The board approved a contested 3-1 ordinance requiring property owners, including abandoned golf course operators, to maintain vegetation at or below 8 inches countywide, with Commissioner Starkey dissenting over enforceability concerns. Commissioners also allocated $1.7 million in CDBG-CV and $835,000 in ESG-CV coronavirus relief funds, including $525,000 to Saint Vincent de Paul for eight permanent supportive housing units. A comp plan amendment rezoning 29 acres on Hayes Road from Res-1 to Res-6 density passed 4-0 despite written opposition, and a 214-unit townhome development on Little Lake Thomas Road by Zaid Corporation received MPD approval.

Commissioner Mariano district two chairman more item p3 that we have proof loose - Commissioner we have a publication in the Tampa Bay Times on April 26 2020 okay well I'll go ahead let staff take this on mr. chairman p3 is an ordinance of the board County Commissioners of Pasco County Florida preparing for the amendment of chapter 42 new Pasco County Code of Ordinances providing for modification repealer severability inclusion in the passivating for an effective date this was last before were you at your early June meeting and the board requested the County Attorney's Office add some language that gave you some control over how many times property might be cut we've added into Section 5 at the bottom of that paragraph for those violations under 2a which exceed one acre prior to the prior to the county suspending the fun spent prior to the county expending funds to correct the offending condition the Board of County Commissioners must approve the taking of corrective action we believe that that addresses at least some of the commissioners concerns other than that with some clarifications and some paragraphs about improved property the ordinance remains the same as it was at your last hearing it's just outside our question this time pull your camera down just a little bit where I only see half of you there you go perfect well trying to squeeze my or sometimes mr. Stein Schneider could you go over what exactly will be the responsibility of the owner of this golf course if this goes through just for clarity thank you so this ordinance does not just apply to golf courses but if in in the event that a golf course is left in a abandoned condition it would be the golf course owners responsibility having having for improved the property at some point to make it a golf course to maintain at 8 inches the whole course the whole course yeah I I still object to this so I I think I think having a band around people's houses is prudent that should be mowed for fire safety and just safety in general but I don't understand how you force someone whose business has failed to continue to spend money I think the better solution and I don't know what Commissioner Mariano has done with this neighborhood but the better solution is for the neighborhood to come up with a way that this part this golf course can be part of their community I don't think if you buy property with it and you don't own what behind you you're not guaranteed a view and and so it's unfortunate they haven't worked out a deal to help pay for some of the upkeep of a golf course I don't think anyone does a course like this anymore if someone's building a golf course in a neighborhood it's it's pretty much mandatory that everyone in that neighborhood pays a percentage to keep the golf course do you know they all do is to help maintain the golf course so I think what this is going to do is hasten something that folks don't want which is a bankruptcy on this with this gentleman or the sale to a developer but you can't force someone to

the same process when when it's not working so I'd love to see an MS bu maybe for this community and some of this property could be a park some of the property probably could be developed I understand that the the landowner who I guess I've never met never heard from never talked to I own some piece of land by the clubhouse which he wanted to develop and I think it's zoned ret Reza fine something like that and his intent this is what an HOA leader told me was to develop that property and then he would have had those those be required to pay into the golf course so then he would have had income coming in but he needed to get an easement from the ho8 because it clipped part of the tennis courts but they denied him the ability to get to that property and snow uh yeah so he's really stuck he's really stuck and I just I find this kind of unamerican people like I said before lived on they backed up to what is now long lead and they came to the county when we came in for our for rezoning and since they paid extra for the view of our ranch and they didn't want their beautiful way and so they wanted the county to not allow us to develop our property which is not legal and and so I I think this will be challenged because I don't see how this is legal I know I know that Seminole County has it why only one county in the state when this when these golf courses are failing all over the state so I agree that he he would I think it should be modified to say 25 or 30 feet behind each home but not the whole golf course mr. Starkey that's what your existing ordinance that we're modifying says you said he had to mow the whole golf course what I'm saying is your existing ordinance that this is modifying creates a 30 foot buffer and the attorney was instructed that that wasn't sufficient that's why this ordinance is before you yes and I and I objected then and I I'm just eject again because I don't I I don't I don't see how this is legal I think it'll be challenged and I think it hastens something probably those residents don't want and a better solution is to find a solution a different solution for that community you don't own your view if you don't own the property unless you're backing up to a wildlife protected land or water you don't own the view um Thank You commissioner now I remember this is a public hearing and I do want to if everybody's okay with that I would like to actually have anybody send up this item before we go this happened mr. chairman yeah yeah I speak before we go to public that's fine I just want to make sure you guys knew I think we do have people signed up I'm not correct Matt it's fine okay I just want to cover a couple points that she in mention yeah so in Seminole County where I one of the place I got the idea from also winner Park has got a similar ordinance where they make then maintain that golf course you've got issues that are out there between stormwater number one things needs to be maintained this doesn't really deal with that but you get rats and snakes that

people are dealing with right now and it's a little different from buying a piece of property next to a farmland where the cattle is raising these people bought into a golf course community paid a premium for the Golf Course property that sits on the golf courses and was expected to go that way all we're looking for them to do is just do the right thing is have maintaining the grass or a certain level maybe they work something out down the road that'll be up to them it's not up to us to step into it I did try earlier but there wasn't a any positivity there wasn't like plantation palms where they came together and made something work it was just a different construct this you know multimillionaires can do whatever they want to go do he's doing what he wants to do I do know that it was probably ten years ago that a previous owner of the property that she that he's brought beside this golf course did come before them they couldn't quite work out terms but it's not to say that couldn't happen if they came back again to the table and maybe this will make that even happen but it's it is a different situation and I'll wait for public comment for anything further thank you Thank You commissioner Mariana and I just want to read one thing everybody making sure we know this is a countywide for net so mr. snipe said our this isn't you know this is a focused on one specific area to make sure we're all on the same page that in public that's listening is that the essence this is really is it dude because just couldn't one property right we're gonna make sure that we understand this the county's wide world this was time to legacy that's correct it's countywide ordinance it applies to anything that would be that would meet the definition of improved property under under this ordinance mr. Snyder question on that data are there any other properties that come to mind that need this kind of attention I'm just curious as I think now the d-o-t is gonna have to cut their swales and there are they exempt to exempt yes as we discussed it the last year and those sorts of things are exempt from the definition of everything in the counties except as well those sorts of things there's a definition of improved property and those things that are listed as exempt whether they're the county whether they're County State or otherwise are from the ordinance and they don't they ordinance doesn't apply to it and I wanted to address the snakes and rats and things because people pay a premium to back up to our wealth yields that are full of wildlife coyotes snakes wild pigs all kinds of things and thank goodness they're not asking the Water Management District to declare it so there aren't any animals running around but again I don't think this is a good idea at all okay madam clerk could we go ahead and take public comments though yes sir we have two callers who had registered but only one on the line to speak mr. record and start your comment oh my name is John sy Bart my wife again I've made a few phone calls and emails our concerns here is the closed Golf Course and we've had this discussion as I noted many times the the big concern right now is that the courses is really overgrown there is rodents which I have evidence with both pictures and the image that was done to a neighbor's pool heater and I think this is just the beginning we're just going into July it could be a lot of rain over the summer I'm really hoping that an ordinance change would help us with the overgrown course it is not just the Estates there's over a thousand single-family homes which includes pinpoint estates Barrington woods Bluebird village and further away Oaks that's where were a thousand thousand homes once again please the ordinance is on the table please require the owner of the golf course to mow when the height is over eight inches this has been going on for a year and his attempt at growing trees is it was a really bad move on his part and it's created a big mess so I'm asking you as a resident taxpayer and [Music] thank you very much all right thank you sir and we do not have anybody else online been apart no sir but we have two emails to be read into the record please go ahead both are from Miss Diane Cooper Nick commissioners as you are aware I speak Aronson I'm out madam clerk yes two emails on one item that mr. Stein - if she can get it get through it in three and three minutes yes when I met sure there yeah we can't go three minutes in three minutes so well yeah I think I think they were received at two different meetings but but I'd go ahead and read what you can in three minutes one is dated June 15th and the others dated June 27 so the first email is as you are aware I've been speaking and sending you many emails regarding the issue of chapter 42 long before you brought this issue to forefront by September 23rd 2018 letter to all county commissioners detailed the county code violations under chapter 42 the letter also detailed the Florida Statute one twenty five point six nine which is available to the county on how to deal with repeat offenders and the stricter fines allowable I understand that some county commissioners are worried about the cost the county may incur if an in responsible owner does not abide by the county code however I would like to remind you that in the existing approved ordinance section chapter forty 2-1 Clause three the following is the actual language the notice shall inform the owner that if the condition is not corrected within fourteen calendar days of the date of posting the offending condition will be corrected by the county or an independent contractor and the cost thereof plus a penalty administrative cost interest and attorney fees shall be assessed as a lien against the lands section section chapter 42 - one clause five the following is the actual language in position of a lien if a any land owner to whom a demand or order has

been directed fails to correct an offending addiction within the applicable time periods provided in Subsection three the Board of County Commissioners through its designee is authorized to correct the offending condition and by resolution to assess a lien on behalf the county the actual cost of correcting the offending conditions plus the penalty of the amount equal to the cost of or $75 which is greater plus administrative cost including necessary expenses for investigation of the complaint preparation filing and recording of the assessment lien and legal expenses incident thereto plus interest plus reasonable attorneys fees shall be assessed against such lands the lien shall be a special assessment lien against the property and shall be given the same priority with the lien of the county ad valorem taxes and will be superior and prior to all other liens and conferences titles and claims in - or against the land's involved and shall remain a lien until paid appears mm-hmm it appears the county has a viable solution should the county need to correct a violation I believe that one any violator should be made completely aware of the com winces of not correcting the violation the county actually follows through with what is already and their arsenal of dealing with the violators three and I'm paid about ad valorem tax is subject to County foreclosing on a property for unpaid taxes for foreclosures of these troubled properties is available to the county or the property only owner actually pays for the costs five if the property owner does not pay the ad valorem tax and the county needs to bar closed the county would then own the property and have the ability to provide the subdivision with a protected green space for the benefit of the subdivision in conclusion the county is the one is in a win-win position if the owner does not mean the property the county should make the corrective action and file a lien after that one of two things will happen one the owner will pay the lien or an existing lien owner will pay it to protect positioning the year get wages paid or to nobody pays lien and accounting forecloses and owns the property for free that was just the first email is there time left no that was a three-minute buzzer okay thank you back to the board I have a question on that letter you must know Starkie yeah mr. Stein Schneider mr. biles have we had to step in and take care of any property when the homes or whatever fell into disrepair hello yeah that'd be mr. Schneider we we do we do yes have we foreclosed on a house because they had uncut grass I am NOT we have gone through the foreclosure process on any of the these outstanding liens with the possible exception of Sutherland property so if we if we do have to step in and take care of property are we gonna foreclose on it or are we allowed to pick and choose what properties we've foreclosed upon or do we have to do them all that would be up to the board's

direction to the county attorney that was my question okay just walking under him and Jack Mariano yes your Mariano when they look at the list that we're giving for public comment from this morning it shows in the we're supposed to have some public comment by phone by a Elizabeth kick-outs for the Lynx compost but she didn't speak for some reason didn't call then okay and then there's another one by Thomas Carroll talking about the same thing was scheduled for this afternoon I guess he didn't call in either and they were I think I feel everyone looks at the list there was a Judith Parker it was William and Mary Ellen Anderson in Kendra Tino Nancy Pelzer Phyllis Cox Carencro Isola no Susan Croft Nancy and Larry Peter and Neil and Cindy Minahan and I and I know we've got a lot of other emails from people through the week past couple weeks and I had met with the associations all five Association with all their elected board members and they all signed a letter and sent a petition in I didn't see that anywhere in the record but they sent a letter in saying that they what did want to see this organs go through these people have been through a lot for a whole year as I said I tried to step in and only try to make something happen like Commission well you were successful at plantation palms but to whatever the reasons going on Seminole County's had great success long-standing Commission was also senator and representative for that area when I was asking for help he come up with the idea say Werner havens had great success with it you know we had talked with the agricultural community we put them at ease where they're comfortable with this same thing with the development community so primarily it's gonna do a lot of great things for this area these homes have probably lost what would have been at least 30,000 value just from what the owner of the property told me from one transaction so it is protecting the neighborhood it is quality of life that's out there they're rats the stakes etc and a golf course you don't get nearly what they're getting into right now so we're actually going to do the right thing but so I'll wait for further public comment for another my other commissioners first wixmerio smiles and anything you know I asked mr. stark he said I I don't know who the owner is I've never heard from him or her which I'm kind of surprised but it is what it is but I know it's a mess I've seen it it's looks kind of like quite frankly alcohol farmers does in some areas and the golf course that we own that we're maintaining obviously we're gonna have to maintain more of it but I do agree that something has to be done up there and I'm really disappointed that this owner hasn't come forward to have a conversation with this so if this is what it takes to have him do that I mean I'm okay with it as long as you've met with the AG community and and I have not but you telling me they're good with it but I'm okay with it [Music] I have a motion for approval

any other questions from the applicants representation this Wilhite thank you okay we're good work is straight everything's good and now we can we can go ahead so moved okay a motion by Commissioner Wells a second by Commissioner Mariano madam clerk please call the roll district three Commissioner Starkey I district for mr. wells district five Commissioner Mariano by district two chairmen more hi motion passes for zero thank you okay that's two that the consent Commissioners for the record good afternoon it's Marcy Esper director of teeny development and we're here today with a public hearing for the additional funds that we receive for the coronavirus aid relief and Economic Security Act next slide please I still need proof I'm sorry sir temp P 19 Tampa Bay Times June 21st 2020 all right thank you go ahead Marcy thank you so we received an additional 1.7 million dollars of Community Development Block Grant otherwise known as CDBG cv funds and that could be used for economic development public facilities and infrastructure affordable housing and general public services and then we also received a little over eight hundred and thirty five thousand of the eight hundred thirty-four thousand dollars of the emergency solutions grant ESG CB funds and that is primarily for homeless services and in order to debt in order to put this money out on the street we had to make or that all the projects and activities would prevent prepare or respond to coven 19 next slide please so just to give you an idea of the timeline we were notified of these additional funds on April 30th we published funding availability requests for proposals on May 6 we reviewed we brought our committee together on May 27th to review the applications and we should have updated the slide we were going to present these to you on June 16 and here we are June 30th so that is actually a two month turnaround with our projects to start on July 1 next slide please so here are the funding recommendations we are recommending a joint project with the office of economic growth of $500,000 to work with local businesses to respond to the 19 and how it affected their business and help them reopen we're also recommending for funding five hundred and twenty five thousand dollars to saint vincent calls for the purchase of eight units of will be permanent supportive housing for the homeless next slide please here's the list of agencies that we would work with under general public services for all agencies that we work with these in range of working with those that are unemployed to those that might be experiencing foreclosure mental health issues children's trauma and of course help and and drug testing the next slide is the list of projects that we are recommending or under the ESG CV funding and they are divided into three areas homeless prevention will be basically rental assistance delivered from from these agencies for people that

services again the purpose of CDBG is to help low and moderate income persons in in the areas of decent housing suitable economic development and also economic development so these would be the suitable environment and all of these projects would either be new or expanded to serve the low and moderate income citizens of Pasco County next slide please for CDBG public facilities and infrastructure we are recommending the following projects and the list is there from smaller projects with Lighthouse for the Blind to put in an automatic door to helping am skills by brand new building and everything in between so we're really good and list of projects really helping side-by-side seniors a variety of different populations working with the housing authority to reroute some of their projects next slide please we are also recommending several projects for funding out of home and that would include a youth and family alternatives spear village it's actually phase 2 at Habitat for Humanity on the east side there Cove project helping them build eight new houses and a new project a new partner for us the housing and educational alliance coming in as a new chotto also building some new single-family homes and then starting for the first time with us we'll be putting together tenant based rental assistance with the Coalition for the homeless and st. Vincent DePaul $400,000 going into helping our homeless stay housed or a cup years with this funding again this ties to the 3.8 million really a lot of funding going to our homeless initiatives next slide please and then here are this our regular ESG funding so we saw the eight hundred and thirty-five thousand that we allocated but here we've allocated our regular amount which is just around two hundred and forty thousand it's basically for emergency shelter services to help these standing organizations and also our homeless management information system thanks bye and here's the timeline again you can see why the timeline that I just shared with you for the 19 funds was so absolutely amazing is because we start our grant kickoffs in March and then and we they have 40 30 days to respond to a request for proposals we had an 11 person committee that met three times to review these these projects and then we're presenting doing the first presentation to you on June 30th this presentation also opens up our public comment period which is going to run for a little over 30 days and then we'll be back on August 4th for a second approval a second public hearing and asking for your approval and then our plan must be our 2020 action plan must be submitted to HUD on August 16 and these projects will start on ten one pending your well for as again the covered 19 projects we'll be able to start July 1 next slide please if there's any questions or public comment I'm happy to hear that any questions from the board go ahead sorry about Mike's back good
