6:22

Good afternoon. Amy Hyler with long-range the matter that you see before you is PD. 21 dash 0, 2, 2, 5, is the adoption hearing for small-scale comprehensive plan amendment and the name of see past 20, '02, men Flight. I can do. Since this is the adoption Go ahead and read ordinance into record. An ordinance amending the Pasco County comprehensive plan providing for small-scale comprehensive plan amendment to the future land use maps. Matt, 2 dash 15 and she 20 changing from or as 3 residential 3 dwelling units per gross acre to calm commercial on approximately 1.6, 7 acres of real property located on the southwest corner of state Road 54 and Meadow Brook drive providing for repeal or severability an affected date. So the proposal before you as stated is requesting an from or as 3 to calm commercial located at the southwest corner of state Road 54 and Meadow Brook drive. There is an accompanying petition that was heard at the PC that was previewed. That is continued now to April 1st. So you will hear that shortly. The comprehensive plan. That's being We evaluated the policies in our comprehensive plan that allow an amendment to calm and identified these as being so go into detail with respect to those policies. So location for commercial development allows for an amendment to calm in our comprehensive plan. There are 3 criteria that are specific to allow for an amendment to commercial. The proposal must meet all 3 criteria in this case a location for commercial development should prohibit or impact any TC future land use. The only to see future land use. That is in the county is on the East side of the county. So it's not going to retract from that detract from that. Town center town center future land. Use. And then the second one is going to be a cannot proliferate strict commercial. I do have a vision of a visual in here of the zoning where the property is located as along state Road 54 and Meadow Brook drive. It is that the southwest corner of that. It's of the southwest corner of that intersection and proliferating serve commercial where the sites located. There's 2 parcels that are to the West and office parcel as well. As an existing storage facility and

9:20

then a cat one wetlands so it can proliferate outside of that criteria. Minutes adjacent Meadow Brook. So I can't go past the roadway. There's also a Creek that is to the south. So it's not going to proliferate. So from that as well. And then the last criteria is that it needs to be located at an arterial and arterial and collector roadway intersection. And so where this is located is at Meadow Brook drive. The North segment of Meadow Brook drive is classified as a collector road way. And the state Road. 54 is classified as an arterial F dot roadway. So with the definitions F dot that it meets the criteria as being defined as, quote, an interception. The second is neighborhood commercial also meets the criteria for neighborhood commercial, which in essence is the same. But it limits neighborhood commercial to allowing it along an arterial or collector roadway. Instead of it being at an intersection and then transitional land. Use policy flu. One 0.3 speaks to allowing or implementing a proposed amendment. Within the area and ensures that those land use as or accurately or transitional between each other and so the next slide will show you this is our transitional land use table. And as you can see commercial and use a proposed land use is adjacent to an existing residential 3 land use. It's classified as being with as a transitional land use. However, it does need to have sensitive site design with that being said, the property owner. The applicant has agreed to doing a deed restriction to enhancing buffers against the residential uses. And so here's your As you can see, it's in the South market area in urban service area. It is located at the southwest corner of Meadow Brook drive and state Road 54. And this is your existing zoning. As I stated before the existing zoning is agricultural and then the 2 parcels that are to the West are still agriculture as well. You have appeal one which is an office use and then your existing storage abutting a category one wetland, which as you know, cannot be developed him. And visual for the proposed future land use to former as 3. And so just to give you a little rundown of what happened at the local planning agency back on March. 4th. So they found

11:54

that the proposed comprehensive plan amendment is consistent with the policy set forth in the comprehensive plan. They did recommend staff to continue the rezoning petition because they were going to. Develop a deed restriction on that. So that was continued from March 4th to April 1st. And with that, we recommend the board find the comprehensive plan amendment consistent with the comprehensive plan and adopted by roll call them. I'd be happy to answer any questions that you may have. Question.

12:25

12:30

That was provided me with what was by that time documents were not that kind burden aware. Don't let that come what know that the doctor work properly submitted.

35:37

Because I there. But they were partly committed pursuant to procedures that see the

35:50

We received this

35:58

Public hearing that this is but Preston. All the petitions have been submitted to staff electronically prior him yesterday and they were part of the planning his own record. I think we have a little already got their way only to receive it again. Whatever he was. Mister chairman, To be Our You're muted Mister grow is that work with us and coordinate on the legal side. Thank you. Okay.

36:36

Number the commission items with my address is 20 to 40 Biller road water Florida, 3, 3, 7, 6, And I'm hearing my head as you in to talk about before you my colleagues have indicated. And I think the planning and zoning report that we gave you and the issues first brought up about possible environmental of conforming may not be used in this particular area. I think that's the biggest issue, the fact that there's no specific use identify.

37:10

Really cast the whole application of a comp plan amendment on its ear. If you don't know what's going to be there. How can you establish whether it's going to be consistent with your view. I think the statutory requirement that this County make sure that whatever develops takes place consistent with the comp plan, not knowing what will be put there makes it a complete and there's just no way that you can know that. Now I know that Mister Mister Pressman said that these residents are not opposed to any development. They're opposed to the vast majority of the conforming uses that would be allowed there because those who have such negative impact not only on their property values but on their quality of life. And I've spoken to a number of them and candidly what they said. It's a doctor's office or something else that wouldn't be open deep into the evening with noise and smoke and fumes and things of that nature. It's a professional type of the development. There's no problem whatsoever. Nobody wants to deny the property owner of the use and benefit of that particular property. What they want to make sure is that under the guise of this very request. There's not conforming use established there. That would out if you read this today that would cause permanent irreparable harm to their continued residents in that area. looked at a lot of the comp plan issues myself. And I think without that specific designation of what kind of use will be there. I don't know how anyone can actually vote on this will you ensure it stuck in my work. It's traditional seat too. And there's no way to what mitigation would be necessary because you don't know what will be put there. My consideration and something that I had thought of as an I did hear remark before. Was that as part of this proposal, the applicant from my understanding is willing to place a restrictive covenant on the buffering requirements. It seems certainly within the province of what you can request and what the applicant can offer is that if you want to make sure that we don't know about one of these adverse uses to be developed considered a restrictive covenant that will limit it. The many, many options available. Only those options

39:24

that would not have that negative. An adverse impact on these residents. That's certainly something that you can consider. And you can ask for it. I think that if that takes place, give and take about what are we really going to be looking at. That's going to develop, right. That's our neighborhood. Maybe there would be opposition but the way it's the answer is nobody knows what.

39:48

that puts you in an awkward because you know what's going to be. But there's for your comments are times that.

39:57

They have someone else. you know, I don't Mister chairman and yeah, this may be an opportune time. So. MR Rowe is indicated that it would be a. Crapshoot. You wouldn't. You don't know what the uses are remind you. You are any comprehensive plan hearing today. Not a zoning hearing. You never really know what the land uses. You have to you have to see whether that future land use. January is or is not compatible with what surrounds it. So when I interview and do an analysis of what could be there. You know what? All the category of all the uses that could be in the calm category and is its placement in that particular area consistent with the neighborhood before you would vote to to approve war or deny it. But you never know in a comp plan hearing unit, you're never going to know what the use is. unless the applicant disclose it to you and sticks with it. But once you once you put come on the site. Anything that could anything you're come could be there. Mister Mister chair. Mister clarify something Mister them might be planning staff. Tell me about office use.

41:29

staff to say Mister Stites letter. It was office just strictly office that would be categorized

41:40

have a future land use that.

41:46

Yeah, we can do. If you do office use, it would a flu. move. Okay.

41:55

If could be

42:00

say, well, yeah, I was going to say officers loud calm. But if you restrict certain types of commercial just go to office flip about right. And then I also wanted to point out as well. even an amendment to calm. If you do approve that today.

42:14

It's still going to be subject to the uses in the zoning. So right now it's still a C zoning. So even if you approve it to calm, it's still has to be compatible with the zoning district as well.

42:28

Mister chairman, we done with the comments and has borrowed get a present. I'm not sure we're done with them because you want to go back. And I have questions for staff. But I was going to wait till let's white or person. You you know. Okay is someone else at the kiosks to speak.

42:47

Yes, we have a lot of people in the next person up.

42:58

We have it by the far as development of this property would not be opposed to something like it office or something in I didn't know first I was called by the personnel are I believe, a represents. I was told that this was going to be gas stations last hour. Watch OK. We cannot have a gas station car in on I didn't know that the 3 people that are adjacent to this property in 2 of them are here today Never got notice is that any sort about this property anything of that nature. You have 2 people here today that currently but within the last 6 months, which will not purchase if they want in on this could be a gas station on a this side Street for delivery trucks, gas stations. It's hard enough now would. So it becomes a U P S comes the neighborhood try to turn around because the streets are so narrow you imagine thousands of cars as they have already stated that would be coming. And now on this side street, that is the only way that we have to get in and out of our neighborhood. So I'm asking for the commissioners to please the complaint at this time. Thank you. Thank you much.

Hi. My name is plan and I love that 1, 7, 1, got him on road I in her with them. Neighbors and citizens that have expressed their concerns and ask you consider tonight for the reason that are already expressed their 2 points. I'd like to couple people spoke about access and kind of the issues is that when people come into our they know how to get on their way out I don't live on a cul-de-sac, but I would basically on it elbow into a act and we have had issues which large trucks being unable to turn around and we have actually get neighbors and help even a semi truck that literally stuck. They thought that they could get access to wrong. So this is this is a considerable it's if it's an issue of practicality as People come in. They They can't find their way back out of the neighborhoods. The traffic concerns are very real. Their ongoing right now. About amplified tenfold are a 100 the gas station is put in there. You know, that people are not going to be able to make a left and they want to coming into our neighborhood and bringing some of the concerns that neighbors already So I just want to reiterate that son sent me a that just so as being myself, I'm asking you to please consider that is couple citizens and Pasco County residents and preserve one of the few places open spaces that we have left in our that hopefully serves as a tool that you would want to preserve and I would also like to say that we do have the of the newer developments to put in about 4. So the first one is Robert minutes from the last name our C Z y K 1, 7, 2, 7, 0, raintree road. It's Florida. It may concern the current issue to consider high traffic commercial land use at the entrance of. 54 and Meadow states is disturbing. Heavy traffic business would turn the main street of a quiet residential neighborhood into an unsafe thoroughfare. My way, frequently walks or small your key and baby carriage down. Meadow Brook drive. She waves to everyone and gets much needed exercise as she travels one mile down the road to visit her sister. If you allow plan to develop entrance of our community for any business that causes with traffic flow down the primary road of our at our neighborhood. It will in my opinion, cause and regrettable loss of use for our community myself. I am concerned with any business establish that maintains outside normal daytime business hours. I didn't retire to this property to pick up trash in worry about break ins. I live on the corner of raintree and Rainbow one block from the proposed development site. If any commercial businesses causes intrusive use it with unsightly dumpsters, heavenly light lit heavily lighted parking lots and loud noise of any kind after 09:00PM and before 06:00AM and will more than considerably damage. I will be more than can certainly damage and inconvenience. I managed. I imagine that many of our I imagine many in the immediate vicinity of the entrance to Meadow Brook drive will feel the same way. Well, I'm retired and have plenty of time to complain to whomever. I need to hear my concerns. That is not the way I wanted a peaceful retirement wanted My investment in this property, which I just purchased in September 2020 is substantial. I was not aware of any land use change issues being proposed at that time. If I had been made aware, I would not have relocated to this address. I'm more than upset about potential loss of security, loss of sleep and a decrease in my property value. If any interest said land use at the entrance of this residential neighborhood is approved. It's isn't there any way anywhere else to locate such high traffic.

1:11:57

Long is at state Road 54. Has anyone considered the hundreds of vehicles emitting carbon Mount monoxide at the entrance of our residential agriculture neighborhood. Our beautiful wildlife will have to move on. I would sincerely appreciate your consideration of meeting the commercial land use to route 54 at Meadow Brook drive for purposes that are consistent with the current low key residential uses atmosphere. Thank you. Next e-mail is from Michael Killian. 17 5, 0, one C but Florida to whom it may concern. I moved my family to cierra pines area to enjoy the peaceful country neighborhood. This neighborhood allowed me to have the serenity as well as be near the growing array of businesses being developed in this area. Pasco County. I have pets that can roam free in my yard without worry. And I feel very safe. I love my home. I'm concerned about the unconditional land-use proposed 4 parcels at the entrance of our neighborhood because this residential neighborhood is not considered as not structure to accommodate high traffic businesses and other problems that could come from high commercial establishments. I'm surprised to hear that this land was being considered for anything other than gentle business services. Well, the future developers be required to consider a costly negative impact on the residents of this neighborhood. If traffic is published pushed into the matter. Brooks Sierra pines residential community and becomes a cut through to West plate from road. Will we be compensated for the serious change in use of our primary Road in life down. The traffic. Could that could potentially route itself through the neighborhood will be hazardous to the residents and could cause security concerns for many. Well, I don't live at the entrance of Meadow Brook at route. 54 I can certainly appreciate the other negative impacts to those who do. And myself as I battled my way out to go to work if a high traffic type business is established on either corner. Your consideration to limit the land use to businesses that would truly add value to the area and not negatively impact in established residential neighborhood would be greatly appreciated. I don't believe we are lacking convenience stores or gas stations. They

have already been established elsewhere and are plentiful and easy to access regards. Next letter is from Joe and Killian 17 5 O one cedar the lids Florida. Tim, it may concern approximately 2 years ago has been an island city of Tampa to escape the many attributes. It's game to many at rates of the busy city area. We look our new home and to see her live in loots because it allowed us to have a much larger property with peaceful atmosphere. We're now faced with the front. We're now faced with the front door of our neighborhood potentially let up with gas station traffic noise debris, litter and loitering. I'm placing my objection of this intersection. I was in my direction. If this intersection would benefit from a gas station. It might be harder to argue with, however, there is no shortage of gas stations in this area and the entrance to our metrics here. Pines neighborhood is hardly conducive to this type of business. It is a private residential neighborhood, not a high volume rental unit community. Many residents in this community have pets that live outside. I'm extremely concerned about their safety for a few reasons. Traffic noise and potential city to torment or feed or animals is a huge concern. My husband and I both work and use Meadow Brook drive to enter and exit the neighborhood. It's the only option increased traffic caused by any heavy volume business at this enters at intersection would never negatively impact or a daily commute and take away precious time in our schedule. A gas station or any other business that creates high traffic, high noise and personal safety issues should be disallowed the land use at the entrance to our residential neighborhood would be better suited for Mount traffic to professional services. Thank you for your consideration. Next e-mail is from James Collins address is 2, 3, 4, 5, Meadow Brook drive lutz, Florida. This is in reference to the propose comp plan amendment being considered by the BCCI strongly oppose the CPA which would produce increased traffic congestion not to mention increased noise and light pollution like a gas station, for instance, I right next door to the subject parcel the last 20 years and I've seen firsthand the

congestion that builds at the meadow Brook as or intersection. That's the FL. You should not include commercial activities such as gas stations, auto-repair dry cleaners and those commercial activities that would increase noise and light pollution as well as excessive traffic. James Collins. Next e-mail is from Lynn Morrissey addresses. 1, 7, 2, 7, 8 raintree road. This is regards to March 23rd meeting to discuss the comp plan amendment related to the property at the state Road. 54 and Meadow Brook road requests that a Pasco County representative read this letter to the BCC during the meeting. Thank you. My name is Linda Morrissey. I live on raintree road within the Middlebrook estates neighborhood for the past 5 years we've seen tremendous growth in the area in these years, being positive improvements. I'm open to growth in this area. But in a well thought out manner. I believe the amendment to the com plan to change the parcel at the corner 54 in Meadow Brook 2 commercial will have detrimental effect to our neighborhood. I'm opposed to the change to the comp plan to commercial and and some subsequent rezoning to see 2 zoning. I believe any change the comp plan would allow commercial would allow commercial. What. All right. I believe any change to the com plan to allow commercial would have adverse impacts to the traffic pattern in and out of the neighborhood Middlebrook road is the only entrance and exit to the neighborhood with the whining of 54. We have seen a significant increase in traffic and accidents in the area. My fear is that that any high traffic commercial use such as gas stations were completely clogged. The only X entrance exit to our neighborhood. We are an older neighborhood and do not have any space between the subject parcels and our homes like unlike unlike newer neighborhoods in the area. As a result, we will have significant noise and light pollution from the commercial development, gas stations operate 24 hours a day, 7 days a week, 365 days a year. I don't believe planting trees to offset the noise and lights would be sufficient to offset this impact. In addition gets sick states is on well water. And I'm fearful that high traffic retail, especially gas station. We'll put our water

at risk again, I am not against progress but hope the progress can proceed in a well thought out manner. If the committee feels still feels the need to amend the comp plan allowing commercial use. I would hope that the committee would consider only those businesses that conform to the neighborhood appearing. Residential in nature and the minimal traffic implement implications. I professional offices again. Please keep in mind the middle broken states is an older community without the road systems in place to support the high traffic commercial. That's the 2 zoning would bring. We are not indexed the appellant Ray, thank you for your time consideration. Next e-mail is from Charles Hoffman. Addresses 3, 4, 0 riverstone drive lutz, Florida. I trust harsh ha Hoffman of 17. 3, 4, 0, riverstone drivers. Florida has a past County, Florida strongly oppose any such commercial rezoning to the subject parcels for the following reasons. the current intersection is not designed correctly for current use and for the commercial activity will increase our residential risk of entering and exiting our community B in conjunction with the traffic increase we currently have obstruction of you Obstruction of you verified by passing County dot due to highway 54 being elevated above Meadow Brook see the elevation has also made our entrance unusual blocked due to flooding which the county has been aware for years and still feels to tells correcting the port engineering, he dressed model is not adequate and adding more traffic can jeopardize emergency travel. Our neighborhood consensus is that pass County does not take into account of the affects of the surrounding development, although we continue to pare taxes which continue to increase beyond any added value to us. The county. Allows flooding traffic safety. Traffic safety traffic planning quality of community and our overall safety to to be sacrificed. Most of us realize the property will be developed commercially as it is no longer attractive from a residential standpoint. But we the community request that you consider the impact to our established neighborhood in do the right thing and not only make an educated and responsible decision on rezoning. But also move forward with correcting the issues we currently have before adding more burden. This is the case with highway 54 quarter and the infrastructure can not support the development. I strongly oppose any development at Meadow Brook 54 until the road evaluation drainage intersection engineering is fixed adequately. Next letter is from Bill. shock. It is a C h a l C K addresses 1, 7, 3, 5, 0 riverstone drive lutz Florida. I've been a resident in that overcast states subdivision since 1980 object to this amendment to the comprehensive land use plan changes profit from rest 3 to commercial for the following reasons. This land use change would allow heavy commercial uses such as gas stations, car washes, vehicle repair regulators, pawn shops and many other heavy commercial businesses. We now know that the intended use for this person is a gas station and pray pending contract contingent upon this change. This parcel is the very first presidential lot at the entrance to matter. Brooks estates, subdivision. There is no not a long road between state Road 54 in the first House or entrance to the homes like Ballon tree in Baxley where they have a long road between the commercial corner at 54 in the entrance to any homes in this case. drinking water with carcinogens. This could also make their homes worth less. There is a school bus stop just a half block away from this parcel which would make it very dangerous for children, not knowing who may accidentally or intentionally turn into the neighborhood instead of turning left on state Road 54 from the proposed entrance exit on that of a drive traffic concerns. There's already a traffic problem at this intersection with residents of metal breaking states 85 plus or minus homes and Sierra pine subdivisions at the South. Which is 350 plus or minus homes. A school bus is trying to exit. On to state Road. 54 traffic backs up at the light because Meadow Brook drive in a minute states has one lane and one lane out with a very short left turn lane traffic from a commercial business will only make the problem worse with a gas station on the corner It would mean gasoline tankers, trucks, dump trucks delivery trucks and all vehicular traffic exiting directly into the neighborhood, rather than exiting on to state Road. 54 miscellaneous contrary to a statement made by MS Wilhite representative mckinney campus at the planning Commission hearing on 3 1821. There that there was only one gas station on state Road 54 between the Suncoast Parkway in clear Parkway. There are actually 5 gas stations in this area. 2 of which are within a half-mile the inter station at intersection of Meadow Brook drive in the state Road. 54. Well, it may be inevitable that the lots facing state Road 54 in states including this parcel could be changed to some type of commercial status in the future. I hope that any change would not allow any heavy commercial businesses. I asked that the come commissioners, please, but vote not to approve the requests change to the comprehensive his plan at this time. Thank you. And believe this is the last e-mail. One of my kids to grow up in the same neighborhood that I did. This neighborhood is all about family. I'm pleading with the board tonight. The com plan for this property. We cannot have commercial in our neighborhood where kids ride their bikes and play. Never mind the delivery trucks, gas trucks and everything that goes along with gas stations. We are aware that this is what. This is what wants to go into the property. It will be literally destroyed in our neighborhood. It will. It is a small Tulane residential road that cannot handle more than any more traffic. So now the county is saying because we put a light and we can have commercial see to zoning directly within our neighborhood. Please remember, this has a meadow Brook address, not state Road 54. I'm off the land. I do have a question for the transportation You don't mind. I would call this very similar somewhat similar discussion when the McDonald's was wanting to come in on state Road. 54 in front of country place and they were going to share the driveway with the entrance to country place which has happened. How you get in there. You turn left into the entrance to country place turn right into the McDonald's and the residents of country plays. We're very, very concerned that they would all die in car crashes and not be able to get into their house and so we had a very similar experience like this today. And so I drive that area frequently. I've never seen a backup. I don't know of any accidents there in front of country place. And I and I've never seen people make you turns what's I think the residents are really afraid they're going to drive into in to their community. People are concerned it if their on that corner that there's going to be more traffic into the neighborhood. That is there any science that shows that any data that shows that because there's a use out on 54. Their neighborhood becomes. Commercialized as well.

1:36:44

We've got to let the committee at what will more people So in neighborhood. Sure. Okay. we're going. But for extended to 49 was the for 2 were was vote and then P 50 was continued by the planning Commission. Yes. This is my personal opinion that I I would prefer to hear both the same day mean 49 to 50. Nobody them up like this. So enjoy it. And think rightly pointed lot more people have questions of stuff. If I'm not correct Mister Le That's representative of the neighborhood as well as Mister Pressman. And then this will high obviously is is representing applicant. since we have heard 50, it's going to be continued. Any chance you guys and we know we've done this maybe suggestions in the past. Any chance Council on both sides can maybe get together, put their heads together a little bit come up with a compromise between the 2. Bring this back and when you bring it back we'll be hearing 49 to 50 as together get your planning Commission. Just a thought. A suggestion. I don't know both sides are willing to. Have those discussions. Mister chairman I don't.

1:49:58

Normally recommend. In fact, I'm sort of surprised that the planning staff would be bringing the 2 of them together because in in you clearly in zoning, you have to assume that the comp plan amendment is effective. It won't be effective on the same day. only time we normally track 2 together is if it's an you where you can condition. The mpd on it not taking effect until. After that. Plan. Okay, so that normally would be counsel legal Council's recommendation that it that they not be tracked the other. And then maybe they were only tracked up the planning Commission. The other.

1:50:39

That happens sometimes you're right. I thought it was different than past there comes that. but the same time as one during this of the stone is out here. Is there chance that I don't know both sides of Council of both sides have met of willing to. Get together and try to have a compromise sometimes we're not they're not all in the audience today and sometimes the walk out the side and have conversations and come back to us. That would be nice. Yeah. So I don't what it is there's maybe a willingness there. So guess that's the question too. Mister the room. Mister president. It's and in the hallway and this will hike that's on like right now. MR. I'll just wait there. Answer Mister chair.

1:51:28

Some questions because and also for the folks who came and spoke today and I appreciate their passion and.

1:51:33

We we know. We know the growth in the county is sometimes difficult to see and but nonetheless. We have rules that we follow and Florida is a high-growth state where high growth County and state Road. 54 1 of our most important roads in the county. But I do think there are some questions that hour. that. I would want to be but I'm assuming that those things happen. Not at this kind of hearing that. And I'm hearing that would be went P 15. I mean, right. Lighting buffering, all those things. That's not what we're considering today. We're considering if it's appropriate for a piece of land on state Road 54 at a signal lies intersection. Should a different years than what it is today.

1:52:37

That what is in front of us today. That's It is a change in your future land use classification appropriate for this site. Now, I will tell you when you get back here in the because until you Libyan zoning.

1:52:54

None of the stuff that you've just mentioned will be appropriate to be discussed there either because you can't condition have. Yeah.

1:52:59

That makes it tricky because I do think.

1:53:06

That's why there was a discussion about that. They had proposed a deed restriction. Okay. you can't you can't condition.

1:53:15

This is an you get if they're if they're seeking, see do anything that is acceptable and C 2 would be acceptable in the so if we waited today we could get restrictions on buffering. Well, let me ask you this. Does art do our codes are ready to contemplate protections like what the citizens are asking for. For example, lighting. Do we not have a lighting ordinance already that says you cannot. You know. Well, I mean, I know that I because I have worked on it when I was a citizen activists are lighting ordinance for commercial. What wires down lighting. You can not have big lights that interrupt neighborhood or your your view visions as you drive down the road. that correct? Right. So many of

1:54:03

Concerns raised by residents have to do with site planning aspects of the lighting landscape thing. It's Land development code does have ordinances and provisions that address a lot of those things specifically because uses can impact the neighboring properties. In this particular discussion the comprehensive plan in exhibit 2 dash to does have language in there that mandates. Specific site considerations between the transition in the transition between the commercial and used to the 3 land use that So the covers, the plan is already mandating that activity to occur part of the reason why there was a discussion that the planning Commission for deed restrictions. Yeah.

1:54:49

So and I think that's important to me. No one wants to living next door down lights that are intruding into there. Their own private the private space that's why checked and some of these billboards that go up on it. Neighborhood lot where that's what when you look out your living window. That's all you can see and we have that all of the county's happening.

1:55:13

Okay. So emergency vehicles and I I think it's and they raise a point now to tell you we got a letter before.

1:55:20

About needing to work with Hillsborough County to get Sierra pines Boulevard paid. It's not a county Road, not a Pasco County Road. It's a Hillsborough County Road. But if something were to happen at that intersection. Meadow Brook and 54. They would not be able to get out. if that road keep deteriorating as badly as it as it is, it's really bad. So I do think we need to try and have some discussion with Hillsborough about. Fixing that road so that these people have to say ways in and sidewalks. Is it common. One development comes in in a situation like this that that they would put in sidewalks or we would put in sidewalks. I don't know I ask. And by I mean typically when the county is putting in roads right now. We put in sidewalks. I don't know why that was included when dot improve the center section. You're referring to state Road 54 know I'm concerning that there are sidewalks on state Road. 54 I liked there's a trail actually going there. What their what I what I don't see or any sidewalks on the improved part. A matter of fact, it goes down to this. The creek is that when there's a a slew book that goes through there. Yes, plans? You can in many cases require sidewalks to be built as part of the site development that takes place. But.

1:56:57

The question becomes is the sidewalk going anywhere. So for the neighborhood has no sidewalks because the never never had sidewalks would require them to build a sidewalk that would not connect anything.

1:57:09

Well, if there was some attractive use at that corner that attracted to kids in that neighborhood to go there and put them in more harm's way because there would be more cars coming out of their driving on the 54. I would want to be sure that there were some sidewalks are some kids could be. Yeah. The road and we're trying to encourage pedestrian and cycling activity. And if there's more use their I think they need to be. Protected. Let's see what else with their crime. Well, that's I think that's a fear of that. Is not. Reality at as is the traffic issue that we talked about in. I would think what if we could no 3 trucks and I don't know what kind of signs we could have. So the people they can go through. So that they know they can. You can drive to lose. Like There's another accident of their feeling keeps its one way in one. There's not there's not one way and there's 2, but it's you wind through the neighborhood and frankly those neighborhood. They're very wide roads. And there wider than normal. You can you come out of Hillsborough County asking so I'm sure a lot of people are going to work in Hillsborough go out. like from an and get on the Suncoast down. There's a drive down to 4. So I'm just going to the list of things I heard light pollution. I do. I do feel for the House. That's not right on the corner, but it is I think it was 50's. That's how some as it was. The gentleman from true. And so I think that consideration has to be taken I don't know what the site plan would look like on the use that comes in. But I think that. He he needs a little consideration about the Knicks and buffering in front of his house across the street. I mean, like I mean, imagine if they put a dumpster across Street in this guy's eyes House. I think that would be very inappropriate so I think the site plan becomes very important. I've been looking at that map. And actually if you put up Todd's map, but or if you just go to Google Earth and you look at this lot, it does. If they preserve, I don't know whether it would look like when they cleared but has a lot of trees that they could along the buffer would be really good. And we've had that in in other areas where we've done. commercials come in next to residential. And I think that they were have to have a 60

1:59:54

foot landscape buffer between see, too. Residential.

2:00:04

I don't know the answer to My head. I think it's pretty sure thing, too. I 60 feet, but.

2:00:11

I'm thinking that one of those houses there is already commercial because if you look at it, if you zoom in 2 or 3 parcels to the left of that OK, so you see that now there's are there. The storage facility right there that that's what that white thing is right there. Smart. Stop storage. And then you look to the right. I want to look at that So, you know, are these homes are. Fronting state Road 54 and I you know, I'm sure when they first moved there. That wasn't. One lanes there. 2 lanes sleepy road. But can you zoom in more. OK. Yeah. Now goat now look at that. That that's got to be commercial or what. What's going on there in the coat over there. So that was going on. See where it says to cool designs. I looked at clothing store. Website. But the House to the right that looks like. The not over. I don't know what's going on that. that's not presidential. All right. There. Yeah.

2:01:19

Facing 54. So that's is peel won its own peel one office and then that's a budding. the storage unit. What about stuffed in the back yard. That is actually the resident right next to the office. And so that's residential. That's that's presidential. Correct. That's that's a home.

2:01:39

So there's 3 lots between the corner site and the storage unit to cool designs is currently zoned office. Then you have your to residential the site to the right of one with all the stuff in the yard. That's actually the same owner has to cool designs. They on the same piece that was previously listed. For sale. But it's no longer it's taken off the market.

2:02:04

Okay. So but you see it on time. But with the trees and that's the heavily cannot be peace and it's buffered on the South by the stream. Its buffer to the east. My concern is this house over here to the right. Yeah.

2:02:28

And then just make sure so that stream platted is measured to 45 feet for the plan. I was so the stream to the south is actually plotted as 45 feet in width.

2:02:42

I was 9. Yeah, yeah. It's not about jump across it. Yeah. money went in played that out 4 years ago. plant itself has dedicated a 45 foot. The mansion. To accommodate the original that even though the strange not very, you know, governors 45 feet. So.

2:03:06

So I'm inclined to have some kind of deed restrictions from my this, the commercial zoning district. Require 75 foot buffer from light on jul. Yeah. So 75 foot buffer I Which is substantial.

2:03:22

have metrics. You have questions start because I know you.

2:03:25

I know you had mentions McDonald's at that location now not I other locations writing on down and get 54 that was on the East. But on the west of 50 people. morning North where they were 54 looking North McDonald's and then you have country place office building. Now, is the actual.

2:03:54

Yeah. But they share that they share the entrance. Yes, they should. The entrance, but it's. What my concern is. It is with their showing you here.

2:04:06

And what we have here is there's a home directly across the street. There's a home, a home in a home on all side of the property. So when this person gets up right here on the corner of hope for in Middleburg, how they're going to look directly at people that I can. You put that back They're going to look directly at. we know if this is a gas station Katie college universe. We're not allowed to OK. So.

2:04:38

That's why I think that plan is important is no other I from what I of what other community has a home and then commercial.

2:04:47

It was in their plaque.

2:04:51

Well, I took I just did I thing around the county on my Google Earth and we have commercial in front residential neighborhoods. All over place in from all over little road. Yet all over.

2:05:05

It's it's. This is state Road. 54 at that.

2:05:15

Usually it's all of the front in detail. This new front is residential and now you're going to put me clean next the residential. well. Are you saying that should be a house on 54. No one is going to build a house right at this point. But you the street from it. Well, though, 1001.4 Fort policy does have that stipulation of it needs to go gradually. Mister Moore, thank you. Mister chairman.

2:05:51

Question for their staff, Mister Stites murder. Weise still before that. We're going through today is a mini that cop to move this to calm. go over, get what's allowed and calm. You know, for comment question, though. He took time and uses Permits. The commercial gain. So the commercial land use according to the comprehensive plan.

2:06:30

The Germans of potential uses are commercial. Uses office uses hotels, motels compatible. Like manufacturing process soon and some of goods know uses which have a primary purpose of distribution of goods. So be permitted in commercial. Residential uses are only permitted. One constructed in combination with commercial uses within a single building of 2 more stories. Remember for you says a commercial office and other non residential uses FOX News did not count as nonresidential uses in this context.

2:06:59

So to continue on. Go ahead and explain commission those. Watching at home, you're in the audience. What P 51 mean is. Moving from a change zoning Irwin. To see too. Explain why. We go through P 49 today and come back and actually do zoning change.

2:07:34

In order to affect the zoning change to see to the future land use. Must be in place so that the zoning is aligned and implementing the vision of the comprehensive plan. So in the case of C 2 C 2 can go in future land, use categories such as com today as well as our occasionally other. Future land use cuts occasions such as usually they come in PD. But. Are in the PD. Flu and the TC flu and other such with.

2:08:18

So today, if we allow. people that we approve the amendment. In change from rest. 3 Com. If we go to p** 50, what limitations of any can be put on. This parcel when it comes to. I won just pick a few things out say restaurants. Filling stations. Office. Multifamily. Yeah. Right. What limitations could the board put on when this when people comes back to us. No. To it.

2:09:14

Beside. And that's why you have voluntary deed restrictions. In some cases is because in fact this is a Euclid Ian's eat a district that comes back before you whatever is a permitted use under 5.25 correct. Is. Maybe it's 5.26 I C one pulled up here. Yeah. 26 by 26. I scrolled little too high. Anything that is that is in as a permitted use wood be allowed for that applicant to go straight to the planning department with there's a plan and then get permitted. Those that are conditional uses in that category currently multifamily would have to come back before you write.

2:10:07

So without P, without hearing P 50. Could anything happen. Fifty-fifty was denied. They can still move forward or can they not move forward so that the the problem you will have it is if you Grant.

2:10:23

change the future land use classification to come.

2:10:30

And then they come back for rezoning to move out of a air. One is really not a consistent future land use with Haitian to calm. And so it would have to be. It would have to be another you. Another zoning district that is permissible for for them to pick and. It may just be the covered this trait commercial categories it you may be able to do it office ending in the to it. So I become use that use it. You set the trend by approving the small-scale amendment by on the other hand, I'm not mean it does it right on 54 so rent rez 3 may not be appropriate either. It's right yeah. That's the balancing act that the board has to do right.

2:11:29

I think, you to get off subject here. But we saw the matter. But what we obviously rewriting the land development. I think some things need to be you would probably agree. Cleaned versus having to go through this process twice. Essentially my opinion. You still have to go through it. Tight twice regardless of how much cleanup they do. You've still got to make us what we have make a change to their classifications.

2:11:52

takes it off. Mister

2:11:58

so I know I do. I do have you get a question, Oh, sorry, I meant commissioner. Let me just finish that I'm sorry. appreciate it. So this you know, I do have just like the residents in both commissioner stark commissioner Fitzpatrick did mention this, you know, when I first heard about this in the U you seek 54, you think 54, right. Okay. 54 easy enough. But do have concerns for the House. Obviously directly across the street and the one that essentially will you know about this. It's. Right next to it. I I just I'm trying to figure out this buffer. I don't know how you're going get the buffer. So the 5 foot buffer on to the home to the West.

2:12:50

Well, that's all going to up. to buffer actually is. Star. The property line across the road or would it be.

2:13:01

On the I don't know what you see the home the what's going there on the West the driveway. Yeah.

2:13:05

Is behind start at their property.

2:13:10

Does the bumper start out of the property. Buyers are typically along the periphery so begins at the property lines and the conference of plan already mandates. Attention to the buffer nerd transition from commercial. To the from the calm to the rest of the an exhibit 2 dash 2.

2:13:33

What was Mary. I was that after I'm just trying to get in the line. I'm getting You they mean commissioner Mary on it was.

2:13:41

after me. Yeah. I want to forget about him.

2:13:49

Thank you, Mister like to say I did meet with the applicant on site. I think when everyone else which 54 think commercial all the way through. I thought it wasn't a Sony when I met with them as well. I do know is going to land use change. And generally speaking, I think we need we a lot of stuff on zoning in the comp plan. But there's one item here that I can't get past Mister president is also with to use part up and I thought that's a good Presenting mean. They had been no conference presentation. But just a little bit, it's lame duck and I'm not. But here's what I can't get past policy. 1.6 before section B end, too. And the neighborhood commercial and I could have been spat. Forget you touched on this and I think she's on the money with it. It said new neighborhood commercial uses shall not. He located internally within existing simply single-family neighborhoods. This is clearly an internal. That's the second partial would try to change. It's right across from the game that gentleman from true. There's a reason you can't buffer because its internal going to be limited there anyway. But I haven't anyone get past that argument. This public instep see what they thought of it because I think it's I think I think you just I think it just kills of they don't African comic con one 0.6. What school the to appreciate it. Thank you. MR chairman, I around for that question. The.

2:15:26

The proposed amendment is predicated policy flu. 6001.2, which identifies the location of commercial development noting there that com so be limited to areas adjacent to existing collector to roadway intersections in order to maintain would wake up at road capacity not to the president for further strip development. 1, 6, 4, is in detail in neighborhood commercial uses. In this particular future land. Use policy. It's talking about the commercial uses specifically until you get to point B with those. Talk about the application of of calm. To permit small-scale neighborhood commercial uses. That's occurring in situations where you're not that. The intersections arterial collectors. So the the policy flu the that we're focusing on. Here. It is on 1, 6, 2, which the primary policy used to appropriately locate com the comprehensive plan on the future land use map.

2:16:39

So I understand what you're focused on. But I think you focus in the midst and I think Mister president especially brought up the pictures showing the gas station would be right next to the right next to the guy who's across the street. A true you can if you all this to comment, I want focus on section number 2, that says new neighborhood commercial uses shall not be located internally within the existing single family. They How do you get past that statement.

2:17:05

So the comprehensive plan in some of the policies and some of the definitions that identifies what constitutes internal within existing single family neighborhoods for instance, in the case of office. That has to be between 2 residential uses not on the periphery of residential uses and having or other physical infrastructure that separates you from. Single family from directly abutting single family and single family in either side consideration. When we're talking about whether the EU says internal to a neighborhood or not in this particular and this guy speaks also to the comer, the proliferation of strip commercial the commercial infill sort of illustrates what I'm talking about here. infill site does not set a precedent for further strip commercial development because either the site is surrounded by existing build commercial development. And this is the part or the geographic features including physical infrastructure such as roads. addition to the site preclude an extension. So the idea is that these. This physical infrastructure, the roads, the geographic features other uses and limit the the land use. And therefore it's not. Interior or internal to. neighborhood.

2:18:44

I there was a suggestion about. People getting together. And working things out. And in my mind, one of the things that could be worked out. Protection of the gentlemen. Okay. We don't know. We don't know what's going to come here it's been suggested that might be a gas station. We don't know. And I'm not sure how much we can take that into consideration when we do this. the partial that is to the south. There's 2 parcels right. There's one on the front and then there's one to this adjacent to it. Depending on what they put their could be fined for that house across the street the devil is in the details of of making sure that gentleman is protected and they can either they can. Be very sensitive and I don't know how we require that. But that would be my goal is to require them to be super sensitive on the site plan. And potentially maybe they provide him a buffer, which would be an opaque fence and landscaping. And so he because a gated home which might be very nice when you're that. Offense home in the front, right. What you may like being so close to 54 and having everyone coming out right there. Maybe. If they if people talk that could be part of the package. Is that that guy gets protected in that way. That would and thrown hand out that that these big that time.

2:20:33

A mission get it. I will let me do this we're going do what I do want to commend both both the applicant in Mister Pressman him the residents accepted one lacy was a little feisty, everybody else when it came to the residents perspective and we appreciate their knowledgeable on the issues. I think if miss well high Mister Leroux. Mister president. You probably see your you probably. I can't really tell which way this board's going this. But right now I would probably. Take our suggestion commissioner Starkey. Just I think you agree with that too, to maybe see if you guys can meet both Council. See if you can come to a reasonable agreement in bring this back to us. If you can't you can't. It is what it is. But I think allowing us to give you one more shot to put your heads together and see if you come up to a conclusion commissioner started to make a good point. second ago. Yes, we've heard what could possibly be there. But this board is not allowed to take that consideration. We're really not supposed to know what's going to be there so with not actually knowing what supposed to be there. You know, that's we know it's going to be com. Well, we don't know. Was a product is yes. Yeah. Use. can't take into consideration. But the. The problem is no. There's no commitment to what's right. What's there? What you can to take into consideration is.

2:21:59

The uses that the fact that you're having all of these discussions about a particular use that is allowable him. Is that something you can considering whether or is appropriate for this they're right at the camera. not calm and it can't be The party can't take away.

2:22:21

The property right to the person who com. A lot of a lot with can become but office and the A's you know.

2:22:30

there's a lot of things that could be very there's there's many things that can be appropriate there. It just depends on what it looks like the power of the site Yeah. That will have you guys want to have that conversation. As well. High.

2:22:42

MR. President still around.

2:22:49

Mid term you know we have conversation. You and up. Happy to help cover it. I have eye on. Can you put those pictures

2:23:04

Well, this or we can artifact.

2:23:11

I just want to say if I can get the 2 parties to me and maybe make something work and bringing back I think there's 2 very professional sides of that. Are there and I think there's a went out there, but it's not that that's not an easy one, but they're willing to be done. I think it's been a great opportunity to of And I have I have all these pictures. I want to show you.

2:23:32

Here's one. Just go through quickly. As a gas station with houses next to it. Here. What where was this this is along Lee. This is that daycare right across the mouth and some just don't you see twos. and within Keep going. This year's one here don't know what that is. But there's houses right there all around it. 4 sides. 3 sides keep going. The way of looking.

2:24:02

I don't see where it is Walgreens across from this house right here and next to this house right behind it. So. We have here. We have boat and RV storage right across the street from all these houses right here. Another one. There's our department health right there. Is that it is not picture. I does real quick see that going around the county. There's a lot of examples where residential is up to I'm a band of mixed use and putting things.

2:24:41

Near where people don't have to go down the highway to go get stuff and where you can walk to it. so depending on what goes here, you know, could be could be beneficial for the thing. Mister president is that the microphone is Only see the boxes. You know what happened to it.

2:24:59

Yes, Needles here she spoke with Mister As we understand, told her like she's right here to confirm this. And she told me we can use with the station convenience store. The seat to use one to today. see, a to industry uses of is not appropriate for this site. In these

2:25:43

You are are you willing when you have your More? That's But

2:26:05

we're going to discuss that. We need to know what the use is going to blame.

2:26:12

That's the cool. That's the Mister president. That's the conversation we're suggesting you have. Council. We remember what Mister what Mister start going on. Mister said I'm trying to help you guys here across the Mister senator just said we're not supposed to know that it can't come into play with our decision-making. We cannot use that that cannot be part of the testimony. That's the fact. So. And it's up you behalf of your clients to have that conversation and see if you can find out from Council and work through this and then come back to us.

2:26:45

And and I want to say I'm not so hung up on the use as I am the site plan. The buffering that has that lighting the traffic flow for me it's I'm OK, I'm actually.

2:27:02

mean, I'm okay, but don't want my And over time here we are concerned about the residential area. But I want I want it to win it. I mean, are these the Fed within the context of that neighborhood.

2:27:16

think we can put the cart before the horse. How you make the site plan for president will be right now because of not in the probe is going to have to move are you willing to meet with miss will watch as well. And have this conversation. We can continue. This will come to a decision. Now I can tell you where which with board's going move will lead to me. But you put in applicant of what he uses. They can have the cake and eat it too, trying to assess to to come to serve reasonable conclusion. Are you guys willing to meet or would you like us to move forward with our decision today. Or the other. I can't tell you which with this board's going because I'm looking at same basic their head yes or no.

2:27:53

take your shot. Or where that will governor. Mister president are.

2:28:10

Thank Mister press. I strongly recommend take the opportunity to meet with that a likely vote We don't know what's going to go yet. If you look at all concerns. We don't know what's going to happen between you guys. We can't get into that. I run into them and you take advantage of continue we can have another another meeting of the day.

2:28:30

You get when I hear commissioner and with that think given choice but to do even talk. But I'm going to say again, as you're putting the onus on the applicant for offering a site plan mean, you know, some for use.

2:28:43

I disagree with that would come back to us. just give us the opportunity. Okay. And then 10.

2:28:54

it is a move to Should be think to an unknown date or. believe 30 day.

2:29:05

This is a ornament right now. Continue that matter if I may.

2:29:12

The item P 50 University rezoning. That is continue to April 20. continuance table, 20 our past it.

2:29:27

2:29:37

That to happen either on April 20th. What you're saying. Yeah. We have

2:29:46

said, we can have say meeting. I mean, I've never I've never seen anything like this.

2:29:52

What I said was I can't have you take action on pastry zoning plan. That's the for the comp plan becomes effective. And it's plan is going to be heard.

2:30:06

So motion to continue the thing that we have an app to continue continue into the following month. HeHe 50's goin to be continues, right. 2:32:14

because we have continued this week and this is kind of for our County that end the folks outside public comment has been taken on this. Do we do public comment again. Here on the in this particular one, I think you're going to have to do public comment again because you've asked them to go talk about things, then bring it back to you. So you got to you got a public comment.

2:32:41

To hear what the sides agreed to. And if if you're going to. Hear that, it's got to be a They go forget they can limit the amount of testimony to you. But I think you've got it. 2:38:02

what I'm looking at the road. I don't know.

2:38:05

And it's it's agriculture. And there's no density around there. We're going to put. So what this can end up being like a little teeny mobile home park with the Lane and under what what's the plan here?

2:38:26

I believe the staff is online and to. Be able to answer that question. The message that I'm getting is that it's going to be a total of 2 units located on that property.

2:38:39

Come to you. And why are they going to fight. Is that your next category goes one by. That. Didn't really mean. Is there any rules in that area on 12 acres. Well, district. Okay. Orchard pleasure on consent items.

Well, that's a reluctant I. District 4 commissioner Fitzpatrick. Right. I. District 5 commissioner Mariano. District, one chairman of I motion passed 0,

2:39:45

54.

2:39:50

Item. P 54 was published in the Tampa Bay times on March 10th 2021.

2:39:58

Mister of you may recall this is this is the one that the motion to to not approve. It was failed. And then it was continued. You are at the deliberation the of the project.

2:40:17

Given

2:40:17

the fact that the public hearing is cloe was closed. Just want make sure that none of you have had contact with either the applicant or the public on this matter. Since you since the so if the public hearing was closed.

2:40:35

Anyone

2:40:39

They're one of big announced That's reason Yes.

2:40:45

There was e-mail that was submitted into the record, let her into the. Or when Max portal last night.

2:40:56

That e-mail in my opinion should not be considered. It shouldn't be read into the record the year that.

2:41:01

record is closed and what this board wishes that real been and re advertise the project every yeah. Re advertise a new public hearing. We don't have my under my understanding is that the board was going to further deliberate on. 54 and make a decision today yes, Yes, Sir. think so. Since that. Last meeting. I come up with additional evidence. backs up what really did additional evidence that backs up my motion. But the same being cordial to the applicant here. You know, since we didn't open up. This were a public hearing. Probably they probably should have the time and the ability to respond to it in this test. I'm having a meeting with theft up this Thursday have to do something very important. That's happening right in front of this project when it comes to a close, a median which can be detrimental to. The area unless it's changed. I'm meeting with that on Thursday to see if I can get them to put some things off. But I can't really want to get into it right now into details unless we open this public area. And I think we public hearing up so make a motion to continue to re open the public hearing to allow the public and the applicant to speak. If

2:42:36

It needs to be re advertise but says it's on today's agenda. You hurry. You're considered will continue it. continue it to.

2:42:46

To the April 20th meeting. I think that's plenty of time. I don't as it needed to be continue forever. I just I want to have this meeting, this Thursday as well. I really don't want to get into the details until I had a meeting with up going to be with me to a meeting with the people from up at the location.

2:43:02

I don't know how much time We I mean, I meet Thursday in. I'm finally here early. So it's sort of it's sort of on the other side of the the project location. I didn't know what you Yeah. Over the next against whatever the next April 7 to 0 when this is your date city meeting. Yeah. That's everybody. we have a motion and second, the continued to one, 3130. But look, want to say something. So.

2:43:41

Do you need to say what you're going to You can advertise in time. And I think we can. If April 7 in 10 that that's fun. April in big city right. Yeah. that. Yeah. Thank you.

2:43:56

Roll call that.

2:43:57

Who is the second. yeah. Mariana, thank you very much. District. 2 commissioner more not district. commissioner Starkey. District. 4 commissioner Fitzpatrick. I district 5 commissioner Mariana. District, one chairman of I motion passed Thank you. When you come April 7. And one 30.

2:44:24

Next item is very fine find. 6 past due.

2:44:34

He 55 was published in the Tampa Bay times on March 3rd, 2021.

2:44:39

Good afternoon. Commissioners is a call the public this 21 dash 0, 0, 2, 0, Rusty. The PBS. Number 3, 4, 3, 9, this is a micro service project and this board an issue to can I. If you. Went to their 7 roads in this their condiment pave there's a 123 120.7 6, your use the estimated project calls. And as I said before, this is Michael service in is a 167,000 approximately on the 60,000. Michael mccaul spurt. You're you. $1390. This going to the mound is 11,500, $10 and the maximum cost per year. You after this Cone 1292. For them. I I'm A The repayment is what, 10 year period at 3.2 5% interest. This is a location map here is a couple photographs of what the road is like. And I thing.

2:46:16

I was going to ask to a motion to continue today an a. Are you that you are that.

2:46:27

And it maybe help helpful to the commissioner to end to the rest of the board there has been some discussion on this project about discontinuing the micro surfacing and going the full depth reclamation yes, and I was open commissioner didn't mention So I believe that's why the commissioner. And to continue the item because you she doesn't want to move forward with. The micro has a decision it's up to the board, but it has a decision been made. Which the appropriate method of proceeding is has makers are facing really been abandoned because of it. Temporary nature or is that decision is still up in the air with the neighbors. There was some discussion in terms of repayment period in terms of the effectiveness of, you know, down the micro surface and.

2:47:25

My on the side is that you were thinking of this continue in the micro surface and project and initiated if the our project, if that is the case, we left the River ties, but it's. For you to and you don't have those there'd be no, no, right. Okay. And if I could.

2:47:47

And 2, I think there is some discussion about drainage concerns. I think 2 months the the citizens. So I think that would need to be considered. second the motion.

2:47:58

Mister steins that or do I need to abstain. I own a home in their one of a 120 homes. Well. Not

2:48:11

To continue the item. I don't think you need my general advice has been you don't need to don't need stay to abandon the project or 2. To approve project. I think you will have to abstain on either of those residents.

2:48:26

Or I will have a

2:48:33

continue to of the unknown. Council. bring it back as record. The vast right.

2:48:41

So we're this continue in this market surface and and the board has done us to move if they correct as a So rather ties calculate announced that meeting, OK.

2:48:54

It if that is the commissioners motion. That is not a continuance. If that's really if that's really what the commissioner wants to do is abandon makers are for the Mike are surfacing and go to fold that the reclamation. And start this clock all over again. That's and that's an affirmative action today.

2:49:21

And Bill, you wanted have another public hearing and then discuss with the residence.

2:49:29

Public meeting hearing actually this neighborhood meeting, a neighborhood meeting is that met with some unable make

2:49:37

So I would think. And then once today and I would just continue This item 4. So April 20th agenda. Assuming or.

2:49:48

Or the agenda. whichever you you think to get to a neighborhood meeting. So that the board can be. No. What did you know what the options are for it. mean, that.

2:50:04

You're going to need direction. And so I'm We continue into a date uncertain. You still have to put it back on the agenda. So it would make make more sense to either continue this to the.

2:50:17

April 20th or

2:50:24

may view May 18th board meeting to

2:50:30

So, you know, if you're continuing here, you're keeping the same type of roadway. Right. Right. Right. if if if we want to change what we do, then the board would have to direct us at the next meeting to do that. And then we would have to bring back a brand new project and understand what I thought we were going to OK as Miami So that's that's will do so.

2:50:55

Then I would make the I would do for 20 meeting. Because the city get done this year. We can bring back project.

2:51:03

I want to thank a motion to continue until April 20 and I did. Thank you. Motion seconded by roll call vote. I can pull up So is there. I just want to make sure that there's nobody on line for this project.

2:51:20

Yeah. Number here to this project on item. P 55 there's no one on webex and I do not have any males.

2:51:24

They're anybody at him and he

2:51:30

There's no doubt that Okay.

2:51:33

guess you can vote on the continued Commission.

2:51:37

This is a board projects. There are 6 roads include in this pvs project. 2 of them were not actually chips. You buy like Spain in a why they were included in the there. Is lots. if you want use. One of things I'd like to note is trash or Lane and tracked sorry, Planters treasure court. It's the section that goes. So and forms like an L those were not ship sealed. in looking at the condition of the road and also a picture in a minute on condition of the road is a road that them the patch them in their patch. The part of patch. It was recommended that this be included in the project. If we did not include these 2 roads in the project because P best methodology and on policy guidelines, they would be included in this system and that 25%, but they would not have those roads paved. So we're proposing that these 2 would be included. Although the directive you know, the rules that were to seal. This plan to slain. So you see the con this of road and ice. There it is again, also on trash or Planters treasure court plan to slain the U.S. will. The pavement less than half an inch. And the comments questions.

2:55:43

Commissioner Mariano but lately.

2:55:49

I wouldn't say Commission I've actually been out there. I've driven the roads. I've met with. Citizens. And I also spoken to staff already. I was going to ask for continuance with this one as well until April 20th because they have mention 2 other roads that may need to be included into the P bass and then if we were possibly looking at alternatives if 2 of the roads that were not tips. Yield, not be included. But again, we wanted to meet with the public.

2:56:18

That was motion right. I can tell you when April 20th. Roll call vote. We're going to take any of the commitment to continue right.

Adonis is not being done. And I know a lot of residents were not in having this project It's not going to the flooding. You. And we can first place. You know, reaped paving takes a look. Braves. It work from a foot 2 feet. But that up. I'm being assessed twice on 2 different lots of upside. But. This project that I don't wrote that are being paid, but I'm being assessed points or the Mister chairman.

3:00:07

Is that in your comment, Sir. Yeah. Thank you for your comments. Well, there SP.

3:00:17

Did he give his name and address. back.

3:00:26

And give it to you spring own the property over at 8750 right. It's world. Okay. Thank Thank you. Yes, Sir.

3:00:35

What else are speak to this matter.

3:00:39

There's no hope of the key ask. All right. Thank you.

3:00:47

Yes, just you know, we sit back. We'll hear from them. Don't just want more nation.

3:00:54

Yes, this is the storm damage board initiated. These are the rules that were cheap steel that these 2 roads or chip seal them. We were directed to bring back its board initiate and now project that we only did the ones that were chip seal the other road crews are mention large drive is on super going to go do the paving we have to go through with the who's who from an exemption process versus with the previous project of the to it because it was already paved yeah, right. We can map miss thank you, Mister chairman.

3:01:33

I typically go along most the time, you know, with obviously the commissioner of the district because they're the ones that are meeting with the residents in doing that to the community meetings and things like that stuff. I'm still not a big fan of board initiated. That's why you never see me in 7 years. Bring one from my district here. I don't you seen me bring my district. Those are now have that I never brought board make sure I was right have all road. know I know. But I don't, but I want to go through others road. If you go for a lot of if you go understand. there is or not. I'm typically more of a fan of letting the residents voting. It's over 50% door. 50% is not. It's not. That's just me, though. You know, but I let me you know, this is not a debate love is given my statement. My feeling but I typically go along with that. What the district commissioner. That's because they know the area better than I do to him. So, you know, I didn't if the district commissioners feel it's this is these move you play along. Okay. I still I'm just not a fan of or initiated this is understand what you're talking about. But the fact of it is we have roads really need to be.

3:02:48

Paved. They keep down like you're talking about.

3:02:55

The fact of it is I keep complaining and that's about repairing the roads are fixing roads and there are that keeps being voted down in the process and there's no other way unless you get and I and I don't I don't disagree that those issues. I think that's just the way. If you know you did work.

3:03:12

Communicating going on here. This is the option. If you don't take the option, it's not going to be done, right. But don't come back to me and asked her to be done 30 minutes, 30. You know that help the road. I get what you're saying to OK. I'm Thank you. Because not of you are here.

3:03:28

Except kuz Mariano was when the hurricane hit. need you to remember need remember this for cranes need to remember this for this one. This is different in Senate. What happened just so you all know the story is that we got federal money that we could do anything. We wanted to in the county within a certain. Department. We show these roads were really, really shape, OK. They were full of potholes step back, step back a little bit more history, though. OK, well, let these were all the communities that came forward and said to us.

3:04:09

We can't get mail service. We can't because their roads had been flood damage. Right. And we try to get help from FEMA.

3:04:23

For these you know, with bj's, somebody or some kind of because these roads were drivable after the They were drivable because they were in such bad shape and FEMA took a look our Google or and we are not bigs in those roads because they were so bad that we're not you know, that was your responsibility. That was it because of the storm. They were so bad that, you know, I don't know what that was I'm speaking your language, but I mean, the roads were so bad people went to help us. But we I don't have million dollars. We got what we could have done. Storm, flooding and do other things. But this board made a decision because these people could not even drive They couldn't have the they could have the males. They could have the garbage trucks. They went through the county and they pick. They said these are roads that are so bad. This is an emergency urgency. Chip seal. That's temporary. But we're going to spend the other residents money in this County on these roads with the get and we all agree we would do that. And they would be bored initiated. He passes on when the time came. I'm shocked that lasted this long. I that.

3:05:49

Chip seal. How long does that not the bit to go about 4 years so we're about the and why they're one big storm from having those roads explode again. And I know that commissioner who I the road, especially for the Lakewood village. That's coming up. And I'm not kidding. You that those looked like a bowl of oatmeal You and so this is not this this isn't out of it. I don't think this is this is something we all agree that we were going to do and there really shouldn't be any discussion of here because we took money that could have gone the other things and these people have had this benefit for 4 years and that was the deal. And now the that it's time to, you know, do what we needed to do way back before the storm ever hit. So I got to say it's not it's not. When you're going to where we that most or to 1516 Charlie abc's maybe it was like to say, oh, we can't find the pictures Yeah, point we can find the pictures because the governor came and we took him to some of those roads ahead the road that Cindy wherever that is I tried to find in my when we went on say that I don't have the picture anymore. And I clout. But that is why ship field. We didn't. We gain cranes How much did you But

3:07:37

We're almost to reach the Brook similar to what Yes. So we we took our federal money and that's what we used it on is a band-aid for these were it was the federal

3:07:49

It was we that that was not in we got from the BP lobbied settlement.

3:07:56

I it and had no, I don't the stuff that we got from the litigation that join, you know, and had no strings when it came back to it. Unlike the money. The Duke a strict so so we used money that could go somewhere else to put these band-aids on with the agreement that they would be bored initiated when the time came and I were in really bad shape and that's why they blew up so that people think they're driving on a good road. But their one big storm driving on a I think Mister Fitzpatrick. But you Thank you. Were there just a minute. Go ahead, Mister forever commissioner Thank and you know.

3:08:49

put made a great decision doing something for those roads. Something had to be We could have full day month and we decided not to go the other way with the money, Alec is it's the way fit the budget could have gone the other way. I think, you know, it's been so long and I think better decisions are made when you involve the people to what's going on. I just think Rangers the discussion that came up with everything didn't get ships feel on craigslist. A couple got different type of payment now going to get pulled out. That discussion point. Had we not had that. We want to make that decision with this project with just even one person. Coming up, Mister Frank. They like talking about he's affected on a couple of roads that aren't getting paid. The project. Part of the project. Maybe we need project and with the brand new kid commissioner for the she's already ever. A few public meetings. Not I think it benefits her in her citizens as well as all of to let her go. Have some public meetings out that to find out do we want to do just the road trip shield or do we do these other together have a discussion ready for the people to let them see even if you go through all that process in the book, one still decides they want to do it. The board has the power after the public hearing process to make it board initiated and just pull the trigger right away. But I think serves the people better. If we do have that, doesn't all the way. I don't know what conversations happened at the meeting. I'm guessing they conversations at the meeting. I take a different view than commissioner more. And probably I'm more with commissioner Oakley on these roads. Frankly, I think its staff is bringing us a road that some really bad shape. It's because the road is in really bad shape and the taxpayers of Pasco County are paying for it to repeatedly fix until the next rain storm comes and pop those potholes out. I had to fight really hard for 2 years and to raise the $0.5 gas tax so that we can get the money to fix the potholes because back then it was taking 60 days to fit Palm. I personally you know. I don't want to keep throwing money out the window on a pothole. I trust the staff that if they're bringing us a road that's in bad enough

3:11:09

shape. I would know. I do vote. I think they should bring us so many roads year. And that's just all right. You live on that road. There's a responsibility. To fix the road. I don't want to keep paying for your road because you don't want to pay for it. And that's what happens when they don't fix the roads we all pay for it. So far as I'm concerned, if you fail P vast, we don't picture potholes anymore. You know, take it on yourself to get some cement go out there. Whatever. So your own goals that's right. He motion in second. You have a motion. I I made a motion to to pay 57 to do. Keep 57. An emotional wrote covid. District 2 commissioner District, 3 commissioner Starkey. I commissioner Fitzpatrick. I district 5 commissioner Mariano. District. One chairman Oakley. Motion fails 3, 2,

3:12:15

A move on the next 58.

3:12:23

So what happens with that that when men the road father art because I don't want to go in there and fix it. And think taking the suggestion Mariano made that close look at this. 2 roads. A German spoke about bringing back. That's an unpaved road and that would be it can really reverse N to make a continuance that would be That's

3:12:46

We have to been anybody who is on the prevailing side of that motion to reconsider it if they wish to every continued rather

3:12:56

would you be more likely to reconsider its staff to go back and make sure all the roads that need to be included or We're not included if they were not chip seal because we only have position on that.

3:13:10

I'm going to refer back to commissioner Mariano because you made you made pretty good statement we refer to the to the roads. Jim was talking about it.

3:13:17

I have problem that a craze now you know that is on his own this and Mister Fitzpatrick are comfortable. If you want go have a public airing of these people and get a bad decision which way to go. And then.

3:13:34

However we take it to a vote tonight. A dual believes get with the people and find out what they want to do and then you can put the numbers together. That means the roads. I'm happy to go that way. It might be just as quick to start afresh it could this so that you want to do all do

3:13:52

pay $0.50, little bag and then know you need to ask the commissioner if make an has asked you to a question. If if that's. You're answering yes, then we'll commissioner me. Mariana reconsider, the previous motion. Commissioner. I would. You reconsider previous motion if I go back in because I know it. The other ones I have so would you reconsider yes, I I will reconsider move move to reconsider.

3:14:23

Okay. After discussion a roll call vote. They're not 100 is We now been question under So we all know what was on.

3:14:33

Thanks. Leight war world is an unpaved road.

3:14:35

That's correct. And so is upon us.

3:14:40

And Adonis. So when you unpaved road to be paid. Who pays for that.

3:14:49

The property owner is joining benefited property on that. so my understanding that we're asking for the folks to pay to take an unpaved road to become Pape. Is that what we're going to be doing. Can clarify? Can you from with this. Talk about expensive.

3:15:11

So the 2 are zoned to white lines are down this in the and they're on paved because of the PBS methodology and policy guidelines. The folks who are on and Adonis, although there on they have to they must use. Camille Broad Street. So they are into in this assessment. So what would happen if we go ahead and war alone Adonis. That would be the much longer process because you have to go through for the exemption. Also, we after whether or not we would after FDR bringing you knew, you know, Virgin material. So. The 2 mix in 2 different processes. Yes, the reconstruction is different. Versus the, you know, unpaved road. It was a much higher cost. But just something to consider you combine in 2 different processes.

3:16:12

So then what we would be looking at over here on the right where you the gentleman who was getting acess to He would be getting assessed at 25% plus a 100% of world. Right. And not know if you combine everything. What happened is that the costs go up.

3:16:30

So he would be 100% because if we do pay of war. He would be 100%. But the cost for you are you will be much higher. And also that would be spread on the folks on calm you and there you would also go up. Well, that's what you all think is a good idea.

3:16:48

And I think that's what going go back. Understand what your neighborhood but what you're voting on is reconsidering the denial of the project entirely.

3:16:58

me go back and have a public meeting. Look at those guys. Good. I have spoken to cranes and I think out there. also has been out to areas And that was supposed to be a micro chip seal. And that was. From the minute met But they want do and after the hour now. Right. So because the microchip last 3 to 4 years. They'd still be paying microchips when they would have to do the that she is. They don't want do the microchip now they come every 5 years and do that. I just do that. You're ones and not have to pay for my yeah, well, that's what's going to happen.

3:17:40

So sure you have a motion second to reconsider okay. Will reconsider when they can. And second group reconsidering this project. Roll call vote.

3:17:51

District. 2 commissioner district, 3 commissioner Starkey. I district 4 commissioner Fitzpatrick. District, 5 commissioner district, one chairman Oakley. I.

3:18:05

So it's 5 in motion passed to reconsider. Now.

3:18:09

and moved to continue so I can have a public meeting, second.

3:18:14

he knew what they. We're going be. And the fact that we have a long April may have may continue Right. April going. You might want Mister chairman.

3:18:36

I bet same time. This could look up Mister Fitzpatrick here for a second. Have a couple of these already continued. You this is suggestion for your own wellbeing but might want to spread these out a little bit. You're going to be very busy for about might not have opposition of this one. Can we motion thahave

3:18:54

It's a odod move. Secon Yeah. anank you.

I know there should be somewhere and often photos of the one neighbor time on the road clue did. leave my it has that he wanted this Every yellow late Karen drive, OK.

3:19:59

You're right. was supposed to be right. there. Yeah. It Okay.

3:20:23

These are the ones on share and our people. If the agents from going I it was commissioned play times of every 2420 21. Yeah, those are the ones

3:20:42

they go in the other greens race. These were the Sharon drive. This road. that was on yellow Lake. Yeah, that's though that's when we get we think those are tips yield. No, there are not.

3:20:59

We haven't gotten that. vast requests for those roads.

3:21:04

Yeah. I'm not I've not OK. So kranczer is comes in off a little. But they also enter cranes roost on the back.

3:21:12

On these Okay. But the directive was that it's true that were chip seal and because of the content can to guess nature off Planters. That's why Planters was included. So the Planters and number chips.

3:21:27

Right. All right. not me moving forward with Granger is today, OK.

3:21:31

So if we did not include that the paving off Planters. What would happen is that the calls per year. You would go up by over $400 for the folks along cranes roofs. So the folks on Planters would be paid approximately $1800 for not having their but having to use a paved road. The in and the folks who have the pave road there. You would have gone up by $400. That's why they were included. And this is following the methodologies and guidelines.

3:22:05

For the program. Us program but meant for me, OK. You're welcome.

3:22:10

Things that we're going to talk about one of at the next meeting.

This is a board initiated project but it's not the storm damage board initiated project this was brought up November 1720 20, the repayment is here. It is 10 years and the interest rate 2.2 5%. And this is the location map. And it's Brown Beach called the section. From calm to angry North that is being proposed to repaved. This is form of the condition of the road to go back and. Fall apart. Is there anyone think there is.

3:24:03

We we have 2 people on weather next. Been little wave came from this year from them.

3:24:08

All right. The first a person I have on what banks is Vicki King state. Your name and address for the record. Thank you.

3:24:19

Keeping 1 one to one that drives Florida. 3, 3, 5, 5, 8, You may proceed. Okay to residents vote against this proposal. Still what wants repair alone or It's very functional road. It might not be a static. put the thing the it's not reality. What documentation you have the road is a during storms and it very viable by cars that go the 90 to residents that go through here. Any paving that the road will only increase the and Safety hazards for those in every part it. Thank you.

3:25:09

It she said there was someone else. I have is that all your comments. Thank you. Yes, that's my comment, right. Thank you. my my interest is, but we voted against this years ago. So someone goes to the county commissioner and she comes out one Kai decides that it's OK to a when it doesn't bother anybody here.

3:25:36

Thank you very calm. Next for us.

3:25:43

We Larry motto I don't know if he's still on the drop. Looks like he dropped off.

3:25:50

So those are the only 2 that I had on webex for item P 58 and I do not have any email for P 15.

3:25:59

this road was brought to our attention, white men and women. So when the Kiev. There's not that he asked Thank you. OK, mom.

3:26:14

How many times this one come up for a fee. Bass of this game up once and fill in 2019 to 22 yes votes and no votes. So.

3:26:26

This 2 years ago, 3 years ago. Some one of the maybe in 4 years ago, someone brought this to the attention of the county that it needed to be paid because it takes a while to go through the process. Since that time and continued to deteriorate. And so I don't. I appreciate that people want the county to keep coming in and repair in your road. But it's it's just not a fair use. The money and so when your road is in such bad shape as we saw and that picture and can you put that picture back up. I think it's time to go ahead and fix it and.

3:27:10

I wish we had a different process because who wants to spend, you know, no one wants to spend money fixing the road. They want someone else to fix it. But that's not how we do it here.

3:27:18

From my presentation there. But that road is. Is is. And really bad shape. And so. I'm just not it. I'm looking at it tonight and I've driven on it and it's falling apart. And I are staff wouldn't be going through all the time to to go out there in aceh said and bring it to us. If they didn't think it was needed to be fixed. So.

3:27:49

There in front the beginning of the road who is so I don't think must be having a conversation back and forth. So this is my district and I think it's. I it wasn't that far off that between the yeses and the nos. I've been contacted by people who've asking for help to get this road fixed. And I lots of times we ask Lee who's reading and who We haven't done that here to see who are the yes is a new and who are the nose many times. Not to the hope it's that it's an absent. What do we say it's a landlord who doesn't want to pay for the road and the poor residents have to drive on it. I would I am in favor of fixing this road. It's a main road in this community and I would make the motion to approve the be Mister chairman discussion.

3:28:56

That was a good statement that commissioners stark. You made reference to who vote yes or no. Are you able to show us since it did fail. Where then did the nose come from one large property owner. Was individual.

3:29:13

Homeowners was in owners but I have to pull the to show which parts or do we have that in. And I ask that because we have we have seen. And you're right. We have seen some failed before because it may have been one large parcel owner that had understand your use socket.

3:29:31

I mean, at the same go back to my last statement is if we're going to have these votes. Allow the residents to vote and when they fail, we still bring aboard. To me. It kind defeats the purpose of allowing the people to vote. I'm is being honest. You know, it's kind of like you know, hey, we asked you to vote on something. It doesn't matter. Well, it should matter if they are voting. So in this instance, since it was brought up. How do we not have those documents now that could. I don't have them here. Things are OK, so not getting you, but might be good to break those because you have in the past. Ford, some of questions asked. We can find out because now I'm inclined of deadly vote no. that's records are available. Yes, Sir. So my.

3:30:21

I don't know this for a fact. But my guess is that Lee with asked that question before you initiated this project may have been made But I don't have today. I mean that that because the board voted to initiate project. And I had to get you hear. Yes, event. again, I cannot get on your anything to say it would probably just good to have that that questions asked.

3:30:46

so I'll be you know, because I would like to know that question is one of the questions I'd love to ask Mister to somebody doesn't want that road fixes. Are you willing to not have the county pay for it anymore because I'm not clear why we should keep it. Put money down a hole if you don't want your road. To be better. Then I think you I just think we should go in there and more expensive effort.

3:31:13

the question of it lost by 3 votes. I would like to know how many households voted for no no more than not a it's a good friend to us. The 33 0 know.

3:31:30

27 sort 22 to 2 no votes. The 3, 0, Sort U.S. troops to 3, 0, No votes. I'm sorry. And 2222 yeses.

3:31:43

If you have.

3:31:50

a single person that says yes, but then you have a married couple and they both say no.

3:31:55

Then do they go about how, you know, it goes into The property.

3:32:00

Since Mister chairman. you don't mind says were discussions. And I brought this up before. Now, the county, this current board in this started years back for any of us were here, right. I mean, any probably anybody in this room. But moving forward. You know, I think it's really, really important when it comes to playing master planned communities developments to make sure that does communities have away. They're going to pay for those. Can the community roads going for whether be a cdd or H away. And I say that because. I know you know, for a fact there's a couple newer mask of a play communities actually in my district. With the county. Still maintains the roads in the new developments. It makes absolutely 0. 0, 0 sense whatsoever that we actually allow this to happen now. There should be a way. Built Will there be a CD or H a way to pay for these roads going forward. There has to be very good because all we're going to do is going on in the same situation 30 years down the road. So nothing to do with you guys. You know. But when it comes to planning and what we accept. It's important that we see this because I just I mean, it's comical is kind of comical to me that I I've seen. I'm getting already calls from it. A few developments that are 2 or 3 years old. And my office in saying their potholes in the roads in the county maintain roads. Those roads never been County man have their private community. They're built wrong. Yeah. Or they're built wrong by developer the same you know it we should not be taking. Maintenance of any roads going forward with in residential. Master play communities. Mister chairman that's you know, don't what you

3:34:02

When should I So she right now in the land development process. And there are 3 ways that you can can plant a residential subdivision. You either can. Dedicate the roads in the public. That's right. If you have a cdd, we have now gotten to the point of saying that can't the. When I got here we're dedicating the roads to the county right. Right. And so we have moved to move to that or you're going to private roads, in which case the a would maintain them, right. Eye.

3:34:36

The.

3:34:41

that was in the 80's probably 90's.

3:34:46

Where.

3:34:47

County roads are maintained by homeowners associations. I can't recommend you do that. You either have the choice of them being private first or If you don't want to have them.

3:35:01

You don't look at some right. What I just pile on a little bit. use an example where I live. They're all seating maintain. You know, we can to put in a lot of people are no limits in cds. But even the connector. Which we all know what road that is, which gives public access from 54. Bruce B downs. Also 54 to 56 Street.

3:35:28

Pat public access as but the county does in the paper that the the deal was made that the cbd would maintain that the residents maintain the road that road which is going to of are actually in the sidewalks. 100% within that so, mean, listen coming to those in the county when they made that deal with with that community to have that actually maintain that road that the public has use but getting going back.

3:35:55

should never except anything going forward where the county is going to accept maintenance of a new master as we about that one person that we call all go wasn't there. But is there now to speak on the same I made and then I want to things up kind of like there's a bit.

3:36:12

It's not Mister Larry motto. If you could please state your name and address for the record.

3:36:23

Starting here out. We can't yes. Okay. It's Larry. 2, 0, 4, to 0 loss print port Richey, Florida, 3, 3, 5, 5, 8,

3:36:34

A lot of people with of wants the road actually I'll just, you the meeting see what my backyard actually what we. Water drains into. Well, that's something else will address. But I really like the idea put on road and they're like get beat up pretty I the I just think it's it's not on the roads very do see a road that you got. Estimated neighborhoods that saw words.

3:37:06

Okay. read that you took the time to comment I've heard from the residents in there that. That they're very frustrated that they can't get the road. Thanks. And it's costing them money with their cars. you know, it definitely affects the property value. When you wrote books like heck so. I don't I can't remember where we are on this one. But. I wanted to this this leads to a bigger discussion that we once had a discussion about different ways to pay to pay for the road. Paving and it seems to me that we need to do a workshop on the different opportunities. We have to figure out what is the best way to fix our roads because I I don't think there's many counties to do it the way we do. And I think this is a very painful way that we do it and really do. And I I think we do much better for everybody mean I'm facing a P vast on their state. lived there. My mother lives there. But. I voted for it when when it came through. failed there's some million-dollar homes and they're in. So I but I have heard both you guys that there are better ways to do it. We just have to have the political will to go ahead and make that change and I think the county will be better off for it if we modernize the procedure.

3:38:37

And thank you. Mister is a good question. Player on it says in the agenda item this 97 loss of 36.7, 70 or use, but it up into the voting was 20 to 30. How how do you put those numbers together.

3:38:53

Why there are few your use. Not going to you 0.7 or use. But you've got you've got a total of 52 how to get 52 votes 36.7, 7 areas. It doesn't make so you're 2 different things. First of all. The votes are based on the balance of power returned to us. So if you're in a 45 day period of the 97 that should have returned to us 52 came back and this what comes back to us. This You know, as up for a second. And with them just trying to carve out.

3:39:36

You've got some of these homes and in recess at a one year. You yes, some of them are going to find some are 0.5 and there's number. So I so. With that said, you know, coming a warm is the same at the point for a vote.

3:39:50

Yes, that's what the ordinance has to do. Because if we're talking the vote, but because it's not to guess it's not the media here. It's being paid. It is reduced by 25%. If it's on pay us or if not build out, there's no dwelling. There's also further reduction. So there's there's a reason why you have a reduction in the number of jaar use. With that. But they're 2 different questions here. kitchen.

3:40:19

But if helpful. Can I think that that helps with understanding how you get to the Baltic said Put the map up again.

3:40:35

So everybody who on the main drive coming one in the other's back in there are at 0, right put 5 pretty much.

3:40:48

All all the ones that are in that whether from I'm not going cause but all all the one is our that our system, the 100% I do not use the word one year. You because remember, the assessment is based on the size of the property and the zoning. So I can blanket see that because the ink. It's what you are. You? But says that a 100% property may have 2 or, you know, the 3, your use for larger properties. The ones in blue are at 50%. And the ones in green are 25%. This is why you out that odd 36 1, 7, 7, use. So if I if I knew.

3:41:37

That the people being assessed in 100% of use that road every single day and the others may be a pretty good roads are either not been affected. And that that that my way my vote just just as well as I knew of people are renting or not. But I think that's where the disparity comes in here. So. Unless it gets of the resident commissioner

3:41:58

Well, you heard it. It's these it's beating up his car. I do. I got. I got contacted by numerous people to please help them.

3:42:10

Well, it was here that pink you can save a silver I don't remember where we are. We have motion that's on the table. the motion I a motion There's a motion and there are means a second. Her. I got a second.

3:42:29

By rogue all but.

3:42:35

District 2 commissioner more on this and make them with that information come back like we talked about so the vast majority is at 25%. District. 3 commissioner starting by district. 4 commissioner Patrick, I district 5 commissioner Marianna. District, one chairman of Lee. I motion passed P 15 AnM P 15. I was published Tampa Bay times on February 17th 2021.

3:43:07

PW 21 0, 1, 5, Liquid villas few best. Number 3, 3, 5, 4, This is also a 2015, 16 stardom is roads, which is 10 for the repaired in 2017. But should see you. 3:44:11

And this is ship's steel and it appears appears this is a temporary fix. So sometimes folks look at and say, oh, this is in good condition. But this is what you see look like.

3:44:24

That. We have that chip seal. Yes, it is time to come up with were much literally Yes. Yeah.

3:44:30

Okay. I'm I'm I'm done. Is weather week the Senate.

3:44:34

It's meant to people on with OK to just the first person Sally Anne Here. Can you hear me? Yes, ma'am. State your name just for the record, thank you, and

3:45:06

And 7314 called the dry it called a drug to call the drug and 70 to 51 called the drive new port 3, 4, 6, 5, 3, May proceed. Yes, I obviously speaking to oppose the of Lakewood. Bill Rhodes. I was completely object to it. I I know you've been talking about that chipping and repaving was done. Our was done in 2000, 17 certainly wasn't my I wrote was in good condition before they put it down and those rocks actually made it very uncomfortable for everybody on the road there was a guy who lived down the end of the street or at a motorcycle. The rocks shaking your head Councilwoman, but you don't live on my Street. I'm I have been asked to speak and I'm speaking like showed if you don't believe me, that's fine. But you have to keep shaking head. It's disrespectful. And.

3:46:16

And now also I think you're been disrespected anyway. talking about things are being very vindictive well, a team doing this. I am then we're not going to help you.

3:46:23

You know, we are really trying here. It's a road This big to the road This is covid economy and people are putting their health insurance and you want them to take $3,700 for for a repaving. There's no need to repay these roads. They have been asking to put new so allies were all on septic systems here and they have been asking to put. So we're lives in this area for some time. We know that's going to happen sometime in the near future. So we were just being really we would be digging up these roads that their repaving now. So I'm asking you to deny the project to maybe put it down the road several years. Once they put once they put the sewer lines and the other thing the letter that I have in front of it says the late one bill up paving assessment project. It's a resurfacing project resurfacing project. The predominant condition of the streets within this project or pour the Department of Public works engineering evaluated the road related storm or drainage as part of this project is not recommended as any improvement. That's the only reason we should have anything Reagan is because there is unlike some of the other people that were saying they didn't have any flooding in the area. There are a few areas in the repaving project that does have flooding conditions. I completely agree with that. If they were be engineering that area than there would be a reason to repay. We have not the source. I couldn't yet the not going to re engineer and the areas that flooding. So to me, it makes no sense to resurface right now. Not at all. It's just a bad time to do it. I mean, with the covid economy. There are a lot of people can't even pay their health insurance and you want to pay 1000

3:48:25

$3,700 to get things It's just a bad time for your constituents and you just don't think they have any compassion for what might be going on here. The roads are not that bad, that they need, you know, to your unless they're being re enter.

3:48:40

Your time's up. Thank you.

3:48:48

person next. Sen and Alexander.

3:48:51

Mister chairman. This. a quick ago. My just this reminder. You know, we when we talk to the board says, you know, make sure that, you know, there statements are made on the subject matter. And, you know, not against Commissioner doesn't mean we all all agree all the Never anything either. But the same time we got we need that mutual respect

3:49:13

Out to work closely. As get paid with the water. If they're still

3:49:22

His own you please state your name and address for the record.

3:49:36

was I was under the of their

3:49:46

Miss Alexander, please state your name and address for the record.

3:49:55

And you hear me now we can. Yes. OK, my name cull and Alexander 6627 Parkside got a new port Richey. 3, 4, 6, 5, 3, I also oppose this project. I don't believe that the roads are in that bad of I also say that until we get I can't see any point in this. We're all in septic. We need vote. And and and you are. But if you pay now and you're going to have to tear it up to put in which we need. But that's what makes no to me. It came back and got the cart before the horse. I get that. have to OK, thank you for your comments. Yes, man. In.

3:50:49

Mister chairman question or not this week. We just people even regard to e-mails. I did not have an e-mail to read on the record in 4 okay. And mentioning is that there are people at the kiosk. Okay.

3:51:03

Governor. The key arts.

3:51:14

I this shooting marks and I'm it's everyone's experience either. Bill right 7 to it from you know what I Well done. did 6 months ago to the it.

3:51:30

One Why is or might not working out there. we need to s her over again. But why is it going in and now they

3:51:38

we keep getting noise from the board room of the dice.

3:51:46

Okay. Can you started again, Thank mark. I'm at 7, 1, 6, one Cedar point dry also 72 to cedar point dry just sold a home on wrecks 6 months ago due to the flooding that exist on that road right by the drawing.

3:52:04

The water goes up to the garage door of that hole. And we're going to last.

3:52:10

5 years has been happening even after they did repairs that happen. The water since in that Street for about 4, 5, days because those drain the water is going to get the lake. The Lakers is already full doesn't take any more It's posted during into a little 3 foot crack down on the other side is a but it can drain into that with lots of stuff. before I add a few more comments. We have a we the residents of this area. Do the project at this time because there's some serious actions that need to be take. It. The Reds are not really bad condition. Thanks to the chip and see a project that you all that we've been there for 11 years. At seen results with roads except for the flooding. But I do have a question because this voting press my concern at this point. For all projects is that you may be hearing from all the residents because later with the voting process. We didn't get asked to return anything in the mail. For like with those not of the residents. I walked the entire area of the last month to residents looking at the the roads and all of these these 10 streets, 7 which ports and very low

3:53:41

are for this project that I talked a lot of them are a about it.

3:53:47

But anyway. The voting process for Lakewood does not exist. It was also a very difficult to get connected to today's hearing. I was told by commissioner staff and by County staff. There's no 50% rule that that's that's something that's really all it doesn't matter if you get a petition, it probably be wasting your by County, commissioner or staff. So my concern is you may not be hearing from all the residents and lastly, because the hearings during the day workday. People can't connect and there's a good majority of elderly people who do not have the tech technical skills. And it's just that to get connected. Having said all that, I think there's some very important decision factors that you should consider. Did you

3:54:39

is.

3:54:39

tax man has all your time. Thank you for your comments.

3:54:51

This

3:54:51

on 6827 new water to of that. There years for put was flooding in there just about ready to go in my and neighbors across the street it made it in houses off. They they have done a lot of work up there. Look at that condos in across the street. So it's higher than it comes in on front It is in their houses. So if you've been debating in your wasted are ready. Your time and the reason is water going to take care of. They're going destroy the black to. So you into you do something about improving Lakewood bill has this large your question or doubt you're tempted.

3:55:42

Yes. Thank you. Thank Thank you. As now, we've got more.

3:55:53

And getting ordinance. 7, 3, 0, and we're dry and like what I do want to say that I definitely others to speak of directly about subdivision. A lot of yes, that was a couple areas. Good flooding issues. But it's certainly not this whole area at all. Most of the roads are fine. In fact, that ship and still went through. And I set in an email with pictures for you guys. That not in your seat, but you also through. Yellow double yellow lines ever flecked ers. We've got people coming through all the time for Main Street from Roland. We are a short cut for all kinds traffic. They're small subdivision with 25 foot wide and make this a race track or that having that happen. We've got people driving 4050, miles down the So it's not just traffic at all. In fact, I was just mentioned today that 7 have car go down a road that's not local traffic. So the main roads that are contention for. Senator Snowe. and one and those are the 3 that people use to cut through not only from the main streets but also from this is also made that that essential. All of these other subdivisions. You can see that the attachments, if it was sent and it was that enough time. Those are also the traffic patterns. It is all about those 3 boats now, again, what a couple of areas. Yes, there is during drainage issues that need to be addressed if they're not with no point in putting down the road. Overall. They're in good shape. I would love to have sewers. That's something I think would get agreement on of people be willing to pay for. But in general this system, the Pasco County is is a crazy system it is not stay at all. Is about traffic circles and lights and speed bumps.

3:57:56

The county ordinance that report.

3:57:58

The state. Only makes this an alternate payment option. The assessments that you do like none of the other place. Look at the way other counties are doing it because everybody all the and all those will fail. Everybody needs to be chipping towards the roads even if it's a special assessment like storm water on the annual property tax If everybody's. But at the then over time, all the roads get taken care of.

3:58:31

Thank you. Okay. Thank you, Frank. want. There's no outs of the chaos. All right. Thank There's no way that I can speak percent.

3:58:48

first of all. Appreciate that. They think their roads look great because they're driving on that buried in chip seal right now. And like I we can take roads because they were in good condition to add more money to spend more money on. We picked him because they were and drivable. My brother just bought a house on cyber snow. And I texted him and he said please, please fix the road. But I do have a question for you concerning. You know, they're talking about that. They're on septic. And I'm I going to sewer I do think in this situation when I was at Tampa Bay water city of new port Richey did a presentation. And I believe that this neighborhood is part of something called a warrant with. Is that correct.

3:59:42

So I'm trying to confirm yet given up County utility service area. Yeah.

3:59:49

my understanding is they about to take this neighborhood on to the new port Richey water system. I don't know what that means as far as digging up the roads. If that is true. I make sense that we don't want to dig up the road. So I don't know if that's where the pipes are going. I don't what the story is. So.

4:00:11

So in forgive me, but I think in the past we have coordinated PBS projects even though they've been approved to to. I think, you know, like we're we hadn't proven he bass and we actually delayed the physical work by a year or 2 to allow utilities actually to do just that. Upgrade upgrade the water lines. So it's not an all or nothing kind of thing. But we can certainly coordinating with orangewood. That's going are part of this the

4:00:39

We road related range road related, not the Basin. The entire Basin drainage.

4:00:47

It's not like you're celeb plan. We're talking about. It's just what impacts the road. So we're talking about ditches things like that. OK.

4:00:58

I I am little nervous for the people to wait it. That mean that they have to cross their fingers that we don't get a big storm and it. Demolishes their chip seal this during the storm season. But I think. I think we need to see what the city new port Richey has planned.

4:01:16

For that area this year. But from what I was going to say is I have a home in there since 2004. And it was on lbw and then after 10 years, the city of new port Richey had taken it over. And that's how they had accumulated. I haven't heard anything about city of new port Richey transferring it over to. During or sewer system, anything like that. It's on its own. Self-sufficient community. Yeah, I think that's about to change their buying orangewood. But that's been the city of new have that for over probably 5 years now. I don't 7 years.

4:02:00

I don't know if in the purchase of orange, what that means. They're putting new pipe son or they're just taking over that system. But I feel like we should continue this to. We have that answer. I also know ever do flood 9 o.

4:02:17

Yeah, I think we've got a few good reasons why we need to continue could be another great opportunity for commissioner Fitzpatrick to get to know residents I know him quite well. Out but but I think, you know, with with sure coming into that possibility than others going Tara Rosenblum lot. Definitely one on the on the other side of the road on mass We've got Magnolia Valley. in the midst of designing a project Michael ballack, an update as to where we are right now. As far as that design, what percentage were

4:02:51

Yeah, I think we're getting ready to enter their priority one and are we at 30%. You know, we're we're that review stage with the water management District.

4:03:01

with that, too, might be that they may be in. I don't know. Like those systems to connect at all. Would we would like fixing that really help them at all or does wonderful a different way.

4:03:14

I'm not familiar enough with the base of answer that have to get back with you on that one. I'm pretty sure that water goes up. North.

4:03:22

I feel no. Then that's even more reason to kind of get tickets to make sure we're going to get distorted. And before we fix the roads that don't later them

4:03:29

You say that, Jack, but of the roads. Well, I think the commissioner can tell you what the roads look like since you've lived in there. Well, I was going to say even if we.

4:03:40

Motion to approve, then.

4:03:45

Like Mister karbala had stated they will make sure it is timed after they complete the lot of medication phases because we're going to have another one of these coming up in another month or so for the East side of Lakewood villas, which is Richie lakes. And a lot of them want also goes all the way from Massachusetts all the way north to my other Street. you say you want to go ahead approve this now but have them wait to the project until they do a lot mitigation project together.

4:04:19

One of the water mitigation project you're referring to with the utilities because. The flooding tide project is it is a difference is a different animal altogether. I mean, these road projects when we come in, we dressed as a as we stated road related drainage and that is simply the water that is generated as runoff from the road itself. Property flooding in those are much larger holistic issues. That really are independent of paving a road. So that's just.

4:04:55

The water that they're talking about on Ronald drive actually when it goes around the curve. It runs all the way up into the people's houses and you can't drive down right because of the flooding is so severe in that neighborhood. So I.

4:05:13

If that's related from the road runoff. Then done as public works goes through their rig rates. Tritsch ditches. They'll they'll do some engineering analysis of the existing culverts and where that water goes, that that type of that type of drainage is under arrest. But if we're talking base unrelated flooding because it is a just naturally low lying area those are more comprehensive public works type projects that we do in conjunction with the water management District. Those are focused on property.

4:05:39

I think it's more along the lines of the water dry runs down certain streets into that one little House or those few houses right there on around the curve.

4:05:50

Yeah, that should be part of road related range is what it sounds like to me. Thank you. So that I would do a motion to approve the project because that would fix that problem. That would fix running. Okay. second that.

4:06:01

This is the than it was a different has yet Mister chairman. So.

4:06:10

Deal with the motion maker for to do. We do have a conflict of interest on this project his eye on the House on the opposite side of Cypress, not in this project but on the air pride, if you is Richie.

4:06:28

Thanks. Which like not part of this project. Not part of this is not part of the project is being is as you do not have a conflict. The second or however, just said her brother lives in. Yeah. just bought a home. He is he in the is moving the area as we speak. She to my brothers from me. And so he's relatively uniform so it's a special gain or loss to you around a relative. Okay. No, I My brother says play. You what is the motion OK. I may come up. I would motion to appear hand. having staff recommendation to approve it to approve this project. Yes.

At says as long as that at the same time as they fix the water. According Mister. know, and we want to get Mister chairman. There was no vote on this president. This is a border. would initiate a county boarded that was a stomach was about of there was never a P bass boat know not to sit did or didn't it. It's another storm drainage.

4:07:47

Repair project through the board said will come in and roads. But come back in a few years and P bass you to do right yes, that's it's that's 3 of these today. We're like that. We have a couple more coming up you approved a couple of last several months think. total, yes. Yeah. The board spent the money is Commission starting sent the money that could go in other places. The county to repair these roads with the condition that the board would come back and do a special assessment to repair correctly.

4:08:17

Mister chairman Jeff around yesterday. I mean, being that this is borne in one of the big issues was we fixed usual because of flooding. We haven't fixed the flaw done. I'm not convinced we're going fix the front of a just war going for improvement. I'm not going to be supporting was going go this way right I they should. Go out there and it's the bolts tied the scores, but all system and it is just too early.

4:08:44

They've only chip seal that correct. They've never did any water mitigation or want water store management. So when they go back and do the actual roads. You guys are going to address the flooding issues doing the flames are not going to these people's houses Road in a and storm water issues drainage. So and you will make the roads so that if they they have water on them. They'll still be able to drive to their house with.

4:09:10

The weather there. House rules and water don't will get quick, quick as possible. So that's in terms of road related drainage. But Mike said, it's the base and drainage. That's not what was being addressed. This is most stormwater project right road that you're going to get the roads. I mean, where it's wet. You're probably do have full depth cremation parts of this. I know this. This one minimum repave.

4:09:33

No, pay Mister chair from depends on what for are going to have issues flooding. Are we not.

4:09:50

So commissioner again, we have flooding all across the county want about of this specific project was. stick with this specific project.

4:10:01

It's all the water floods down into Ronald drive. Where floods these people's houses. So you're going to redirect that water.

4:10:08

Good afternoon. So, you 3 years ago we never did that drainage. fixing roads since that time we've implemented this program that we are fixing rules. We take a look at the drainage system. Or on the road. The Florida, the road and we address those improving and its wheels. a ditch replacing pipes. And this is a program that we've been doing is very different from the big storm Cup to projects where we fix issues beason based, you know, if we take the same approach them be. I'm not going to fix in the road impassable because if we are waiting to fix the Bee got drainage Basin issues. Then then no road is going to be fixed. I think the current approach is the right approach to take. We are going the road. Really that drainage on the road in a row that we fix. We've been doing that for the past 3 years.

4:11:15

Just in chairman right amount.

4:11:20

Branford what I'm hearing you say you're affecting the road related range. That means water doesn't set next. The road to destroy the base, right. Exact okay. So you're the water out of there. There may still be large blood. That's what you can't fix right. We can fix that. But in general, the normal as water. Well said. Next to the base will get the water out of that. And that's really what damages the base is

4:11:44

it's very effective and it works. Yeah. Mister

4:11:49

Thank you. Mister regular credit the brand for will do. For if you what I believe what they do is they buy the whole project they get in front of the citizens. They say, look, a little bit of picture drones, but his ability with the drainage is a as we go. Then a and bear Creek. There's been a lot of time out there spent a lot of time fix the drainage to first to get the water off the road. we're not doing that with this board initiated. I really think mission of this back to go think about to start this all over again. And that's when we start from start to finish. Get the public involved, let them know what we're doing. So we get full support to support better education. Yes, Commission every rule that we fix since we've been doing this for the past 4 years. We look at the drainage issues.

4:12:32

We have just to speak either for about 3 years that we didn't

4:12:41

engineers for the well stormwater Cup to prided engine so we do. We are going to look at these and fix in a drainage issues relating to those.

4:12:55

A question on when this would appear on people's tax because I think that was a valid question. But I think you'll see that it's not for number of years. this budget does approve this year.

4:13:09

And repave this fiscal year. More likely to show up on 2023. But this November. But 2023, I would like to withdraw my motion to approve and move a motion to continue here. Do it. You haven't time that you want to continue it too. Are we in May.

4:13:34

We have a road. People 20. One of the It was on the same want what day.

4:13:56

I district 5 commissioner Marianna. Mister Cohen, chairman motion passed 0. have the book chairs for miles south the border question on The storm damage.

4:14:26

Roads that we fix with chip seal that we paid money for. If the board does not want to force an assessment. What you want to consider the money that we put on those roads several years ago that and some cost that will never go back and get or do we need to go back and assess them for that cost. If we don't go back in past. Great.

4:14:53

I don't not interaction have with boy aboard agenda items past. But right now might part of it needs to go into what the commissioner is going to have meetings with her constituents that is a question will come I think this is so that is debate right now. I don't know why people some people are getting roads and others aren't personally. I think it's irresponsible that we said we're going to do something.

4:15:17

That was the condition of they're getting their roads fixed and not get vast right then. Parents he was not chips field. air speed is a separate issue but yeah. And then can chip seal

4:15:30

Re meeting with the storm damage to field roads.

4:15:36

because not all those roads with chips. You know, that's the only reason continuing that Mister miles, based on your question ask about where we put that cause of the that we it for the where they tell that sometime in the future. If they didn't do the best, they wouldn't pay that amount.

4:15:55

predates me. I don't know the answer to that. But it is my understanding that the it was.

4:16:01

We will go in chip seal them now. But in order to do that, we will come back and force an assessment on you to do rise in the Do that successfully you do client that man that I was not there. Okay. That's what asking. Did you know if either

4:16:17

communities when they were being paid us to The chips. Him.

4:16:21

That was never to this day a rumor process that it was a Mister chairman. We bring this back. Its agenda item and in the county minister can research what happened in the past and bring will have the yeah. There's a legal question of whether you can Mister chairman. will. That's Any tips. Yields have been. you.

4:16:42

I will tell you this one. . All the hihis that's coming up that we had to do a pipe in the ground to go fix the drainage. Those people have been flooded like 4 years, 5 years to been a great success up there. But that going the ground that's been approved as well. so that's one that's going to be coming up. The support that of people that we want fix the flooding. So I think we need the full dialogue about let's go look at public babies roads. And let's go to want to course, right and put it all in one box together with all the question. Yeah. I'm stand that. We don't do that. I not been a to

4:17:48

So, you know, Mister marrow, there was no calls for anything in film. We did it at that Urge say there is nothing about any calls to resident about that. But it was a fact that come back later and do be vast assessment to make some So there's no cost in there from anything else.
