The board approved the largest acquisition in ELAMP history, a $22.05 million purchase of 843.5 acres in the Cody River and Five Mile Creek corridors from the Angeline and Bexley families, and voted 5-0 to find the FGUA Aqua utility system acquisition serving roughly 3,600 water customers in the public interest, though a companion 2% rate increase was continued to December 10 amid concerns about east-county residents lacking notice. A 4-1 vote on a $1.5 million CDBG funding allocation drew dissent from Commissioner Mariano, and Commissioner Moore was unanimously elected the new board chairman.

3:55he is the speed King I heard you learn from the best right well with that at this time I need to take nominations for vice chair I'd like to make a motion for uh Mike Wells this last year I have a nomination for commissioner Wells as Vice chair do I have a second second I have a second all in favor same sign motion passes congratulations commissioner Wells thank you okay give me one second here to get situation and getting my ground here again well thank you for that nomination I'm excited to be here once again and I look forward to a great year with that we will go to public comment do you want to read the name she would like me too I will read the uh disclaimer first okay okay citizens are getting an opportunity to comment on any proposition coming before the board during public comment the board also takes public comment on items to be placed on the future board agenda or under their purview public comment for public hearing items just are taken during those individual public hearings at 1 30 p.m or is thereafter his item can be heard is requested that when you address the board the comments are not directed personally I guess a commissioner or a team member but rather directed at the issues this provides mutual respect between the board members and the public I will also reiterate there is no back and forth between the commission or citizens or in public comment um and we will move forward with the people that are signed up and go ahead and if you want to go ahead and read the first five first five line up if you have not signed up I will ask you to line up if you're not lined up I will cut off public comment at that time okay the first five names is it Joni Stokes Suzanne Greene taldon Ann Marie Ryan Gary and I'm sorry I don't the handwriting is it strongest thumb I can't Smithson sorry maybe Smithson and then Mike armato hi good morning good morning thank you very much my name is Joni Stokes I live at 22718 Penny Loop Land O'Lakes Florida I've lived in Pasco County for six years now before that I lived in Hillsboro I have been rescuing animals for the well over 25 years on my own dime I was on the animal Advisory Board in Hillsborough County for nine years under Ken Hagan since living in Pasco I've had the unfortunate opportunity of needing to get in touch with Pasco Animal Services but wait you can't get in touch with the Pasco Animal Services you have to go through Pasco County Pasco County who knows nothing about animal problems Pasco County does not put you in touch with animal services unless you meet their criteria they know nothing about it but you have to meet their criteria my first encounter was about an animal
7:08left in the yard with without proper conditions they told me unless the animal was dead or emaciated they weren't coming my second account was animals off leash myself and my dogs were attacked numerous times by off-leash animals they told me to take pictures take pictures while I'm holding three leashes and worrying about who's gonna die which dog I asked if I should make him smile then there was the police officer who came to the parking lot due to a dog being left in a car he stuck his finger in the one-inch opening and told me the dog was not in distress so he was leaving I told him that the law said that you couldn't leave animals in the car and that you could break the window if they were in distress but otherwise he could get in touch with the owner and explain to them that it was illegal he left my most recent was it with Hoarders a neighbor living in a duplex had nine puppies without the aid of a vet or anything his home in front and backyard were actually unlivable however he had also had three small children living there in a duplex the puppies dot one puppy died within the first week or two the second within two months they never saw the light of day never had they did their business in the back bedroom the house smelled of urine and feces one neighbor told me that he had to leave because he was ready to throw up from the smell and the garbage I fought with Pasco County I was never in the house so I walked down to a neighbor's house who was inside and they finally put it through to Animal Services Animal Services came and because it was too much food in the house not necessarily being given to the dogs they refused to take the animals they were Pit Bull mixes he was going to sell them for a hundred dollars each can you say animal fight dog fight Pasco County should not be the first step in reaching Animal Services we need a direct line and every case should be looked into we need a written ordinance and easier access to the website we also need money we need direct we need money and we can make money thank you so much money thanks man thank you that's the free meds thank you so much and we have a technical difficulty on this side just give me one sec test now it's on okay you got it thank you okay next please Suzanne Greene tall down Dr Suzanne green taldone 8751 Cranes Roost Drive Newport Richie Florida I am here today representing the almost 1500 residents of have signed a petition strongly recommending against locating the homeless programs in the neighborhood in our neighborhood at youth Lane the Commissioners have consistently voted to move forward on this project over our adamant objections I would ask you again
10:16to find a better suited location for this program rather than on the youth Lane property this is a tremendous amount of funding so beneficially applied if it were applied to elsewhere to the homeless needs and projects these votes are based upon fraudulent overstated pit counts and inaccurate surveys both of which have been flagged to the Commissioners but nonetheless ignored just three years ago I warned you of an increase in hepatitis A in our County based upon your lack of activity and the aggressive promotion of homelessness into Pasco County now Pasco County leads the State of Florida in hepatitis A with 373 cases as of August 2019. I signal you to the next concerns being watched for among California Homeless as stated by Dr Mark Siegel NYU Health director typhus carried by fleas on rats feeding on the garbage that accumulates near the homeless people where they congregate a leprosy outbreak spread when an infected person costs and sneezes and it is inhaled if the Commissioners move forward with this program I am here to remind you of your commitment to close down this Resource Center if it becomes a significant safety problem to the neighborhood This Promise has been made at several bocc meetings November 28 2017 June 19 2018 and consistently when objections to this location have been discussed personally with the continued press coverage for the Youth Lane facilities the homeless persons in our neighborhoods have increased problems with the homeless in our neighborhoods have continued in ways the Commissioners did not initially forecast two bank robberies by a homeless person September 13 2019 Chase Bank on little and ridge September 14 2019 Bank of America on Embassy and little tent encampments and homeless invasions into the empty buildings of the Boys and Girls Club buildings and a significant increase in transient homelessness along little and ridge as stated in the filing cdbg funds are vital to improving the neighborhoods providing decent Holdings and creating new economic opportunities this item does not comply with the spirit of cdbg funding this will not improve our neighborhoods we are concerned for our safety and will hold the Commissioners to their word to protect us the tax paying law-abiding citizens of Pasco County thank you next up Anne-Marie Ryan give me Miss Ryan that's that's fine good morning uh Cherry Smithson I'm the uh one of the founding fathers of the central Pasco and Gulf railroad at Cruise Lake Park address is 4411 Eva Street New Port Richey Florida I'm just here for a brief minute to talk about the permitting situation that we're running into for our railroad at Central Pasco on Gulf Ray Road we're starting to have a burden overburden financially because of the cost of the permitting and also the cost of of hiring the employees of the park for
13:41doing the overtime costs this year went from from a thousand dollars to almost twenty five hundred dollars for one event so I'm asking the county to help us with the permit the permitting for our events because we are in the park I mean it's not like we're coming there we're actually there to help the park to promote the park we have spent every penny that we've made in our events to expand our Railroad and to better the park we've got over half a million dollars in our own money uh in our in the park at Cruise Lake Park uh the events uh sponsor the park we have one coming up December 15th excuse me December 5th we're having Charlie Belcher there to promote the park in our holiday our holiday Christmas event everything we do is for the park and for this community we sponsor homeless kids we sponsor training for kids and adults we I mean just a whole bunch of things we do for the community and suddenly we've got this overburden with our the permitting money Etc et cetera et cetera so I'm asking you to take a look at that and help us out if you can great thank you so much thank you I've asked Keith Wiley to meet with them okay beautiful excellent thank you good morning name and address for the record and good morning Commissioners I'm Anne-Marie Ryan 11436 Windstar Court in Newport Richie I'm here to um also talk about uh Cruise Lake Park and the and the railroad um with hat in hand my husband was a member of that Association for a long time and I want to thank the Commissioners for taking the time into giving us access and them access to the Rangers and all the advantages you need to know I hope you all go over and see the park and what they've done they have over two miles of railroad it's made for kids and families the events that they run bring in hundreds and sometimes thousands of people it's been very successful they have a big investment over there and I think what you need to know is that what you've done by opening up the door for them everything they do all the money goes back into the park there's no profit made for any individual they do spend a lot of their own money in time but it's benefiting people they're coming from all over the county to go to these events and it takes it it's nice because once a month they run the free runs and everybody comes it's become a family event so I hope that you'll listen to what they need to do so they can go forward I think the park has really benefited from their presence and I think that families need a place to go that's economical and fun and I think it's keeping children in a place that they're not handing you know with their computers and everything people go for a day of fun they even went and put in an extra Pavilion so people can park closer to the playgrounds and take more advantage of that and it helps people with web babies
16:44they don't have to walk as far to the train station so everything you've allowed them to do has been beneficial and we look forward to your help for them to go forward thank you thanks so much next up Mike our motto then the next five is Nancy Haynes Timothy Park and Marie Ryan again um Mike Stanco good morning name and address for the record please good morning our motto I'm at 98 40 San Sierra way uh Port Richey I'm the president of the Westport Association I come today to speak to you about the dredging project um Short history of it I've been in my house for about 13 years now and I start hearing about dredging 13 years ago it was always told that the Corps of Engineers would have never approved the project well lo and behold they finally approved the project so now everybody's hopes are up and to date after close to three years or in excess of three years nothing has happened and so people's go back and say well nothing's ever going to happen I keep saying oh commissioner Mariano keeps telling me it's going to happen the project is very important for many reasons obviously to the homeowners it's important because it would increase the value of their homes make it easier to get in and out with their vote not have to worry about whether the high tide is coming or not coming the other thing it would help is increase the values of their property which will also increase the taxable value of their property which we didn't help the county the other thing it would do would be to help the drainage situation particularly the drainage situation on the east side of US 19 because eventually that water gets into our canals and out to the Gulf so I guess what I'm asking is we need to get this project going and quit uh I don't know quit studying it and start shoveling some dirt and getting it out of the way because if we ever get the Katrina here God hope we don't get the Katrina here but that water the most of it will get trapped on the other side of US 19 and it'll take weeks for it to go away the canals the main East and West Canal in in Westport can carry a lot of water provided it's clear there's a lesser canal and it's uh on the on this on the south side of the the subdivision that runs along where the old Target used to be that Canal is really a drainage ditch it's not really a canal it's not used for any boating purposes but that needs to remain open and cleared because a lot of water probably the water from Jasmine to uh the mall comes through our canals so it's it's it's important for a lot of reasons not just for our boating pleasure but also for the drainage so I would hope that uh you know you can get this project moving get it funded uh and uh everybody be happy I think with the results thank you
20:05thank you next up Nancy Haynes Miss Haynes good morning um name and address for the record please good morning my name is Nancy Haynes I live at 18430 Sugarberry Lane in Spring Hill but it's a Pasco side I'm speaking today for the majority of the residents of Highlands unit 10. we're here today in an effort to change the Zoning for the entire community of Highlands Unit 10 less the exempt Lots the list having been presented to the commission Highlands Unit 10 was developed in 1974 and at the same time the developer designed and recorded deed restrictions that among other things required that all housing structures were built following the southern building code mobile and manufactured homes are built by Hud code manufactured home construction and safety standards and therefore under the restrictions not permitted in Highlands unit 10. even though the zoning may have allowed them unfortunately those restrictions are no longer in force in June of this year the second manufactured home moved into Highlands unit 10. this event awoke the community to the realization that this could continue and has the likelihood of reducing our property values there are currently 73 vacant buildable Lots in Highlands unit 10. when most of the residents of Highland Unit 10 purchased a home or vacant lot in our community they were sold as being in a home's only Community every resident I have spoken with has confirmed this and as a realtor I know this is how the properties of Highlands Unit 10 has always been marketed I bought my own home there because it was marketed as homes only the residents of Highlands Unit 10 are looking for a permanent solution to this issue that solution is to rezone the community from AR to ar-1 we're asking the commission to approve this request we have reached our required number of petitions and all documents are in committee we would also like to thank the commission for taking the initiative to move forward this rezoning effort for the truly grateful residents of Highland unit 10. thank you man yeah thank you okay next Timothy Park uh yes uh my name is Timothy Park and my address is 8202 Autumn Lane I'm here um requesting help really I thank you personally uh for being able to listen to me I this is pretty much a personal request I'm at a dilemma um I've had a problem I live really just a half a mile as the crow goes west of here it's on the other side of little Ridge in behind Genie's restaurant and initially when I bought that I've had that home for 40 years and raised my my seven children here been a had a business on Massachusetts the lawnmower shop I've had been the the chaplain in the county jail for 40
23:36years but and I and this is my home and I love it but this last year I had a fire in my home um on Autumn laying there and uh in the process um we hired somebody to Pro what is it uh Service Pro to come in and to redo it but in the process I also talked with someone that is pretty familiar with the what makes good sense in this community of what to do and what happened is I have a problem with the water there and as they began the the process of considering repairing this this was back in April when this happened our early rains came and what happened is I have over a foot of water that's been on my property on my driveway or on the drive for over three months it was there now it's finally gone down the problem is is that when I bought that property it was a beautiful piece of property it didn't it was before this building here was built before they widened a little road before all the development that took place and what happened is little by little all around there was Grand Valley um all the elevations around me were built up including uh here to where the water where it used to actually run on out to Massachusetts it actually ran before this was built it actually ran over to um oh Bass Lake Area there was actually a flow and as all these areas were built up my property now if we look on the record it's called a closed basin in other words it's the place where the water collects I am paying money in for all on I have two properties and so I hate that I hate to cut you off but we I'm over here I hate to cut you off our three minutes is up what no it's okay so stay with me for a second stay with me for a second okay so okay so I want to point you in the right direction okay so Mike if your team could Mr cabal is right there if you could walk over to Mr Kabbalah he's going to help you discuss this situation either further sir okay thank you so much next up well we can't different topic okay it's a different topic I am Marie Ryan 11436 Windstar Court um I come before you with a concern that I have of what I've been reading in the paper and I've heard in person you have we have an epidemic of hepatitis A it was in the papers it took two full pages to explain we've had the board of health nurse come to summitary development to try to get all of us anyone 55 and older to come down and get Hepatitis A injections and we need two of them in order to protect us we have Pasco County has the highest rate of Hep a in the entire State of Florida over 460 cases have been reported compared to 101 and
27:09102 in a few other places many of them don't even get up to 50 in a county so since we're back in the papers again and we just got through this gigantic hassle that we had with having the highest rate of people getting prescription drugs we've now in in the worst place we can be because now this is impacting everyone going into any restaurant or anywhere you go even going up to a drive-in window you put yourself at risk you cannot clean your hands by using the over-the-counter and to anti-bacterial you have to wash your hands with soap and water and sing Happy Birthday two times to get these germs off your hands so it's becoming a prolific problem so I'm here for asking for a solution I know that you care and I know this is like the worst thing that could happen to our County to get into the papers for the worst of the worst in the state of Florida you know I'm a leader I really and I don't jump on a lot of quizzes but this is important so if you need people to get people involved number one so that we can get out there to protect ourselves because I don't know that everyone gets the paper at home or is aware of how serious this is four times the amount of Hep a in just this Corridor on 19 in Hudson and Newport Richie between 52 going down to Ridge Road no matter what restaurant you go to so whatever we need to do if you need us to get people to get the word out there if you need us to write letters to get more funding whatever you need I'm willing to step up and help thank you Anne-Marie I'm gonna um go talk to Kathy real quick she's got some additional information you can share on some numbers and things thank you you know Kathy right okay thanks Emery the less signed up is uh Mike Stanco Dennis Wilson and Ann Corona okay if there's anybody else that wishes to speak after Miss Corona I will ask you to line up behind her does anybody else wishes to speak after the gentleman that just lined up behind Miss Corona oh that's Dennis okay anybody else wish to speak he will be the last person today then okay that's it thank you yes sir name and address for the record from 9939 Tradewinds Drive uh Port Richey I live in the Westport neighborhood um I'm out here to talk about dredging and water rights um when I first moved in there well I actually bought this house when I was working for our Saint 100 I was supporting the 160th overseas in Southwest Asia I did three years in Iraq in Afghanistan I mostly supported jalalabad and Salerno well I was in Salerno I got in the computer I was looking for a house I spotted the one in Westport on trade winds I wanted to be back so far from the golf because of hurricanes and I wanted water rides so I could I could fish so that was my main goal I found this beautiful house on the corner on trades win three level house
30:09beautiful I bought it um within a year I put in a floating dock my taxes about doubled but uh I was sitting in about three feet of water under my floating dock every year it got lower lower well now it's it's 12 inches before it hits the bottom I have a pontoon boat I have like probably 12 inches of water under my pontoon boat now all from the sedimentation that's in these canals um living on the corner there's there's a corner lot directly across from me it's the only one in the subdivision that doesn't have a sea wall it's on the point so you got two sides like this the lot is right in front of me it has a cement slab on it nothing else well there's no sea wall there I'm in my second level where my kitchen is drinking coffee every morning looking out the window and I look at the raw dirt across from me and I watch Boulders you know not rocks I was a geology major they're Boulders they're boulder-sized rocks falling into the canal one by one I saw four last week they're all gone they were slowly falling in into the canals all the dirt they have what's called slump with the rain and wind erosion it slumped all the ground slumps into the canals little by little and that lot is slowly going away and filling in the canals which is so the sedimentation is filling it with the tide coming this way and going down my Canal this way it's packing it's packing you know the canals so I can't even get my pontoon boat out and as the Oyster Bar the choke point at the end where you have to get get your your boat through there and mind you I have a pontoon boat I can only get out I have a four hour time period to get out and back otherwise I can't get back because the water's within inches because it's a constant buildup of the oysters there and and with the with the the less water coming in the fish the fishing is getting worse and worse every year for 10 years I've lived there the fishing has gotten worse where I have a hard I haven't even seen a trout in years now the fish the fishing and then it's supposed to be a state park Salt Springs Park the state is not supporting at all we have manatees back in there we need some signs to protect the manatees they're getting hit by boats and it you know it's the only state park I've been in that does not have speed zones all these lagoons back in there are fish breeding areas they should have it should be no wake because our fishing is getting worse if they don't protect our fish breeding grounds we have none thank you so much sir we appreciate it this Corona name and address for the record good morning Commissioners Ann Corona seven six one five Tanglewood Drive New Port Richey Florida um at the risk of repeating myself I'm going to repeat myself um we've all heard it before but um I'm here to discuss the funding for the Coalition project on youth Lane um I'd like to go at it from different direction and discuss the face of West
33:02Pasco what do people think of when they think of West Pasco right now they think of homelessness deteriorating communities buildings and empty Mall restaurants closing the ones that are open I probably wouldn't go to the last time I went to the Panera by Gulfview I was with the assistant administrator at Bayonet Point Hospital and the executive director of Area Agency we had to wait for a bunch of homeless people to to clear out of the back room they were changing their socks obviously they had been bathing in the bathroom um I haven't been back there since we're Anne-Marie just addressed the rise in hepatitis A that has gone up 40 percent in the past three months in the State of Florida if sea Stripes think zebras where's that Rice coming from and it's a very dangerous issue there was an alert on my email as a nurse this morning a new hepatitis alert my husband has addressed that he's property manager one of the largest developers in the Community he was told okay you have a commercial property you have to trespass every single unit in that property okay so we did that so we notified the police once one car showed up the um the people they've lost tenants because of this this is on 52 but it's probably I would say 50 of the properties that he has in Pasco County that's not acceptable Tallahassee I never hear homelessness addressed in Tallahassee why because the legislators don't want to point out that Pasco is the face of it it should come up because this new this this project will be a new magnet for homelessness and we're going to have the same face as Seattle and San Francisco the face of West Pasco is not the lovely communities we see in Virtual of virtual kingdoms that we're going to be having in Wesley Chapel in that area Avalon sounds like Camelot Pasco is a degraded Community give that one million two hundred fifty eight thousand dollars three hundred and three hundred seventy four dollars to the elderly they're uh as a wait list in Pasco and Pinellas for thousands of people to get Meals on Wheels these are the people that still continue to contribute sixty percent of gross income to the State of Florida help them stop trying to brush sand off the beach it's not going to help this is not a suitable area it's not an adequate project you're not going to change anything um 32 people at a time for six months remember the people who elected you the people that vote the people that don't have felony warrants thank you Mr Wilson will be our finals speaker now I hope you let me go like he did well she didn't go over three minutes sir there's two Bells there's one and two there's one at three name and address for the record my name is Dennis Wilson I live on Rainbow Lane and Port Richey I'm here about your Sheriff's Department again and again and again they need to have a civilian oversight committee on December 28th my neighbor was beat up by her boyfriend on December 30th she told me about it I told her any problems you got to call the police me and my wife went to Starkey took our

39:07development program class of 2019 done a resolved in regular session with the Quorum president voting this 19th day of November 2019. my approval second I have a motion the second all in favor aye all opposed same sign motion passes well good morning welcome back good morning Commissioners another another great year for you and your team so congratulations to each and every one of you so we look forward to hearing what you have to say and hear more about your project uh thank you and I thought you guys might be sick of seeing me it's been uh since 2012 we've been doing this program um you guys are pretty much familiar with the program and I want to first start off by thanking you to continue to support this like I said we started this in 2012. uh both the board and Administration has been more than supportive of this uh you kind of know the details of the program we select the group each year they go through training they go through mentoring we take them all around the county show them different aspects of our organization different aspects of the county itself and then they're given um kind of a Capstone project to work on and this group I won't give away too much you guys will probably be hearing about the project that they worked on in the coming weeks and months they did an awesome job what I do want to spend just a moment talking about is is the caliber of folks that that we have here in the organization and that come through this program you know I think we're 2700 employees under the board of County Commissioners and for as long as I've been here it always amazes me the caliber of folks that we have working here and I can't go through all of it here but just to give you a heads up we've got folks here that have secured grant money for animal services so that we can continue to meet and or exceed our save 90 program we've got an individual here that pretty much single-handedly coordinated the entire two good Souls shoe and sock drive that that we participated in not just participated in but have been organizing for the last four years we've got a we've got a Parks and Rec Employee of the Month back here we've got a handful of Florida Sterling examiners in here so um this group is really they're just awesome they really make me feel inadequate about myself sometimes but uh no they're they're truly rock stars here and uh so I just wanted to take a moment and recognize them and thank the board once again and thank Administration once again for uh supporting these training and development programs they really do make a positive difference here in our organization and in Pasco County so thank you very much great well thank you what we'll do is the board will come down we'll we have some resolutions to hand out and we'll probably get come back up on the diocese because there's a big group but let's all we'll split these up and just hand them out together [Music] around [Music] now you're trapped then now dance in the
42:15picture congratulations [Music] how are you good to see you see yeah good job [Music] um hold on one sec we need we have one more commissioner we're waiting for eign hold on thank you all right good thank you listeners if if you don't mind Kathy had asked me to to make one more mention here before you you're done give me your I need your name and title for that I'm sorry Ben deal uh training manager training and development so I I told you they work on we call it a stretch project but a Capstone project uh this group this year actually chose the project they wanted to work on and I didn't quite mention it too much because it's still in the proposal stage and it's kind of now been handed off to to Kathy's folks here but uh the program they're working on the proposal they're working on is a is a program where uh Pasco County Board of County Commissioners can partner with some of our local uh local entities here to help provide a temporary work program geared towards uh some of our more vulnerable uh uh population and so Kathy do you want to speak a little bit to where we're at Kathy Pearson assistant County Administrator public services so this group was amazing they really are and I want to thank Keith Wiley whose mentee was Lori Bryant Lori Joe stand up girl where are you stand up stand up raise your hand so they came to us with this idea of putting the less fortunate to work for Pasco County we've always wanted to do this we're partnering with um career Workforce we're going to be partnering with them Kim Price's group director Kim Price director of community services going to be overseeing the program and we have designated some pilot areas Animal Services parks and recs storm water Human Services to test pilot this to bring some of our folks to work for the county to get the skills hopefully in six months they will be employed by us but if they are not they'll have some job skills to to take somewhere else which is really awesome and we're going to treat them just as we treat any other individual that comes to work for the county or wants to be interviewed by the county as a Veterans Preference so they will have Veterans Preference to be applied for a job here for the county we're also working with Career Source we have a meeting set up the first week in December to launch this program some of the members of ldp will be part of this to make sure this goes all the way through so they can be part of it Career Source will hopefully be paying some of their salaries for up to six months so it's a win-win for all of us and so thank you Keith and thank you Lori and thank you to this amazing team that worked so hard getting The Kinks through HR and all the great things that I just

50:27a property and based on the board's input the trespass agreement will be an option for property owners registering property as well as Property Owners will be able to use the registry to receive information if they would like if there are occupants are you know violating any of the County's ordinances we view this as an informational registry that is intended to assist Property Owners with knowing what is going on on their property and assist property owners in giving information that the sheriff's office will need in the event of an emergency or serious situation where somebody needs to be contacted immediate immediately as I said this is a reintroduction I know Mr Daniels has some I think tangible way the registry is looking and shaping up I have I'm asking the board after they hear Mr Daniels to authorize the proposed amendments to um uh the chapter and direct board records to advertise the ordinance for public hearing on January 21st at 1 30 here on the West side I wanted to give everybody enough time to absorb what the registry actually says and provides and how it will work before we send it to public hearing thank you Christy do we have any questions Chris wanted me to go ahead and bring oh Sheriff's here instead of Chase so that's even better right I mean nothing against you chase but when we have the boss here because it pulls a little more weight right all right Sheriff knockout good morning thank you chairman we have a four hour presentation for you awesome we're going to keep this extremely uh quick and I appreciate it Chris Nako 8700 citizens Drive um I want to say thank you very much commissioner Wells thank you very much commissioner Starkey because this is something I know for years uh you've been looking to help to do and something that was brought forward commissioner Wells and I want to say thank you very much and we have our full team here that can answer any questions I want to thank Christy and the attorneys for working on this together it's something that's going to need it it's something that's going to help us out um you know many times a day those front line deputies even firefighters looking to see who lives at the location who owns that property and be able to connect it together for Public Safety is going to be tremendous so again I just want to be very brief say thank you all very much we have our I.T staff here along with members of The Command Staff attorney's office our intelligence policing Patrol that can speak to any questions but if you want to a brief demonstration for RIT staff to just show you what it looks like and how they built this off of another existing uh platform they had appreciate it good thank you thank you Sheriff we'll need your name and title please
53:44Ed Schwartz I'm acting software development manager Hunter Marquis here who is going to help out with the presentation he's software developer too okay um take a full screen I guess um we were tasked with uh making a registration uh application um we started this thing called citizen connect um this is the the first thing that's going to be in citizen connect we hope to expand it in the future but right now we're going to rental registration I'll go through it'll be at citizen.pasco sheriff.com if we move forward um it's a real simple a citizen will come in here they'll add a new property they'll log in and they'll be they'll have the opportunity of adding a property they just put in type of ownership whether it's individual or not the address of the property and then there's some um optional Fields they can fill out whether that's power or not and then after they add the property they'll be able to add who the the owner is um the person logged in might not be the owner who might be doing it for your dad or for your uh for your wife or something like that put in the owner's information if it's run by a management company you'll have the opportunity to put in the management companies uh contact information real simple and then um optionally you'll be allowed to enter in who the renters are the property um so if you if if you want to say who the renters are you'll be able to put that in and they're uh start and end dates and the the whole idea is be able to connect the property with an owner with the renters and kind of can connect all three of those things uh so that's the uh the whole idea behind the site and what we came up with thank you both yeah um any questions commissioner Starkey so what is the plan to get people to register and to contact people who haven't registered so we are proposing a an effective date of March so there's plenty of time for the Sheriff's Office and the county to get together and do an educational push regarding what properties are should be registered and what the registry can do for property owners to assist them in giving them information about what is actually going on with their property and or their renters and keep in mind this is both vacant land and occupied rental I want to stress that in no way is this registry um intended to or will be used to change from an enforcement perspective who we
56:57the county hold responsible for violations the judges expect us to see if there is a violation by an occupant or a renter just this registry isn't going to change that's who we cite for property maintenance violations is the occupant of the property is their most responsible for those types of violations so um I if if the board agrees with the concept um you know I I view this as sort of the first baby step let's try it out let's see what happens there will be warnings before we do enforcement projects to get people to register that should be registered and as I said we've pushed the effective date out to March which gives everybody a time between now and January to understand what the registry does and what it doesn't do because there's some misinformation I believe out there that people think that it's more than it is it's not you have to have your property inspected every year by the county that's not part of the registry it's really just information based and that's our intention um and certainly there will be an educational component with us working with the property appraiser um to send out letters or the tax collector to send out inserts letting everybody know how the process of going about registering would you know how with the link to do that the fact that it's free all of those things if the board agrees with the concept if not every single detail inside I would ask you to authorize the proposed amendments to chapter 18 and direct board records to advertise the ordinance for public hearing on January 21st 2020 at 1 30 PM in the boardroom here on the West side I have a question from commissioner Wells and I still have more questions okay so commissioner Wells commissioner do you want to have a follow-up to that so and I agree this is a baby step um but is there a place here where we can track code enforcement and law enforcement calls to that property well we we can do that anyway um but if we're if we're collect if we're making a database there should be and I've done a little develop list management development there should be a field here where we can track if it's it's a problem landlord and a problem property so can the IT team add that where the public could see that there's multiple or if there's any infractions or calls but to the home by law enforcement so to answer your question commissioner if Congress was alluding to if we had this registry up here and it's 123 ABC Street and we're constantly getting calls you know hey I said this is going to be a process where the good people are going to register their homes somebody doesn't register their home they're not going to register we're going to end us our fire rescue are going to end up going to that
1:00:17house it's going to come up the in-register the fines will probably modify Behavior so then they will do register if we want to know the house all we're doing is going to another just switching over to another database type in one two three ABC Street and all the calls for service will come up on that house and then if we wanted to if you're saying but are they calls for excuse me calls for service from the sheriff's office or calls for service from the code enforcement we have that option as well in our system to look at an address and see all of the code complaints or County Warrants violations that have but but so these lists won't Co aren't um so if we have a list and you have a list they don't work together we'll have to look in two different places well go this way commissioner what would you be looking for to gather this information for so I guess one of my beefs and why my constituents brought this idea to me in my district is that um there are houses who are have tenants where they have repeated problems with code enforcement violations and it brings down the value and the quality of life in those neighborhoods so I'm not sure that that I mean this is this is for me this is not going far enough to help those people who came to me for help but I would like to track it so that we can see how this works and and if there needs to be improvements so it seems to me it isn't that difficult to figure out how to input something I know but trying to always go trying to solve the problem you're looking for so if there's a troubled house and there's a lot of law enforcement calls that get there what would be the are you looking for the end goal for the county then to say we are going to find this house or we're going to repossess this house or they're not paying our taxes I mean what are you looking for the end goal to well I'm I'm looking for a solution to our code enforcement and Law Officers having to act as a responsible landlord rather than the landlord taking action himself Okay so rather than duplicating the information that the sheriff's office already has that we can we can pull from ILP and get a list of everything that's gone on and I do that routinely if I'm looking at a nuisance property and I can pull from our gov QA system and I do that routinely if I'm looking to see whether something is a nuisance property rather than duplicating all of that information within this registry what this registry will do that will be helpful is first of all it not only gives the landlord for a rental property and an owner for a vacant property who is not local the opportunity to affirmatively say yes I want to know when those things happen they have the opportunity to trigger an affirmative alert to themselves but the other thing is that it requires a local agent for us to be able to contact so right now if I have a problem property that has multiple code enforcement
1:03:43violations but it's empty and the property owner let's say is out of state I can't get service on that property owner regarding those violations so that is I understand that you think that this doesn't go far enough but what I I do want to reassure you that one of the most important things that I think from an enforcement standpoint um it's secondary to giving Property Owners information but it also provides a local contact UM that we don't have right now and I think that's all important right it's just that when someone for example I'll let the public know is watching when the county has to go mow someone's grass how much does that cost us Christy there are years that we have spent up to a hundred thousand dollars a year mowing people's lawn and do we get any of that money back rarely rarely I don't think that's fair to the taxpayers of Pasco County I don't and uh so I think there should be another solution that the land the the landlord should have to pay for that grasping mowed not the county not the citizens of Pasco County so I'm willing to take this first step and let's look at it in a year and see if we're done doing the job of being a landlord and paying for it okay commissioner Wells and commissioner I think we all agree with you and I think there's other ways to get that done with our existing system no that money goes to the state no but I I think that's a conversation we can have it separate from this but I believe there's a way for us to word it maybe differently we're able to keep that money and during miscellaneous business with the county attorney's office we're going to talk about the hre task force and for example that would be one project that that task force would take on is looking at which properties are we spending public money on over and over and over and then delving deeper under the surface excellent so and and the key to me here it goes back to just really life safety and and something you brought up Christy brought it up the sheriff brought it up is it's not for us to harass or trivial things it's about letting the property owners know what's going on because right now they don't so we're going to be able to let them know when the sheriff's office is being called out there because you know I'm a realtor as well and the last thing we want to do is is not make them aware so this is going to be a good thing to help them but we don't want to pick for every little thing and that's where the Sheriff's Office comes in it's about life safety that's I've said it over and over again and and I know the Realtors you know they did a survey they stand behind this when it comes to life safety in the Sheriff's Office informing them if they want to be informed but I would think any land Lords would want to be informed that Sheriff's Office is being out there which will help everybody I I know Mr chair I I did get

1:09:24replanting the the sea grass that's why I wanted to give that to you and we've been up there now since 2015 and I'm going to go through a short PowerPoint it's it's uh 25 slides if I could get that up on the screen how do I click it right here the big button forward okay I'm gonna let y'all mainly read it and I'll kick in when there's a question or something that someone wants to ask but uh we've been up there since 2015 and it's kind of exciting it's a positive project it's a it's a pilot project but a model for for your area here and I want to speak to the slides because the people that are going to be watching this if they're on TV they're not going to know what's on there I can only read it I can hardly see it that's my problem well um here here it is in King's Bay Yep this is where we're doing our restoration work um I've seen it you can see the canals in this in the system there that uh we're working on there here's where we're doing the dredging this is how many of the canals and all that we have restored and working on currently we had to quit November 15th because of the manatee season so we pulled out the dredging equipment and now we're starting to plant uh we we have an exclusion cage that we that keeps the manatees and the uh ducks and Turtles out of the out of the um so the so the grass will actually grow and it's doing a great job growing and expanding you know it's funny you say that because I was going to ask you that question because we were up there we were kayaking in the Crystal River and we wondered what the case was before but now we know why so you're trying to save it from the being eaten by the manatees and that other well everything wants to eat the grass yeah and so we protect that grass we've seen it firsthand that you're we are doing that job we have we have 900 cages going in right now wow this week wow and uh I was trying to fish around them you can get the grass back you get the fish back that's good you get the whole system back and we're excited about it to be doing the work up there but it's a positive project here's some of the grass now picture of the grass underwater they had actually zero grass up there when we arrived in 2015. it was all monk silt just like I was hearing some uh earlier talking about y'all's situation here and I believe and I know we can help you here uh with a with a plan and that's what we do our company does is come up with a master plan long term and it starts with the dredging getting it down to suitable suitable growing medium and once you get the suitable growing medium you can grow seagrass back it's not that it wants to live there it it can live there and we've showed it at the pilot project in Crystal River
1:12:41and we'd love the opportunity to kind of work with this organization and your county if if possible and invite you all up to see Kings Bay to be honest I mean when you it was murky Crystal River was murky and muddy and it was kind of silty and once we started doing this pilot project that was so successful we started getting the grasses back everybody's returning there's 250 boats that pontoon boats dive boats that take environmental tours out every day it's a screen I did my checkout dive up there excuse me oh I did my scuba checkout I did too back in 82. 94. so here's here's one of our dredging vehicles and we're the contractor of course but there was a lot of limbia which is caused from the septic tanks and the nitrogen from the septic tanks gets this limbia started to grow and that's what we're removing and once we remove it down to the suitable substrate we put these cages in little habitat centers okay cool here's some of the Geo tubes and how we do it with uh we have to dewater the muck goes into a big Geo tube probably for her thighs the house of this room all the muck and silt goes in there and then the water is distributed out and what's left is the Monk and the silt and we return that out to a farm because it's a good growing product so the farmer wants it and we deliver it out to him and he spreads it out on his field really yeah there's phosphorus and nitrogen that's just got too much of it once it's excellent so a question okay or do you want to finish to finish this up to you well I mean how many how many slides you have quite a few slides Left Right 25 I'd like to see one of them is it okay yeah let's keep going through and then I know we probably have quite a few questions we have the grass called Rockstar it came from the University of Florida uh is the one we're growing up there we also have a salty dog that takes a lot more salt because as we're going further and further out now in Crystal River out towards the gulf we have to get one that takes more saline environment and we're growing that now in our raceways in Ruskin we have a farm in Ruskin Florida that grows the grasses that was the pilot project that's that's part the side of the cage right there and you see the grasses growing out outside the cage manatees have eaten it yep they do that's that's why the cage is there so you're taking out that brown stuff there oh yes uh-huh we do a maintenance every month and that's the key the what we're different our company is different than most other companies is we do a maintenance program with it I tell the story my wife goes to Home Depot and she looks at that hanging basket and we bring it home we hang in front by the front door and what's it do I watch it die it's maintenance once we do the maintenance on this River and on the
1:15:57cages every month we go and we scrub them we move them we we do what we need to do to them we cut the grass back because so the manatees can't eat it if you cut it back it'll spread so we've we've learned this in our aquaculture growing system that's some of the four inch plants that go inside the cage so I would cut them back yeah that was January 2016. the cage in the grass outside the manatees cannot knock it over we had to prove it to the State of Florida it was quite a task but uh they cannot knock them over Turtles sit on top of them munching away and that's when the sea walls where the grasses have recruited actually on its own even even outside our cage in our area that we're working some of the grasses are breaking off like your Saint Augustine at home and breaking off and distributing further out and re-rooting and so the grasses are really doing their job very resilient why is it working well the sea grass absorbs the nutrients the shading of the algae keeps the algae from returning so the leaves in the rhizome gives off a gas and which is generated they provide Foliage for the Ducks the turtles the animals plus it gives the fish a place to hide before the fish as they run outside the area that where there wasn't any grass and get picked off by the bigger fish so that's uh one reason the seagrasses are so important and so important if you know there's small grazers as long as the zooplankton and the invert invertebrates that hang on the grass blades it's a shrimp hang on y'all are a big shrimp area right here very important the sea grass it's talked about is is the key it's something we do that no other company that I'm that I know of does and we increase the animal utilization and the light manipulation by filtering all this and having the seagrass in in place it has cleared up all the fogginess of the water it's Crystal Clear it's called Crystal River again and we're proud of being a part of it working I don't know if you all can see it it's hard for me to read it but that's the graph of how it's working brass expansion the reduction of the algae of course is is the reason seagrass is there it's it's taken in the nutrients the seagrasses so the algae can't keep up and the grasses are now resisting herbivory now we'll have 680 manatees up at Hunter Springs and we'll stay ahead of them we stayed ahead of them the last two years which is amazing I mean that's a lot of animals up there wanting to eat and is that three sisters or is that different excuse me three sisters spring where's Hunter store Hunter spring uh Hunter spring and three sisters spring they combined throughout that whole area we planted Hunter spring in 2017.
1:19:30those are the bubbles that are now that's part of that's a picture we took and you see all the grass and the bubbles coming up that's that's the key that's the oxygen clearing the area as you can see the grass and Hunter Springs there was Zero there that's an awesome picture right there right there yeah it's pretty well I have one in Homosassa so and then you can see the flowering that occurs once it flowers it seeds and the plants distribute throughout other areas and keep up from um and keeps growing and doing areas like I said that that have not been vegetated this is amazing if you read that uh these are the funding which you all very much be interested in and we have gained 25 acres restored as of now that's in all those canals all the working canals behind the residence and out in Hunter Springs is there a is this Swift Mud money tied into those fundings as well there is there's State funding and and Swift Mud funding um and you haven't done the BB you haven't beat the done the BP restruct money yet no not yet are you Rebecca guys you just go with me and then we'll go yeah because I have questions but you might answer them in a slide Senator Simpson's been a big part of helping us get through financial and some of the hurdles there that's the other thing that we're doing is opening up the spring vents that are in Crystal River that is so important because they're clogged with that Libya and just just plugged so we stick our hose down in there and where our divers are out there and we we expand and blow those up and suck up that stuff and they start bubbling again it's a just a joy to see that happen and we've recovered three over at least 300 now one of the biggest problems we have there now is the 250 tour boats dive boats that go in taking tours out there they're anchors their anchors go down and they bring up a big chunk of the grass you need buoys oh any buoys bad and uh or power poles something but they're working on that uh it's a lot of grasses floating up in the air and it's it's uh it is a problem but they're working on it save Crystal River group is just amazing group powerful will be your answer another prop scars are a major problem as they go through the grass beds I'm sure you have prop scars here I have them right outside my backyard all through the grass there seagrass was very important Mr Wells are all over the place I know what we're doing is The Mooring stations is what we're coming up with them public awareness and education of course and all the kiots uh trying to put in place a local ordinance and of course the community stakeholders and the Spud and one of the other things we do up in Crystal River that's amazing is we've gotten the
1:22:59school children involved the high school students and we do grasses for classes with them in the beginning of the year they all grow them in their classes and they know as much about seagrass and Crystal River and as anyone as we take them out and we plant that in the spring with the high schoolers it's a fun event good and event that the community gets some rallies behind you know that's the seating and the flowering that comes up the bubbles air bubbles that's the rock star plant there occasions that's a key okay well no thank you so much for that presentation so I would assume that we want to commissioner Mariano you brought this to us what are some things we might be able to do or is there some possible funding options to help with this well there are there are and one of the things I want in my discussions with him as far as how we get his funding how I could try to even help them the BP restore act money is pot two money is ideal for this type of project so with the data they've collected right now I think with their project up there they can go there put that presentation forward and probably get a good chunk of that money if not all of it for what they need I would love to see them take a look at our canals he's actually spent the other day with me we come down look at look at our canals look down the Port Richey dma site and he thinks he can do the same type of thing here when I when I see pictures to years ago like Cow Creek up in the Hudson area and I see pictures of all the people you should catch all the fish that are out there and I talked to the residents that sit in these canals that have been silted in and all of a sudden what they used to be able to go in there and jump and swim they won't go in there now they see this silt that's grown in they would love to see something like this so I hadn't even thought as much as I've been pushing dredging for all these years this project would only give us dredging for great boat access but I think the water quality benefits that these guys could bring to the table could be phenomenal for the whole County I see a giant frankly an msbu going up and down the whole area not only to do the dredging at first but put the seagrass in there and then as he says put a long-term maintenance plan in place so I think with the study we have going now with Gulf Harbors in Hudson once that gets done it's probably going to be a good time to get these guys to come in and you know everyone else that wants to bid as well to go look and then put a even put a better plan together as far as how we can actually make this really Elevate for Pasco and then we can go look for that extra extra funding out there as well to go to help fund it question maybe for you or for you sir you mentioned um Senator Sims has been a help Swift mud's been involved um financially financially um how much did Swift Mud contribute to

1:29:05back there um you know we all love you but I'm going to have the clerk read it and then we'll have you say a few words no crying no tears please you know how I get about that but so Madam clerk Nikki if you could please yes resolution number 20-036 a resolution by the board of County commissioners of Pasco County Florida yeah these time out I'm sorry can we get the mics working again they're pretty much not working for it or you have to get rid in there right here okay we can just turn them off that way she doesn't put her mouth on it okay we'll start over so this will be your last surprise well I hope baby all right Nikki resolution number 20-036 a resolution by the board of County commissioners of Pasco County Florida commending the volunteer way founder Lester Cipher for his 33 years of service and thanking him for his generosity to the citizens of Pasco County whereas Les Lester Seifert retired from the volunteer way on October 31st 2019 after 33 years of serving our community and helping countless individuals with food shelter clothing and other Essentials and Raz he has always had a calling to help children families mentally handicapped low-income homebound elderly and alleviate their hunger with a faith-based approach to service and Raz it all started with Lester in Lester's Garage on March 13 1992 with one person showing up and asking for food assistance today the volunteer way is assisting over 25 000 families per month Andres other amazing programs Lester has started along the way are the hydroponic farm that produces thousands of thousands of pounds of fresh food every year the Brown Bag program created to feed the homebound elderly who are dependent on others for food and the mobile Pantry that goes to isolated food desert areas and offers food to the homeless and low-income residents of Pasco County and whereas the volunteer Ray also has a Moon Lake Outreach facility with a soup kitchen to provide hot meals facilities for showers provides gently used clothes and houses several social service agencies to help those in need connect with government and non-profit assistance and whereas Lester also sits on the Pasco County Personnel Advisory board and the Pasco County Mobile Medical unit Advisory Board and whereas Lester has received several Awards including but not limited to the spirit of service award from the Florida Senate humanitarian award from Christian International Outreach outstanding humanitarian award from the West Pasco Chamber of Commerce President Bush's daily point of light award JCPenney Golden Rule award has been a recipient of the Florida's point of light award twice and Community hero award from the Tampa Bay Lightning in 2015 and in 2019 the agency of Distinction award and whereas Lester has not received a single penny of compensation during his 33 years as CEO of the volunteer way and

1:35:36and we'll get a picture with this but we'll change it to 64 years pretty awesome keep me out of trouble [Music] thanks so much that's great okay yeah so we're getting back commissioner Moore commissioners we'll take one with Lester and then okay let's take let's do this guys let's take one with Lester and his wife and then we'll bring the whole Groupon and the Commissioners will go to the top so now let's do okay where's commissioner get up there and hold can you get up there hold up that's all about yeah thank you all right we're gonna go back to the diets if you guys don't mind everybody everybody back here if you don't mind we're going to come back here to the follow me too okay one more picture Lester sorry for you and your wife can come in the middle here and then everybody could sing come to the side the world is going to jump up there thank you everybody smiles ready fly off the camera all right thank you excellent thank you [Applause] foreign okay ladies and gentlemen moving on to our three agreement for sale and purchase property project r3ological Corridor sites 843 and a half acres at Southeastern corner of Suncoast Parkway 52 in Atlanta Lakes primary lands acquisition Management program 21 million nine hundred thousand dollars is that it you're good let's go that was funny Mr chairman members of the board good morning Keith Wiley director of parks recreation national resources I'm here today to with great enthusiasm to present the largest purchase and sale agreement in elamp history before we get to the presentation I wanted to cover a couple administrative details the actually the published contract that was with the original agenda has there's some minor changes mostly to the right of Entry agreement you should have copies of the change in front of you also the original BCC memo we had to adjust the budget amendment from 21.9 21 million 950 000 to 22 million 50 000 to adjust for an increase in closing costs so those are the two changes um when I started with Pasco about 10 years ago I was hired as the environmental Lance program manager I was actually the second environment Alliance program manager the first manager that actually created the program back in 2005 is Dr Renee Brown who's over there and um so I think it's it's actually fitting that I'm going to give her an opportunity to present this contract um I think with I have members of the team that were involved in the negotiation as well I think it's we're trying to do the math it's easily over a
1:41:05thousand hours and maybe close to two years of a negotiation so quite quite an undertaking to kind of present this to you we couldn't have done it without the help of the county attorney's office Mr David Goldstein and other members in the County's attorney's office anyway very very uh very very pleased to present this to you and with that I'm going to turn it over to Dr Renee Brown so she can present the actual details of the agreement in front of you thank you good morning name for the record please Commissioners Renee Brown natural resources manager thank you Keith so this is the purchase and sale agreement for 843 and a half acres in two ecological corridors so the map on your screen shows the boundaries of the corridors to be acquired on the North the upper left of your screen is the Cody River Corridor and it is 196 Acres it's the Eastern portion of this Corridor and the western boundary of the project Arthur mpud the bottom of the screen is the Five Mile Creek Corridor so we're able to include all of the acreage within that Corridor that's in the project Arthur and PUD so everything from Starkey Wilderness Park shown in green to the railroad tracks and that is 647 Acres also included in this acquisition is 147 acres for a new park and we're envisioning this park to be largely passive in nature but with some Active Components and that's in the center of your screen so this acquisition the cost for it is 29 21 excuse me 0.9 million dollars this is the rounded average of two appraisals as per the ecological ordinance that's our appraisal and their appraisal there's two owners Associated this project Lynn Angeline and the Bexley family and with the 147 Acres of Parkland I mentioned they're meeting their level of service requirement for this mpud there'll be a trail connection to Five Mile Creek corridor and within five years of closing Len Angeline has committed to spend three million dollars to develop a portion of the park site so going back to the original Wildlife study that led to the designation of the corridors there's some specific conservation objectives in that study that will be furthered with this acquisition so these include protection of the floodplain of the pithlo river protecting the mature forested communities along the Cody River protection of the flood made of Five Mile Creek and sustaining the native communities along Five Mile Creek we also wanted to show this was sort of a last minute ad but we wanted to show put this in perspective of where we started so this map shows the boundaries of the corridor at their Inception so this is when the quarters were just a concept so the Cody River Corridor is from Starkey Wilderness Park to crossbar along the Cody River and cruise Lake and the Five Mile Creek Corridor is from
1:44:03Starkey Wilderness Park to Connor preserve along Five Mile Creek so this is when they were just starting this is what we've been able to protect through the environmental lands program through the Willing seller program shown in red and some additional Acquisitions in purple including Cruise Lake Park and then this is what the map will look like with this acquisition so we're very pleased to show this and the progress we've been able to make using the two-prong approach we have to protect the corridors the Willing seller program and the ecological corridors ordinance and we thank you for your continued support of this effort so with that Keith and I are available if you have any questions on this questions comments commissioner Wells I'll just saying real quick you know unbelievable job I know we had an email earlier about somebody questioning this and I walked through the gentleman you know we this started back in 2004 when it was on the ballot and voted again in 2012 and I know the numbers over 30 percent of the land that we own with the state and the county that will never be developed and it's nice to add this to it and it's great concept the Park's going to be phenomenal um excited about again thank you to your entire team for what you do every day Miss Marietta and I'd just like to compliment uh keys to team Renee at phenomenal acquisition this this project is such a massive piece that fits right to the core of what we're trying to do from the get-go incorporating the park right next to it another phenomenal achievement especially getting them contributing three million dollars back to the park I mean you guys have done a phenomenal job with this for sure Oakley if all your group and your staff and all I thank you for doing this this is a great acquisition for the county and a lot of protection goes along with it environmentally and flood waters and issues that we need to address and keep in mind as we are growing community and especially out in that area it's very good Mr starkey's Everything uh yes I do because it wouldn't be a land acquisition if I didn't ask about Trails so um we have Ridge Road coming through with the trail on it and and um and and Trailhead so I know that we talked about a trail going along the edge of the um the uh the wildlife Corridor will there still be the trail going continuing along the Ridge Road and a trail along the wildlife Corridor or what's the plan there so I know that I've talked to to the team in project management about that specific location um I don't have the details on that right in front of me but what I could say is that we have talked with a developer about some kind of trail system that would would kind of would operate out of the park is like a hub
1:46:45that would use use the corridors as Greenways that would go north and south east and west so I think there is that opportunity to make that connection in the future assuming there's the appropriate funding in place to to make that happen so is Sam bennick here because he was here a little while ago Sam is the project manager for the Ridge Road Extension excuse me okay so the Ridge Road Extension has a major Trail going along it and a Trailhead on property um that we have with do that Duke is letting us Park on we also have an agreement with Swift Mud that we need to make sure we talk to them about regularly that we could have a Trailhead at Ridge in the Suncoast on the south west corner where there's some Uplands left when they built their ponds to build to build the property and so it seems like it would be a shame if the trail came across to the Suncoast and then stopped so um there was you know we I don't know what the trail master plan looks like in the county but I thought there was one going all the way across so just want to bring that to your attention I understand we hear your concerns thank you thank you Mr Starkey um one question for me and we'll move on we talk about the percentage of the county that is protected at this time do you know what that number is so approximately 22 percent if you include all state land and e-lamp Acquisitions and that include this acquisition or that's we'll move this will move up so we'd move it up the percentage would it would increase slightly yes okay 24. 20 maybe 22 points something oh but it would be an increase yes okay so if we compare ourselves with I think the surrounding counties you and your team and this commission and the board and this and this and the staff are doing a pretty good job of making this Acquisitions so we do have these lands protected for future future Generations would you not say so I would agree with you yes I think we're doing a great job one of the reasons I took the job 10 years ago was this is a pretty Progressive proactive approach a lot of jurisdictions attempt to think of this after a build out scenario and there's no opportunities or it's very very expensive to create those opportunities so I think that we're following that the plan that was put in place this this contract actually I think is a great example of that so yes I would agree with you 100 at some point in the future for one second sorry one at one point in the future if you don't mind maybe come back to us or just maybe individual with Commissioners and give us a comparison of you know Pasco County with other counties because I know you're doing a great job and I know we'll be very very happy with those numbers but I think what also at the point will be a good point in the future to show that to the public and and make sure that they understand how much this county is protecting you know laying in vital resources for the future Commissioner
1:49:42Oakland and commissioner Starkey Keith um that land that you're saying that we we own actually that that would not include any lands and mpuds that were protecting also right yeah that is correct sir yes so that would be outside of that but there's a lot of lands that we're protecting from all the growth to save in this community so we need to Rises it's actually the percentage of to be set aside for open land and protection there's a lot more based on that yeah if you were to include those that percentage would obviously increase it's difficult to create a database to track all that information I would love for the jurisdiction you know for the state to to come up with a method to be able to to itemize that but you're absolutely correct commissioner Mr Starkey um going back to the Trails um I I think it's important that um County Administrator that we look at Sam's plan to make sure that the trail that he has on the second part of Ridge Road is going under the bridge under the underpass at Ridge Ridge Road won't the road be going under so um just to avoid the problems that we have at State Road 54 in the Suncoast um I'm sure I I'm pretty positive that plan goes under so there needs to be as things get developed and I know the developers are here in the audience they need to look at that connection with what is being built on the other side to make sure it continues on because I think the residents in this area want to be able to cycle under the Suncoast and get to the Suncoast Trail that's a huge amenity for the for those people down at Bexley they have to put their bike in the car and drive across the bridge to safely access the Suncoast Trail so this way the residents in this area can just cycle to the trail I understand great thank you um with that on entertaining motion move to approve motion second all in favor thank you thank you okay moving on to miscellaneous business we will start with commissioner Oakley yes sir miscellaneous do you have anything for us today sir yes I have one item um I have I want to recommend Amber Burgess for the animal service advisory committee representative she'll be representing district one Amherst director of the Planned Pethood Wesley Chapel and co-director of Planned Pethood of Pasco she is also currently the animal service advisory committee Amber has lived in Zephyrhills most of her life and feels strongly about our community so out of the motion by commissioner to nominate Amber Sturgis second I have a second all in favor same sign motion classified zero thank you anything else sir that's all I have thank you Commissioners um commissioner Starkey um yes uh we launched the um Global let me see what the name of it the Pasco Economic Development Council
1:52:58Global competitiveness committee and I'm really excited about everybody who has stepped up to uh share their different committees and I want to commend Jenny summer the a new edition over at the EDC for doing a great job of organizing this um International effort to bring We'll be working on bringing in more International businesses and encouraging more of our businesses to do exporting and we plan to hold another growing Global event I think some of you came to the ones we had a few years ago this will be in Wesley Chapel in Mar in March I believe and we'll get you more information but we'd love all your help in getting Pasco County businesses to the to this event so that they can learn um actually free there are free opportunities to go overseas and meet with with um prospective clients at the state department pays for so we want to encourage our companies to expand their businesses I do want to tell you that we had a pretty contentious Tampa Bay Water executive committee meeting yesterday and um I want to get with our staff to be sure that we are all on the same page as as we deal with Tampa Bay water and reclaimed water and valuation so I really couldn't speak to where our position was because I didn't know 100 where it was so I just listened to everyone else's thoughts on the executive committee so I'd like to get with you guys on that and just a little heads up I don't um so in southern Hillsborough County they're starting to want to run into water pressure issues because of the growth and they are commissioner merman mentioned that she's getting um complaints about homes with very low water pressure so this is something as we're facing a lot of growth on the east side commissioner Oakley well this will come up at our next meeting we want to be sure that we're doing everything we can to ensure that we are adequately supplying water at the right pressure to our new constituents on the east side so I want to talk to you about that too and let's see tibarta we had a workshop at the meeting and a workshop at the airport and T Barta is trying to figure out how to move forward as we have transitioned to a Transit Agency and a Transit Agency without a dedicated source of funding has its kind of has no legs so um we we are beginning the discussion on how how that agency gets some kind of um funding because we have a brt system coming and someone has to run it the thought that we had at the workshop yesterday was that t Barta would subcontract that that um to a sub a subcontractor and the thought
1:56:20is that maybe we want to look at Rebrand branding all of the transit in the temp in the Tampa Bay area or the Three Counties so that it's a seamless kind of trans Transit effort so this is something that we just started in our Workshop and I'm sure we'll have discussions at it at our mpos but I wanted it to be on your radar so that um you could be thinking about it um and I think oh I participated in the call with the White House on deregulation and um and one of the projects that they're talking about a number of the governors mentioned this is an issue that I've raised at the state and National level and this is uh when the spouses of military um that the spouses in the military family when they move they have to get a new license in every state they go to if you're a realtor you have to go through the whole process if you're a teacher my daughter is a physician assistant and every time they move she has to find a sponsoring physician and then get a current letter from everywhere she has worked that she can't use the letter that she had before she has to get a new letter and it's really a hardship on military families so many of the states are are changing their rules on that unfortunately it's something that is a state issue and I'm going to get some information here to bring to the board I'd like us to do a resolution asking our state to consider doing what Idaho Kentucky Ohio and a lot of other states don't have done to help these military families because Florida is a big military State and we need we need to help our military family so I'll be bringing that to you at in a future meeting thank you thank you commissioner commissioner Wells just one thing real quick um as you all know I'm on the Tampa Bay Estuary board we've got a meeting on Friday and our our five-year strategic plans coming up and right now the way it works is they're able to do projects in Pasco County for any um tributary that goes down out the Hillsboro River into the bay um not necessarily up the coast so what I'm going to talk to the board about on Friday is see if we're able to maybe bring on Citrus County and Hernando County because it only makes sense kind of like what he talked about today to do some seeding or grass and I think Tampa Estuary when it comes to the state and federal funding it wouldn't hurt so I'm going to reach out to the two counties to see if they're interested I just think it would be a win-win for everybody for us to do more on the coast here than just Tampa Bay and Hillsborough for the money we pay every year for it so I'll let you know what what happens after the meeting Friday so anything else sir no sir thank you so it is the witching hour Mr chairman so thank you I just want to talk about one item to further Russell later we had the meeting when we had the conversation at

I'd like to remind everybody that please silence all electronic devices and moving forward we're moving forward to public hearings now we will proceed with the public hearings agenda starting with item P1 Madam clerk do we have proof for item P1 yes we do just one second item P1 was published in the Tampa Bay Times on September 27 2019. thank you Mr chairman for the record Victoria's pitos Planning Development Department item P1 is PDD 2005 which is the Self Storage design standards the first reading of the ordinance was at the November 5th border County Commissioners hearing and I'll go ahead and read the title into the record an ordinance by the Pasco County Board of County Commissioners amending the Pasco County Land Development code creating section 1105 Self Storage design standards and amending section 525 C1 neighborhood commercial District section 905.2 landscaping and buffering section 907.1 on-site parking section 1302.2 Mobility fees to increase the mobility fees from any warehouse appendix a definitions and other amendments as necessary to ensure internal consistency providing for applicability repealer severability inclusion in the Pasco County Land Development code and ineffective date uh today is the second public hearing at the border County Commissioners for this ordinance at the November 5th meeting the board requested that staff go back and meet with a subset of stakeholders which for scheduling purposes occurred uh the day after Veterans Day last week and having met with a subset of stakeholders we heard their comments explain the code made changes and Incorporated them into the text of the draft code for you today and which we presented individually throughout the remaining three days of the last week the last internal meeting with the commission members was yesterday and so with a commission member was yesterday and so the draft of the updated draft code was circulated yesterday afternoon and we have hard copies of that if needed for the record so at the November 5th 2019 Florida County Commissioners we had the first reading in the time between November 5th hearing and the November 19th 2019 hearing Planning Development continue to receive input from the stakeholders October 24 2019 the LPA forwarded the proposed ordinance to the BCC without a recommendation the lack of a recommendation is due to the fact that the LPA was unable to reach a consensus a total of 11 months including the moratorium have gone into the research Outreach and crafting of the proposed ordinance
2:04:52um crafting the proposal to fulfill the directive given to the Planning Development department since August PDS completed six stakeholder meetings at a county-wide visual preference survey which gives that opportunity to further refine the code we've reached over 120 different voices each stakeholder input was carefully considered based on the problem we were tasked with best practice research on the subject matter and current industry practice adherence to the compliance policies and the County's vision of being Florida's Premier County and stats for professional assessment PDD has done this is due diligence providing the board with an ordinance that provides citizen applicants alike predictability flexibility and it actually introduces a new format to the code as well which is user friendly a summary of the ordinance revision since November 5th with regard to the exemptions section clarification was made for existing self storage facilities um and that they would be applicable to 12 section 1203.2 of the Land Development code which speaks to casualty and repair Corridor specific design standards the purpose was refined on the protection preservation of Economic Development potential for the U.S 41 State Road 52 Corridor that was identified and the three acre minimum was also adjusted to only be applicable to the north flag of U.S 41 from State Road 52. also revised were some of the general design standards the buffer requirements were refined and clarified for parcels and designated corridors for Parcels elsewhere and Connie to ensure ease of review there was a circular reference noted within the draft text that was corrected also part of the effort for this particular ordinance was to update the mobility fee tables with regard to Mini Storage or self storage facilities and RV boat storage the direction from the border County Commissioners was to eliminate the incentive for mini warehouse and self storage facilities that's described on the overhead showing the various tables in the mobility for the ordinance and how they're how the elimination of the incentive impacts the use this is for self storage facilities and then part of the effort here was to actually create a Mobility fee for RV boat and storage previously that sub use if you will was part of the mini warehouse use and was being assessed according to the mini warehouse Mobility piece so here we've created a new fee for RV freestanding RV boat storage and you can see the incentives that are applicable to that land use those are the current Self Storage incentives applied to the RV button storage uh as I may have mentioned today represents the adoption hearing day for this proposed ordinance however given the shortened time frame that I

2:11:11to com on approximately 6.82 Acres Real Property located in the northwest corner of Land of Lakes Boulevard and West area Loop providing for a repealer severability and an effective date so P2 was published in the Tampa Times on September 6 2019 and November 8 2019. thank you good afternoon Amy heiler with Planning and Development item P2 is the adoption hearing for a small scale comprehensive plan Amendment since you already read that into record do I need a Redemption um so we'll move forward the proposal is actually going from uh res 3 to com to allow or maximize the existing commercial C2 uses that are already permitted on site excuse me and to remedy a conflicting zoning that was established in 1986 as you can see the comprehensive plan consistency it is consistent with the following policies specifically policy flu 1.6.1 commercial development which allows for commercial development in a C2 Zone that was previously established prior to the adoption of the comprehensive plan in 1991 and what this is doing is identifying this as a medium commercial node and then also policy flu 1.6.2 location for commercial development states that there's three criteria to actually go to or allow a commercial flu Amendment which this amendment does is consistent with and as you see the site location is in the Central Market area and the location is at the intersection of Wisteria Loop and Lando Lakes Boulevard there are three Parcels that are involved in this amendment the North Parcel is an improved office the middle parcel is unimproved and the South parcel is recently permitted for commercial uses and this is the visualization to identify that the existing C2 zoning that was established prior to the adoption of the comprehensive plan in 1986 and the res III flu that's established this is where the conflicting zoning is uh being remedied and with that we recommend that the board adopt by roll call vote and uh proposed that the amendment is consistent with the conversation quick question for staff um I ask for this to be continued at the last board meeting and hold off of consent um after Consulting with staff and actually having a conversation with the applicant it came to my knowledge that because of the current Z2 zoning it does have they would be already allowed to have Mini Storage which was my concern so my plight has been pushed aside there's nothing that could be done about it they could still continue to build that Mini Storage no matter if this was changed or not so just wanted to make that statement for the record correct so this is a public hearing anybody like to speak to this item the applicant commissioner more fellow Commissioners um Clark hobby hobby and hobby PA 109 North Brush Street uh yes just wanted to

2:32:58not you're going to have to Pony up and and get some serious dental work and it's time for that here I know some people are concerned about the price because they live on a fixed income and I'm sure that there's something that could be done for some type of relief in that regard and some of the streets right off of Little Road don't have many problems because they don't have the traffic that we have further into the development and that's all I have for you thank you for your time thank you sir thank you thank you um yes sir name and address for the record sir Joe Stewart 11627 Fox Run um we live in the house that my animals built in 82. they lived there till I passed away and we moved in in 2009 so we've been associated with the subdivision for 37 years we know the condition of the of the roads and the the history of the the subdivision prior to living here we lived in a subdivision up north similar conditions the economy would not maintain a roads and it was only 40 homes our property taxes were 4 500 a year so we went ahead and established the street Association and we paid for our own Road improvements which caused each homeowner twenty one hundred dollars uh so as lurkers to think that the county would now take over all the roads in the county to maintain maintain them um the cost would grow up considered property costs taxes will go up considerably throughout the county uh and it's it's again ludicrous to think the county would do it we need the improvements to maintain the property values the the continued to degrade the roads aren't improved so we need to have the roads improved and we hope the county would vote in in them in that direction other than one thank you thank you for your time thank you sir thank you thank you anybody else see none any other questions for staff Mr chairman um I would like to see us go out there and take care of some of those potholes that are out there as quick as we possibly can but one of the things that we've talked about adding before when I brought this back was to take Schrader and nature trail and make them collector roads whereas they do a integral part of the uh World Network here and I think I had to bring it before the board before we could just go do that if the board agrees are approves sure commissioner Starkey well no they looked at it but District but there's a there's got to be a way we changed a road status there is yes all right we'll go back to the voting right here where we need to evaluate it and it meets the definition of a collector of road then then we can we can make that change but yeah that's um
2:36:17we do have a process uh an objective process for assessing uh whether local rules fall under that function so we will take that through the process and advice okay in their comments commissioner Mariana I'm going to say that when we talked about when I brought this forward it was one of the things to make this go and make the residents get behind it as well that we're going to take these things and turn it into it I was told just had to bring it back before the board we couldn't do it ahead of time to do it as it came before the board so we got to go bring it back out to do your study to bring it back then I think we should probably just either continue it or just make it subject to that confirmation okay approval subject to the determination that Schrader and nature trail will be visited collector road if that book I would rather continue yes my recommendation would be to continue this item if that if that's going to be right a condition of the approval that's exactly what why we brought it back and exactly what we said we're gonna do some move to continue with limited discussion do you have a date you'd like to see this brought back by as quick as we can get it back here over here well they've got a good mixed media get it done quickly and bring it back the next month we don't meet over here until the second meeting in January okay so I think you went up 21st January 2nd it's really what 21st is the second meeting in January we're back over here all right because we're back to back in Dade City if they have an affirmative decision we can bring it back to the next meeting if they don't have an affirmative we'll wait till it comes back over here okay you've got to continue it to a date certain or you have to continue to the next board meeting okay okay do I have a second okay all in favor all right all right thank you P11 I'll read it as you come up public Industries acquisition resolution regarding the utility system transition agreement between Pasco County Florida government Utility Authority for acquisition the Pasco County Utilities 17.7 million additional obligations transfer expenses to be determined upon closing publication thank you lines on November 8 2019. good afternoon Mike carbala assistant County Administrator public infrastructure just going to give a very brief overview of what we are going to request of the board this afternoon within both P11 and p12 and then I'll have staff come up and make some presentations we're essentially asking for three votes today we're looking first at a public interest hearing so we're asking the board to determine if the acquisition of the aqua fgua system is in the public interest I'll have a staff member Ed Rogers come up and present that information uh you'll hear public comment and then
2:39:05after that discussion and then a vote on whether or not that is in the public interest should we proceed past that we would then ask that you hear item p12 item p12 is the rate resolution in order to fund the acquisition and again staff will make a brief presentation we will then ask the board to accept public comments and then discuss and decide on the matter if that determines that there's a public interest and the board approves the rate revisions then we will have staff create have a very brief presentation on the transition agreement and then seek approval of the acquisition agree the acquisition resolution as well as the transition agreement which will then set those items in motion the systems that we're discussing today this map shows all of the fgoa systems in Pasco County the ones in teal are the ones that we are actually discussing today as commonly referred to as the aqua system consists of a system in Jasmine Palm Terrace as well as Zephyr Shores the systems consist of a small water plant a couple of raw water wells as well as some small wastewater treatment plants and Associated collection infrastructure there's also some land as part of those assets system of Palm Terrace does not have necessarily any water treatment capabilities but also has a small Wastewater Plant as well as a small number of pump stations and spray fields that we would assume ownership of right The Zephyr Shore system out in the Eastern side of the county does have a well is also interconnected currently with Pasco County for for water service there is no wastewater treatment facilities that's currently being provided through an interconnect with Pasco County but there are some small pump stations within the site for all three of these service areas combined uh Pasco County would would assume responsibility for 3 600 new water customers and 3 100 new Wastewater customers so that is the system assets as a whole I'm going to ask engineering manager Ed Rogers to come up and present to you the items required under state state statute for the public interest may I ask you a question commissioner Starkey thank you um can you move it back please yes that's interesting that part of the park is in it and part of it isn't is that correct more this is your District that's mine that's yours I think it is whose district is this in Zephyr Shores in mind I think it's in one could be one or two I'm sorry I don't know offhand the Moore's District go back to this I think it's commissioner Morris District go back to this there's a little there's a little split around there somewhere that it's hard to figure out so yeah it's where is it right on the 54 bits and commissioner Morris District Moore's District
2:41:56I've met there several times okay so um all right I just wonder if that's really an accurate map that part of the mobile home park is in one utility district and part of it is in another it may not be clear from this map as to whether or not they are actually physically connected but utility lines uh service area boundaries can be strange in some in some in some instances they could go from one District the other right they can they across municipality living the road right there and one side of the road yeah okay that was my question just making sure that that map was accurate yes and let's get through this okay and then we'll answer any questions because I have some myself okay all right good afternoon Mr chairman members of the board uh I'm Ed Rogers with Pasco County Utilities engineering uh again Florida Statutes requires that we have a public discussion to determine whether acquisition is in the public interest there are 10 public interest items in the statute uh eight of which apply to this acquisition there's a great deal of detail on that in your board packet um so requirement number one and I'll I'll go through these quickly uh is that we look at the most recently available income and expense statement for the utility uh there's a detailed income and expense statement in your packet um the bottom line is that the utilities net position increased by 750 000 in FY 18 which was the last fiscal year for which audits are available this demonstrates that you the utility didn't spend more than it made so that's a positive which brings us to requirement two which is looking at the balance sheet again there's a balance sheet in your packet it accounts for all assets and liabilities including the 18 and a half million dollars worth of uh of bond debt that's on the system um when you look at that the net position is 2.5 million dollars as of September of uh of 2018. oops looks like I've Advanced the ball a little bit too far there requirement three is not applicable uh requirement four is that we look at the physical condition of the utility facilities being purchased um there's a great deal of detail on this in your packet stantec and staff have done field reviews and looked at the condition of the systems the bottom line is that you know fgua has maintained the system to meet ftep regulatory standards as low as they can they've made some critical Investments judicial judicious Investments since they've owned the system in 2013 but it is an old system so there are you know some things that the county would look to modify if we were in ownership of it um requirement five the reasonableness of the purchase or
2:45:10sales price and terms and it's important to note that there's an interlocal agreement that the county entered into with ftua in 2008. and this interlocal agreement sets the ground rules for acquisition and it essentially says that acquisition is effectuated by the county assuming the system's debt in addition to paying any reasonable and verifiable trans transition expenses so we did look at that relative to other Acquisitions that have been made throughout the state and based on those similar transactions and looking at the ratio of price to uh you know a surrogate measure of value the purchase falls close to the middle of the pack so it's it's not an outlier in terms of that requirement number six is uh looking at the impact of the purchase on utility customers both positive and negative the most obvious positive is that if the acquisition proceeds and Pasco County absorbs the cost the existing Aqua customers could see a substantial reduction in their monthly combined Water and Wastewater bill as much as 46 percent in some cases depending on their rate base the rate structure the next slide has a visual that that shows the order of magnitude another positive is the Environmental benefits and the treatment economies of scale that the county can provide both Palm Terrace and Jasmine Lakes have wastewater treatment facilities with effluent disposal ponds that are at risk for overflows they can discharge to the environment during wet seasons and that's something that if we acquire the system we would have the ability to pull those systems offline connect to our regional treatment facilities and remove that that environmental risk on the negative side there would be Financial impacts to our utility assuming aqua's debt plus the additional Investments that we would make would put a financial strain on the utility that would need to be addressed and we can address that later also under the next item in Greater detail the next slide indicates just the visual of what the rate reductions could be to the existing Aqua customers the red line represents um their combined bill under County rates and the blue buyers represent what they're currently paying requirement number seven what are the additional Investments that we would be required to make or that we would that we would want to make and what is our ability and willingness to make those so in the board packet we provided detailed Capital Improvement budget that was based on stantech's review and stats review of the systems based on our assessment we looked at making approximately four and a half million dollars of Capital Improvements in the first 12 months along with about 2.7 million in renewal and replacement improvements and then after after year one we'd be looking mostly at renewal and replacement issues going forward and over time those costs would taper off and they would be smoothed into our overall low M budget
2:48:28some examples of the Capital Improvements we would make would be Master Pump Station Replacements and or upgrades construction of system interconnects that would be necessary to take Aqua systems offline and tie into our regional facilities and decommissioning and properly abandoning the existing Wastewater plants in the aqua system some examples of renewal and replacement costs would be lining of leaking gravity sewers and manholes programmed water water pipe Replacements as needed and meter Replacements as well requirement number eight is that we look at what the Alternatives would be to purchasing the system as an alternative to purchasing the system we could just decide not to purchase it and the impact of that would be that things would continue largely as they are ftua would continue to operate the system the customers would continue to pay those rates over time ftua would likely need to make system improvements which could in turn create the need for rate increases there's also the alternative of delaying purchase and the the idea there would be to wait until aqua's debt per customer is closer to the County's existing debt this would take potentially a long time because right now Aqua is in year six of a 30-year loan so they haven't really paid it down very far um and then requirement number nine the ability of the purchaser to provide and maintain high quality cost-effective utility service staff is confident that if the system were required were acquired we would be able to maintain a high level of cost efficient service our utility is financially sound and we have a consistent record of Regulatory Compliance so with that we would ask for discussion and that you vote on whether this acquisition is in the public interest thank you for that quick question for yourself or Mr kabala um you initially stated would listen to P11 a portion of it you want to go to 12 and then come back to 11 again right is that correct we would want to come back to approve the the agreements right now are attached to P11 we're just asking to decouple those so we could come back and vote on those later the motion I believe spells out that we would want you to find the public interest and then we would come back after the rate resolution to hear those so yes you are correct okay so how P11 is written now we cannot vote on P11 as it stands you want to decouple those so we would need a separate motion for the agreement itself am I not correct so the recommended board action is to accept public comment and find that the acquisition is in the public interest right if that finding is made then the BCC must consider how the acquisition will be funded by considering the rate
2:51:44adjustment in the next agenda item if funding is approved then the BCC should approve the acquisition resolution to acquire from the fgoa for an amount not to exceed Mr chairman thank you Mr Snyder so the motion for approving the public interest is the first sentence yeah yeah right so right that's that's where after you take public comment if that is the pleasure of the board the motion would be find the acquisition to be in the public public interest and then you'd move on to the rate resolution then we'd have to go back to the but there's the then you'd have to come back to the agreement later yes again just and I think originally I thought there was gonna be three items the agreement was separate they were they were coupled together I was separate public hearing is not necessarily required for the transition agreement Northeast vote on that separately so you can approve a portion of P11 and then come back to the Ukraine yeah okay you can okay excuse me nope okay so we don't speak from the audience you don't speak for the audience areas okay okay he'll explain it to you the gentleman that's walking behind you he'll explain it to you okay so moving on so I just one before we go to p12 um I just wanted to well you know what go ahead and go to p12 but one of my concerns is as we spoke before we didn't actually talk about this I think I think it's been since February at first so February 1st was the last time we had a discussion as a board what's that yes sir February 1st let's see and I understand 12 you need to do the public hearing for the PLS and I understand that yes but we're going to go to our rate increase right after this so again one of the concerns I have with doing the going forward with the rate increase portion today is that this is a county-wide rate increase and people on the east side have not heard this either so I'm just stating that now we'll move forward with the public comment but I want us to think about that before we get to p12. okay so any other questions from the board I don't really have a question but my thought is that we have to approve P11 before we go to p12 because we had to prove it's he said he needed a citizenship right correct so if if the board if it's pleasure the board to find that it is in the public interest yes we were first asking that you would accept public comment towards Mr rogers's presentation and then upon closing the public comment any board discussion and then uh finding of whether or not the acquisition is in the public interest if that finding is positive then we would recommend we move to item p12 to discuss the right resolution I have a motion but

2:58:24um so I'll give a little background as to the rate resolution uh last time utility rates were revised was back in July of 2017 for a four-year rate plan that runs from 18 to 21. uh this resolution we brought forth as the intent to acquire resolution that has been mentioned here before back in February I kicked this off as Mike and Ed both mentioned here before me to support the acquisition of funding mechanism is required to offset the capital on o m costs as well as mitigate negative effects to the utilities Financial structure and the note here is as we looked at that map just a few minutes ago there are a number of fga systems in the county all of which uh forever in a local agreement could be acquired so what we do today could set precedent here for future acquisitions oh back in February in concert in as well as having stantec here to represent the multiple options that were presented before the board the board directed staff to investigate alternative number one which represents a two percent County rate increase on both Water and Sewer that is a one-time rate increase also considered were multiple assessment options as well as some Blended models that called for a different rate increase across the board as well as a 25 surcharge for those that are in the service area that's alternative number three as mentioned and should answer the citizens question that just came up a minute ago the board also directed back in February for us to look into alternatives to offset costs of the acquisition staff did thoroughly investigate those things and one of those things that was investigated was the srf loan through dep it was the agreement on both accounting legal counsel as well as Bond Council it was determined infeasible due to multiple reasons it just wasn't in in our best interest to do that can I stop you yes sir so can you explain for to the citizens in this board why it was not you don't feel was feasible yeah so there there's a clause in there and and if the board requests additional documentation under the county attorney or Bond Council can speak to it but there is a clause in there that uh refers to add Bond tests so that in layman's terms basically gives the ep the right to govern whether we issue uh how we can issue any future debt on the utility uh we requested some metrics and things like that that we could hit um that would allow us to pass that test ultimately they were unwilling to change the language in the agreement that basically gave them the the ultimate say on whether we could how we could manage any of our debt moving forward council is that would you like to add anything um just name for the record please Dwayne Draper Bryant Miller and Olive we serve as the County's Bond Council and that was one of the reasons during the negotiation with fdep that provided us concern on behalf of the county there were several other items as well but
3:01:31that was certainly at the top of the list anything yet it appeared based on the conversations that dep had never used the state revolving Loan Fund for this type of an acquisition and that was part of the problem but but the overwhelming concern was this would jeopardize your fund your your ability to do Bond funding and your rating across the board that's that's correct uh one issue is it's a misfit for utility Acquisitions but there are broader issues that would make it difficult to implement srf funding uh for for any other debt purposes that that you know one is the defaults and remedies are very unfriendly to the county and aren't Market meaning to the extent that you go out to a commercial bank or to the public markets you'd have more friendly defaults and remedies that was an additional issue another issue was there's a requirement of uniformity of rates and so it prevent prevents you from having the flexibility as decision makers to deal with those types of issues in the future and they're also not only your lender in in certain cases but they're also your regulator so there's there could be changes in philosophy whether or not you're having a regulatory issue or not as your lender so there's some subjective legitimate legal reasons that make it difficult to utilize especially that they would have a subject of right in terms of your ability to issue more more debt in the future and so that's a pretty significant issue because today you've had the unfettered ability to issue debt to finance long useful life capital projects so those were several of the issuers that we encountered and there was complete inflexibility in terms of working with us on some of those provisions good questions go yeah if I'm not correct Mr biles you and I had a discussion Mike Cabello and I had a discussion several months ago and you were going to look for different Avenues and this was the Avenue that you took so we look at multiple things yeah srf was the first one which was a loan program we also looked back and I believe commissioner Starkey referenced it last time uh Forest Hills if I'm not mistaken was the last one we looked at that was a state-appropriated grant that was assisted and acquiring the utility unfortunately that was a one-time deal that was run through the state budget that is not actually a reoccurring program we did call dep to investigate if that has been done since they said that it has not been done since in the state of further records so we we looked at that we also looked at a USDA funding acquisition opportunity and unfortunately that loan that's another loan program they don't fund utility Acquisitions those are smaller in scope
3:04:29and size maybe I'll ask commissioner Starkey so the suggestion you made was that an actual appropriation it's um actually you can ask Jack more about it um it's the state program that we use to buy that one uh with that one project right Tim McPherson we got a loan what what was the money you mentioned there was an appropriation so there was we can get you we can send you over the exact details but there was a there was a grant component back in the acquisition of the Forest Hills that did have a component that ran through the state budget that was approached oh in mine in my I don't I'm sorry I don't remember that so four years ago in Forest Hills the the the to answer your question chairman um the the point of this investigation was to see if there was currently any other grant program yeah I mean that would allow for funding for an acquisition for utility and currently Upon A Research in contact with dep and other programs throughout the state there is not one right that we have located I mean obviously I think we would want to look for any any funds where we could to and I think as we go through this process we should still continue uh to do that to help offset because things may become available and we should always try so but right now I think there there is nothing okay go ahead yes sir okay great um so next line um looks like I went to this is a quick snapshot of uh the proposed increase and what it would do to a typical County Bill uh notable is the county bill is at six thousand gallons a month for accounting usage you can see that raises um the average six thousand gallon rate pair will only see an increase of approximately 1.48 per month you can see it doesn't change our standing relative to other municipality and utilities additionally there's a number of metrics that measure utility affordability I'm showing you the most strict metric that we typically utilize there are others that I'll mention here this is the awwa America Association metric that measures things against two percent if the utility bill is two percent or less relative to median household income even with the increase this would still put us well below that at about 1.87 percent it's notable that the EPA calls for two percent water two and a half percent sewer for Combined metric of about four and a half percent we're significantly below that you also have a number of metrics that are done by each one of the rating agencies with three and looking at all their different scorecards we rank strong in each one of those categories in terms of affordability even with the rate increase proposed today detail table that supports the graph that you just saw and this is just another graphical representation that takes a look at other County
3:07:25area utilities and the percentage changes that they have going on the notable here is we work with santek to uh to create create this graph and so this is on best known information at this time some of these are forecasted and not all are approved but this gives you a good graphical representation that if if sorted in descending order this would put us the only one beneath us would be Port Richey that is staying staying flat but this is our recurring for your structure as compared to others in the area at the at the Tampa Bay Water yesterday Hillsborough County did say they're voting on a massive increase in January so just to let you know most of them are any all right in summary this is a one-time two percent water and two percent rate increase on existing rate uh existing rates to generate Revenue support acquisition mitigate impacts the utilities Financial structure as we covered the average six thousand gallon month rate pair let's see an average increase of just shy of a dollar fifty a month and you can see that based on all the affordability metrics we discussed today it still makes our rates are continually affordable for our customers that's a good question so next year you're going to bring a similar item to this board for another acquisition will you be asking for additional rate increases at that time for that acquisition tip yes sir So So currently the structure that was discussed before the board back in February and then again today is when you go back to um or this slide that represented the multiple choices alternative one represents a two percent across the board which is what the board directed us to look into that is a one-time two percent increase in the year of acquisition for each acquisition and how much is that annually it's about a dollar well it's a dollar what it was about a dollar fifty for an average six thousand a dollar fifty that dollar fifty for a resume yes a year 1.50 a month I'm sorry dollar fifty a month thank you yes ma'am and it still keeps us way below many of the others for for a two percent increase you're saying it's a dollar fifty it's a dollar fifteen per month so yes as you add on it obviously increases two percent then three sewer so that's that's for a combined bill that dollar fifty is for Combined water and sewer bill together okay commissioner Wells just and just so I'm clear if I remember the exact wording um our Direction was you was for you guys to come back with the max of two percent not two percent not to have that be the top priority and I know I met with staff I know they're saying this isn't ranked um and just you go back to the other scale with the one and a half three and
3:10:34a half yes sir please oh you're talking about the um relative deal utilities yes so so the one and a half and three and a half is what we're doing now they would be a percent added on each one of these so it'd be two and a half four and a half it'd be it'd actually be two percent per so so right now we based on the structure that we have right now one and a half three and a half went in October and then right now if this is approved it would be a two percent one-time increase on both the water and sewer rate yes sir all right for a total for a dollar fifty then again any other questions the time before I take public comment commissioner Mariano thank you Mr chairman I mean I'll tell you years ago we tried to look at doing direct access uh direct purchase and this utility wasn't cooperating let's say a few other ones such as lindrick one wasn't cooperating the one down in Trinity wasn't cooperating so it was difficult to make something happen the f2a provided that vehicle the residents here as we bought these systems through the fqa we thought that we were going to try to turn them over as quick as we possibly could it was all designed to go back into the county system they were just the vehicle to make it happen uh frankly I wish we were here three or four years earlier but I want to I want to salute this board for bringing this forward to make this happen it's the right thing to do these people have actually paid into the system actually subsidizing the county systems anyway if you figure because they've been paying money into our system as well so to take these properties and all of a sudden bring these rates down such a dramatic way give them better quality quality is going to help the values of all these properties that's going to escalate property values which we'll see a huge tax base on the back end I know it's not tied to utility but it is a benefit for all of Pasco right so and and I I would commissioner Starkey um and I would agree with what commissioner Mariano said you know there was a time when I was um hesitant but I've seen how these prices just keep going up and up and it's it's um and because of that I have talked to other Commissioners from around the state and I actually had a conversation with um Adam Putnam about this and he used to be on the when I brought this up I said if if you become governor this is a huge issue that you you need to deal with and he said my gosh we were dealing with that back when I was on the city council and Polk County I don't know what city council was on yeah and understanding this was a huge problem then so um what I've learned from many of the other Commissioners is they didn't go the fgua route but they went ahead and bought them and so what many of these citizens have experienced over the years is they paid these really high rates and didn't see their any Capital Improvement
3:13:25really in their neighborhoods and then fgu fgua came and um I I know um I know there's been Improvement but not not not to the quality of what we have in the county so not only do we need to help these citizens with the really high rates we need to get these systems fixed quickly I know next year when the Gulf Harbor system comes on and some of the others that are aged aged and need help it will improve the environment around them the water quality and so I think it's really important for for the county to to go ahead and bite the bullet and bring everyone into the family which I agree we should have done this years ago and I think we have super low taxes in our County we're still one-third less two-thirds less than Hillsborough County and Tampa and I don't think anyone will even notice this except I know the people living in these communities will celebrate and will I know in this community it's a difference of hundreds and hundreds of dollars and that means a lot to the people in this community and probably the one in yours commissioner Moore hundreds and hundreds and hundreds of dollars a year thank you um would anybody like to speak to the rate increase no okay so you know so there's just one thing I have a concern about and a second ago we did complete the public hearing determined there is a need there's public interest which we all agreed on to acquire the systems at the same time I'd feel better to let the entire County weigh in on this too when it comes to the rate increase itself not in the public interest side but on the rate increase because remember this is a rate increase for the entire County not just for the citizens that were taking over the utility for um so I had quite a few people reach out to me not in reference to take another facility the the utility but in reference to the rate increase after we had discussed it back in February so I guarantee they'd have time to speak um I think the right increase we should at least allow the people on the east side to have input if they like maybe nobody shows up that's fine and dandy um but at the same time I think the rate increase we should at least hear it on the east side of the county too I don't know anybody else thinks about that that's my it's a it's a County right rate increase again separate from the public interest portion of it but it is a county-wide rate increase typically when we have these rate increases we're talking about these rate increases time and time again on this dice or we're hearing from staff or we're having these workshops over it since February this is the first time we're hearing about a rate increase you know you did your job you did research did your due diligence weren't able to find another mechanism and I
3:16:20trust that you worked hard on that so now we are here like commissioner well said up to two percent is what we said we do um across the board to make this acquisition um but now we're hearing that citizens are hearing the rest of this board is hearing I'll get you the rest of this board is hearing that there was no other mechanism to assist with this and we're going to have to go to the top end of what we said we would probably we would be willing possibly to do so I personally think we should at least hear the rate increase on the other side of the county before moving forward with a rate increase commissioner Oakley yes I I'm just curious on how many customers in water and sewer do we have say on the east side against what you have on the west side because I would think the majority of people are from Center back to the west side that are on water service and Sewer because my district is pretty much that whole east side and it's it's pretty rural well you've got Central customers there Central Pasco I think about my district it's Central Pasco all the way to Zephyr Hills and that's the probably the very large majority of especially with the growth going on of the customers that would see the rate increase yeah I'm just wondering if there's a way to tell so commissioner I'm not sure we've bifurcated our our customer base uh by by geography I would say much of the new growth there's a lot of new growth to the to the east of I-75 um as well as in the Central and 54 corridors so a lot of your new growth would be there yeah um you know I I'd have to get back to you to let you know how those numbers well I'm saying that I mean I don't have a problem in waiting and hearing it on the other side of the county because that's my district yeah and they should all they have the right to be heard same way but I also at the same time think that this is a very reasonable increase and um a worthwhile project for our citizens so yep and I could and again I appreciate that too I just think you know again how many customers tell them we have again Mike uh approximately 120 000. okay so 120 so if you said let's say 40 was on one side of the county you're looking at 50 50 000 probably at least East because you have a larger you have a larger number of people on the west side on that are sitting under private utilities I.E golf harbors and areas like that that aren't on Pasco County Water you also have your cities you know Port Richey Newport Richie that are not on Pasco County water so that shows you that there are a very large number of people under Pasco County Utilities but this world East Central to East yeah based on our operations I mean there is uh you know the higher density on the west side so you know that will stand the reason that maybe more percentage on the right side correct so again we decide there's
3:19:13public interest rate increase I would like to see if it's moved at least to the next meeting I'm not saying dragon on I'd already talked to staff previously this it's not going to hold anything up um what they're doing they'll be able to move forward in a timely manner does that create any issue with us if we commercial Wells had his hand up and I agree with the chairman again we're all here because we agree to move forward with this it's the right thing to do we just I just think we need to be as transparent as possible even if we don't like what they say one way or the other we still have a tough decision to make and or should I say it's an easy decision really it's the right decision but but I it's not going to hold anything up but not the other part Mike yeah so Mr chairman I was if if the board is to entertain a motion to continue we would ask that you would continue p12 and P11 because you have to sign the agreement correct second part of the second part second part of P11 second part P11 we can approve the first part of p11. you've already done that we've already done right but the second part number 11. just just as a matter of yes that didn't cause any issues I mean that that's okay or because we're not not in terms of of the acquisition schedule okay yeah I don't want I don't want to hold three weeks in one of the weeks is a holiday week yeah so yep you know if we're going to do that I wish that was done that way because with the people that are being less affected are right here uh these people paid higher rates because the board did not make a move that I think was the right move to make between taking them over and and getting them quicker uh these people have suffered suffered and suffered uh if it doesn't go well on the other side I want to still make to bring it back but I really think there's enough evidence here there's enough benefit here I mean we didn't even get into the pictures of where these people so where everyone's been down to a ranch road where the water floods over and pollutes the Gulf of Mexico that's not good for anybody uh when you see the way these systems were set up they were set up very poorly in the way the county was set up Pasco County utilities was set up to take over these utilities that's why it's here it's why we're here so these people waited and waited and waited and yeah if you want to wait three more weeks this so be it but it's not going to affect the timing they said so I know but if it doesn't go well over there I'm going to say that we need to continue back over here this actually doesn't go in force till sometime in 2020 right isn't that right no but we need to give the notice I think part of the acquisition is a notice that we have to give fgoa so I mean it we can't drag it on forever right yeah right so yeah we we have by agreements 180 days notice that we have to give to the fga so we have to give them six months so that would be effective drag
3:21:48it out too long I mean you're costing those customers that we want to help right so that's why well we said the next meetings not drag it out for the record I'm sorry Mr I would say for the record just I'm comfortable with it right now well what I think you'd rather have though I think if you're comfortable with moving forward cohesiveness and not nay votes I don't think we should be making a decision until you hear from the public I already called for public comment there's nobody yeah yeah I call for it again yes perfect yes that's okay yes I already did that okay so I would I can't make the motion or well I could but I'm not going to but I'll tell you this I feel comfortable with this issue and personally I would like to see it move forward and not not hold up on it and I'll make a motion that we approve it today well I don't want to so now I'm gonna I'm gonna deny this now what do you mean you're gonna buy it well I'm just telling you making up your own rules commissioner you what oh my God if somebody says through this process we need to be as transparent as possible I think all five of us are willing to vote three weeks from now in Dade City to move forward with it with the maximum of the two percent which is why we're here we've already agreed on that I just I I again you do it I just think it makes sense I think it's the right thing to do we do it on everything else Commissioners to make sure we hear from both sides of the county it is affecting everybody in the county again we've already committed to doing it it's the right thing to do for these folks we've seen the water quality we've been dealing with this since I first got elected so we're but I just think it's the right thing to do to listen to the folks over there if anyone shows up they may not so you know I mean you made a motion a second but at the same time I'm going to let you know that I will get you in a second I will let you know that you were setting in my mind almost a precedent of not letting a rate increase being be heard on both sides of the county and that's on you so when the constituents come and they start calling I will say reach out to this commissioner in this District because they weren't willing to let it be heard on this side of the county when we ask for that that's not the because anyway I understand what you're saying yeah I want with that I'll withdraw my emotions okay um so this was publicly noticed I didn't get one hey what are you doing I had no comments so I'd like to make this suggestion because um I I do think in the future um we do need to be having this on both sides and we have another one coming up that is um
3:24:43the uh lindrick next year so I would like to move forward with this one but suggest that with the lindrick acquisition we schedule this one to be heard on both sides so that would be my suggestion I this is a dollar fifty I I don't think I don't think it's anyone's going to be in opposition to this I don't want these people have to take off another day of work and drive to the other side of the county um they were here for it already was passed yeah the person they're here for was already passed the whole comment on the rain increase I think they um if there's no are you saying we're going to purchase it whether there's a rate increase or not no okay no no the purchase the acquisition would be contingent upon the rate right so they it does affect them very much so they're all going to have to travel over to Dade City and this is I I just think they've been through enough and I think we should finish this today but in the next ones I definitely think we need to um take more um have more care to be sure that the east side is included I don't think as commissioner Oakley was starting to say I don't think I think a large portion over there is on a different system or on well so um I feel pretty confident I'm not gonna and get anyone enraged at me and I'm up for re-election I think we should move forwards if I could and it sounds like you're going to withdraw your motion anyhow but and thank you for doing that again no one really asked me my opinion a month ago on this if I would know I didn't know it was coming forward until a week ago I would have said and I assumed it was going to be on both sides of the county commissioner Stark you just said it we need to do it the right way again it's important to me we're all on the same page and I think at the end of the day so three weeks now we're all going to vote to do the same thing which is take care of these folks it's not going to hold it up the right thing to do is to continue it to Dade City vote on it over there and we're done and these folks are happy everybody's happy I mean again going back to the past when we talk about the rate increase portion we do allow people to be heard huh yes sir I will withdraw my motion I feel very comfortable with my motion and move it make a motion to continue it to the meeting in Jeffrey or Dade City our next meeting and at that point in time vote on it for the betterment of all the citizens second so motion and second to continue the rate increase portion to December 10th through third what is that December 10th 2019 that'll be here before you know it yep it will have a motion a second all in favor aye all opposed same sign motion passes by zero okay so thank you for that so the second part of P11
3:27:40will come back to us after the rate increase I think we would need an emotion to continue that as well okay okay I'll make that motion some emotion to continue these second part of P11 to December 10th 2019. okay all in favor aye all opposed same sign motion passes thank you thank you okay moving on we uh that's it for our regular agenda back to miscellaneous commissioner Mariano you still had more I think yes sir something I'd like to just have before the end of the meeting yes sir okay yep um so to I was at the Habitat for Humanity meeting last night and I will tell you they are concerned about what's going to happen to the project the infrastructure the Habitat for Humanity we could wait a second commissioner so you can be heard come on [Laughter] okay Okay you Okay commissioner I'm good okay thank you so the Habitat Humanity project from leisurely and vandoren um of the conversation was happened last night they did a matrix as far as studying where the value was with the things that we're doing and I get to the end and I wanted to I made mention about you know let's talk about the Leisure Lane project and their concerns are they've got the 51 Lots uh they lost 50 000 on the first one they sold and if I can encourage you before we even really get too deep into discussion I want everyone to go drive down those roads go take a look at what's there now you'll see 51 Lots down there but I will tell you there's one area where the lady was on NBC she had the white trailer and they broke her hose they were like stealing her stealing her water and just you know living their life right in their backyard uh the Connie was able to tear down a tree which we thought would maybe make them move I will tell you what happened was they came back but they came back with a grill they came back with couches and there's more people out there than ever so they're really abusing that area and what's going to happen if we don't do a massive thing to do something big in there my opinion is the values are going to stay low habitat would keep on losing money which they're not in the Customs you lose that much and it's going to be hard to get that project ever to go so I think we should do a meeting Workshop meeting with habitat talk it through and let's go find a way that maybe we can put a planet together that we can try to implement with the state next year to kind of make some things happen because right now the way it's going they don't want to build any homes if they lose fifty thousand dollars a home and I don't see I can't justify them to change they're also going to be looking for us to kind of reduce our
3:30:47fees which we've already taken the transportation down to zero but they're going to be looking for the school board as well to get some help to make that happen it's a huge opportunity we've done a lot of great things I think making the move of buying those lots was a first great move but we still need to do more otherwise it's going to kind of languish along to really make it come to fruition um Jack um I don't understand why their school impact fees and um Mr attorney if it's Redevelopment it's not a new home it's not a new Resident it's a it's a new home on a lot so I don't understand why they would be able to collect a school impact fee they shouldn't I tell you what we'll we'll study that issue closely because the first one is what they're talking about they just did all the numbers to that one there and that's what they that they said that's what they said they were hit with Okay so let's make sure they're not because they I you don't get a new impact fee when you're building a new house on on a lot that was existing um second I do think you know maybe that should have been included on our legislative agenda um and thirdly when we all kind of blessed merging with the Pinellas County Habitat I thought it was because they were out of lots to build in Pinellas County and they had money so what happened to that story that we were told they actually at the same time we were like buying ours they had bought another one I guess down there and they got another project like ours that they're actually doing down there so so we're not going to have um enough from that organization here well they'll put more money into it and invest with us but at the same time this situation here they can go down there build a home and not lose that much money so have they built or started another home since we did the go the harbors house there's four more permits that have been pulled so they're pulling four more permits and so there's funding for four homes and then there is the sewer line from the rich New Port Richey does connect to those so that that is in progress to to keep on moving it's just after that I'm concerned about what's going to happen I think now's the sun to start looking at it with a little bit more information that we didn't have last year that we have now well I I agree with you that we can't let it Fester because um even just now lunchtime I saw homeless people camped out in front of businesses in that area on the way home to pick something up so yeah it can't stay the way it is now okay so maybe I have a County Administrator reach out to Habitat and let's try to set up a workshop it can be a little bit later on but I think it's we need to take a look at it uh why don't we meet with him first and see if we can develop a plan we can bring to the board they're anxious to do that thank you
3:33:29um and I just want to kind of go over one thing that was going on actually no I got a couple other things too with Shady Hills uh Mr County attorney Highlands unit number 10 with what we've done after the meeting is we're walking out for this afternoon people said what are we going to do about the people they're going to apply for permits for mobile homes to try to like get under the wire across system is there something we can make a motion to to kind of protect that from happening no the only way to protect that from happening is to declare moratorium would have to go through the ordinance process but by the time it gets done yeah okay you're gonna you're likely gonna hear the rezoning before you can get a moratorium all right how how quick do you think we can get this thing back to the board can we get it to the next meeting that would be a question for your planning director not the County Attorney no remember that the rezone has to go through the Planning Commission too and has to be advertised so there's more than just put it on the 10th agenda right in fact I think the next Planning Commission meeting is not until after the 10th it's on the 12th the 12th correct so do we have to have time can we get it I mean I want to just expedite that's all and this this is not a complex one well I don't have the full schedule in front of me Victorious pito's Planning Development but I have been in communication with the zoning administrator to get that ball rolling today okay so we're going to move it as quickly as we as we can forward okay and I can follow up with you with what that schedule might look like okay thank you thank you all right at our last board meeting we had the meeting about the BP restore act money with the allocation to Port Richey and I want to just kind of give a little bit of History when Port Richey first came to the restore eye committee they did a presentation we told them as they focused on water quality Etc we told them think big come back with the project they came back with a 12 million dollar project before the commission uh so at some point it's it's swung back to a six million dollar project again water quality was a big part dredging all the canals getting the water flow at our last meeting we asked the city to work with us to go work with Swift Mud to work with Army Corps of Engineers dep to try to work all these things through I talked with Brian Armstrong the head of Swift Mud after we had our meeting he told me because the the allocations had passed for the Cooperative funding by October 1st we had to we couldn't just put something in afterward he says it's too much of a household to go he says but if you have a project similar or connecting to it it's something that could be looked at to go forward
3:36:07I talked to Dave delosch who's doing the Port Richey outfall which is where we get that state expenditure fund money it runs all the way from Magnolia Valley and key this list of this keyword all the way down to Siesta Lane which is right past the Suncoast mobile park which is the southern part of the outfall where the water goes in so the connection is there Dave delos was going to try to give me some information to it but he says he sees no problem combining those two to go through because the canals that are on quiz drive those five canals that are right there all will take that water and go out one of the key things that's in the restore Act is if you're going to make an improvement on stormwater flow and protect the residents and get water to flow it's a big bonus part so when the scoring system was done for Port Richey they scored against all the other things that were out there all the other projects are out there that was one of the categories that was very strong where they did very well on so as we go forward with this I I wasn't happy with I listened to the council meeting that they had I wasn't happy with the comments I was hearing I didn't get a lot there wasn't a lot of accurate information as far as things that could have been said that didn't get said so it got convoluted there was one gentleman that spoke at the very end that seemed to nail it on the head what he basically said was look the County's trying to help you get more work done and get a bigger bang for the buck by using other sources guy says I think you should look at doing that so I think we've got the right approach doing it I know that everybody's calm that we kept the money there for the city but I just want to say that we do need to work Swift Mud is from what I can tell you from what our response says we've got great potential to make that happen and I'll tell you the dma site that they have they're going to have to spend all that money in the class one landfill um whenever they do a dredging project dep's first move is to say put it in the in the class one landfill that's the like default position I've talked to two separate two sets of Consultants that both say that could be negoti negotiated out I've talked with sand expert that things that could be negotiated so I think we can do a lot better for the city than just doing the one Canal like they're Toronto do and do the ones they want to do and then get these other ones that'll really help the area and as you saw the presentation today I think the water quality aspect of this whole thing could go even higher and better than we ever thought so I just want to say I am trying to work with it was progress from the meeting that after our meeting and I think even though the city of Port Richey I didn't like the way that meeting sounded I still want to keep on moving to get everybody together okay anything else sir that's awesome County Administrator well I'm going to go back to him before I go
3:38:46all right I just have one item just to let you know that your facilities team was awarded received to award last last week from the national facilities management and Technology at the national facilities technology conference in Orlando for personnel management is really regarding the interact the Innovative and best managed approach to training their team members across the board for not just um the creation of the skilled based Assessment program which allows them to be trained not only in their main skill but in other skills actually improve their customer service to the to the county as a whole so they can solve more than one problem at a time so just want to let you know that they received an award last week I haven't seen it yet no I'm assuming it made its way back from Orlando yeah otherwise I'd have it here so congrats good job that's excellent that's good Mr steinster County Attorney's Office as you're aware at the last uh board meeting you had a conditional use that which was withdrawn um and Ms Sims would has talked to you individually but uh would like we'd like some direction on where we go with that particular range since it doesn't appear that they're going to abandon it right code enforcement went out there's been no evidence that they're tearing down the infrastructure that they've built either in the vertical or horizontal infrastructure of the actual range Christy Sims County Attorney's Office um I can move forward with making them comply with the technical codes as far as building and site development um or I can move forward with our position was that they needed conditional use in order to make use of those facilities um I would do that by filing an injunction either which way I went but I did want to make you all aware that there is the potential if I attempt to enforce the zoning regulation or sort of jumping without a parachute because there's not a lot of case law out there to guide us on the scope of the state's preemption over the actual shooting use in this type of zoning district and I don't like to file litigation when there's a potential that we could be counter sued and incur attorneys fees and things like that um this is one of those situations where I can't really tell you that I have a high level of confidence I'm not saying I have a low level of confidence either I just don't have enough information to advise you one way or another so I'm looking for some direction do I just enforce this with respect to the building permit and site development portion of it and ignore the zoning portion which would if they meet all the technical codes
3:42:17allow them to keep shooting or do I take the position that they're required to have a conditional use and stop the shooting um and and incur whatever risks of litigation that might bring that's real quick yeah I've talked to Christy about this same issue my opinion is we've got an ordinance there that says that we have to have infrastructure and and a permit to allow that honest agricultural property that we need to move forward at stopping it and seeing that once they take that out and decide they're going to do it just on the ground state law provides that ability to do that on agricultural property we can't stop that but as it is there disobeying actually our ordinances that we've got set here in the county as far as doing the infrastructure that needs to be taken out so if I need to and I'll ask uh Mr steinsteiner if possibly I need to reach out to our legislators to see if they can do something about an issue like this when it not necessarily the shooting part of the law because I agree that they are to be able to shoot on agricultural property but then you still need to abide by the County's [Music] ordinances and infrastructure that we talk about and need permits for unconditional use I think we need to set some up that way I also heard in Hernando County that a very similar thing where somebody went out and set up a gun range without any permission or any anything to control it I mean if you if this gets by then who's to stop a rifle range or whatever kind of range and we need to protect our citizens out there from these guns and I've been asked before about temporary rifle ranges in the county for a day and there's no way in the world I'd ever prove something like that because it's dangerous and so I guess I need direction we need to go to the state level for some help for County ordinances to abide by not necessarily for the gun issue itself Mr Marietta I concur we need to enforce our current Ordinance Center in place and if there's a way to go back to what we first cited them let those fines accrue from that point in time all the way through and if you want to try this state well here's the difficulty as it stands up until today based on what I hear from y'all we would not have given them a building permit up until now because it our position has been that that use violates our zoning now if you want me to go forward and enforce the technical codes and not pursue the use I I can do that but this is this is what's so difficult in articulating this is um you're going to end up in the same position of litigating the zoning any way you look
3:45:32at it right I mean as a practical matter right unless unless I advise um the building official to issue a building permit regardless of our position or interpretation of the zoning regs if it meets the technical provisions just difficult I I stubbed commissioner Starkey would like to get to Mr yeah so um I agree that they need to take down the unpermitted structures and I agree we're going to be in a pickle if they come in and get a ask for a permit because I think some of these rules are not in our hands however in talking with Christy um the residents do have a remedy and that is a civil suit especially I think the gentleman with the business next door um with the horses but that's not something we can get in the middle of that would be I believe a civil suit what's the word that you told me private nuisance a private nuisance so I personally don't think you should be able to shoot and I I'm I have a lot of guns um but I don't think you should be able to shoot something that could go for miles into someone else's property without some kind of safety behind you know something that stops that from going a long way but I don't think we set those rules here I think they're set in Tallahassee and in fact we used to have a local ordinance that said that you cannot fire a gun within I think it was 300 feet of occupied property and the legislature came in and preempted us and we had to repeal that so I think this is a a little bit out of our hands um so I think we should deal with what we can and that is unpremitted structure has to come down the residents can take it up and um and if you know if she's out there shooting an AR-15 which can go two two miles how far can those go well no off top of my head depends on a lot of things she's on video shooting an AR-15 but I don't think that's something we can legislate so I have seems like commissioner Oakley commissioner Starkey for an agreement do we have an agreement down here about the structure commissioner Wells you come up for the zoning not the conditional use because you're telling us we it wouldn't stand up in court no permitted structure is what they're referring to is Right require them to remove the unpremitted structure is what I'm hearing from one two three so far that's all we can regulate for now Mr chairman so the issue is that your regulations which are consistent with the legislation is you can't have a range without a conditional use we we determine that the range is created because they built a structure without a permit right so so yeah you can go after them for the building permit but then if they apply for it then what are you going to do because they're still not in compliance
3:48:51with your Land Development well she can't build a rain she can't build something that makes it a range right correct this is right this is how this would play out I would go to court and say you cannot make use of this range that you have constructed because you don't have the appropriate building or site development permits a judge would agree with me and say go get one they would come apply for one and then we would deny it based on the fact that they don't have a conditional use then where does it go from there then we're right back at the beginning which is do I sue them saying you're violating our building regulations our site development regulations and our zoning regulations we're not there yet okay so well I think we need to go at doing just that and also reach out to our legislators to see if something can happen to help support counties and their ordinances against gun ranges so the direction from this board right now needs to stand alone so the direction from the board near the district commissioner your suggestion was do you need a motion what or do you need just Direction I mean what we're looking at what we're looking for is we don't normally unless unless it meets the the conditions that you've already given us authority to file injunctions we don't normally file an injunction without coming back to the board in this case we also have the the at play the state law preemption which will likely be argued in in any injunction of action that we take and so that's that if you wish us to proceed as we normally would the next step for the county attorney's office to take is to go into court for an injunction yep and and I've and after the after they withdrew I had at least two Commissioners who said how are you gonna what are you gonna do to stop this I don't that's why it's back I don't think you I don't think you win that I think that's how do you win on the injunction when so if if you don't fight for supporting your own ordinance that you have that says you can't put in an infrastructure without a conditional use then anybody can go in and do whatever they want to with that is that what we're talking about here because I but I thought we were going to make them take down the structures and then see what happens well how are you going to make them take down the structures without going to court for an interview well you got to do the injunction to do it that's okay the injunction is to make take down the structures but but as part and parcel of that you're we're going to have to argue that they couldn't put the structures up because it's a gun range if if they would have voluntarily complied and taken the stuff down and continued to Skeet shoot there'd be an entirely different
3:52:13recommendation from the county attorney's office but at this point you've got an ordinance on the books we they went through the process they left the process at the very end at the very end but they have continued to operate okay I I heard that um she fired they fired once out of the structures but they're using a a hand you know when when you say I don't know what you say pull and the bird comes out or the Clay comes out I heard they're on the ground which is allowed all I can tell you is that I had code enforcement go out at the end of last week and there was no evidence that they were removing the vertical structures or the range that they had constructed so what did we tell them to do chairman if you if this board wishes us to write a demand letter to them to to deconstruct it and see what happens then if they if they don't deconstruct right we're going to be back here and asking you the question again but but I need some direction that if you all get complaints you don't come to the county attorney and say what are you doing about it so I I mean the the first step if if you wish is to write a demand letter to the to their lawyers and say this is you withdrew as part of that withdrawal take everything down yeah and see what happens I would like to do that yeah let me ask one question yes I don't think it's really apples apples but using this as an example if somebody were to put a roof on a dock in a canal which currently isn't allowed and they built that structure what would we do without a permit because they built the structure without a permit all right what would we do in that case are you asking I'm asking the county attorney's office I'll use an example if somebody Builds an unpermitted structure for example okay unpermitted structure okay unpermitted structure if I if somebody if let me keep it going if on 54 somebody built a structure without a permit right what would happen enforcement options we would file an injunction we could give them a notice of violation to go before the construction board um we could issue them a citation um Etc what's the most extreme thing we could do in that case Under Our Land Development code and ordinance find them every day that's what I'm asking I'm asking her because I'm trying to get to a spot we can all agree on here well I mean from a financial perspective um wait six months you know warn them and wait six months and then find them or past morning stages every day okay we're past morning stage what will we do we would find them we're past warning stage
3:55:33we would find them every day until they pulled the structure if they did not pull the structure down after a certain amount of time what would we do then file an injunction okay that's what I was going to ask I mean this started with the code enforcement action right right well where is that and let me make it yeah where are the fines this is what happens whenever there's a zoning question and somebody makes a complaint about zoning if they are then going through the process to come into compliance with the zoning regulations um both Mr Moore and I sort of abate the enforcement action to let them come into compliance that's they're not willing to do that so after the last meeting when they walked out the fines should be accruing and I'll have to check to see if there was a citation or something way back then but this is a little bit different because again what we would be finding them for is something that we are never going to give them we're I can't cite them for not having a building permit that we have no intention of issuing to them they build up a structure without a right that we would not have given to them because I'm going to talk about back to what I asked a little while ago if somebody did that on say State Road 54 you had two options we could find them and we could file an injunction both assuming that we would have given them a building permit that what they were doing did not violate the zoning regulations okay then that would be the answer to your question but this violates the zoning regulation that's our position okay so that's where we need to do the injection see why I get paid the big bucks [Laughter] um typically I don't come to you with every lawsuit I file because I have sort of a general idea of what you want me to do and you've said hey if it's a sheriff's issue as well go ahead and I know a number of years ago I came to you and I said ah you know I want to be able to file these injunctions without coming to you every single time right permission but because of the gun and the preemption issue here you know I really felt like I needed to get specific Direction um on this before I go too far down any road well my opinion is we should I my opinion is we should it's a jet or move forward what the county attorney's office is suggesting we do because I mean I don't the five of us not being an attorney long and never get to a spot that's fine without moving forward I'm coming away with right now is that what you want me to do is issue a demand letter to them and see what the response is yeah okay structure right yes but I have a concern and I would like for the county attorney's office to research this a bit um because I want to see if other areas have been sued um for disallowing people to shoot in there
3:58:50I know but you're you're kind of asking if how far we're going to take this right I'm asking yes yeah I the bottom line is I'm asking what is your risk tolerance right mine's not mine mine is uh usually the guns win and I just want to hear some um I want to know where where my chances stand if we go to court I don't I really didn't want to say that here because I don't want them to listen to all this you I can't answer that question there's been too little litigation about it you know we had this kind of come up before you Commissioners were on here but Jack will remember on State Road 52 with that guy that had set up were you were there and he had the gun range in the back with the with the berm and you know Pilot's country I think was very upset I I it went away it went away because we took the conjunction action I think he went away he had some other issues I think yeah [Laughter] I've gone back and read them review um we won in that injunction case um but the distinction is he was teaching classes there and there was a commercial aspect to what he was doing so not exactly the same but um our position is still our zoning administrator's position is that you require a conditional use when you construct a gun range and they clearly have constructed a range I I'm I'm just trying to get a an idea of white y'all's risk tolerance well if it's a if if she takes away the wooden structures and she's shooting from the ground is does that is that still arranged all day she can shoot all day so I think we have adequate Direction at this point I would apologize for being long-winded but after y'all with that last discussion I'm not apologizing so the other you have directions right yes okay the other the other Quest I will make this very brief from his Sims the other question is uh the county attorney's office wishes to bring back a presentation on how the high return enforcement process is going we can either schedule that to be done during your meeting in December or we can ask the administrator when there will be an available Workshop in January depending on how much time you want it how much time do you think you've won we think that a presentation will take between 20 and 25 minutes and it just depends on how much discussion the board wants to have how much Direction you want to give us regarding your goals for next year and how things are going it seems like a workshop item no we're having a workout not meeting it meeting well we said 20 25 minutes for the presentation then we had a discussion I do that I haven't seen you what's on the agenda for the 10th but I think we can probably do it inside that meeting you think it's 20 25 minutes out we could probably do it but I need it
4:02:06yeah that's fine yeah I didn't know if you don't need to see anyone's up scheduled already 20 25 minutes for the presentation and then whatever discussion or questions are they okay with that we had one this morning that was 20 minutes long yeah we did what date your meeting in December board meeting in December is what I'm hearing the consensus is we just didn't want to that's what I was going to talk about put what could be a workshop topic on a regular as a regular item if if the board would rather hear it so you may see directions January um that's fine he'll look at the light he'll look at the agenda and see what the lightest is for regular in the morning and then we'll go from there okay cool thank you all um thank you thank you Christy so clerk's office I'm sorry thank you so I'm gonna go to the clerk's office and go back to you said you had something else okay and then I got 20 minutes um as you know Veterans Day was on November 11th and in celebration of that our office is offering free passport photos for veterans and the military if they are going to get their passports so that's great and also on November 23rd it is National adoption day and the courts in Pasco held adoption day on November 8th 17 families adopted 22 children on that day isn't that awesome I love that and so just trying to bring awareness to adoption in in Pasco and there is currently I believe eight no 600 children in the State of Florida that are awaiting adoption last thing I just want to say something fun our office had a constitutional essay contest for fifth graders in Pasco and we do have the top three and I'm presenting Awards to them at the school board meeting tonight so I'm really excited about that excellent congratulations thank you for that so commissioner Oakley commissioner Starkey and then I'll go I just had one thing I wanted to say is this last meeting before Thanksgiving I want to wish everybody a Happy Thanksgiving staff and all the more members uh thanks so much appreciate working with you and enjoy being with your family and make it a great happy holiday I don't see you afterwards thank you so much I appreciate that commissioner Starkey I have made a note you know I was very concerned about what we heard about hepatitis A and um I have been in contact with Mike nape here at the health department I've asked them to come and make a presentation to us um I don't know if it's a presentation or Workshop I suggested presentation he wants to talk to us about it what what's the board's pleasure I think that's fine I think that back here and Kathy want to win I think I thought personally but I think it's better to hear from him I would agree with you commissioner because from my understanding those numbers have been going down right not up
4:04:59the happy numbers in past so we're going down not up still they're up they're high yeah but but they're still honestly all right then I'll just ask him come present to us and then we can decide from there if there's any anything that we need to do and um I got um I wanted you to know that amp skills was the only private training program in the state that was awarded a grant from the Department of Education six hundred and eighteen thousand dollars so thank you commissioner Corcoran they came down and audited us and sent their number two guy down and took a great look at us and um we're very excited for that award also Pinellas County Schools has um uh the Education Foundation there has nominated am skills for their um business of the Year partner so um I think we're up against some other competition but we'll we'll see if we win but that's very nice for them great thank you commissioner and that that gentleman Ryan was that was at the metmen what was uh he got a job at Paul aeropower we have two of the three homeless that have been employed one one I might need everyone's help with to help that person get employed there's some other issues there excellent matter of fact just so you know Mr Stark if I could uh I talked to texted Ryan and I said now go apply for Habitat for Humanity to get a house oh that's a great idea what a great excellent well thank you all um just a couple things FY 19 tourism numbers tourism numbers uh FY 19 over 1 million visitors in Pasco County that's an increase of 7.6 percent over the previous year tourism had a total economic impact of just over 652 million dollars six one six point one percent increase in tourism supported 7 800 a little over 7 800 jobs in Pasco which is a 5.2 percent increase so again I want to congratulate that team for just all their efforts they're doing an extraordinary extraordinary job and I only see those numbers going up in the future of course with everything that the tourism is doing this board staff the team's doing that our community is doing and we're having obviously the Wiregrass Ranch sports complex which will be online towards the we need to be in next year okay well we'll call yep I will and you know Cruise out there one day and do that so those are good um updates still more mural program we brought that up last week turns out staff actually did go out there and uh with Clearwater so I would assume they'll probably detail either us at a commission meeting or the Commissioners individually especially the West Side Commissioners I think they like what they saw they had great conversations there so great American teaching I'm doing it tomorrow so I want to thank staff and the team for your items that you contributed to give out to the kiddos I think I'm doing three classes or three combined classes tomorrow I don't know if anybody else is doing it
4:07:492 30. perfect perfect beautiful so it's a fun time so I want to thank obviously staff from Andy and Terry been putting bags together the last few days so thanks for all those items this morning was it was talked about um with home about homeless numbers um I know a couple of the constituents um mentioned that pasco's county is the highest in the state and some other um uh they made a few other statements that I'll just put it this way they're unsubstantiated and they're not true so Pasco if you remember the account last year was 894 which is down significantly um Pinellas has 2612 and hillsborough's was 1 650. so there's the numbers yes we want to get the population down we will continue to do that work with Kathy work with Don work with all our providers but I did want to say that for the record those are those are the true numbers that were done in the accounts um that's less than a third of or almost a fourth of what Pinellas County has and a half of what Hillsborough County has so when you hear those numbers and you heard this morning I don't know where they got them from because they are not right more continuing on what you're saying there too some of what we heard today referenced California and many of those States out west have passed ordinances that allow for the homeless to live on the side their sidewalks that is not going to happen here and so that is to compare us to those those kind of um cities uh is not fair because that's not happening here yeah so once again thank Kathy your team everything your all the efforts you know you guys have done to help with that the numbers I'm sure with the numbers will continue to go down so with that we're adjourned thank you all so much yes Happy Thanksgiving too [Music] thank you [Music] foreign
