The board approved a comprehensive plan text amendment for the Pasco Employment Village covering approximately 2,304 acres near State Road 52, and rezoned 130 acres at 74020 SR 52 from agricultural to ECM PUD for up to 1 million square feet of light industrial use by 3KS Family Limited Partnership. Commissioners also voted unanimously to remain in the national prescription opioid litigation settlement negotiations and rezoned 211 acres at Trobee and Dowling Lake roads from AC to AR5 rural residential.

4:11based in Pasco we perform education training services on overdose response we do this at methadone clinics we give out a narcan to methadone clinic patients because they're connected to the community of active users and they take that information in that narcan and they go out and they save lives with it in the last 18 months a hundred of our overdose traversals a little bit over 100 have happened here in Pasco County and you've got emergency services personnel that are well represented today and I think that they would tell you also that the opioid overdose issue has become a crisis of epidemic proportions so we are a family-owned business we are a nonprofit that pays for everything out and I have here with me my mother and father who both work for safe exchange one is a former Marine the other is a retired nurse and together we're gonna tell you a little bit about why we want to do this service why we think that Pasco County should be the first County under the new state law that just passed in July to start up a syringe exchange program and how we are prepared to help you guys with every step of that process to help communicate an understanding of why this is probably the most effective public health policy issue that you can take action on to address the opioid crisis and the spread of HIV and AIDS in Pasco County and and how it's gonna cost you nothing at all everything that we do as safe exchange is paid for out of pocket by me including this program so this is something that we feel very strongly about Dianna's about to speak in public for the first time in decades and that is a testament to how important it is to her thank you Miss Dianna's well hello my name is Diane's while I live at 1842 tumbleweed Court in Wesley Chapel Matthew went over briefly what we do what I have in front of me are some statistics concerning syringe exchange programs a lot of this was put out by the CDC the opioid crisis is fueling a dramatic increase in infectious disease associated with injection drug use reports of acute hepatitis C cases rose 3.5 fold from 2010 to 2016 over 2,500 new HIV infections occur each year among people who inject drugs I'm gonna assume that that number since this stat ended in 16 that it's gone up even more so because with the opioid crisis as it is the government's done a good job in preventing prescriptions for opioids world we what's being prescribed by doctors however people that were addicted are now turning to IV drug abuse instead so that's just compounding the problem syringe exchange programs are associated with an estimated 50% reduction in HIV and HCV incidence they are also a bridge to other health services even currently as we're distributing narcan we've been able to refer people to health care providers we are like in connection with one position that is basically served in hepatitis C patients for a minimal a very minimal cost a more less expensive than it would take for just like a checkup he's actually a very huge humanitarian so we
7:54are referring people to him oh okay syringe exchange programs help support Public Safety by reducing the number of dirty syringes that are disposed of in an unsafe manner as you know that there there are areas in hepatic Oh County where syringes are prevalent on the ground where children have access to them and it's quite dangerous syringe exchange programs prevent overdose deaths by teaching people who use ovo opioids in any form about the use of naloxone which is nor can which we would continue to do as we do with syringe exchange we would also continue to distribute nor can cost effectiveness I'm not going to go into a lot about that basically there is no cost to the taxpayers everything including the syringes comes out of private money and syringe exchange programs of trying to talk really fast but they they service the community and as far as finances go because just one case of endocarditis which is common among IV drug abusers cost a small fortune and I are going to distribute all these facts to you if I may most soon receive a second mr. Chairman I think it'd be great if they linked up with Miss Pearson okay good followed by Charles Lily and Jeff Farlow hello y'all names Roberts while out of 18:42 tumbleweed Court in Wesley Chapel Florida I'm a volunteer with safe exchange in Tampa I volunteer my time I'm retired and I want to help with the opiate crisis that's going on right now the syringe exchange program will help alleviate a lot of the AIDS and different different things like that what was what the problem is is that y'all probably think well we're gonna just give out syringes to everybody it's not like that it's like if you turn in a dirty needle you get one back if they take in more we the program in Miami that they have is a pilot program and it's done by the University down there their County Commission has not authorized it yet no but no County Commission in the state of Florida has authorized needle exchanges in their counties yet since the new law has taken effect I would like Pascal County to become the first county in Florida to authorize this so that the other counties could go ahead and do the same there's some protocols that you know we'll go into about how to implement that and all that what you all need to do in the state of Florida you can go ahead and go into a drug store buy out the syringe no problem you'll need a prescription for it you can just purchase it what happens is is that people feel that it's a police officer stops them and they have it they gonna get it charged with having drug paraphernalia when the needle exchange program takes effect and we were able to do that they won't no longer feel the need to toss their needle on the ground for fear of being arrested for having it that's basically but I needed to tell you all and I just hope that you all look at the information that was presented to you and understand what we're all about
11:57we're not out there trying to help drug addicts we're out there trying to stop diseases we're out there trying to stop children for picking up dirty needles from seeing them on the streets and everything you know and we're out there to help these people who have drug addictions see where they can get help for HIV and Hep C and all the diseases that associated with that we give out literature we give out narcan North can is a big thing too a lot of people didn't realize that North can actually reverses opiate somebody who's in a diet that they're actually dead - almost you know and without the narcan they don't read no more reading is what stops and that's thought he died anyway that's what I wanted to tell you all and I hope you all understand what we're about and implement this in North County thank you very much for your time thank you mr. Charles Lilly followed by Jeff Harlow bless you please state your name and address for the record search man Charles Lille 184 to 5 Lawrence Road Dade City Florida 3 3 5 2 3 first of all I like to thank you all for having me I want you to know that you have a fine local Dade City Police Department and the sheriff's are awesome I want that to be known I'm not here to cause trouble I'm here about thug life coming into our neighborhoods I've dealt with the sheriff's and my parents have my mother's passed away my dad did two months ago being harassed by people that are on drugs they're thugs and it's gotten out of control the sheriff's have been great they're really trying to help but just like I was told their hands are tied they can only do so much that actually us the innocent people have less rights than the criminal after 15 years of my parents are being harassed I'm now paying off their reverse mortgage and buying that home and I swore to them that I would never let this lie and my dad was a Marine and I'm a disabled vet and I mean business but I thank you and I asked for your help actually I'm beg for your help well we have is I won't mention gender or race but we have people that play exceedingly loud especially on weekends the boom boom music that am F F I will tap the police I sell my drugs and explicit behavior that they'll do to females and while we're cleaning our yard and pulling weeds we have to listen to this our Sunday meals are listening to this it has escalated now to where they're doing donuts in front of my house I'm being threatened because I don't condone we have junkies there selling drugs they're physically violent they are the bottom feeders of Davis city and the reason I know this and I'm ashamed to say this in front of you all when I lost my family my home and everything I turned to an alcoholic I turned into a street person want to be alive anymore unfortunately I fell into the devil's playground I found out from the inside but these people are thanks to the Lord Jesus Christ I found my way back home I don't condone these people and I need your

Petersburg good morning commissioners I'm currently a student in SPC this is their public policy program and I have been studying for my capstone project the possibility of passing an ordinance in Pasco County to close the gun show loophole before I earn background checks and waiting periods for firearm purchases on gun control on gun shows the Florida Constitution end of it amended the was amended by a ballot initiative in 1998 empowered counties to pass ordinances to close the gun show loophole the ballot passed with 70% of voter for support currently only eight Florida counties have passed ordinances although federal law prohibits certain people from purchasing firearms fugitives felons those convicted of domestic violence offenses and illegal aliens among them the gun show loophole allows these people to purchase firearms with no background checks at gun shows while licensed gun stores are required to follow federal requirements for background checks I've spoken to Pasco citizens and interviewed community leaders to determine if there's interest in such an ordinance I heard from gun owners and non owners alike that they think gun show purchases should require a background check gun gun owners expressed their support because they are purchasing firearms or legally and they're getting background checks themselves non owners support this because they want to live in a safe
18:29community where criminals can easily obtained guns I bet with a gunsmith and a licensed gun store owner who graciously walked me through the background check process and explained that most background checks come back in a very short amount of time he recommends to his customers that they go through the background check and titled transfer process even for private sales he charges a fee of $50 to provide both these services you may ask why any county should do this on its own why not wait for the federal or the state government to move to take care of it the reason I'm here today is because I believe this is a small change that would have a big impact on Pasco County I don't believe the federal or state government is going to act on this anytime soon it's an incremental step that can be taken now to ensure criminals are purchasing firearms within Pasco County the ordinance wouldn't have an impact on the ability of those who are legally allowed to purchase firearms under federal law criminals can of course cross county lines to purchase firearms and a county that doesn't require background checks at gun shows passio county is one of these counties three nearby counties have these ordinances Pinellas Hillsborough in Orange County Orange County was the most recent county to pass this ordinance in 2018 and gun shows still take place there within the county but with the added security of background checks keeping firearms out of the hands of those who are prohibited from purchasing them is a common-sense approach that will make your community safer with these reasons I recommend that the Pasco Board of County Commissioners consider passing an ordinance it would require background checks and waiting periods on firearm sales that take place in public events I posted information on my project website at Florida gun reform comm that includes all of the existing ordinances thank you alright thank you he comments anyone else here wish to speak this time seeing no one that ends the public comment and now it's time for a resolution they have one resolution this morning yes could Pascoe fire-rescue please come up to the podium I'll dress up yeah resolution number 20 - 0 0 - resolution by the Board of County Commissioners of Pasco County Florida declaring October 6 through October 12th Fire Prevention Week in Pasco County and supporting the many public safety activities and efforts of Pasco County Fire Rescue throughout the event whereas fire is a serious public safety concern both locally and nationally and homes are the locations where people are at greatest risk from fire and razz Pasco County Fire Rescue responded to 323 residential fires in 2018 and according to the National Fire Protection Association on average twenty two thousand seven hundred and eleven people perished nationally in home fires per year an R as three out of four fire deaths occur at home each year in the United States and rasz Pasco County residents should identify places in their home where
21:33fires can start and eliminate those hazards andraz working smoke alarms cut the risk in half of dying in home fires and Russ Pasco County residents should install smoke alarms in every sleeping room outside each separate sleeping area and on every level of the home andraz 2019 fire prevention week effectively serves to remind us that we need to take personal steps to increase our safety from fire andraz Pasco County Fire Rescue is dedicated to reducing the occurrence of home fires and home fire injuries through prevention and protection education by encouraging all residents schools recreational facilities businesses and homeowners associations to be aware of their surroundings look for available ways to I'm sorry look for available ways out in the event of a fire or other emergency respond when the smoke alarm sounds by exiting the building immediately now therefore be it resolved by the Board of County Commissioners there's a Pasco County Florida that said board hereby declares October 6 through the 12th as fire prevention week in Pasco County and supports the many public safety activities and efforts of the Pasco County Fire Rescue during fire prevention week 2019 Dunn unresolved in regular session with a quorum present and voting the seventh day of October 2019 those lights and motion passed chief Casey thank you very much mr. chairman members of the board Scott Kathryn Fire Chief Pasco Fire Rescue I'm going to turn it over to no I'm just kidding walk into a burning building but [Laughter] for those of us that are in the fire service industry every day is fire prevention day for what we do however you know at the national level we like to take one week out of the year and really highlight the importance of fire safety so that happens to be this particular week as we recognizing that with the resolution and we appreciate that currently today we have 21 professionals many of which are standing behind me that make up our community Risk Reduction division and that's the group that's tasked with making sure that Pasco County is the safest that can be and they do that through commercial building fire inspections they do that through public education we do fire investigations in that group they're very very busy it's not just this week it's all year long so we also have with us today our Deputy Fire Marshal our our fire marshal couldn't be here so we've asked a deputy chief from if you have you want to and talk about some of the things that was commissioners mr. chair our messaging starts with your support so we certainly appreciate that this year the theme is not every hero wears a cape plan and practice your escape so throughout the week we'll be highlighting for you our social media platforms some of our videos that showcase some of our community heroes throughout the county reiterating our messaging as well as over 40 special details scheduled throughout the county where we're going to reach over 2,500 people in person contacts disseminating

31:15great entertainment and that's their attraction they don't need to spend money and advertising as much as others would do but that's the only way they can get money they're going to try to work with the West Pasco tell you're better to try to get a tracking of nights but when we get a 10-day event that puts that many people in there this almost a hundred years old now I think it's something we need to give it better backing to so if I'm gonna say we're gonna go spend a million dollars on this advertising when I know what event would benefit more just by getting the money which actually stays in this community I think it's something to look at when I look at they were just up at Sunwest parking lot matter of fact we had a accident up there today where someone I guess passed out to some reason and we didn't have the infrastructure to take out the immediate middle median with a teller was there to do tolls which we want to clear out for a safety people to have to get in easily it took a took a little effort to go around I've got a dirt parking lot off to the side that if we just put a one base coat as we go through the RFI process would be a much better use for money and if we're going to make a destination management push I'm gonna say for the west side fixing that parking lot putting sand on a green Key Beach and dressing it up a little bit would make a lot more sense for the west side and going forward this week and I was up it's like my rotary had a getaway up at Homosassa nature's Park with the RV park Sun West is actually looking at put an RV park up there where people gonna bring their boats up there they can go along the scalloping which they everybody acknowledges by the way Commissioner Wells captain wells then our scalping was so much better so we were to position early gather a lot more positive things but I would rather see us spending more money especially especially on the west side to actually putting something in capital as opposed to this now it's our far as the other monies that you're looking to spend out there for the non-competitive bid I'm wondering how many of these firms that are on that list are local and I got to think that we do have some local talent that would benefit from this so I couldn't see that from the whole list but how many are how many local firms that we're looking at as well okay mr. chairman yes before Adam jumps in Adam can you hear me okay so I think it's an Adam will reiterate this it's important for for a destination management organization to a Versailles outside of the area our goal is to bring people from other parts of the nation for internationally to visit Pasco County that's where your local businesses are going to make their money putting heads and beds spending multiple nights here that's how the west side is going to make their money that's how the people that rent boats are going to make their money that's how the restaurants tell the small businesses and downtown New Port Richey are going to make their money your round yes we have some great festivals across the county who
34:15north-south-east-west responsibles and in this county but remember what we discussed a few years ago which everybody agreed on is there there has to be a point where you're self-sustaining if you can't be self-sustaining I and this is across the board whether it be kumquat festival pigs in the hills chasse Co multiple other other events by now you should after there be five years ten years or twenty years or 90 years you should be able to do your own drawing I mean just like any other business I think of it I put it think about when the SBA when they help a small business get started that's to help get them off the ground after year three if you can't stay in business there's a problem so these dollars are to bring people and that's what we have an academy jump in here I'm taking I know I'm probably stealing your thunder a little bit but I either Superman agency that are professionals and go out there they're an advertising agency that knows how to draw people here now I did question a few things along you know and some of the board members agree with me I thought we should do a little more TV but they're working through that and I say TV outside of the area not even not in the state of Florida but and in certain markets and then especially in the Midwest where we know we can draw from and for a certain event so when we advertise and we mentioned things like chassé go and stuff like that people all over the nation are seeing those things when they come to our website we drawn to the website they're seeing that we're having these events ie each ASCO I come co-op fest wherever a festival may be so this organization this marketing plan helps market those events too but we can't continue to give money to organize a to be honest with you and we said this on the dice the only reason we're still giving some of these festivals some money's is kind of for goodwill to be honest with you they shouldn't need it none of these are nobody's nation and needed and I'm not picking on one I'm talking about if you've been in doing the festival three four or five years it's time for you to handle it yourself you know it again so I'm gonna heads and beds too so think about that all right but again the purpose of economic developers not just heads and beds it's also the turfs development part of economic development just kidding if they get ten day event and they got people there every single day packing them in in their biggest hook to bring them in over and over again just have a bands it's different from the marketing that we get set up and I agree everything you're saying as far as how to advertise how to bring a Mainer but I'm telling you you've got a local event here that is a 10-day festival keeps all the money in the community and the way they make it is just like the roller skating rink when we had them yet they were the number one draw here for years they didn't need our money to go advertise as a DMO across this nation they had the draw to bring the people and yet their draw was by having the

39:46going all the way down that chin which is ninety one hundred ten feet wide seven to twelve feet deep at mean low low I could create another amenity there for an attraction that when you go advertise something you can show something now I appreciate this will we put the Sun west money in there we put the sidewalks in there they look great they're gonna protect us and I'm glad we're working the water ski show but there's more money we can put in capital for the west side that'll do more good on the green Key Beach don't take a look at it and I'm glad we talked about putting that Road in there in the car path in there but disapprove it's can be done there too so when you do have something to go advertise you'll have something to show them that'll be attractive that's my point with all the money we're spending on this year I think we need to go take another look at what's going on out there because it's going to help the west side so I both I think you both have that I'm not sure Commission Mariano that what you want to do it is that the tourism money is necessarily the right pot of money and I think it raises the question once again that we're underfunding our parks department on the capital side no doubt about it and I think pretty soon I think we're growing up enough that we need to talk about another kind of entity alts Arts and Culture whatever you want to call it but we need another vehicle to help support cultural and cultural events in the county lots of other counties have it for example we have lectures on the lawn I think when we get going with the the park out on anklet River Park we'll have some festivals out there and and since they're you know the the motel folks are the ones paying the tax and so I believe they should be getting the bulk of the advertising efforts but we do want to promote other activities in the county and let's see figure out a way maybe a next year's budget that we set we start setting aside a little bit of money to promote cultural events and arts events in the county that would be my suggestion and we fund parks better I think yeah I think Adam can actually tell you talk to you about all the things is they're doing to promote the west side in reality in reality it's being promoted more by his team than things on the east side and he can explain that all right before I get it down let me bring up one thing to Adam when you when you talk talk about if you have potential to bring in local companies to do your social media stuff that you want to go advertise as well as well [Music] we sell [Music] great lunch and we're still working on brand awareness Stamper in and doing a brand audit it's the nature of power tightening and the competition that's impractical advertisers generally serve a specific audience each trade or region a profession or even a topic process for 5 or $15,000 each phone so when it comes
44:29to chess - yes sir that's the only sustaining events we have together but over the course of us funding chess would guess that we ate them close to 700,000 dollars over the past eight or nine years we should check that matter the way we do our business we end up their business model accordingly state statutes and what would give me the best return on investment the rule events even though chance bill brings in thousands of 1000 of guests or consumers or visitors to the event per day we have to keep in mind that during peak season they're already here they're already here and this isn't a chapel in that the chaplain visit was in Maine that would be a different story if those numbers came back and you hundred thousand people over ten days another little thoughts of information we're spending two half years ago we were spending three hundred and seventy thousand dollars on local events and festivals which wore pushing our metrics at all and we were only spending around ninety thousand dollars on marketing which we are tasked to do according to state statute we have to change some things and now this model is actually working for us our KPIs are moving north instead of staying stagnant so we are actually moving forward in pursuing a destination for visibility mr. Jim I just think it's important again remember for us to promote countywide but you're talking a lot about the Westside now somewhere but no way for us to promote those assets along there we have to add Versailles outside the area to draw them in that's how these businesses get to continue to be successful that's how tourism is gonna grow in that market and that's how we're gonna help again eventually fill the hotels they're gonna rent the boats you're gonna go to the fishing guides are gonna go to Sun West they're gonna go to Tesco they're gonna go to the restaurants we want to draw people in I mean we all do some travel or have done some traveling our lives and I pay very very close attention that more now than ever what I see advertisement I get kind of giddy when I see something when I'm not nor if I comes in the Northeast in seeing places in Florida advertising oh wow that's cool they're doing it right there they're hitting the target market up there and that's what you want to do it's gonna only be beneficial to all those businesses for I mean and this is you know in the advertising they want to do I mean they don't just throw a dart at a at a board and just pick something out I mean there's there's a lot of time and energy and effort and and due diligence it takes part and what's gonna work and if it doesn't work you don't keep doing right that's why we changed some things I come this immediate side so we stopped it we put a stop to it done we're gonna do that internally now because it can be done better that way but I just think it's very important when you look at this these dollars if we don't do it tourism is gonna decrease

1:00:25another I will say on my honeymoon my husband I spent some time in Zurich and they had a needle distribution program it sounds like it might have been different than this one but created a really big problem for the city of Zurich that became needle Park I could look out the window of my hotel and watch hundreds of people inject themselves and then when that when the police or whatever would show up and they don't scatter and then as soon as they were gone they come back and there would be needle wrap words all over the ground and it became a magnet for for drug users but maybe they have a better program where you have to trade one in to get one back I can tell you in my district there are places where they find a lot of dirty needles so if there's if there's a way that someone can tell me that helps get dirty needles off the ground I'd be you know but willing to listen I'm a little nervous too but so I think maybe it's something maybe you guys can look into that I will be having an open house in the eastern part of my district and people don't realize that I go from the coast line all the way to boost B downs and so I spend a lot of time over on the west side in the holiday area and listening to those constituents and so I'm not I don't have town halls or meetings very often on the east side so this is my attempt to reach my constituents on the east side although anyone's welcome it is at the Holy Trinity Lutheran Church and that is Wednesday from 6:30 to 8:30 and we're going to be talking about transportation we'll be talking about paving assessments code enforcement long-range planning planning the Sheriff's Office will be there and we are reserving last time we were there we had a very full agenda and weren't able to take a lot of questions but this time we will be sure to be leaving at at least half an hour for constituent issues and questions next week I'll be going to Washington as chair of the federal committee we have 90 commissioners from the state of Florida going to Washington DC and the it's going to be extremely busy we're going to be visiting all different kinds of agencies and congressman we will also be going to the White House on Thursday and meeting with the White House officials that has been just a great resource for us and I am very impressive they reached out to misters from around the country this time last time it was just Florida this time that's Florida Georgia maybe in Alabama I don't know three three southern states where the commissioners have been invited and so I'm looking forward to that and I think that is all yeah that's the yes sir that's the that's the video that's play that video now team did a great job on it thank you sound with it there is so today we're here for the groundbreaking for the universally inclusive playground at Wesley Chapel District Park it's a obviously a great day of Pasco County and we had amazing turnout and it's just an exciting time in this county it's gonna be even exciting time
1:04:22for our children what you see a lot is you see that playgrounds actually have some component of a DA accessibility but they're not always designed specifically from a piece of equipment to equipment to equipment for special needs children so that's this playground follows those seven principles of design and and and from the lead from the ground all the way to every piece selected is specifically for those children to use one of the things that I noticed was a void and that void was a place that was inclusive to all kids gave kids of all abilities a chance to participate and reached out to keith wiley and he was excited about it all in thought about funding you know always a challenge sometimes to fund certain things and reach out to some community partners like the West Chapel rotary the Lennar foundation an Advent health Wesley Chapel and between the three of them they all donated one hundred and twenty five thousand dollars towards this amazing playground we're gonna have great [Music] good job to the team and they're good very nauseous that's a great thing coming in basket mr. Bowser li ER with our staff and the Suncoast Recovery Center which is applied for a demolition permit we thought we're gonna be all set but because of FEMA actually not FEMA regulations we overcame FEMA regulations does a guy has an appraisal that can work but because of our code which I want to bring us back to go change this it'll take you know it's Oh probably January actually if we have an outside appraisal on a piece of property that I want to be able to use that to allow us to go you know rebuild a building if the numbers work out and the staffs gonna be able to bring that back it's just one thing in our code we actually can think work um FEMA which is crazy but we have our trouble with our own code so Dan you could bring something like that you're fully briefed on it yeah the Code

1:13:27message out there's the judges so what don't attorneys don't realize we we have to we listen to both sides all day long and make decisions so pick me next time just say a little bit about that last time I left i sat there half a day to find out that I knew both attorneys and you the judge and you wandering attention was the City Council personal Zephyrhills and I'd given funds to for his right piece so I got the one judge I didn't really know but but I don't have anything else Jeremy yeah I'm sorry can I share something good this is beneficial for everybody you can thank you hey Mark can I bring you up you okay is this too early okay so the reason way to bring mark up is obviously you know the illegal dumping initiative that this board has obviously they're very supportive of and a few weeks ago there was a video released of a couple gentlemen pulling up in a tractor tripping I want to say well as a yes the Box trough van with a van the truck on the back up to Walmart and we got it out there to press who did some TV print and we have some success now because those gentlemen have been caught yes they were in fact they were pursued although at the plant city where the business was established and they were fined $500 and had to clean up and the investigation was done cooperatively between the Esso and our code enforcement what I had just found out is that the determination of whether or not it's criminal is based on the the willingness of the state the state attorney's office to take it on that it rises to that level to where it's worth their doing right and that's generally made on-site by generally the sheriff because they understand that more than we do because we're based on ordinance so we will encourage the state to file criminal charges in this matter we can we were encouraged we can indeed encourage yes we weren't currently determination this comes back as to whether or not they feel they can make back as we stated we would like to pursue these in Criminal Court under the state dumping what illegal dumping law right considering that it's on camera that they dumped multiple couches which I would assume they would definitely weigh over 500 pounds in other items too so it will highly encourage them to pursue pursue this as a criminal matter where five hundred pounds could be a felony so the good news is to that regardless of what the citation is whether it's ordered and this is what I just got off the phone with it regardless whether it's citation by ordinance or by the state it is documented as a crime which means that we've really accomplished what we intended to by getting them they do have an arraignment date set for December 13th - and that is I just checked with our attorneys and that's based on the citations not necessarily because we just have to learn and continue to encourage with our County Attorney's thing to pursue those criminal charges
1:16:57we cannot pursue criminals we don't be encouraged to do that the citation which was issued is a county ordinance violation we understand she is non criminal I understand that we set right here on this board and said going forward if it's if these cases will be we will make sure that these are put under the state dumping law correct that was the direction of this board that's correct thank you and that would be up to the Sheriff's Office so we what we could still obviously encourage that because we have obviously were the ones that hold the records of the video that will be turned over and we have the code enforcement officers that located the people with the great support from our citizens that multiple citizens were able to report that they knew who this company was at a plant city yeah yeah so it's going yeah I just want to make sure that we're doing our side to follow through what we said we told the citizens we be doing yeah from what I'm seeing a cooperation between ESO and our code folks has been outstanding and they're they're pushing this as far as they can for sure from what we're seeing excellent essentially brought that reminds me that in my district on Saturday October 12 we have a clean-up day at Micucci in my district and Dunn Street be set out and clean up a lot of areas that's just come on Saturday yeah it's all awesome this have been very successful we've got our successful okay with that I thank you mark appreciate all the work for lunch and be back at 1:30 [Music] good afternoon everyone I would like to call back toward the Pasco border County Commission meeting of October 7th 2019 I would like to remind everyone present to please silence all electronic devices if now time for our public hearing items which we will start with p1 and I have no one signed up yes p1 was published in the Tampa Bay Times on August 23rd 2019 Christie Simms with the County Attorney's Office commissioners this is the final public hearing on some tweaks to our donation bin ordinance it is an ordinance by the Pasco County Board of County Commissioners amending the Pasco County Land Development Code section 5 30.20 to donation bins for providing for applicability repeal or providing for severability inclusion into the land development code and an effective date as a reminder these well miss Fernandez was kind enough to shuffle this through the LPA and the saira process for me these are amendments to section 5 30-point 22 that are recommended by the county attorney's office for legal reasons upon adoption assuming that it is adopted today by the board this started off as a high return enforcement project so we will get with the appropriate personnel and building and construction services who handle non construction permits and get the ones that are legally placed on two properties shepherded through the permit process and as I told you before the ones that have been placed or dumped on to properties without the property

1:24:40901 point six Street design and dedication section 901 point nine Street naming and addressing section 902 point to stormwater management requirements section 905 point two landscaping and buffering appendix a definitions and other sections as necessary for internal consistency providing for applicability repealer providing for severability inclusion into land development code and an effective date fees this set of modifications proposed amendments was presented to the horizontal roundtable and interest to parties group on August 21st 2019 and on September 11 2009 teen additionally this went to the local planning agency on September 26 2019 who found the proposed amendments consistent with the Pasco County Comprehensive Plan and recommend that approval to the Board of County Commissioners I'm gonna go by some of the sections but a lot of that changes in this and that are proposed in the land development code is as a result of the 2019 legislative session specifically there's some changes regarding review timelines to different sections of the code including 300 and sections and 400 as well and those are due to changes that were in Chapter 1 to 5.02 to Florida statute basically we had different timelines in our land development code currently chapter 1 to 5.02 2 basically states that if it's a staff staff level approval it has to occur within 120 days if it's an approval that has to go through a public hearing process it's 180 days our code did not consider that one of the considerations in our code is actually that one of in one of the reviews the applicant has up to 180 days to return review comments and that's not consistent with 1 to 5.0 to 2 so we made some changes there another other other changes include changes in table 304 - 1 which basically adds requirements for noticing of substantial modifications to preliminary site plans preliminary development plans and masquerading requires mailed notice for those modifications another change is section 402 point 2 zoning amendment and PUD it adds a provision that unless otherwise determined by the county administrator it doesn't need currently all items that are within the coastal high hazard area if there is any type of change increase in density or a change to development beyond what the applicant can currently do under the current zoning district that would require a master plan unit development district and this there was a determination made by the director of planning and development that states that that's not with a complan intended all of these are reviewed timelines of section 4 3.1 preliminary development plan residential we are changing the term site development permit to development approval because not all approvals are done through a site development permit there are all development approvals and that's for consistency throughout the land development code section for 3.5 construction plans it says an unintended consequence of what we did in land development code amendment 32 which is
1:27:52to create a no improvement plat and sorry that says 34 it's Lena Velma code amendment 34 that's that was the change we created a no improvement plat or a plat and I a construction plan is not required for those now that we have a no improvement plan section for 310 it creates a new section what it does is basically brings all the landscaping information out of nine or 5.2 and brings it into the landscape plant section it's completely rehashed it's the same exact information just doesn't it shouldn't be a nine or 5.2 it should be in a separate section for a landscape plan so excuse me there's no new language no new language in it yeah section four oh six point eight garden plan permits this is also consistent with chapter six oh four point seven one Florida Statutes so basically it adds the definition and it adds home and garden vegetable garden on residential properties as a permitted use and that's based on changes in the 2019 for Ana legislative session section 522 point nine connected city master plan it basically adds modifications to some metal requirements that was something that was an unintended consequence so just recently we had a submit all for a connected city master plan and they wanted the the applicant wanted to modify their submit all requirements we said well you didn't put that into the connected city section of five 22.9 so we're adding that back into I was an under the unintended consequence of creating five 22.9 section 527 c3 this is a legacy issue so in 2007 with the the comprehensive plan in 2007 a land-use called com commercial was adopted was a new land use so basically it adds that folks that are within calm future land use can seek ac3 zoning which is current practice section five thirty point twenty three this comes from the food policy Advisory Committee where permits are required for community gardens with structures market gardens with or without structures or community farms with structures it just clarifies that right now permits are required for everything the Food Policy Advisory Committee brought down those recommendation also it adds home garden and vegetable garden as a principle permitted use so in residential districts and that's consistent with six oh four point seven one florida statutes section six six oh three connected City stewardship districts this is a change in six oh three point you point eight which adds at the discretion of the county administrator or designee the connected city property owners members group or a science may be a lot to use planning fee credits above and beyond one hundred fifty thousand annual limit currently there's a one hundred fifty thousand annual limit to use the planning feed credits seven hundred this is again inconsistent with one to five point oh two two Florida Statutes it changes the review timelines 901 point for substandard roadway analysis and mitigation this is actually in the in nine or one point four but it wasn't in
1:30:53the applicability section and we put into the applicability section where your Clinton zonings that generate more than one hundred daily trips are subject to substandard roadway analysis mitigation section 901 point six point eight point five this comes from the horizontal roundtable where that there they have this products that are these are attached townhomes they wanted to have a minimum width for their driveway of nine feet currently in the minimum driveway width is 12 feet so this is for this new type of product that the horizontal roundtable the development community has out there 901 point ninth Street naming an address scene basically adds that street names that have a secondary name such as a vanity name or memorial name shall not use that name for addressing purposes it's confusing to the folks who are responding to to calls to locations so they can have the vanity name but they cannot use it their address stormwater management it this is something that your you've probably seen with all the master plans explaining how you can have fences within the setbacks and fences within easements we're just codifying a standard practice so basically it acts at adds exceptions that do not impede drainage and setbacks so it gives standards for fences with in drainage easements and fences with incept setbacks again it's standard language 902 point to pay stormwater management requirements it removes the requirement for gutters this is also at the behest of the development community the Tampa Bay Builders Association requested this I know if I could for that one item you know when all the canal homes going up and down the coast and I talked to people at years ago used to be able to swim in the water but now because of lack of flushing because maybe Sultan in the canals it's it's not flowing I know some areas have actually worked with having gutters would actually go from the houses and actually go into the canals to help with flushing is that something that could be modified down the road if we decided to go that way so all this section does it removes the requirement and necessity for gutters it doesn't mean that they can't come in and install gutters on their own it just currently there is a requirement for a gutter on a type a graded lot and that requirement has to be met before the certificate of occupancy has issued this adds the removes that as a requirement as a necessity section 905 point to Lansky landscaping and buffering and this is something that we talked about in the past during different rezoning and conditional uses it basically adds note on the table that states unless specifically stated elsewhere in this code landscape buffers must be from the zoning district or use whichever is the stricter of the two section 905 yes I do so before you said there were no changes and you just put it in a different category so now I'm confused yes so here so this is the table of landscaping a buffering there's a table that's in there it's on we're just gonna put an aster
