meet that qualification as being located at an intersection of an arterial collector roadway. The provision is commercial. Uses shall not be located in a manner or type that will detract from or the development of designated TC flu or town center flew the only town center flu located in the county is out by Curley road. To the east of the county. So this does not deter from the existing or any interesting town Center for future land uses and the development or proposed commercial shall not designate strip commercial. And if you guys call the location of this proposed amendment is located at the intersection of Meadow, Brook and state Road 54 along the frontage of state Road 54 there only a parcels that would be in or that would be. Impacted. 2 of which are currently residential. One office and then the other is an existing storage unit, anything outside of that. It will be impacted because of an existing. Wetlands that can't be developed on. And transitional land uses. So transitional the land uses. We have a table that is set in place that allows us to navigate our future land uses and proposed amendments and ensure that they are a transitional compatible adjacent to each other. If you go to the next slide, please. This is the table exhibit 2 dash 2 transitional land uses. As you can see, the proposed land-use being commercial is considered a compatible transitional land use adjacent to residential or existing residential. 3 future land uses with sensitive site and as previously in our meetings the applicant has agreed to a deed restriction to impose buffering and other other development standards. So this is your locator map that shows that the property is located in the South market air urban service area. This is your area where it shows location being at the southwest corner of Meadow
1:08:30Brook drive and state Road 54. And here is going to be your existing zoning as you see the site is zone a or one agricultural residential. It is being proposed with a companion. See to zoning district. And the future land use current or the current future land use is raise 3 as you see. The proposed future land use would be to come commercial. And it it does meet the location criteria set forth in policy flu. 1, 6, 2, So this is just to give you a little run down again or refresher as to what had occurred previously at the March 4th public hearing the local planning agency did find the comprehensive plan consistent or the proposed comprehensive plan amendment consistent with the comprehensive plan. They did also recommends staff to continue the proposed rezoning, which you will in a couple days. As well as directed the applicant strapped a deed restriction. And then the BCC action which was previously made on March or 03:23AM. so that's the type but it should March 23rd staff. They directed staff to continue the item, which is why we're here today. And then on April we did confirm that the applicant and the developments representation to me to. let Barber Wilhite speak to that in their meetings. And with that, we do recommend that the board find this consistent with the comprehensive plan adopt by roll call vote. I'm happy to answer any questions Mister chairman yes, the you back to the map that shows the parcels trip.
1:10:19Or do you want the zoning map if you want any one of them were shows the parcels identified. when we were discussing, I was I was concerned about the intrusion of presidential. I mean, commercial into a residential neighborhood.
1:10:34And what was most concerned with on the 2 processes that are highlighted in color to the right side. The one person 54. I mean, that should be commercial all day long known there, bill residents there. I did the with the applicant in and the in-form to me that on the partial. That's right. Below the one a budding 54 that's actually a commercial use. It's not the gentleman we thought from true simulation with the partial. It's right there. Hearing that that that dramatically changes. My interpretation is I thought if he was right across the was residential. It was a different scenario. Knowing that that has been given some type of commercial designation because the person is offering a business out of their home. That to me that changes quite a bit. Terry, was unaware of it but give him and I had talked about extensively because I really want to really delve into that one point that I thought the had made a super is still concern about environmental stuff but understand looking at that point there that effect to me the you had before. Sure.
1:11:50Just to come comments. Now. Are we going to have our business partners. This here from the applicant.
1:11:58I was part of a high 6327 grand Boulevard. New port Richey, Florida for the applicant. So in the effort cannot be repetitive because my presentation of a lot like that. I would presentation what we did before. But we have a lot of public comment lot of rich people buy a lot of rethinking the record. A lot of people would think care our Web extra people. so I think the most efficient way not to be repetitive. The staff presentation had was to go ahead. The pier from the public and then get the bottle with our presentation.
1:12:32Mister chairman. That. That's fine if that's is why it wants to do. But there were they were directed to. I mean, it was continued for a reason and we probably should have the right reasons before that before public comment.
1:12:48Well, and we ask you, Mary idea, the folks in that neighborhood stream even see if you all could come to an agreement. And get back to us. That was the main reason for containment. It doesn't seem like that's happened.
1:13:03We we haven't reached agreement. We prepon put together the folk that we're going to 10 from the neighborhood and we did have a Web back. We were not able to reach an agreement. The residents are looking for no commercial uses they would want to wander off a few of them and that's what the future would be allowed. And so we were unable to reach an agreement. But we have and pursuant to what commissioner Mike stark you down. Very important, which is they actually the neighboring properties. We've been working on that would So it's not really in our presentation for day presentation for planning Commission on Thursday. But we have been working on. But from plan. Going to be a distraction. So that we ran to present that to the planning Commission member, the comp plan for you to decide. Is it the probe, the current land you going to do on the property presidential. Is it appropriate to go to non-residential if so, you would support be that calm designation that would apply for. And the rezoning issue that come back later and and planning Commission is going to be talking about the rezoning on Thursday.
1:14:26if you if I just kind of piggy backing on what commissioner Marianna just said in one of the reasons why I wanted them to go back tax was because I was concerned about the impact on that lot to that This one but learning that is a business and probably will come in for commercial zoning. Maybe as well that city's health or his father's House. I don't recall his is. Is not the one that's across from this that. it's been a much more at ease of though. There's still discussion about buffering that property. The other House just south of The other side of that, the canal or the pitcher one. Extreme, whatever you want to call it, they of offense but it made me much more comfortable you know, all those parcels along 54. Of those possible on 54 Barbara storage unit.
1:15:38And this corner. They're set for one. There. Either opt businesses are going to be commercial or business is correct. That we know that correct.
1:15:54That's correct. It 2 of the 3 part of a long 54 around by a doctor. One of them are because he is owning or the property adjacent to the Web to done by a doctor. It's a big it's not being used to residential. Part one between the doctors part but W to residential and the one that is.
1:16:19Apparently still I don't know what's going on there. But if you look at it on Google Earth and looks to me like it's I don't know an auto repair.
1:16:26Building or company or a. Something something's going on there that I don't I personally don't think its own foreign. Maybe we need to look at that. But looks like it's already in some kind of commercial youth.
1:16:42This year from the other ziebell webex to speak this. I'm yes. Mister chair. We have. People have pre-register, but only 4 or log in. Can take. The first one is like. I Douglas Grant. Mister grand, if you could. If you don't, you. MR Grant, can you hear us? I can hear you. Okay. Barely now. Great. Yes.
1:17:21OK. Thank Just for the record. And then you may proceed. Yes, and there's a presentation please. Thank That's not it. I different presentation put it. From Douglas credit to 2, 3, 5, Brookside drive with Florida. Before campus company signed a contract. So to lot to a fuel station developer. A fuel station is one of several sea to land uses because groundwater pollution. Consequently require comp plan amendment alito groundwater pollution source. The subject parcels which are in a community that uses ground water to drink wash near a gate next slide. Please. I previously told you I'm qualified to address this matter. But this time I'll show you what the EPA and the next slide. The greatest have heard from a leaking underground storage tank is groundwater contamination that slide. There are more than 10,000 patrolling tank subject once mediation of Florida next slide. Here's the key is map of the sites in central Florida. It's not whether contamination will happen when that flight. Here's a map of the hundreds of petroleum restoration sites just in Pasco County next lot. Already 3 fuel stations within a mile of the key campus company. Lot with a 4th fuel station under construction at the new Cypress ranch development. One quarter mile East. Now the board is contemplating allowing if if station in this area and this one will be in fight or neighborhood. That's a lot. It's important to understand that at the cut cap parcels. The fuel tank be submerged in groundwater, which is only approximately 5 people a land surface, if you will impact the adjoining Creek and ground water and the impact of groundwater flows to our Wells. There are 6 Wells adjoining the campus company lot. There are 19 Wells within 500 feet with many more Wells nearby next slide. Here's a summary of the county inspection results for the 5 fuel stations closest to the Kent campus company parcels.
1:19:58All have issues that relate to contamination. Didn't passed over for protection devices. Didn't perform the required integrity testing. Nearby racetrack is only 2 years old. If inoperable components that have or can cause a release. No response to the leak alarm next slide. Circle K is only 4 and a half years old. His compliance issues related to contamination, including fuel relief detection, not conducted. Next. A lot. 7.11 and the racetrack, the same pollution related issues at every gas station. The station will be no exception next slide. The Florida legislature has already established that the protection of groundwater resources is vital and the protection outweighs any economic hurt next slide.
1:20:59The board would not allow the option of a fuel station at the South as well. If the county allows the comp plan amendment rezoning you're not going to auction of the pollution source right within the metal per community. Well field. When our ground water is contaminated. Ask yourself how would you explain placing the financial interest of the campus company about that. Mister rancher
1:21:27next. Person signed up is Todd Pressman was approved for 5 minutes. Mister president, if you can state your name and address for the record and then you may proceed. But even for president or just second Avenue. South.
1:21:44In the second Avenue. Number. 42 months acres of Florida before to begin a presentation. Mister chairman. It's very difficult to follow from the I need to ask if I may. Please a clarification from Mister Mariano. Exactly what he was referring to in terms of other personals and having. Business activity. If I may, please was very difficult to follow up.
1:22:07We say that because I'm.
1:22:10On the partial directly across. The lowest parts that we're looking at. That person that we thought was it's it's residential. But this a commercial business being run there that is specia Classification was done to work. They can do bo fide commcial work there. So whereas we we I thought that was resenal before any peonctually fr tru silaon we thought wa loing osthat I thoht s oking across theayas nothcase. He'sctlly the rtial downn thotr side of the canal ilit of that. To me e mmercial intrusi haalady happened. Beit. And if tt's been approve it's harnoto approve the one right ross the street fr it. OkaySir, just befo the clary is that the purple referring to across Meadow Brook. Acrosfrom Middleburg S. OK, I understand if I may respond to that. This is new information for us. But I was sent information from a resident there that. I'm just being reform. What I'm being told that that was a special exception for real estate office and that was rescinded when the property was sold. I haven't confirmed that. But that's what I've been told. I don't know the credibility gap. I think that's important. First of all, because it's a lesser commercial use of soft tissues, which he says except for the residents and I understand has been rescinded. So with that, if I made move forward with the presentation, Sir. him. Okay. Commissioner Starkey brought up a really, really interesting point. And it's it's also tangent or what commissioner Mariano brought up, which is how the site that proposal situated in regard to the neighborhood residential and she referred to specific site of McDonald's the country place. So we started to research this to be good. And that's likely. What you'll see at the McDonald's. The country placing you'll see that is a single parcel is not a partial that intrudes into the residential it's built with the commercial along 54 and no intrusion or a lot into the subdivision next slide. Please.
1:24:19Again, no interior lot as part of that, Donald next slide. Please. Was this is what we get. That's what it would look like next slide. Please. Here's that. They think this is the plat. You can see the Vols a site and 54, which is which were commercial or wanted, but also about that a lot that is completely interior to residential subdivision next slide. Please. And this is life. You can that the intrusion of the heavy commercial. Let's talk about this for a second. The applicant with both to come forward per your motion and give you specific uses. That's what staff programs motion was the only in specific use we heard from this white was a guessing convenience store. She referred to taking seat abuses and excluding them we have not seen that. I didn't hear her say that to the only use that we specifically heard from her as required by your prior motion is what used to be. And that is gas. Inconvenience next slide, please. That's incorrect out of Harbor to direct them support. Look further to the east across what I look for. Any other type of similar scenario of residential close to commercial and 54 and I followed for the Dow Mike Ross within same thing. Commissioners. The commercial lot is equal distant with all the other commercial lot. There's no lot intruded into a plant or the subdivision. As you can see here next slide, please. The next. What if I was a carpenter one to the West. Same thing. The commercial uses all contain a long 54. There's no intrusion to the rear neighborhood residential next slide. Please. The problem for these the manasota Rochester. Same thing. You'll see the commercials lineup. for the use for the residential to the rear next slide. Please. 7 Springs intersection to the east same thing. You'll see the residents a little better, but for but no commercial lot intrusion. Next slide. Please. And our planner told you that this residential subdivision next. Like these. What was planted in the 70's. So this very brings us a very unique and singular site. The plant in residential community have been there a long time before this applicant came forward to try and resent this lot for commercial government and called upon to 6001.4 is very clear.
1:26:48New neighborhood commercial uses shall not be located internally within existing single family neighborhoods. As you can clearly see there's a tremendous distinction between this life and the many others that I found along with before they're somewhat located next. Likely. The county should protect restore the trust in the Centre intrusions of adjacent uses. We don't believe it is any way possible that you can offer or cracked this residential neighborhood neighborhood when you're intruding in which directly.
1:27:19From the Prince could one of the most intensive use it you can have, which is a 24 hour gas station and convenience store. We believe it's impossible and no formal buffering will be able to do it at this particular location. That's why we didn't agree with the applicant, the applicant. It's supposed to look for the specific use of that. I have not heard the next slide. Please.
1:27:40Remember the uses a very intense a veteran to come next slide. Please. And I'm sure transitional use of their flight Lee's. Next slide. Please. We reject the applicant's claim that both parcels, particularly internal are due for the infrastructure. Improvements that are violent 54 they should not be like they're in the front lot, perhaps. Yes, but along with before or behind it because this like the singular and has pointed out to be terribly makeup. It negatively affected lower property values that it is different than what you see around 54 and it should not be approved. Thank you.
1:28:30We have gotten to more on webex. We have look Bureau. Thank you. Mister libro. You can state your name and address for the record.
1:28:45Yes, it's Luke Laura 20 to 40 Bel Air road Clearwater, Florida, 3, 3, 7, 6, 4, And I also addressed to the left during I just want to express my appreciation. This Wilhite was kind enough to meet with a number of the residents of the area and Mister president on. It was at that point been a rather than the general described the description of a commercial use. It was revealed that this would be a gas station and convenience store, which was a suspicion that my clients we have from the get go. One of the reasons that I have a concern with this and certainly what's been elicited by the folks that live in that neighborhood is that there were 2 prior efforts to try to get this properties, don't in a more commercial fashion for a significantly less intensive use, both of which were unsuccessful. And I think that the whole concept of what you're doing here has or is the fact that the comprehensive plan supposed to be designed to preserve and enhance the public health and and obviously to make with the neighbors is a small-scale amendment. So I would respectfully suggest that there has to be some sensitivity to the small-scale impact its use would have. I have to agree with Mister president. I don't know what buffering would be able to protect those residences in that that would have to bear the actual impact of a business that would operate either 24 hours or as many can be in stores are open to 11. It's a real difference. Then any kind of a real estate office or whatever the other so-called commercial intrusion was and quite honestly, I don't know that it will be a success either in the comp plan considerations that you would have or any way to. But for this because when you bring something in the context of commercial. We all know that that covers a vast expanse of different types of uses that vary greatly impact that they have on the properties near them. These residents are terrified that this is going to have a dramatic negative impact on their property values. And it's not so much the NIMBY thing that we all know about. This is a very clear and unequivocal impact, especially when it comes to the output of operation of a place it's going to be noisy and you can get away from that. I mean, obviously a gas station convenience stores a
1:31:07lot different, a dentist office which closes at 5 or 6 or whatever. So I think that to just simply say that this is consistent with the plan. Certainly overlooks those components of those plan elements as far as the. The fact that this this is more of a could hit that had been a transition and I would urge you to reconsider this and either deny it now or when it comes to the planning consideration demand but rain components of a restrictive covenant that protect these residents really adverse impact such years. Thank you. Thank you.
1:31:45Mister chair. We have one more on webex Wanda Neal.
1:31:53Good afternoon. we have signed up by his self and my mother Lillian on the task and my daughter Alexandra any oil with his We're all here. We decide on one cameras. We need to sign and we had all registered. We're just using the same camera do we all need to log and separately.
1:32:12If you're basing going to say the same thing. It would be better if one of you spoke for the 3 minutes.
1:32:17Well, but we actually yeah. Maybe we have a we have a slide presentation thank you, And I was going to started my daughter was going to continue and I will finish up. That's OK and it's just the first couple of pages are just showing introduction. My name is Linda. There's a there's a very loud background noise. So you guys hearing that as well because it's very distracting there. We don't hear it here. Areas when everyone when each individual comes up to speak up. They can state their name and address for the record and then they can begin. I think
1:32:57I want to kneel one 73 a bridle path or if you could fast-forward to slide number 3.
1:33:02We would like to cover time permitting a description in comparison of our 50 year-old on a chilly subdivision to others within the area, including traffic environmental issues and a specific. It is a specific commercial entities as well. As Arts Center says, like Pasco County is rapidly going from a role to a heavily commercial area sideways. Our offbeat comedies lot of open spaces, vibrant places a commercial property and every cultural residential neighborhood is not getting with that Lotto. We are the only subdivision in this area without space between the main road and homes as we'll show until there are no parks. A community areas within our borders as other have others happen as you'll see they're over water and underserved life. We do have some suggestions on a future use in future planning. But the area one for us will be a nice place to our community and meet like a park area slight. Many of our residents have been here for decades before. But the rapid our subdivisions enjoy spaces between our homes. We're not looking into each other's Meadows and we have space for farm animals and pets as well as enjoying Royal wild like regular. Looks like the next several flights will compare the entrances into this year of highs in the book and other This is the entrance into Syria. Pines. There is a narrow two-lane roads as the turning Lane recently as last year's. But the traffic light the remaining roads this year. Opponents are narrow two-lane roads medal birthright at this point. Measures 3024 feet with the additional looked remind makes it 33 to 34 for because the planner in comparison average semi is 72 feet and I do not see how somebody could turn into this and come out on that might be able to make them right now can turn on to 54. It's a big part of the roads are small and Kirby. There's no place within Syria pines to re 72 foot truck to turn around this white. The streets dead ends sharp curves and there are passages slide. The next several slide show. The difference is this one is a balanced trade. It's a 124 P one entrance crosses a three-lane with the median and find it slide. Oakes said is to cited 2 ways and 68 slide. And Suncoast is two-sided median would sign a
1:35:17landscaping. It is a 2 way road as well. It's a 121 feet at the last meeting. Starkey should pictures properties with commercial residential nearby. However, all of those properties and multiple roads and highways in and out. They were not in residential agricultural subdivisions. They were not. And what we did with flooding issues and we're not dependent on. Well, water. Well, the combination of commercial residential is appropriate in some areas. It is not appropriate and cierra kinds of networks. And that got me Realtors can hear properties for her big pricing models. We are completely different from the rest of the models. We do not have Park areas. Public ponds, walkways side makes public Street lakes for bike paths fly. That's the difference is similar. As you can see to the other subdivisions. I don't have the exact with. Thank you believe it's the widest in the area slide. There is a parent is unfit to fly. Express lights. You can go through that the next several slide starting on page 13. Okay. Next next speaker? Yeah. Next, speaker.
1:36:22Mister Mister chairman. This is commissioner more of a quick yeah. Start the clock. The last mention that there's it's hard to hear this. A lot of wrestling. That's almost all I hear is Westling papers. So I highly suggest that somebody could you are microphones whoever's playing organ me or whether they're doing because it really, really left.
1:36:48We don't hear them out here.
1:36:53But every so I can hear that means everybody else here. That means that your home that's the trigger, a Web that he held no. Everybody is hearing. So Michael Mosley speaking of roughly a paper, OK. When your body. But, you know, I couldn't. All right.
1:37:11Next speaker.
1:37:18I mean it because I didn't knew I was 18 to 3 by the popcorn can hear him. Others presentation. Can we set aside 13? Please.
1:37:30You gon. It's like.
1:37:33It's so next up, it is so massive that reason to buy a lot of gas station in the south side of the people was legit. A previous meeting. The station. I got him suspended and resort from his own side of the road. As your 0.4 miles, with the subject property. Therefore there will be guys. It wasn't for the record covid 5 hostages with former those in favor then compliance the gas station is not a necessity of flight. Always tracking the store and gas station is not the right way. So I've this just examples of everything. It's 7.11. Is over. The Oaks said. So I go. In addition rings. A huge problem on Meadow Brook drive as well as many other things that the subdivision. That's what you call this is the 5 foot strike. So this is the private stream have been is like during flooding season record set back some but which is directly adjacent to the subject property. It contended that slides very concerned with. That would be. Want to consider a large truck or the vehicles turn his ending up in the stream. How of course now the gate water is contaminated. Where will it go? Because it's just neighborhood. The residents directly adjacent to the property only be protected site. And there's another black eye for the son of the road, but it is your eyes. It goes all around. It's like. And then there's more flooding and debris. The roadway in the top just completely overrun. It is also joining another waterway. In addition, there are 2 parties including one of her body behind the house where the water overflows. Can you imagine? We will watch the Eagles trying to navigate through this. There are multiple environmental concern previous Researchers at Johns Hopkins University found at a typical gas station. Bastrop was set up to an estimated 1500. But it is a leader, a gas field over 10 year period, including 7 really is a benzene according to the company got sully. Additionally, there are concerns of toxins in the air for nearby residents as there. There's no barrier space for the properties that were residences early states have been guided the ground water bears about as far as what's the mission break came from. This new research on it.
1:39:54But it's light. Residents in both in Europe and the middle. But in your communities would prefer there's nothing to see here. And next next to our Michael. They voted overwhelming to leave the site of the natural states. However, if they had to Tuesday rather see a garden or a park. There were 257 participants in the survey. About 350 participants in the survey put slide. What if what if become a public interest of purchases property to make it into a community going about teach sustainability science ahead of politics to children said property from commercial development next the research phase. What the United.
1:40:34Next speaker.
1:40:44We cannot. That's just that's the problem. With muting. The room is it's.
1:40:50Your time's up on the second speaker says town to your 3rd speaker. Name and address, please.
1:41:13It may be slipping out all right on that score for its football. And that's 55 by.
1:41:25That slide. My mother's heart appearing. So if you hear me in the background, it's just because she is a little hard of hearing. You need to get to slide. She's going to certify 24.
1:41:43runs in nearby communities fix. But is there consents regularly to next door traffic concerns safety is another concern it who has Seattle times, especially is there is no alternative access to route And their legal right to about this said if the ration thinks 15 minutes us route 54 Luke Scully to that to him. It's of Saturn. Yeah. racing for the interrogator was spotted in Meadow, Brook and read the press corps. And the church down there with the consent of besting through. Well, it control attempted to The danger and to take it to a different spot. do you have grossed more than that. Not only increased traffic on Route. 54 also rallied concerns of all who live in this area now fly. It's the residents here because its other properties in an. It is out here to change the rules of the game.
1:43:27People with what this all. It's blown coast act again. This time it. This and this community is Chad is doing what is right. But the. Communities as a hold. It sees the EU. only into 2 and a T. It will make them to sorry. Would benefit from this change. It's there in the zoning and can this properties that owner of this property and the one benefit. With the financial gain for debt owner of the property and. Robin, their health is. They support about their free. If it didn't happen. Both of my
1:44:44Icon.
1:44:47No one can know. Okay. All Mister chair All right. Thank you. There's no one else on webex this item.
1:44:57Okay. And I do you know, that were submitted for item P 47 can I believe there are individuals ethic. Yes.
1:45:03Let's go to the kiosks at this time. Please state your name and address for the record.
1:45:25My name is Sharon Honeywell. John. So 1, 7, 3, 0, 0, reverse Want to talk about the special exception that the commissioner, the chairman brought up. That was a racing across the street from this property was rescinded in 2009. I did send a copy of that. Amy. That is what Pasco County last night. It was for the use of be able to use it for real estate office. No signs were permit. It was not so commercial was a special exception that has been gone now for 13 years. So there is no business across the street from this property. Also this cross, this property does have 2 separate parcels. OK, so you have 0.6 acres it is a budget up to a statement 54 the parcel behind it. It's 2 separate person like these 2 separate taxes that they pay. Then the second parcel is 100% with in our neighborhood. It does not about to stay with 54. Just because one person owns it. It's still 2 separate parcels. The gas station and we know it's going to be a gas station and you see the floods that the slides were showing you those that water is right there. And that will whatever contamination is going to go into our Wells the world they are. I would love for the county commissioners to come out there and see really what this road it is that this is going to be an exit or this service station as well as an entrance because they're only allowed one on state Road. 54 there is an accident at this intersection almost every day. Multiple times a week and then we're going to allow all this activity to Can you imagine being directly across the street from the sparse not more than 20 feet away. You have in your children because market this book previously has 2 kids that you're talking 20 feet away from the front of your property, you're going to have these big lights and everything that is in there. You're not going to be able to but that one is 20 feet from your property. This is a residential neighborhood. This is not the way my what should or stark he said as far as you know, like McDonalds. And so for that, they everybody else is presented before. The adjacent property behind there as well. And you're going to be able to say all of this. So I thank the county Commission to deny the comp plan. We did have a conversation with Barbara if they wanted to bring look at
1:47:53office in there and so forth. But not the highest Sony and allow a gas station to come in here. When you have another one being built, not even a quarter of a mile. I'm here just the other side of our neighborhood that's directly across the Circle K on trade or put another Circle K gas station. How many gas stations do we need with in this area. So I thank the county Commission to the comp plan adoption. Thank you. Thank you for your comments.
1:48:23Next individual.
1:48:26I guess morning's, Chris, you know, you are excited to 0, 3, 4, or not bridge or it's Florida. 3, 3, 5, I want to address the fact that people that presenting their case in favor of this gas. He can't seem to have a lot more attention from the commission and our units to you guys.
1:48:49So it's not that bad out there. Thank you. Next individual.
1:49:01My name is Jennifer Robertson. I resent it. 1, 7, 2, 4, 5 reversed and right moves Florida, 3, 3, 5, I wanted to point out first of all. I think that number is not at grade allowing that flooding to go across the road that can get as deep as 8 inches on the road. You do have to have a tall vehicle to be on that road during flooding season. The other thing is the president that is across the road. It was her residence when it was a real estate allowed exception. She saw maybe 2 or people in Amman. Possibly that also expired in 2009 then it not allowed to have any signage, not allowed to have anything like that. She was partially retired. Also right on behind the where the gas station is where the next president says where the white fences on some of the there is a school bus stop there. It has our country middle and high school children. They are.
1:50:27There's there's the road. It is not what I would consider.
1:50:33A collector road. I consider a collector road is being collecting different pieces of the neighborhood into one road. like Baxley or like ballot tree. We are one straight residential road. Every single. Residents after that. That entrance is all residential. I can understand that. Happen. Acre being, you know, the front half an acre being commercial. The other 3, they have an address on met on. 54 in it. I can understand those being commercial and the most logical thing to collect all of those frontage commercials would be an office if you allow a gas station there. You will not stop your future. Commercial options or the other 3. So I I disagree with. Allowing this comp plan to go through. Thank you.
1:51:43And no protection division.
1:51:51I think you mention I mean, isn't and Grayson that it's 17 3.60 Riverside Drive and lose. We've been in the States for 7 years now. A to point out that my husband and I are both opposed to this. You probably remember has been he's going to address your congressmen and congresswomen last time he is off working. So he is doing its best to provide for our little family. That is going to be the 3rd on the way. It's hard to point out that our community is right off a 54 with the first time being less than a 108 from 54.
1:52:23Ballot races 0.4 miles to the first home. Actually. What I have 1.1 miles comfort station. It happened miles. This is from 50 for the first time in the subdivision long Lake ranch is 0.4 miles and like I said that everything is a 100 and a 100 feet from the for the first time. I'd like to point out that last time it was the little piece of that property. That's the drainage ditch was called the CA. Now last time it told that it was 45 feet by this starting well, according to the Pasco County website on the property. Appraiser's. It's only 30 by the which is 10 feet less and the drainage ditch itself is 18 feet. My husband and I measured it today with a 100. But measured pay. So to say that this is a now is not accurate at all. And you can see that when there's a lot of rain, it does turn into a King out of the goes over or Street. And it was everything. You can also as someone who already mentioned earlier. We don't have any Street lights. It is beautiful community and I there's no straight lines. We in our backyard. Lightning bugs which my husband and my kids think are the greatest thing and more streetlights. This takes it away. That was going in next door. At Cypress ranch. Did you also know that there are 9 blocks on 54 within a matter of the state. So your vote today set the stage for what's going forward. Let's say that you approve it today. That gives all of the other landowners on 54 with in Meadow, Brook the opportunity to come to you and ask for change. We are the second walk off 54 on riverstone dry. There's a lot just North of us that the big this will get the opportunity for that person to come in and say I want to change my to commercial and they're right next to. Cypress ranch. And lastly, I want to say it was my last time that, you know, it's great to have fun in a gas station and convenience store. There. It's like you're sure we have the stroll up to. It will make sure you're not showing up there to start the I just want to let you know. No, that's not the way that our family works. There's too many of the child abduction in new Port Richey last week. There's too many hit hit runs.
1:54:35There's audio accidents. It's just not appropriate to assume that my family is going to do something like that to pursue your agenda. So I hope that you would just see that all of us are here is one person there from the other side. We've had people speak for us we had a huge group last time. We have petitions. We care about our little community and we wish that you know what, appreciate that.
1:55:01The comments. Is there anyone else in the chaos.
1:55:09left bigger on declined to speak. And there is nobody left. Yeah. Thank you.
1:55:16We have some e-mails from
1:55:24All right. So the first e-mail is from Angela Miller. Addresses. 1, 7, 3, 1, to Braintree road wins Florida. 3, 3, 5, 5, 8, Our over 50 plus year Meadow Brook subdivision can not support the type of increase of commercial development that this proposal would allow. We would agree to a less invasive comp plan. Instead new subdivisions along 54 of double lanes having several entrances and exits. Our neighborhood has only one maintained by the county is impossible to add lanes to accommodate the extra traffic flow. And if this business. But constable traffic in 2 lanes existing. Middlebrook would have to be changed to only right turn lanes. Emergency vehicles will have restricted access to mental break to people in emergency situations since passenger vehicles at the light will not be able to get out of the way. Putting lives in jeopardy. Also the nearest you are in hospital or to the left making it a liability for the county. If there are only a right turn lanes in comp plan amendment that comp plan amendment allows for the most intrusive types of businesses such as a gas station. Therefore gas station will be used as my example since the land could easily be sold to one this land will never be a key campus daycare since it is on a major highway and there are ready to within blocks and one in the development. There are 5 gas stations within 4 miles of our homes. None of these gas stations are just they're just feet away from a waterway. funneling into the end quote, River. Any pollution would cause a natural disaster putting every waterway connected. This will be a huge problem to the and M F S have the National Marine Fisheries Service said a federal agency. None of the gas stations won. 54, are this close to a subdivision. In fact, in quotes due to the high crime statistics involving gas station. Florida has a statute. The Florida convenience store statute codified as section 8, 1, 2.1 7, one which requires convenience store owners and gas station operating between the hours of 11 6 to prevent foreseeable crimes. There's no way to prevent foreseeable crimes. What if this was your home when there is a vehicle or pedestrian accident or fatality or 150 plus member coalition. We'll
1:57:52show the grieving family, the commission knew full well, this interaction for this intersection would have never been allowed to become even worse via this comp plan amendment and the great increase in traffic it will it will cause in response to your denial vote. We voters was that will help support you with a less intrusive type of Qom plant. If you want to vote or our relatives, friends and co-workers. You will not approve this comp plan. Next e-mail is from Kevin Miller. Addresses 1, 7, 3, 1, to Braintree road. Lutz Florida. 3, 3, by 5, a I'm not opposed to commercial development as long as the area can support the traffic. It brings entering and exiting this parcel solely from edible drive would bring an enormous amount of traffic to a roadway that just isn't designed support that kind of traffic at the intersection would need to be widened, especially on the matter Brookside to accommodate the increased traffic. The only way to accommodate for the traffic that this type of plan would allow without traffic congestion is to remove the left turn lane and make 2 right turn only lanes existing from matter but drive this would not only be an inconvenience for drivers headed West but will also put lives in danger as our closest we are in hospitals or to the left when emergencies happen. Time is of the essence and with an underdeveloped intersection with increased traffic. This will put lives in jeopardy based on the location of the parcel existing into Meadow Brook will only be possible near the traffic light just a few cars lined up at the traffic light will prevent cars from exiting the parcel there for blocking cars entering Meadow Brook from 54 the data that beacon civil engineer provided to you regarding traffic volumes was during covid. When many people working from home is of dubious accuracy and does not account for the dozens of homes apartments being moved into daily along 54 or the snow birds coming in droves. The annual growth rate of 2% is underestimated. The comp plan would have to take away. Our left turn lane because of the about the. Elevation was performed based on the turn lane warned criteria indicating that the impact would be so. Much traffic that they will have to remove a left turn
2:00:10lane. Making 2 right turn Lane's engineer stated it will operate acceptably waiting behind a cause is considered acceptable. What four-way intersection on a state Road has a street that only turned it only right turn lanes. All the gas stations on 54 have double lanes to enter and exit. Many of my neighbors and myself with support turning this land into a business that would have less traffic such as an office complex. Please do not approve this comprehensive plan since it would allow for the most interest have been busy business such as a gas station. The voters living in Meadow Brook Sierra pines would support our commissioners with this process. If you could support us right now in voting against his comprehensive plan Next e-mail is from Theresa address. Is 1, 7, 3, 0, 1, Green Tree road. Let's Florida. 3, 3, 5, 5, 8, Regarding the proposed commercial development of the to process at the North entrance of Meadow Brook and states. I'm opposed to this development in addition to the negative impacts, us development will have on the community with increased traffic loud noise contamination of groundwater because of spilled gas. Everyone in the community lies on Wells for water pollution intersection. Flooding, etcetera. It will also cost a few real safety issues for all of that, for all of the community Middlebrook a states only has one main road on an off highway 54, which is Meadow Brook drive in the event of a medical emergency medical personnel as well as individuals in the community need to be able to enter and exit the community quickly easily having a direct path to the closest hospital emergency, which is to the left, allowing more traffic to enter and exit on Meadow Brook drive intersection will cause a backup of traffic and make it impossible to quickly enter or exit onto highway 54 and the matter because states with my Handicap husband and elderly mother. The safety issue is a risk. I do not want to experience. I'm sure other citizens in Middleburg us states have the same concern the Pasco County approves its development. How does this safety? How is a safety issue going to be addressed the committee must be protected. Safety can only be cannot be
2:02:35overlooked. Please make sure this issue is documented in address to the come community satisfaction. The next e-mail is from Terry Grant. Address is 2 to 3, 5, Brookside drive lutz Florida, 3, 3, 5, 5, 8, I believe that misinformation has been used to support key campus application. My purpose is to is to address contradictory or imprecise statements expressed during the board. Me during the board's March 23rd meeting the BCC says that they must consider Kitty campus property rights. But that's invalid. The parcels rezoned air one with key campus perk when key campus purchased them getting campus seeks the land use changes for their economic advantage. Florida courts have held that the property owner creates. Creates its own hardship when they knew the zoning when buying property. We know that Katie campus entered a contract to sell the property to a fuel station developer Pasco County staff say say that the county is supposed to apply the principle of highest use when an applicant feels to satisfy a land use as is the case with Katie campus and that a gasoline station is the highest use at their at their lots. Therefore the BCC and planning Commission should assume that a gas station will be constructed at the 2 lots the southernmost of 2 boxes, not at the intersection. So it cannot benefit by being classified as located at a signalized intersection of the highway and collector road. The campus has not provided results of any studies to that match the circumstances of a fuel station building at a narrow local road within an already established neighborhood whose homeowners depend on groundwater. No matter its obvious that traffic will increase substantially in nearby home values will decrease when a fuel station is built on vacant. Lots next to residences. Few people see to live next to a significant source of pollution. One, a home is served by well water. The board only acknowledges 2 homes next to a lot. But there are 6 homes next door. The board member showed aerials that purportedly illustrated situations like the applicant's proposal, but they were dissimilar one aerial cent was said to be an operating gas station. But it is abandoned. In fact, there are no signalized intersections on the
2:05:00state Road 54 with a fuel station and homes joining the fuel station. But even if the applicant can demonstrate that a fuel station pollution source was constructed at an established neighborhood that depends on groundwater than in prior. Can justice doesn't justify another. The board did not acknowledge the critical ground water quality issue and when the board summarized or complaints, they categorize them as perceived, not reality. Insulting insinuating that our concerns are not legitimate. But in a profound contradiction, a board member relied on their own falls perceptions declaring that Meadow Brook a states has very wide streets. We measured the streets in member states, sincere pines and they are nearer than any nearby neighborhood. The board and have can rely on the county place development in McDonald's as a president. But it's completely different County country places further from 54 enter entrance. Road is much wider commercial development preceded the McDonald's a gas station typically draws greater traffic volume and a McDonald's doesn't cause groundwater pollution. The applicant falsely asserted that there are no other commercial uses at is signalized intersection. That 3 minutes, OK. Thank you. The next e-mail is from Melinda Grantham homes addresses 1, 7, 2, 9, 4 raintree rodents, Florida, 3, 3, 5, 5, 8, My name is Melinda Grantham. Holmes. I'm a la lifelong resident of the limbs land O lakes area. I have on my property and member of the state since 2000. I enjoy the feeling of living in a more rural area was shopping restaurants and amenities close by. I have seen understand the growth of my area. But I'm deeply concerned the change in zoning of the property located on the southwest corner of state Road 54 and murder of a road. The need for the traffic light at the intersection of 54 Meadow. Brook was brought on by a number of traffic accidents when drivers attempting. Crossing the multi-lane highway. I do not agree with the argument the stoplight provides for adequate and entry and exit. If the proposed change in zoning allows for retail. I feel station convenience store. A car wash. In addition to increased traffic I suspect there will be
2:07:17an increase in crime in our neighborhood. There's no buffer between the property for rezoning in our neighborhood as with nearby communities, as mentioned in the review of said proposal of my property value will be negatively impacted. If the zoning is changed and commercial development is allowed to be placed within a designated development or neighborhood. I'm asking the board of commissioners denied his request to come to know the lots in question be safe, be left to presidential. I'm culture for the foreseeable future. The next e-mail is from Beverly camp. The address is 1, 7, 2, 6, 9, raintree rodents, Florida. 3, 3, 5, 5, 8, I'm reading this letter is I'm not able to attend the meeting in person due to work commitments that I must keep. I'm concerned with a proposal to again attempt to turn the lane use and state Road 54 and Meadow Brook to drive to see to. My family has resided in member states since 1992 and I live not far from the entrance of the neighborhood, the properties changed to see 2. I'm concerned. Being the parent of a young school age child. That there is no sidewalks in our community and that adding something to the property at state Road 54 in the director. I would create more traffic that would put my child in danger. I'm concerned that this is the only viable and arise and I'm concerned that my child's bus stop is just down the street from this property and would be a safety issue if there was increased traffic in this area due to it being an exit for the property at the to return to state Road. 54 Meadow states is not a master-planned community like all the others along 5th state Road 54. to not set back from the entrance of the neighborhood, like the others. I would love to have peace of mind that when my child is out and about in our community that he is saying from additional traffic from non-residents. I have heard repeated repeatedly that any proposed land buyers plan to buy a gas station on the property which also concerns me as of a neighborhood use uses Wells to obtain water for their homes, including drinking water. Thank you for your time to allow me to express my concerns. And. This is the last e-mail that I have to read for item P 47 it's
2:09:43from Linda Shaq. Her address is 1, 7, 3, 5, 0 riverstone drive lutz, Florida. 3, 3, 5, 5, 8, That she sent an e-mail and then corrected. It's already written an e-mail. First. I have been a resident in the meadow Brook estates subdivision since 1980. I object to the comprehensive land use plan change for this parcel from Reza 3 to commercial this change would allow heavy commercial uses such as a gas station carwash vehicle repair garage dry cleaners and many other heavy commercial businesses intended use of this person is a gas station confirmed by Christina Acosta in the planning department who had a copy of the sales contract which is conditioned upon the property owner. Katie campus University in conceiving a comprehensive plan amendment to commercial and rezoning to see to this parcel of the very first and second residential lots in the entrance to Meadow Brook estates subdivision. There's not a long road between state Road 54 and the first House or entrance to the home like Alan Trejo Baxley where they have a long road between the commercial corner at 54 and the entrance to any home. In this case, there is a house directly across the street to the east, a house directly to the West and a House directly to the South and parcel. There is insufficient footage along state Road 54 to accommodate an entrance and an exit on state Road. 54. So any business would have to exit directly into Meadow Brook drive into the residential neighborhood. Environmental issues of homes and meadow Brook and states are on Wells allowing any commercial use, particularly as gas stations or dry cleaners known for leakage and. Environmental contamination could contaminate many if not all the residents drinking water with carcinogens. This could also make their homes worth less safety issues. There's a school bus stop just a half block away from this parcel which could make it very dangerous for children traffic concerns is already a traffic problem at this intersection with residents of Meadow Brook estate. Sincere prime subdivision. A total of 435 plus or minus homes. Plus school buses trying to exit onto state Road. 54 the traffic backs up at the light because Meadow Brook drive into Middlebrook a states
2:12:12is one lane in and one line out with a very short left turn lane traffic from a commercial, but businesses will only make the problem worse. A traffic study contained by obtained by the applicant or the purchaser estimated that 2400 vehicles per day could exit on to Meadow Brook drive into the residential neighborhood. This could mean dump truck semi trucks delivery trucks tanker trucks and many other types of vehicles miscellaneous the property owners can campus University has already been turned down twice for rezoning the property to see 2 commercial because of the amount of traffic into a residential neighborhood. Well, maybe inevitable that the lots facing state Road 54 in many states, including dispersal could be changed to some type of commercial status. I hope that the change would not allow for heavy commercial business professional office would be much more suitable for this parcel due to its proximity to the residential neighborhood asked that the commissioners please vote not to approve the request of change. Then she says I wanted to correct some information that was included on the attached letter to be read at the for 2021 Board of County Commission meeting. Time's up on that one. I have no further emails to read on the record for item. 47. This will out. Yep commissioner, thank you and I started having might might raise their our current kicking consultant.
2:13:49The 2 men on that thing. Go out to public comment and a map can do a presentation you do that to answer the questions raised. I did happen here.
2:14:02My name is Mike greater rater transportation consulting I'm a lawyer registered professional engineer with a specialization in traffic and transportation. Today's hearing is regarding the conflict in land use which transportation needs assessment for that road. Without that he would prepare my my office dated October 2720 20 group by staff on January 20th 2021. That's that he looked at the collector to project. It would stay were 54 in this segment of middle road nor of 54 that the collector road wait Booker identified to operate level for the with and without the comprehensive plan amendment. We also have prepared a tiny basement of this, which is to a company we could be in rezone application for the going. Which is not the day. But I did hear that have additional information that may help Given that the rezone is you clearly and not include a specific site plan to use or the actor that that he relied upon the land development code reasonable EU regulation which resulted in just under 30,000 square feet of commercial land use which that reasonable yogurt. The region does and to trend. We're states. This study one intial reasonable area which consisted of rewriting state route 54 black that whenever which provides for a worst-case scenario regarding network has and it's been a section was there before it all again, traffic would have been bent to the mat over this area and I do know it act that this would be worked out during flight plan permitting. At what other items such as they did in the great the connection. Another similar item. And we would be coordinating that would we would be seeking a connection from a word for this include member. The finding of fact that he indicate indicated that the figure wider section of the board member will continue to operate effectively in regard to their ugly. The county's transportation performance standard the traffic counts that were used in that body were ejected to reflect COVID-19 and a typical traffic volume percent could be hit. The area. Never drive South of state route. 54 was reconstructed and improved by F dot in 2016 as part of that improvement this year. 54, including the 53 widening an organization that
2:16:51matter. Those limit. State Road 54 southward to the creek along project funded at a difference of about 350 within that segment rains are 12 foot where with the right of way and at the intersection with 54 they're relying. So there's 36 feet of pavement and that area. And as those lanes converge back to the to infection. 24. We have reviewed that segment of road has got to be the segment that any traffic was projected. Would you rather than perhaps folks that live in the neighborhood returning and we have found that the roadway condition me County roadway standard the consideration of substandard road criteria. Also there was a brief discussion about potential neighborhood intrusion and what not. And I find that highly unlikely to occur given that we're a nation of the site. You said they were and that concludes my presentation. And of course I'll be happy to answer any traffic question that you guys may have. Thank you very much. Thank you.
2:18:18The commissioners. I would start with the dressing again. Mister frontman has that for me to address what was discussed during our meeting I always been very receptive to discussing anything related to the intersection that I've been working on. And absolutely would go through uses and discussed however, what stopped the conversation as I've been very transparent that a potential permitted use of this property is competing for a gas pump and that stopped the conversation. The other non guard with Mister Pressman and Keane was not starting at office and then and then put use of that law office. could why rezoning application to the 2. The state. I think so. As you've been at this point you that this property is located near South market concentration area from 54 point or highway located at the intersection. And there are no other commercial use of the lies intersection commercial use as a very specific definition. And so when I say there's no more commercial uses there are not the Northeast. There are professional off the season and a new place in the county that the U.S. investment in infrastructure at this location but not have any commercial uses. It may lead to more than one intersections being signalized. If we don't locate or commercial uses at already signalized intersection. Next. Why. Property concurrently Irwin the purpose of the air. One district that you can see is to curtail urban development in the area could lack facility until such time that the facilities are available. So conditions have changed in all facilities are at the location. Next time. The comprehensive plan your comprehensive plan, the pick a leader X where you want to become land uses. And application apply that the board has that this is where we want to be commercial land uses. They want to see them at intersection. The this is the other property adjacent to existing collector intersection. Your staff of going through that would you explain that? That is the case The other 2 policy be in the death of going over well and purple people at one point to point to subject property is the location for
2:20:50future commercial uses there have been a discussion of policy. 1.6 points for that talked about new commercial uses should not be located internally within single family neighborhood. A couple things there. One that policy is written for when you don't comply with 6001.2. And the second one is that you talk about internally. I can tell you I had a hand in drafting that condition and the thought of what that meant. What internal not edge. The edge condition in a changing ads because they don't they should have because of of. The development that you see on 54 in the type of road 54. The example that comes to my mind when that policy was written internal. But if you think about Regency Park Boulevard. At glenmore that maternal commercial piece there and that was the thought was that it if you work in 1, 1.6 points to the board and trying to get direction where they wanted to be. You're not out of my inner section on state Road. 54 were trying to direction. They're competent to where they want to be commercial uses. And so that they did not want to see them replicating what what would Regency Park Boulevard. Although interestingly enough, modern now comes along and you have a ordinance that. That want to see commercial uses a neighborhood, though. We are not. And in violation of one 0.6 point for next time. You've heard about land uses and the policies in your complaint regarding that. You can look at compatible, transitional land use to compliance with your ldp's requirement and the proposed the restriction which it keeps getting stricter and stricter as they continue to work on it. We're not. Does it prevent in the deed restrictions you want today because we're here at the com plan here in your decision today is whether read it your vision, that property is going right. Mental or not presidential. But our applications to commercial which is a non residential we've not brought forward the rezoning discussion that planning commissions I have on Thursday and I'll be back before you in May and will continue to work on that. The restrictions and the buffering N and the like. You implement your comp plan for your land development code and. The part of the one 4.4
2:23:23implemented by your LDP requirement for buffering building. High lighting. I put parking stacking voting refuse Stuart Street landscaping. Drainage. As well Grant water quality. All the things are in there. We are looking weather. There's any feed the standard for granted that we're looking at storm. That's greater than the 25 year. 24 24 hour event, which would be what the requirement is to the development of property. But if we can exceed it and provide a benefit potential benefit to the community we're looking at doing that again, not really a compliment of caution discussion. We're better had at the time of the zoning next one. This is the example that was given that country place and that they're looking for a couple. We want to show that. Commercial uses can coexist with residential uses and that example was given because those residents were very concerned about how the traffic from the Donald. I want you to high traffic generator would. Interact with their country way Boulevard. And I been to that. You don't put all time and they interact and could this very well. I think that was most of the reason why that was I think sure that saying that the country plagued with going
2:24:59Want to give you the perspective. Can you hear me? Commissioner? Yes. We hear you can still hear me. Yeah, I had I had a grant that 4 times. I want to make sure I'm Michael Hancock the because you don't have the maybe this is what it actually looked like at the intersection of Meadow Brook and state route. 54.
2:25:23I could even go back further this parcel public parking lot trees on it. That will be removed with any development of property. And so there's a 4 story apartment complex requi at the intersection of the problem. From and will they get the ball whenever trees are removed from some of the neighboring parking next time. One of the picture of a wooden bat when he called the creek. We're going to check. Think I've never even dispute that the neighborhood got it. And by the county property and more they in 18 foot be that they feel like water body. No reason to do that.
2:26:03But on the ration and the town. But you can hear on the on that picture is you see.
2:26:18It then that Mister Khan property this out. He spent. We intend to Butler on our side as well will be buffering with a solid masonry wall. Then the county property and then the By that. I think the commissioners have already had up talking about what's going on with you take your property. There's been discussion of the special exception that would really previously adopted by the planning Commission finding that a business was an appropriate use for the property directly to the east. We've got about the properties to be wet and then it got here. 17 o por 8.17 o for about don't by doctors. And you know, court already peel on it. When that if you think the fashion about about what's going on and being at this reason or you can see there before story building next. I have you're 12 minutes or so if you could close.
2:27:17Okay, good there. Next why.
2:27:26The canyon of you've seen it before so that the last bet that the last month talking about how the 3 of the properties are already located took both the 54 and to the main thing they can that their personal opinions that wouldn't affect in their property value. And for the cleaning of it is common to have an non residential commercial use. at the intersection at the entrance to a so that offer would a decrease in value with that. Thank you for your time I would ask you to support the company noted that one went to the doctor, the comp plan amendment. We still have to have what we've done in commission, planning Commission recommended that you do adopt the comp plan amendment. They have not made a recommendation to your husband here. We asked the 2. It's on the comp plan and then we're going to planning Commission and continue on with the process on the rebounding.
2:28:25OK, thank you. Thank you. Thank you for your presentation. Discussion or questions. Why some
2:28:39I don't, you know, have the whole process memorized so I'm something like this timing and phasing, you know that a traffic analysis be required at the zoning or does it happened near the comp of and here comes to repeal. Have the county kind of weigh in on what kind of traffic would be here.
2:29:02The Tigers people's plan timing phasing in usually in the Napa transportation planning else is done at the zoning level. At the conference of plan level of transportation needs assessment is conducted. Typically.
2:29:16So so different uses would be. So how how does this for everybody's of occasion. How does that affect uses on this property. And every and the rezoning. Well, it traffic study.
2:29:34The traffic that is going to identify the type of trip generation that's occurring. And what's coming and going from the site generally and what kind of impact it places on the on the local Street network local network. So if certain use
2:29:53we're too much, then that kind use would not be allowed I mean, that's where that study happens. Not at this point. Right. Well, turning isn't what identify what would be needed to mitigate the impacts of the local network.
2:30:08And then.
2:30:09Someone has to say whether those kind of impacts that women are allowed or not. And therefore a youth. Could be allowed or disallow out. If the impacts couldn't be. Yes quickly when they do that was to send analysys.
2:30:25It's the most intensive uses utilized to generate the the maximum amount of impact commercial property could have on the local network so that if something comes in lower, we know that it's beneath that maximum threshold on. So it would work. So this is not where something is decided because of traffic. I mean, that comes in a zoning hearing yes. Okay. So this is just is.
2:30:53A commercial use appropriate. This kind of property at a signalized intersection on state Road. 54.
2:31:06But this is a consideration of the land use and the planning Commission said it was. And our staff is recommending that it is.
2:31:14Consistent with the company's of playing consistent with what our plan this right. And then. Certain conditions and requirements depending on what. Comes in or implied later. Right. We don't apply we don't necessarily apply conditions out right at the comprehensive plan level.
2:31:35The condition usually at the conference of plan level that covers find itself includes various provisions that we have to then implement as we move down into the deeper parts of the process.
2:31:47All right. Thank you Mister chair which was battered. Thank so did Mike razor already do analysis because that would tell us that current trips. How many troops would increasing with the gas station compared to how many troops would be happening of those office building. I think I would defer that question to the gates here. Mister razor, I believe testing testified that it was then his analysis was done on 30,000 square feet of retail.
2:32:21We should have that study. We well. What it was a part of the zoning case and on the southern part of the conference of plan.
2:32:31Case. Do we have the current trip. Numbers and then what it would be if there was a gas station or whatever else they win the game is looking it up on that expedition is has been put the traffic engineer is online. He probably be able to provide that faster than us. Okay. Well, the recent Mister it can trigger here.
2:32:55Yeah. Hello again. It might raiser for the we re going case. We did already prepared. The timing is an analysis. And as I mentioned in my prior testimony because of that rather than an mpd. Doesn't cite specific uses. So the way the land development code not a one point. handle that there's a term called reasonable. You and so the tffic. Th he is based on a calculatn of generally worth worst-case scenario r or a particular pcewhich takes into account peoe urage ofhaparcel. The maxim ere ratio and thers impactelions assocte th that. S In this paicar te in a sudden now it ai Pretty early in ronapplication. Wee ated that was e film baseon the county asonable your calculation7,280. We're feetnd that result in a generation of approximately 2500 daily trips. 2000, 484 to be precise. Berry cake that volume and add that to the background traffic condition, which can the existing traffic out factor for seasonality factors for covid tractor for growth ad. Traffic generated by that 27,000 in change commercial site where the analysis and as I mentioned previously, the results of that analysis identified acceptable operating condition in could get their consideration of her life. Her level of service transportation performance standard within the coat.
2:34:55So there's currently 27,200, 80 trips. And then you're saying the gas station would yield another 2000, 484.
2:35:04We existing trips in that particular setting. With the euro in the in the in the sense that that you're referencing the trips. We start again that this particular study looked at existing traffic on the road at the intersection factored with for several different items. COVID-19, even allergy and background wrote and then ad that read it. I made it to be generated by that. 27,280 square feet of commercial where those daily trips are 2000, 484 and during peak hours that you're or just below 200, depending on which beat our you're referring to.
2:35:47So what are the current trips going on. 54 in Middleburg right now.
2:35:52At that intersection with the existing traffic volumes. Identify. It intersections. So there are 12 different movements with their with their particular traffic going that you are interested in hearing or would you like me to just go around the intersection or what would you like. What information would you like.
2:36:11The ones that are going to close this to Meadow Brook.
2:36:20So what will go would be the PM peak hour. It looks like it. The workplace. We have currently 48 right. Turns 54 member dry. 49 left. Turns it before the meadow Brook drive in 12. The movement from Meadow, Brook north of it before it gets out of 54. And not a positive direction at that 54 crossing bit before we would have 27 left turn to remove me and 51 right. Turns. During the 08:00AM hour. We would have currently are. 13 right turn from 54 better for drive. 21 left turn on to Middleburg dried and they were vehicles are being felt through the intersection. In the northbound again, approaching 54 there were 33 left from Meadow Brook drive on the 54 courtroom in within 45 right. Turns. Those are the existing backed the traffic volumes. And what do they think.
2:37:29What is estimated trips if there is a gas station.
2:37:37Well, again, we don't have information specific to a gas station because if you put in applications so again, this study relies on the code. I like to help get our coverage. My 3 I can. If I can help you. I think that I think what what you need to answer for the commissioner is the analysis you if true.
2:38:00The analysis you did is worse. Then if a gas station was there. That 2700 square feet is more transportation impact than you would expect that are yes, station correct.
2:38:20it is a difficult question to answer because it depends on the type of gas station on this particular site with pridgen square I don't know what side gas station. We would be able to draw and there's no state plan associated with this OK, so that's that's what a reasonable year calculation takes into account the size of the site. So we were talking about a typical 11 bytes. I I would based on my experience. I don't have that information in front of me. But in general, based on my experience, I would say that this would be the worst-case scenario compared to that when you come while while we're racetrack plate situation, it would be here. Those made in or 8 more or about the same. Again, I don't have the information in front of me to Make the particular statements with 100% accuracy but I will also say to make it even more of it. I was great for tighter comparison when you're dealing with gas station fight. You have traffic that will operate in a certain pattern where most vehicles, one that making right. Turns the that different traffic implications. Thank you for this particular site and white specifically on the south side of the road. We had heard that several other gas stations in the area. But with another on the outside, you get closer to call your several several miles away on the other side of gas stations are set up for convenience and most of the trip sucker right. Turns from 54 back. Right. Turn ultimately back on the 54 whether that's correct or remember. So these items are all typically handled at the site plan. Permitting stage further on down the road. Or you could be in Downing. We look code I demanded level of traffic which get 3 addressed the comments by plan permitting the company active management regulation. We look at the very specific trip, very specific impact and the very specific mutation.
2:40:37Mike, what can I Mister chairman have another question. Yes, Mister Berg and thank you. I know you didn't have to go into all that traffic stop at the comp plan hearing. But we appreciate hearing it.
2:40:51concerns about.
2:40:54The environment. I know that the parks and natural resources had no environmental concerns. But.
2:41:03You know, how when did those kind of Terry get addressed. I mean, obviously the county. Its kind from that. People have clean drinking water and the set. There are some assessment about. The possibilities and we let you know how that happens to us. So every conference of plan and that comes in gets circulated to other departments and agencies for them to comment on.
2:41:29At the conference of plan level. We're talking about the come land use. But when we started going deeper into the reviews. and then furthermore down into the site plan. Review circulations are still within for the organization. So. They're at it is you get to the site plan level and identify what the site the plan is actually going to be whether it's a retail strip mall or a gas station or whatever else might be in a zoning district. At that point through. There will be a circulation and comments would be collected. Where the different agencies would identify with issues that might be on the same plan that have to be addressed. you know what we know what to think. I'm not.
2:42:20I don't recall ever hearing about. A gas station leaking gas and dust someone's wealth may have happened. I've been here 30 years and a lie. I haven't heard it heard about but I would imagine that they have safeguards that they have to put in place and that there are our requirements for safety with gas stations that will be discussed at some point. So people's fears can be. If one comes in here. I its peak. Okay.
2:43:03Thanks. Thanks, Mister my. We I'm getting a quick question on the gas. They just wanted to clarify because it's not my wheelhouse, per se, landed on the court is going to set up what's going to happen or is on to the building codes going to look at what's going on vertically. And vertically down. So the building code is going to have all of those types of safeguards for the different types of uses that are. Constructed in the county. Okay. So we may have safeguards that a gas station storage tank can't be so near.
2:43:36And their industries residents as well. There are industry standards. Okay. So that will be addressed. Yes. Okay. If they put a station or the FBI. I think there would be regulated by state Park, right. Yeah. Your code yet. When the S and B, the state. All right. With that Mister Moore.
2:43:58Thank you, Mister just. A quick question. This was mentioned a couple times.
2:44:07Heat in not correct. And the mother have been denied. Previously e.
2:44:19The It is certainly true to that wrecked because the wrecking ball with the speaker that what with that? What? It really meant.
2:44:28It starred in eastern and is planning and development key campus University was of the proposed. Daycare at that location so that. Outfit applied for a special exception in 2011 and that was denied by the planning Commission. they also subsequently applied for the same special exception. Less than 6 months later in 2000, 11 in December and that was denied. So that part is accurate. It's not a comprehensive plan amendment. It was a special exception to. And I believe that could be addressed at the com plan or the rezoning. But the location. It's now a signalized intersection. A lot of things have changed their since then.
2:45:18OK, Mister Moore.
2:45:22I was I was just curious because I heard that and that was the first part of that. So many e-mail that came through the day has gone up. That was mission today as So that was the day I you know, let's be honest with you. I'm going back and forth in this thing. I can't tell you how many times I did have the opportunity to meet with applicants instead of me with me yesterday and I appreciate that. this will heighten Mister jalloh. He and I will say, you know, Mister Della I see this product to the past would put out their news. You say. You know, but a good product he's and he's a good businessman and others what to do with that community. I know that, you know, really do. I do have concerns and I'll be honest with you. I I up, I've been flipping back in court during this public hearing because I said I'm really, really was mentioned about. This parcel being next year not been told me. Which I can see that we're on 54 point. But what keeps getting really is directly. Is directly. He's. Others. There's one South and one Southeast to this part across the map. This is what. When I think about. Next year, I don't think about. This is a commercial product be directly across. From the home. And I was being honest and it's going to be in. Give that out a way you know, what live with that. If there's that, it takes to the eye. I would buy. I would. I would actually does what little the kids and the traffic coming in and out. So again, that's starting to United before frontage. What does it does houses were across the street. It makes me feel like it's more internal to meet says it is one of the Southeast. I would have no problem. But right now I'm waiver and against. That's why I mean, I really I and just be it's honestly it's because of this for this 2 homes actually 3 holes that really this to homes. Real concert.
2:47:39Thank you. Chairman has been battered.
2:47:44On the South East. Both of those I looked up. I know commissioner Mary Ann e.
2:47:49Mentioned they might be commercial. But when I looked it up on the tax appraiser's website and some property appraisers website. It does say if they are want to do we have clarification if Irwin. Because I think they are one to the east to the West into the South. It's not until one to 3 months down its appeal. One. Denise Hernandez. You have clarification that Irwin that particular piece of property applied for a special exception for home occupation.
2:48:23For a real estate broker and a notary. And one of the conditions of approval is that it would expire upon transfer of the ownership and there was an ownership transfer in 2009. And then another one. I believe in 2000, 19.
2:48:39That in fact owner for comment and we got me for commercial on my intersection. Thank you for with the planning Commission and that. Of our County. The other one. I actually want to get likely it would mean a comp plan amendment to that. Yeah. It would have to say bye.
2:49:01Now there's 2 parcels to the right. It's actually both. Yeah. Liver at the top and it doesn't look like there's a home on it. But there is a house, right directly south of it. So it was to Platts in. That would be very difficult to change it to commercial because they have that little sliver up Latin. Well, I I I I think they would both come in for commercial. But I've looked through the hole.
2:49:29Petition. And and I I guess I would ask that applicant as well. That owner did not object. I can find no objection from that owner for this parcel becoming commercial and my guess is because that but that's going to be a bensley, no one's going to want to live on the corner of a signal lies under section on. It seems to me that the that where I don't know what you call up is that the flu? What someone tell me what the correct word is for the debt can now slew. to made. That seems like the barrier on that Street from a land use change. You know, obviously anything below that to me would be very interested in the neighborhood. But that seems like a buffer as I was. I was pretty much going to be made against this. Because of that home across the street and I asked them to go me. Go talk about buffering up out with the South. But, you know, absolutely. Could they not have their driveway, you know, come out of your driveway. Look at a dumpster or or or, you know something like that. But that is not the case here that houses south of the. And I believe that you're going to see that corner home. Who did not object to this unless someone tells me they did, but I can't find it Become commercial as well or James, you anyway. And some say a few things. This. Where is the other person across treatment doesn't have the commercial that those. Change my various forms of the commercial insurance already been there.
2:51:20But I will tell you the the drainage was something I talked about extensively as one top talk with the applicant as well. And it's not just the drains. It's going to happen now from what I can see him because they could hold a storm water to a certain point. Still the recent low. The pictures that we've just I think by the meals. You know, all that rain, whether it's down. And I look at the mess before I saw the rain were around, but. The rain comes from. The gas station. And the rain just coming down. And now it's going to go from the spillage etcetera, it goes down along the street. It's going to get into the roadway which is going to get into the water was going into the canal. Denise, maybe you remember this. But I mean, we had us the station was going to come in unable to might have been Northpoint my been somewhere else and I don't know what mean northwood 2 members were put ahead. A gas station wanted to come in and because of. The well heads around the area maybe just some type of thing that we could not put the gas station that place because of that. And I kept I guess it from coming in.
2:52:27Yeah, that that is accurate. But that was actually within the wellhead protection area and a specific parcel is not right. within the designated, I believe that one was the WPA area. 5 of the 5 year well head. and it was denied. And then they actually came to the board. On appeal and the board tonight as well. So tell me, what was the theory of the wellhead protection area. What were they trying to do. And I would defer to Mister karbala on that. If you haven't is a new one here. What it is. I'm sorry, committee. What he did it. It looks like it's generally well, I'd protection ordinance applies to public supply Wells. I believe not individual.
2:53:11Its presidential. Well, I think that's the difference. Okay. But but I just want to hear that what with the thought process around that and because if we're going to be looking to protecting the. Health safety of our people. If we have a will have protection of public supply. It really should matter if it's a private split public supply at the same thing's going to happen. So I want to get the variable what that is. My karbala public so when it when you formulate it will have protection zone. You're you're looking to prevent pollution as says Mister Spencer said to public supply Wells. And so usually it's a it's a distance that's offset.
2:53:57You know, from from those Wells now, I don't know if we've got public supply Wells in that area might have to research that. But that I mean, that's the theory that the areas as distance to protect that. The opera for the You know, for when we with drone war. So is withdrawing. The water doesn't affect. With these private Wells and they're all over the Does it does it affect us for years. The same will ultimately a gas station pollution getting into the water system getting into the ground water. Those Wells that are out there. Are they still they own bill. It depends on where that there's there's there's a lot of factors. The depth of the well and construction of the well typically public supply Wells are deeper and prefers. Wells for homes are typically So, you know it. There's a lot of including migration of contaminants and how those how that things would work. Public supply Wells typically s*** more water out of the euro there for them. The movement is is greater versus a person's own. Well, that might be you know, a few gallons of the only states. It's also deeper as well. So as far private well should be could be more sensitive or would have to travel as far down in the ground to get to the. Bottom of the well. On a public supply. There wouldn't be as much migration. Because it's not sacking as much right you have it. You're drawdown your drawdown drawdown
2:55:31But if it's or vishal that. There may be direct connection.
2:55:42its heart it without doing that and now says it's really hard hard to I heard in the past week that if you have.
2:55:49Farm animals on.
2:55:51A sewer. Well, if the well is only 50 feet. If you want susceptible to being back then. So it's helpful if it's helpful. So a lot of Holmes with Wells have septic systems. Typically the septic system is is separated from from the well by a certain distance I don't know. The codes are. But typically they're on the same property for what? For what it's worth.
2:56:20Commissioners. I would also add the butter will at the at the E p regulated activity you're talking about. It's a regulated use. We have to get a permit from Whitman regarding the grant. But it also could that you have to get the permanent weight in the highly regulated. You.
2:56:38Which doesn't happen at the comp plan states that happens at the next 8.
2:56:44It happened back to the 3rd day. I think the construction plan on going. Okay.
2:56:51in discussion with the board only. Summary can can you be a part of this discussion now I'm thing else from yeah, I did. I just want to bring up that the reason I brought the McDonald's again and just to say this in general, an eye. I think we to kind of told us this. Let the last meeting and it's difficult because we set up here and we have to make decisions sometimes neighborhoods or folks are against. But.
2:57:27In reality, the outcome is not nearly. As bad as what they were thinking and what and there's we need to take. I think our professionals opinions. Into our thought making and not decision-making. the reason I brought up the McDonald's was we had the same kind of incidents of. A 100 people coming to the board or very concerned that. When that McDonald's not often put that picture back up it wasn't odd press men's presentation when the McDonald's was proposed to come in. Right in front of mobile home park with hundreds. Homes. I. Probably more there than are Sarah pines and Meadow Brook. The residents were was an extremely concerned that there would be lots of accidents. They wouldn't have access to their home that the traffic generated from a McDonald's which is a lot of traffic. And you've got all the other fast food in there was going to be very detrimental to their quality of life and. If you drive by there, you you must notice that there is no backing up. There's no I've never seen an accident. There. And on the contrary, I see residents coming in their golf carts to the McDonald's without having and all the other stores there without having to get on 54. So. And I know it's it may scare you that there's going to be lots of crime and lots of traffic in your neighborhood. I've been in this kind of see for many years. And I feel pretty confident that people aren't going to get gas and then start driving through the neighborhood and Robin people and doing things like As far as the entrance, this is not the only entrance into the community. There's another one on tier pines Boulevard. It comes out on to lose like Fern. So God forbid there were an accident there is another exit yeah, that that road flooded in our big rain event. I don't. I think it's been like that since that year. I think that might in 2017, 2018. I don't remember the year that picture was taken. But I do hope that can fix that entrance and. Right where it goes over the credit Creek or debts or something that maybe one day of they think it's. A good idea. We raised a little hop over
3:00:06but I will tell you that the one true and the others came in. At first we had a little hiccup. But there was a a berm that was too high. We went in there and fix that that the flooding in that neighborhood has been much better. That ditch has been cleaned. we cleaned out under the Suncoast. There were frankly trees growing in the. The it's called those big concrete things going under the highway there literally. So much Mark and stuff and they're the trees were going there had ever been cleaned out. So we we've done a lot of work in that area to to clean it out here. Pines and Meadow Brook our built in a very low area. So. I don't think we should be too concerned about So with that, I would recommend approval and a lot of these things and a lot of these questions will be answered. And further detail in the zoning hearing. This is a comp plan hearing not as owning hearing. Now, that exit goes in motion. Motion has 4. Lack of a second.
3:01:28The board. I'm on the fence of this one. I know it is happening that you commissioner started that you brought up some really good points. And I know you've worked diligently on the drainage down there. So.
3:01:43Not knowing that when I first went down in that area. That was a first concern is was the flooding like here now. I think all of us in a row district really work hard and districts and kind of expected everyone to kind of get this stuff done. You've done a good job with it. So you're you're you're latest comes again. Cosby. The think it drains. A big concern. I want to I want to know what can we do to put your extra drainage on this. Property at this. Not in this do not want to plan amendment.
3:02:16The applicant was willing to agree to do something like that. This is a comprehensive plan amendment it's not appropriate. Okay.
3:02:23You and I just want to say they were flexible in and I did know it was appropriate at this time either. But. Some other since you asked about the draining drain is let me tell you that.
3:02:33There are homegrown issues in that neighborhood. A lot. There are quite a number the pipes that go under the driveways. A lot of them are sealed up. In the ditches of conveyance of water out of some of the areas the neighborhood has been impeded by some of the things that have happened over the years and the had George Thomas has and we have a surprise coalition. We need to work through each layer and they have plans to go in and. Work on clearing those driveway culverts and so you'll see continue to see more and more improvement. But I don't think that should have affect weather. A property on 54 and Meadow. Brook should be commercial or not. But those are important issues to solve for the neighborhood but that this you know, this is separate and. I think that you saw what that intersection looks like. No nobody's going live there Mister Patrick is there a separate.
3:03:50And transfer exit that leads back into Pasco ways that exit only going to another County. It goes to lose like foreign road was right near the border. But the issue is that there was an emergency or an accident and people couldn't get out of the neighborhood. They can't. They can't. So that's.
3:04:08There is another if you look on a map, you'll see it coming. Like former a I mean, a sea of pines Boulevard. And I for some reason I thought the gentleman that lived across the street was here last time. In the crown. I'm still.
3:04:22On the fence with both of the pots being changed to commercial. Because the second one is directly across the street. From that plot. This is the first plot that's directly to the east.
3:04:45It was the county attorney. So as far as if we want to even talk about even though John brought up and I know it's probably not the appropriate. I mean, about his first lighting buffering. That's also in the next 8 is on or any way. That's that's rezoning. And they have applied for Euclid Ian's. So it's.
3:05:01Probably not even appropriate that got the rezoning.
3:05:05I mean, that they've agreed to put things in deed, restrictions. But but. Traditionally Euclid in you. It is he to appropriate for the site. That's that's the only decision the So as commissioner Starkey states in.
3:05:24The in peace up on 54 is not going to that's going to change is going to go commercial. How much of the next perfectly need to do something viable. It's going to take the partial here and 54. Should be commercial as a commercial product as well. And then going to go through that. Mister chairman. This Mister Moore.
3:05:52But this time I'm here with what's going on out that the died in the second. That's correct. But we will go where where we're kind of back in discussion for back and discuss back discussing so there's to Platts to the right on the East Side, the first plan that's closest northern.
3:06:11Those closest to 50 for is only 0.3, 4 acres. It's not the same owner as a person to Platts in. So they would have to sell both of those. Lots to have commercial use on the front. I want that one plant is an unusable in that size. One point before. Yeah, yeah. So it's going to get combined with the one to this.
3:06:39There's a bordering state or 2 of them were if you want to. But I'd rather not okay. What. So? So the motion is for it to become commercial and let.
3:06:47The zoning of determined. The youth. A second term.
3:06:56I'm going to was the motion. To approve to go to come out to prove staff's recommendation. And let me second all these issues before has tapped his own me that. And I have been to approve and the second by Mister Brown.
3:07:16By roll call vote.
3:07:18District. 2 commissioner more. Now with district. 3 commissioner starting. I district 4 commissioner Fitzpatrick me district. 5 commissioner district, one chairman Oakley.
3:07:39What made us it may include motion fails man, 3, 2, Did you know, the gentleman I understand we're going to honor that he gave up, gave up. Okay. That's that's any be allowed the My understanding is he will come but it will come back next year. Next hearing for purposes of the record, then why don't you. That was 45. When would you like to that's take care of them happened right after P 15 that perfect. Thank you so much.
3:15:04Yes, Sir. Thank P 51 is PD 21 7, 5, 2, 3, and it's a rezoning Robert and Theresa Britain for a change in zoning from AC agricultural district or culture residential district with the voluntarily agreed upon deed, restriction limiting it to a total of 2 homesites total of 2 lots altogether on a little bit over 10 This comes with a recommendation of as stated in your agenda. 3:15:57So having one's big gas made remain on consent. Move to be 52.
3:16:06Item P 52 was published in the Tampa Bay times on March 10th 2021.
3:16:12P 52 was PD 21 7, 5, 0, 5, as the zoning amendment me Salem media master plan unit development district Salem radio properties. I think it's a rezoning from AC agricultural district. A master plan unit development district to allow 325 residential units on approximately 70's. 7.21 acres comes to what the recommendation of approval with conditions including your agenda. Packet from put both the planning and development Department and the planning Commission.
3:16:41Should I be that this is my town home products. But what I have.
3:16:54I believe the applicant is on here. I'm not certain that this is actually a townhome product. single-family Not sure if they're actually attached as what's being proposed here is Jessica, to answer that question. Just a cold planning development Department. The applicant is proposing single family attached and detached units.
3:17:16So it is single-family like a few simple owned lots, but they did not the specific detached only noted.
3:17:24After seeing a town with no trees at this. Everybody comes in here. We want, you know me on
3:17:36If they're going to put landscaping in the because that's. We have to protect protect the county to speak to lot trees. Uni. Yeah.
3:17:49So currently the code doesn't require that. But I will definitely well, I don't I know that what their code requires is. They have to have X amount of trees per lot.
3:17:57And they're allowed to put him in the back and then they cut them down, then we have no trees. I'm just going to be asking those questions until we fix our land development code and so on. Who is the applicant. This power will height is representing OK, miss Barbara. We just little is people come out OK, we'll pulled from consent and say thank you.
3:18:19There was no one else is speaking against his product. You know, can you know, we just pull this one from consent. So we just boarded propped open for discussion. When you move on to be 53.
3:18:41Item. P 53 was published in the Tampa Bay times on March 10th 2021.
3:18:47PDT 21 0, 2, 5, 0, This is a development agreement. Meritage homes of Florida Inc to a development agreement to limit density convey right of way and provide a drainage retention area in exchange for mobility fee credits and a partial waiver of neighborhood Park in landscape buffering requirements. This comes to you with a recommendation of approval as background from this, this is basically. Was part of rezoning 7, 4, 9, on October 20th twenty-twenty there was deed restriction recorded and promised that in the future there would be a development coming forward and this is the development agreement.
3:19:24Is anyone here to speak to
3:19:29I do not have anyone on webex and there were no e-mails to read on the record.
3:19:33Is anyone at the kiosks to speak against this item.
3:19:40Can I can ask a question please absolutely. Why we were waving a landscaping will. It is that we buffering a wetland or what is anyways because I don't want the chaos.
3:19:51There's nobody here at the kiosk that I all right. Thank you. That I'm remain on, don't we're not. But I think commissioner has a question that if you can write, I won't pulling it in and work with.
3:20:06Yeah. So basically on there is of floodplain compensation area and what's going on is that they're reducing the type C buffer that is adjacent to the right of way of Morris Bridge Road road because they're providing. They're providing actually additional right of way based an actual study that was done by the county that that actual dedication of right of way. So the buffers just being reduced. The 20 foot buffer is being reduced to G what know supposed to be a type C buffer on so that no 20 note Heidi buffer is required with respect to any lots that are that is adjacent to the drainage area. So if it's adjacent to the drainage Bay area and the floodplain compensation area. They don't have to provide a buffer however, a 20 foot-high D buffer continues to apply where the residential lots directly about the future, right of way of Morris Bridge Road. So they're just not buffering a drainage and wetland compean. Wetland compensation area. That's what's being reduced. All Only this one on. But I'm going to be watching the things

Therefore this petition comes to you both from the planning Commission and staff with a recommendation of approval subject to the conditions of approval included in your packet. Question. So is this part of the meadow Oaks golf and Country Club.
3:35:39Or is that somewhere different.
3:35:46I believe there some of the subdivisions in meadow Oaks that are part of the country Club. But I don't believe all of them are not certain. and again, I'm on this landscaping thing today, but I'm I'm looking and is the applicant online.
3:36:03Yes, OK, well, they know that one
3:36:10So I'm looking at Google Earth.
3:36:13And I'm saying I'm sorry, but many homes with their landscaping. And I know our code requires that every lot has to have a 40 by what has that been. How many trees.
3:36:266,000 square feet unless it's one tree and then it goes up based on the lot size. Not necessarily the House. So everyone is supposed to have at least one tree. and I for some reason there's looks like there's been no Street. He's in here from what I can see here. with the applicant agree that every home will have a tree in the front.
3:36:51High level I can see that came in to read. He is on the project engineer. Why can't he give condemning is honored by the developer. We need for one of them to jump in on that.
3:37:11And we're not talking live oaks there. This game. And you're already a 9400 crossing Boulevard suite, to have this war. I built the good afternoon. The developer intends to comply with the conditions of the I don't know specifically that it will be in the front. But I can speak to the majority of the houses that are out there at Meadow Oaks have been out there since the late 80's early 90's, at least.
3:37:42So that's probably why it appears that some of them don't have. When it's keeping it needs to current code.
3:37:52there. Well, they won't put them in the front. There's a lot of yard there. On the way. Our tree or a palm tree that be a problem. If if you want to make that a condition. I don't think it will be a problem. Great. Thank you very much.
3:38:12Recommend I have been here. You've got to like applicant present day haha just getting ahead of the game. It just back the second mission. They went just to comment. Just make a comment. I like the connection that we have from Hudson going to connect on son. Evan. Yeah.
3:38:36Very a continuum actually extension for the next 5 thinks yes. Okay.
3:38:42in Wendell, let's let's get back on track again. Barbara, you have presentation or you can rely on staff presentation at this point.
3:38:53So that was a pretty presentation. I'm ready to pending on any public and we're ready for the company. Public comment put that thing I could do that. But just couldn't. and you know, where the next or even now, I do not have anyone on webex or email isn't one of the key or explore. I don't.
3:39:12He could be a 58 be. Did you. You know, when I hear you Okay. I was somebody who was There's a couple people people people dressed in due time.
3:39:31We have people of the he has been for people at the kiosk. Okay.
3:39:35State your name and I was kind of an inch. Yeah. My name is Calvin branch. 12, 7.18, sure. Creek Boulevard. That's in Florida. 3, 4, 6, 6, 9, and you might want to use this. Have you been My concern is that I spent a lot of time last week trying to find an answer to a simple question. All of the construction traffic and heavy vehicles that are going to be accessing the building site. How are they going to get there. And I got a couple 3 different answers. My concern today is this. I would like to make sure that in your conditions. That's absolutely put. That other thing. The case of an emergency stay where you might have to use County unfair wins all construction traffic and heavy vehicles. Well, access to the building site from Hudson Avenue. Thank you, John. S. Thanks, Gentlemen. If you can.
3:40:46I hate from 1, 1, 2, 0, of to have. This is a property that is to the east of it. In question to be So we to start by saying I am the purchaser. A property that will happening in June when we went to first look at the property. But one of our main things was was that we love to the wildlife. There's your turkey. Gobbler I will be raising a family there upon So we are really looking preserving the integrity of this agricultural property and keeping the agricultural healing and to be used for not equine purposes but to raise not livestock with cows to raise chickens to have to grow crops and have a green houses. So just trying to keep the integrity of the area in I know that not only is the property over off of haze being developed. So a lot of that have nowhere to go. Other unless they go across the street across the So also concerned about the buffer between the 2 properties so if we have that and took off or we are proposing that there be 6 foot privacy fence peace events in between the 2 parcels help protect the safety of our animals. And the safety of new housing development as So with the 35 houses being developed on that 10 acre parcel. We have one house on the 10 acre parcel we would just like we're concerned mainly with the safety and well-being of our cultural piece of to ensure making. I'm sure many thanks a good time, the well or septic Richmond's of the houses that are going to be on the property it in for Jen long will the property. So where will that are being brought. Will it be used But as the base of the new house is being developed are going to be taken out while we are raising our We don't want any of the flooding to affect any of the so. Also we are currently an expletive zone. So concerned with how the development of the 35 houses will affect our flood zone where will the runoff go. And can we be certain that it is going to go towards those retention ponds and not go into our area. Thank you.
3:43:35I thank you. you do an I managed to turn a lot of currently at 95 Mike Brooks for drive from Port Richey, Florida. That was why don't we spoke to maybe even virtually and up. And even sure I have this one, OK. Thank you, Sir. I we currently have a contract to purchase 13 1.20. But some have, which is the neighbor to the east.
3:44:04And we've been getting a little bit about Kraft as to what's going to happen. And I know you guess what, your landscaping. But I think of a tree. Every 16 feet is not really very reasonable them between 2, 2 different homes, something we're going to have one home and they can have 35 on just that. One piece to our word for word West when we're going to have them from 81 out West on the north side and on the East Side, they bought J shape all the pieces around us. And I was hoping that we could make sure that you know, if they're going to have sewer or septic. I don't know. I mean, I'm hoping that rain are just going to work. All right. the thing is we're worried about. It's been going on. Make the the drainage ditch is going to take over What are they going to do with it. I take it all. So you're really going to build it on to the global markets, which is going to donate them with all the cones covering most of the way of the driveways, which is concerned that the water is going to come on us from all angles and probably be you know, you which is open. That you guys will make sure they do that, right. We sure your time. Thank you.
3:45:25Jim. 1, 3, 1, 2, 0, have an Avenue on the car current known and I have a contract with the Turner to sell my property. The beginning you. Have you been sworn I have worn it, OK. Thank you. I'd just like to bring up the question of the electric power line country. Let's into my house. It's very good. It's very close to the over. I was wondering how that's going to handle. With any peas. Many issues. This like mind the commission about the facts There was a 2007 agreement provide the PC offense. With the current current owner. The fence has been marked by a wire been since 1984 and the summit had you been there since 2005. We we are going to be working with Mister Clendenin and discuss the media. But we're in Turning to his current diagram the fence. It's well, it is up and the. The fence, but be on the West side of the bunker. This will ensure that the. The shrubbery is and we have the separation between the 2 up. That's the property. I believe the end you. If you do require that it's the butter is there for us. And keep us separated from that development. I just like to remind the board that the owners are going to keep. This is the natural state, the cattle and horses. And I hope the commission can do everything in their power to keep this part of the Board of state. Thank you very much. All right. Thank you. There is nobody else here for this item. Okay.
3:47:34This after having Bangor bottle without him.
3:47:38Sure. Commissioner, thank you. With regard to park the key in any neighborhood. A son my client have been working with them. I'm not sure how would we. The time he went to work directly. We did add language to the conditions relative to requirement for the scent in the area of their actual home and then some. And then we also have the type that your required the type C buffer it up. But for that, the code that we require we as offense to that, I'd like to at the plant. Think from the inside or the outside. I will let my team addressed that regard to Mister granted comment. The question is a good thing condition and the deputy this is not a new project. The build out with the final phase. The particle of this project and so long ago condition 19 negotiated for what the rules are going to be regarding instruction access for all that, all of the project. And so can the 19 required the construction traffic enter via colony road the air when the Mac by. Or from what could happen in the neck by. That being the thing condition. We're not. My point is oh, I love that they can Park been. There are other owner. We've got that that condition when I go there we did after the change that the commission acted on project that somehow the construction traffic than anticipated by the property owner, but the out begin parcel. And so that that it in the regarding how construction traffic is always been required to enter next by. I will let either after condemning or or Jamie, a drought. I guess if we move that plant to the posed to the inside of our fans that we operate in that condition. I suppose that would address the concern. Mike, why? We'll continue to be working with them to Campbell because Campbell driveway and my client property. They've got to work together, anyhow to get that read I think the but that we can do it at the county is to add fewer type a buffer requirement. The vinyl fence and we in the code does not dictate which by the landscaping goes on. But but it it putting it on the outside moved up on them. I could see it making the grade of that.
3:50:26And again, this is Jamie, you're I don't know. Is Mister
3:50:32Thank you to an end. Yes, he shows up on.
3:50:50Yes,
3:50:53Sir. We hear you. You don't hear us.
3:50:59This is Jim condemning them. They can hear you. Jim.
3:51:13I guess what Mister Clinton is having a problem again. Jamie Gerardi 94 on a river crossing boards. We want to be pretty. I have spoken with Mister Clinton inning. And again, he is working directly with Mister Campbell and with the Turner says my understanding. He wishes at this point to keep the landscaping on his side of his understanding and working with them. Is that privacy? The opacity of the fence or that will be provided by the 6 foot trance. He has offered to provide. It goes above and beyond. What's required by the code. So he would he would prefer his residents. Benefit from the landscaping on his side of the fence. I can go ahead and speak with the other. The stormwater that the dirt that's or are they and home for the dirt that's going to come out of the ponds. All of those items will be addressed during the final design and final permitting. The agencies will have to allow us to make the flooding problem worse on the other side of the property line. All the water internal in development has to be maintained on site and we are regulated as far as how much water we can discharge drop our site. So all of those issues will come out to him during the. Design and permitting states.
3:52:38Mister chairman. I guess I'll just speak to the colony road Hudson Avenue access. I think it's acceptable do it the way they can set up the not going to the mainly up sugar Creek going through the development which was probably a concern I would have, but I think that the actions are you putting in for transportation of acceptable.
3:52:58If I may add the order that was put in place to prevent the construction traffic was actually the construction traffic was actually using the more like the one we consider private residential subdivision roads and it was tearing them up so that's what caused a halt and construction and the cars. The order to be put in place. When you look at the whole area has if use beats pan out and the aerial. Less likelihood that they would utilize colony road because of how it circumnavigated through fair ones to get to the northern part of this development where Hudson was is most likely that they will enter Hudson, especially since that isn't a developed road yet they just need to stabilize it together. Construction trucks in there and then propose the rest of the development in which is on the South East corner of metal Oaks were being proposed with this and being developed at the same time, I would have a little bit more of concern. But given that all these 4 parcels as TJ you are all in the northern part of the development. I think it's highly unlikely unless there is an emergency that blocks that that they would be using colony fair ones.

4:04:12I Mister chairman is the Clark being how BPA 1, 9, North Bridge Street Tampa. Florida have been Keep it fairly brief because I think him he's been given a pretty thorough analysis there. But this project has been planned since 1998 to create. Development that had essentially 3 core tenets around creating a new town and what was the content ranch which was originally about 8500 acres. The core tenets work to create a compact developments that discouraged urban sprawl and built a sense of community, a place. And the sense of community to have a mixed use development that provided a greater variety of uses closer to home and work. And to prevent a pedestrian or unit community that reduced reliance on the automobile. Those are kind of the core tenets of Connor turning. And when the DRI was approved, the downtown Cancun area was located in the village. 3 in 4 mpd that we're bringing to you today. The remainder of the entire continent and development party has approved. NPD says this is the final area implementing the DRI as candy pointed out, we have followed the intent of Connor can and what that can monitor him really to the tea by creating this mixed that's going to be the downtown area and then the single-family communities within the balance of village 3, 4, in PD uses their own neighborhood scale originally when the DRI was approved, it was going to be a bunch of very large retail in this area that was not a neighborhood scale or neighborhood serving it had over a million square feet of retail and a community college for a 1000 people that would not really a bill to a sense of place that we're trying to do here. And so we retool it and sense when hours got involved, we've created a great master plan that I really believe through that connectivity plan withdraw this community together and provide the type of services that that is the already live in Cancun. But expected to downtown and what will serve as for village to reinforce. Well, we're very proud of the project. I can tell Starkey that, yes, each single family detached law is going to a tree on the front. We're happy to commit that and that needs to be part of our mission. We're fine on that hang on. 4:06:47because you're an attorney. But thank you for the single detached cabinetry. And what about the multi family.
4:06:57Other townhomes are ready to townhouses commissioner, where what our plan is. There is we're hoping to use the same product that when our build in Baxley, which has been very well received, which has landscaping and trees within the D a.
4:07:11Each count House block. So it's not one of the ones that, you know, I've been discussing with no Street trees.
4:07:16So are those we love that. Our front loaded. They're right and related. But that okay, so hyped up communities within some of the areas are going to be more urban in higher density and some of them are going to be a little bit lower density as you get away from the downtown. So if I were to go into the reserve and look at those town homes there. I know there's not. I know that about an hour, but they are front loaded That didn't have any trees, but they at the end of the blocks.
4:07:47And now they have palm trees. Well, you find can can you find a way to put at least a palm tree so that we don't if their front load that you said front motive right.
4:08:05So we're going to have right. And really the front loaded ones and I'm happy to send you a picture book and put it up on the screen.
4:08:11Of what happens when you have front loader townhomes with no landscaping. It's it's not a pretty big time. I understand we're very much aware of that. And I appreciate you and asked me to remind me again. Now that we do not want extended townhouse blocks with no Street trees in the front yard doesn't work. It's not attractive. Guess. So.
4:08:33can you find a way to put a or some or.
4:08:38It can be a palm tree or understory tree or some kind of tree. And each home that I think committee will. We will do our level best to have a tree that we need unit. That's that's our commitment thank you very much. Yet cartons a great neighborhood in.
4:08:56They deserve a tree. We plan on this being a major community for one hour. We're very proud of the work that we've done with staff over the last 2 and a half years and we really believe we're battling the mission.
4:09:09That the board take that on Connor can as early as We believe we're bringing it home as everybody would like to we have the rest of our team here to answer any questions. The only thing I would say could extend the board makes a motion to approve after it takes public comment. There's any rebuttal it would make sure that the motion includes the correction on the amount of retail to a 150 instead of 55. Development project that not only it doesn't just have 55,000 of retail space. It has 150,000 square footage of retail space involved in cutting into what is just beautiful. Pristine and dynamic other residents have said that really are asking the county commissioners to listen to the to the people who are speaking out against these elements who. The couple of issues that were raised. And this is really for the benefit of the folks who spoke. I don't think they understand a lot about Connor miss Bishop spoke about the need to preserve open spaces and the land in general in the area when Connor 10 began, it was about 8500 acres and 3,000 of those 8500 acres were conveyed. Former preserved swept my of those 3,000 acres with weapon enhancement done on over 1600 acres has enormous and then additionally, there was a mitigation bank that was previously buildings finding had a lot of entitlements. It's over a 1000 Acres mitigation bank now. As to Mister parks comment about Aaron cut off. We heard his comments. He's been making them on the record for some months now. And for that very reason, we have not changed anything about the trip threshold for call Collier and its construction. So if we need is tripped thresholds in existing transportation study. My client will be building a nation. I think the brunt of it, even if they're not triggered by my client from the county building Collier if it so chooses in the future. And then lastly, when miss Miller has to preserving open spaces and farmland. You all are well aware this project has been proposed since 1998. We at the trucks lined up from our house all the way down probably about to block. Stretch for about 2 to 3 weeks up and down our roads when the water finally receded, the roads that the story by the trucks. We did but the roads fixed at that point. And we pursue that and we did to the ship sail. The roads are perfect. There's no potholes in the road. There's no sign of we're in the and I and asking that table this motion at this time. Thank you. My name is Laura sly and I would love a 5, 3, 6, pressure core. I have been there for 20 years.
5:02:09I have not seen any difference Enviro time and time again until today. And. Definitely does not need anything done. I don't recall any flooding on our roads were over on the other side of the lake and the air and the ground was down toward the lake. I do not have to remember standing water in my yard. Or on the road at Planners Lane Rangers drivers a different story or water over roads, especially during our major storms. all of those roads were very, very bad to travel on minors. Lane has a little bit of damage from that, from just potholes other than at all. The potholes and it's fun. We are through community or, you know, 3 traffic that goes through our roads. My road is a dead end Road. And when I say dead and I mean that and it's not even a cul. De sac and we do not need this done. I am one of the people who is retired. And if this is passed through, I am going to be forced to sell my home because I spend what I need on things. I don't spend what other people think I should spend. I cannot afford it. And so this would force me to move. So thank you very much. Thank you. My name is John Schneiderman. I reside at 8433 fresh record. I have been sorted. I think the main issue that has to be addressed today. Is this myth.
5:03:47because in 2000, 15 this idea of it being temporary means we have to act today. There's nothing in the statute. There's nothing in any role. There's nothing saying that we have to do this today. What this really comes down to is a better choice and you as our elected representatives have to make that choice today. When you make that choice, you have to decide whether or not you are looking out. Something that 5 years ago he said this is temporary 7 there for we have to move on and fix it. Now or you have to look at the facts and the fact of the matter or if you have gone in 2 cranes roost and you look at cranes roost, right. You would say this is a beautiful road. This is not a pockmarked road. The potholes. There are no cracks. This one of the nicest roads in the community. Look at it for yourself before you say. Well, 5 years ago we said this is temporary and it might not last. Someone previously said this isn't a through Street and that's why the roads are still in really good condition. At our last meeting where we met with commissioner Fitzpatrick. I asked her to look into how much money has actually been spent to Crane truce over the last 5 years and I haven't heard that number yet, but I would say it's virtually 0 and you know why it hasn't needed. So why do we have to follow up on a policy that was proposed 5 years in case these roads to deteriorate when the fact of the matter they they have it. You are commissioners. 95% of our community says this should not be done. It represent us. Don't represent something that was pastor decided upon 5 years ago but focus on what exists today. Thank you for your time. Thank you. My name is it so be it.
5:06:07I live at 8, 6. '07, cranes roost right. At been sworn in. I want this on the record that are read this are not bad.
5:06:20I mean that we're on Brown. Yeah. Before I go, I go down. These roads are not bad at all.
5:06:34And if if you all want to spin I I want to ask, let's I want to know. How much my money is going and what I want to estimates. I just don't want one company coming in and doing it all. I want somebody that's going to come in. Take care of things to take care of all of us. Neighbors. You know, we don't want somebody coming in and sharing everything. Yeah. And then we've been in a big mess. So I'm just saying in my household says you need to. And say no, we're not going to do this.
5:07:22Yes, Sir. Good afternoon. stamp will come on and I'd resign 8543 cranes roost right. We've been there since Rangers, consist of 82 family residence and 95% of which do not want this to we feel at this time. It's not needed. By the pictures that we were shown earlier. Whoever those roads belong to they needed more money. Do. We don't need this. Those roads right now couldn't are in better shape. They were in 2003 when we moved in there, when we moved and there are potholes and there were problems. Not good. But there were problems. We don't so much if there are potholes at all. We have kids that skateboard down the street. You do not see kids skateboard on the roads. It were pictured in the presentation that you get us. I would just urge the board to out of the app and the wishes of the graders. Grace wrote. Yes, ma'am. I'm doctor Susan. Great held around 11 days and 51 cranes roost rosman port Richey.
5:08:59I have been sworn in and I come to you is one of the residents of cranes roost asking you to vote no. I had to be a 3, 3, 4, 6, The commissioners in 2017. We're trying to help us by stabilizing our roads. Chip sale. And that year they had the action that is before us. It's been discussed is a follow-up mechanical action of what happened in trying to help us. If you chip seal that it comes back to the boat. You should not put this up on us against our wishes. You should vote on what is happening now not what is what's happening those many years ago. Yes, we do appreciate it. And we do not appreciate the chip seal and the stabilizing of our roads. However, we don't want our money wasted because the cause of the problem, the water issues have not been corrected. There will still be flooding of our roads and flooding into our houses and it has not been fixed. Commissioner Fitzpatrick your own stormwater personnel and present it and our meeting that you call for us told you and they were commissioners, of course, but not be there. It will be years before our water issues will actually be fixed. I knew then what road destruction will happen again. If we get our big flux. But again, this new road will not stay if we get a massive problems, a gay white. They also come before you today in red, white and blue. If you can see my parents. To remind you that we fought in America ought to have representation. Of the What they want it. We do not want and have you others parroting us to make those decisions for us, especially for those decisions. Do not make sense. Make your decisions today and vote no on what is happening now, not what happened 4 years ago, not what got put into place by the commissioners who no longer are even here you know, and what is happening now what the situation is under water issues have not been resolved and will not be probably they commented for another 5 years. So let's wait and spend our money them and have our roads think to them. Thank you.
5:11:42Yes, search. I and our low 8445 fresh court. I'm here to watch the same opinions that my neighbors or no reason at this time to do the roads. The roads are in great shape and you put the cart before the horse. The flooding issues have not been resolved. For 5 years ago. Those flooding issues still are in fact today. So do the roads now. Would not be a wise move. So I'm asking you to withdraw this motion. Nobody in the neighborhood that want to die but person spoken out against In to do the right thing and throw this motion, Sir.
5:12:30Off of the Boston know what else that, you know, just become the alright. Thank you.
5:12:34Mister chairman some questions for Easley. Okay. And you know, no, nobody likes to start the bass and I get it has been just a We have an e-mail to reach a verdict as read come back to you.
5:12:55E-mail is from Schneider sneiderman and it's SCH any ID or M a n I address is 8, 4, 3, 3, pressure Courtney purge of Florida. 3, 4, 6, 5, 4, I'm requesting that the following email be read into the at the upcoming BCC meeting. He held on April 20th at one 30 PM regarding the cranes roost pay repaving project.
5:13:20I would have preferred to speak in person. But I will be at work during that time. There are 2 issues that need to be addressed to be addressed based on the commissioner's responses at the last meeting. The first issue is one commissioners claim that the pavement is needed because it is a wave and you need it because it's a waste of taxpayer money to continue paving for maintenance of roads that are in need of repaving this argument seems reasonable. It's based on a faulty premise that the county is actually paying money for maintaining the roads within cranes roost. The truth of the matter is that very little, if any money has been spent in the last 4 years for maintaining these roads. We had a small pond whole one of 2 on patient Lane in front of our home for over a year and a half. And the county never did anything to fix it until last month. That is not spending money for maintenance. Well, this is only anecdotal. You are our representatives and it would be very easy for you to see how much money was actually spent maintaining these roads and cranes roost. If you look at the facts and conclude, but a lot of money has been spent over the last 4 years. And perhaps this is a legitimate argument. You look into the matter and not very much. Money has been spent for maintaining our roads and the argument is based on the faulty premise and should not be considered the reason the county has not have to spend the money to spend a lot of money on our roads for simply because they do not need to. This is why homeowners are so up in arms about this issue. The second issue that needs to be addressed is one that has that was mentioned at the last. Have been mentioned mentioned by at least one commissioner and Mister ainslie. That argument is that cranes roost drive was chip sealed. And this was just a temporary fix prop the left perhaps life expectancy of chip seal is only 45 years. But in this case the chip sealing has far exceeded expectations. If any commissioners have actually look at greens Ridge drive. You would no doubt conclude that. It is not a port, a very poor condition. As mentioned in the letter sent to homeowners. But in fact, is one of the nicer roads in the area. Please look at it yourself before voting for this assessment on our homeowners.
5:15:29Perhaps it is a fact that cranes Ridge drive is not a through Street in gets very little traffic except homeowners visitors and service vehicles. But the chip seal is an excellent is in excellent condition and does not need to be torn up and repaved not vote for this project without actually seeing the condition of cranes roost. Right. Thank you for your time. Mister King okay. no doubt, no one likes the P B bath.
5:15:55I have a home in aristea that's been going to be that us. Nightmare for the last few years. And as one of speakers it was rescinded and that was extended because you what was the process that you're going to do in their state. A micro service. And Michael servicing, that kind of similar chip seal did little more and more.
5:16:18Just a little more. It's similar. But in terms of longevity is about the same. Yeah. So the reason that the air is Dean is not going to do that anymore because they realize that that's going to last 3 years, maybe 4.
5:16:30And then we're going to have to do really fix the road and then residents that live in that will be paying too It's not one they'll still be paying for the first assessment. That is a temporary fix. the idea is that they'll just go for the permanent. Thanks. I think the people on cranes roost think they have a great move because the chip seal hasn't started deteriorating yet. And when that deteriorates how quickly does that deteriorate it's unpredictable depends on the amount room for we many factors that can be.
5:17:13Rapid rapid. what we didn't see pictures of the cranes and I didn't see it.
5:17:19I thought was under water. I didn't see what it looked like after I don't recall and I drove through there was it but if it if it failed, it's because it was full of potholes and the lime rock got saturated. I'm going to guess I have to you have a mixture of 2015 if you can do it and they can put them back up. the 3, the 3 million, 500 dollars that we that we loaned to the neighborhoods. They have their roads fixed temporary. So that's what you're owed looked like and the taxpayers of Pasco County came in loaned the neighborhood. Some money. So that they could have drivable roads and it's not going to be too long before it will look like that again. If you were to get into the PBS how long would it be before you can even start doing their road.
5:18:15if it gets approved today we're looking at about 6 to 9 months out. And in terms of actually appearing on the bill that lacks ability to 2023, 2023. And this can be spread out over on a denier. Yes, yes. And.
5:18:31This would be full depth reclamation. Is that what I rest, correct. So that is full that that reclamation affected by water. It because you C meant it becomes impervious so water would not get into the base.
5:18:44And if you're at the base of the road.
5:18:49Okay. So the road will stay the same. Even if it's under water. And guess so. That's because House. Yeah, it's it's a great Road in the last. 3 water events your your road looks great right now. But. It is. Well, did you measure the thickness of it. Did you go out there and takes and then measure. But are you thinking when you go the there are some cracks that are showing up is not extensive, but they're correct. So the when water gets in those cracks in this rainy season. You're going to see. You can see go. Thank you. Thank you very much. More.
5:19:31Mister Moore family. The statement. Yes, thank you to be starting again. Just keep it on you personally. I appreciate the comments that are made today commissioner returns. We're going to turn your Okay. I couldn't get him to play as that better. That's better. Yes, Sir. I appreciate comments bid by the experience and the spokesman for the citizens there. You know, it could goes back to the last time. And you've got 95%. It put. Separate. If you look at the mission red Raiders, what the what and you know it and that the debris state. They don't up being but they said they don't want it. There's no. The county there is there's no action but it didn't go well. If they don't want it now, don't want it. It 5 years down the road. But what happens at the wheel of a Fort. They are. If they're not, they're not. It's just the reality moment. You've got basically every couldn't live there. This is. They don't want it. Let's look for some that. It's the point, though. It is going to understand what it close that I've said this before. Woods. But he said that if I were, you know, they are wherever it. Maybe it's closed.
5:21:16But the situation here where you basically have every single person in a neighborhood that say no. So that's not force this up on them. It breaks down the fortunate. If the driver impossible's it's unfortunate, but they're saying they're going to take that risk this time. Well mate. If you heard a number of them say that they did in 3, 4, 5, years. We need to do need to do it. They want to do it some guts that in. But if you're not that time that they're not that either. But people at the I mean, we know and what it was that we had some beyond has been praised for its something where we didn't always see eye to eye him. That's a problem spot on. But that for them at this point residents 100 per said could I buy presentable said that it wanted. Let's listen to it to be a debate anymore. Be honest with you. The rest of the rest of the meeting about this. You have enough people basically everybody says no. The force of it. I don't want to they don't want it.
5:22:24Marianna. Thank you. Thank you. Commissioner more that you're getting the you know, is if you had a dummy. Publicly questioned in the survey of the people to ask them if they wanted to survey done and if they came back in 95% of the people said no, we don't want to. What would have happened to that.
5:22:45It's a property on initiated project. We have sent out ballots. The ones returned 50% or more have to be in favorite move forward. If we don't get that it is this continued so its budget 95% this. But whenever you see it's tucked away you get the letter of the doctors were property owner initiated because some were talking even like 51%. A shutdown would come to us. We're talking 95% of the people have come forward to say they don't want. I haven't heard a single person in this whole development.
5:23:12Say they want it. When I look at that type of feedback again, for people in these people are pretty I've been in the neighborhood for many years. A lot of friends in there. My insurance vice-presidential, even though the family was destroyed in this road many times for many years. When we get recommendations like this, you've got a recommendation for approval now. And that's, I believe because you have a board of County commissioners that said, we want to get it done. You get a single commissioner was here before that said they wanted an that's the reason you may do the recommendation of approval correct. That's why we're standing areas. That's why we It was done differently. This thing's not in before us. So let's look at the present situation. You get current pictures. I got past pictures I've been on the road. The roads in great shape. The people say it's in great shape. That's good enough for me to say we should be doing this. They say they don't needed and we don't have to do this. The study debate whether we can do because it's a comp plan issue. Do we need to look at these things. What things to should we consider what things would factor in. This is simple. We got to make these people spend the money to do road. They don't want to do that. They can wait on. And there are there. Are they all know the risk. They don't know what's been done to the roads now even know better. What's done? The roads get to the roads are actually fully done.
5:24:26That might just a chip seal so they know the situation and they still are coming out here saying they don't want to see this done this. This is commission. Would you said this should be simple. Repairs were were I expected last 3 years expected to last 3 years. But guess what? The lasting a lot longer. Why do we need to go back to something. I thought it was going to do for 5 years ago. Find out that my situation is much better now, why am I going to go. Just because they said it was going to do it when I look at the real factor in front of right now. This is easy. We don't need to go do it. They don't want it done. I mean, we are representing these people. I mean, I was there when all the flooding was going. When I got a call from 1, 1, of the residents there say we get we get benderson is pumping into unable to flood this out. What are we going to do when we got to stop that we're in a plate and on news line up the street. That wasn't enough and grandmother at the Galen Wilson right all the way up there. We kept him from plum done. We still get a deal, these flooding issues that are going on in the not solved yet. I think we're doing some great things. I mean, stormwater Mike, you've done a great job. The team with 13% approval rating as far as how would how the looking as we're doing the right things. But this is not the time to do this roan. The people don't want. They don't spend the money. It's their money. We don't need to do this and I'll tell you what, I did a project on hold until the need to get done that the chip seal to put that one needs to be done. This one. He had doesn't need to be done with those people out there speaking. So clearly they know what they want. Why we're going to force it on Mister Patrick.
5:26:04A few different things. So halfway down that road having that pothole. You know. So I know how big that Pol Pot. Why can't we know it. It was extensive. All all along the road. This is back in 2015. That's not today. Right now. The big picture. So my heart and each of a different if use scroll forward this is on plans as Lane and that's plant is interaction scores. I was taken a couple months ago, maybe 2, 3 months ago.
5:26:35Who do we make an agreement with when we use the BP funds. Our South. No, we made a commitment amongst the 5 commissioners. So one thing. commissioners. Well.
5:26:54The 5 commissioner said if we take this money that could be used for something for all the people, Pasco County. We will lend it to these neighborhoods as a temporary fix. But we will come back in and require those roads to be fixed. That's what we said to the 5 of us. That's what we voted on. And we also said we make sure we did the storm water improvements that had to be done to. I think the first set of things were done in holiday. I didn't vote for it because I didn't think the storm are suppose done that didn't have anything to do with the BP money. But everything that we do is a decision based upon the information we have currently in front of us at that point in time and now we're in a different point that so my Mister chair and.
5:27:37At what point will the water mitigation. Because I know when we had the 2 and a half an hour meeting the other night with cranes. Ruth. I thought it was said that the water was going to be resolved prior or when the roads are being repaved is the storm water concerns fixed and I'm not sure of the time schedule there drainage issues here.
5:28:02One is related drainage annoys him or Basin related. And that's at your meeting.
5:28:07Don't carry a dress. I don't have that time but but in terms of in a row today to drainage. And because the. For that recognition is a methodology where use in in terms of preservation of the base that have been most affected. With the men in the road or to preserve the roads are.
5:28:28I want to read. Can I so I did receive an email from somebody cranes or is this morning that is understandably to assess. For the paving do or low top tax cost base, which everyone enjoys. You can see all the puddles this morning in the streets showing all the dips in the settlement. Please vote yes, on PBS 30 to 40 think is a need to project as a resident for over 33 years. It's time to do some maintenance eurogroup Rangers. Please focus on the road issues and not the distraction of benderson pumping flooding covid in all the clutter improving cranes roost is an improvement for the Pasco County which is the main goal. Thank you for joining us. We have a lot of people think now we have other people thing. Yes.
5:29:20Commissioner key so that email to all us. This is public record and we can see the address. There are moments that warm in the sun. This was sent to all the commissioners. This morning at 08:43AM. More than just that may have them. If I have anything on the one yesterday that the 70 of them are against it. So what is the timeframe that the storm water damage.
5:29:50I'm sorry. I don't I don't have that information.
5:29:57At what point can we know that information I can get back.
5:30:04Maybe yes. So that's the hidden Lake project. And I mean, this next fiscal year we're planning on land acquisition. So we're at least 2 to 3 years away from the project being implemented.
5:30:17And then how it's going to affect her answers. I would have to defer Donald carry on the exact. Nature of it. I know that the compounding the storm, water upstream will provide some benefit downstream flooding.
5:30:32Will it affect their roads? You have to you drilling. There wrapping up the road.
5:30:41Now, that's all no, no. That's in there with the work that ainsley's talking about here. The road related drainage is the water that falls on the road and managing that water. The Basin related flooding, which is just related to the topography of the area. That's a different that's a whole different animal Mother Nature can always designed a storm that will outmaneuver us. So to to say that someone's road home will never, ever flood that. We can't say that.
5:31:05Isn't there an additional storm water project besides road Basin project. If it is not a major us with my project. There may be something that the stormwater Department has to do moderate improvements that they do. I'm I'm not privy to that list. This time. I can certainly find out and I did. I was aware. The citizen I've spoken to says and they sent their roads. They're they're pond has not overflowed has not come back up into the road.
5:31:30And I we did. Pasco did. Stop pumping from benderson pump and they sent it back over the roads to the animals and number and you drive. And you know the comment as she mentioned would ever see them. That was changed from a chip seal to it pulled up the reclamation. It was not.
5:31:54Hold or canceled. So the only concern I had was.
5:32:01Who do we make that And if it was
5:32:073 members and for members, 5 members of the board that came to the agreement. I know the one had said. They thought this was over before him. And was pleasant Ward.
5:32:28Mister chairman yes, we're going make them more. But yes, the commission of that. But I think obviously team passion about the What? Why don't you know, I want to put out to the residents and if you're in, if you were stating that there's a few residents use spoken to their favor.
5:32:47Put up for a and see how it ends up depends up over 50%.
5:32:55Mister chairman this week. Yeah. I'm going to make a motion to deny staffs approval. I mention. And then I do. We have abstract all those in favor that. By roll call vote.
5:33:17A district 2 commissioner more.
5:33:29Yeah. All right. Which way, you know, to not bring about the motion is not a yeah, haha.
5:33:40District 3 commissioner starting. I'm gonna say no, I want to say what is that way, what from ocean.
5:33:46This demand the project I'm not going to agree with that motion because we made a commitment with that 3 million, 3 and a half million dollars that we were and we had a plan and that we were going to stick to it and it's not easy at some of those people out there, my friends. But we made a commitment that we were gonna. Use other people's money to temporarily fix their road. And we've done 7 p Vass is already like this. And to all of a sudden cave in to the pressure on the I don't think is appropriate but we could what I could suggest is that so so it doesn't come back up to it. Us again. Inslee is put this off for another year. Okay. We're we're in a voter. I know. I know we can vote. We can vote on this that we could say, yeah, that they'll know. Don't bring it back. You want to hear this again. Now let them have another year of the loan of the money. and then started. So they wouldn't see any fixed for 3 years. Then anything on tax bill for 3 years. But but I'm voting motion against the motion a long day continues to decline Mister Moore. I I'm I'm with you have a recommendation noted that around. I I look at it and I think wrote about the fallen partly, but when you get where you're voting. But we've got to get that. I'm not I'm not in agreement with work. It's like okay, I got and I may.
5:35:19District 4 commissioner Fitzpatrick can say one thing.
5:35:28wait. She said I was. I was going to come in tonight to move to discontinue the board initiated project for Rangers. But do another board.
5:35:40With other roads and obviously not right now, but it was going to have to get restarted anyway. So I am in agreement. As of now. Luckily I was not here. Okay. I think. did not make any kind of agreement with anyone. So I I don't have to have a higher and they know I'm agreeing with the citizens and I am saying guy.
5:36:09Yea to him. Yeah. Thank you Ian has a mission. The 5 commissioner district, one chairman Oakley.
5:36:24commissioners. I don't think we can ever come in and do what we did. Again. it's politically very difficult to come in. You know, borrow money for a temporary fix. Other people have to come in and pay for the roads. Be fixed in these guys didn't have to. And I don't think that's appropriate. I think if if we ever come in and fix a that has an emergency fail. It has to be we're going to have to vote and that there will be I mean, we we just can't do this and we can't subject ourselves to this because. Peer pressures top. Thank you. As we know from the answer.

5:40:51I met Mister chair. Yes, Sir. You know that the I did. this equipment duckett. The talk about a federal I still have seeing what our lack of return on investment was last time. I know there's earmarks that you know, that the current president is that your marks against those possibilities. A good thing. And you know, I just want to make sure we're going to get the best return on investment for our citizens and I mean, I just love to hear from the rest of the board. We feel that we're going to get the best return on investment in a company because the vote. Less than they're both good organizations that, you know, I get that and I appreciate it. But. Besides setting up meetings which we got another got quote, B*****. The contractor that helps of the beach as well. What do we give us time. You guys feel honestly, feel it's worth us making this hire. Commissioner Martin commissioner. Okay. And I'm sorry I have.
5:42:07While this. I have managed to lose my score sheet. So I have actions. Yeah. So, you know, I chair the federal Florida Association of counties have. Interacted with other counties. Federal lobbyist and heard all the things that they have done for other counties. And I I think that is a great question to ask these and ask Mister Glenn how he and the other gentleman that they would comeuppance and all of us know what a federal lobbyist can do for County and what they've done for other counties. So you can you can hear what that is. Up. I there are there are counties in the state that have multiple federal lobbyists they taught one of subjects that comes to my mind is dredging. federal then you have the FEMA maps. You have the bigger waters you have. We'll why you have. The transportation plan. That's coming. There's all kinds of ways of we learned how to engage better. 5:45:13and our other for more than a lobbyist. It was a permit expedite apartment. Whatever they were correcting permit Yeah, others that may I Mister Glenn to come up and talk about the a federal lobbyist complaint and then we'll ask the same question from the other from gray Robinson. He had to catch a flight. So he's not here. So we normally have to go through this current process first and then we presentation. But that wouldn't be an option to date if they're not both here okay. An oral presentation from both of them. But we have to go through this corn processors is just a process that you have to go through first and then you would recommend or a presentation. I'm sorry. You're not be able to hear what they've done for other counties. But I I can certainly have some commissioners call you and tell you how they use their lobbyist and instruct us on how better. To get some things that we need from Washington. What one of which may have been helping to pay for overpass. No punishment for the over pass that on the commission is OK, Mister Mister chair.

5:47:41I will say this, you know, to do to to invest in the sea. It can't be a one year deal. It takes I think, you know, have Harry. We had him up there he was. He was tremendous. Take us around. Help. It was I think 5 meetings, one trip we had up the communication, the the opportunity right now could be even better than it does now that they're back to coming through as well. We we've got some federal needs. I think if we going to do this I think is this is even more important than the state. As far as a lobbyist But it's going to take time to take that commitment to do it for a few years to get something that can not going to get chances are you may know the air much may get some money here. But you're going to get a good time for a couple years to go through it. So I think it's a very worthwhile doing. We didn't have the substantial success to say, OK, his we got back in those. We didn't get that. But I think the opportunities they're just takes time. You just can't do that when you're expected.
